Choosing an architect doesn’t need to be daunting and can even be fun.<br />
In any event, architects are worth hiring if you want to build something.<br />
Regardless of whether your project is big or small,<br />
expensive or thrifty, architects can make it better and<br />
your life easier. Here are some tips on snagging the<br />
right architect for your next job...<br />
Look far, look wide. Don’t hesitate to ask your<br />
friends and family if they know any good architects;<br />
they are most likely to give candid feedback on<br />
architects they know and may have even hired one<br />
for their own project. But don’t limit yourself to a<br />
word-of-mouth selection. For one, there is an everpresent<br />
risk that your building project will be stressful<br />
and test your relationships - if you don’t want to risk<br />
harming a friendship or professional connection, you<br />
may want to avoid hiring an architect in your family, or<br />
close circle of friends.<br />
Ask questions - the more the better. Whether you<br />
talk to relatives, friends, or even the architect under<br />
consideration, it pays to do some investigating. Ask<br />
the architect’s former clients about their experiences<br />
- whether the architect can keep a schedule, handle<br />
crises, or communicates effectively. Ask the architect<br />
how they approach their work - whether they are<br />
more collaborative or prefer to develop designs more<br />
independently.<br />
Choose according to your style. Obvious?<br />
Perhaps, but worth reiterating. Don’t pick an<br />
envelope-pushing modern architect if you want a<br />
traditional style home.<br />
Even if you find an architect that is perfect in every<br />
other way, you will be unhappy if their style clashes<br />
with your own. The inevitable give and take during<br />
the design process risks becoming more adversarial<br />
than cooperative.<br />

Choose according to your personality. Finding an<br />
architect with a personality that matches your own<br />
nearly always requires some face-to-face contact,<br />
whether in a formal interview or informal coffee shop<br />
chat. In any event, be sure to interview at least a<br />
couple architects to give you a means of assessing<br />
your preferred candidate.<br />
If you’re blunt, don’t choose an especially sensitive or<br />
thin-skinned architect; if you struggle to communicate<br />
your expectations, don’t pick an architect who lacks<br />
the patience to listen.<br />
Basically, if you love the architect’s style but hate<br />
their guts, look elsewhere unless you are prepared<br />
to go through months of headaches, frustrations and<br />
arguments.<br />
Take your project’s complexity into account.<br />
Most architects specialize on a defined set of project<br />
types (e.g., exclusively residential; commercial and<br />
civic). Unless you plan to hire a large, full-service<br />
architecture firm, expect to narrow candidates<br />
accordingly. If you are building a home or renovating,<br />
you will generally be better off hiring an architect with<br />
experience dealing with homes.....if your project is<br />
small and you are adventurous, consider hiring a<br />
young architect, who will generally be less expensive,<br />
but just as competent.<br />
Pay attention to the details. This is obviously<br />
applicable to many things, including questions you<br />
pose to candidates and your research of portfolios.<br />
Don’t just glance at images of buildings; look at the<br />
materials used and analyse how past projects have<br />
dealt with ageing. Even better, ask the candidate<br />

architect to set up an in-person inspection of one of<br />
their past projects.<br />
Don’t shy away from talking about money. Money<br />
(almost) inevitably affects the outcome of every<br />
project. Consequently, you should be candid about<br />
your budget and curious about each candidate’s<br />
payment options. Payments generally take the form<br />
of a (1) lump-sum project fee; (2) hourly-rate; (3)<br />
percentage of the project’s construction cost; or (4)<br />
combination of all of the above.<br />
An important thing to remember: find out exactly what<br />
your money would go towards (rarely should you<br />
proceed without a written contract). Payment/service<br />
contracts can be tailored to fit unique circumstances,<br />
but almost always (1) include a mandated time-line<br />

to ensure the project moves forward; (2) accurately<br />
describe the scope of the architect’s duties and<br />
client’s obligations; (3) state the amount of fees; and<br />
(4) identify the method of payment. If a candidate is<br />
unwilling to include any of these things in a written<br />
contract, you should look elsewhere.<br />
Take your time choosing. Selecting an architect is<br />
a big decision that shouldn’t be rushed. You should<br />
expect to take at least a couple weeks or a month to<br />
identify a few candidates - many people take much,<br />
much longer.<br />
Relax. Finding a good architect may seem like a<br />
chore at first. But hey, you get to look at projects and<br />
get inspiration for your own project, enjoy!

Exceptional homes typically exhibit at<br />
least one ceiling that does more than<br />
hold the room together.<br />
The treatment of the top of a room is designed to<br />
evoke expression, and speciality ceilings can do this in<br />
a variety of ways. Understanding the different ceiling<br />
ideas and options makes it easier to discern what<br />
custom home builders are offering.<br />
What is a Conventional Ceiling?<br />
Conventional ceilings may be either flat (look just like<br />
the walls) or textured, most often called "popcorn"<br />
(sprayed with particles that look like painted popcorn<br />
kernels.) A "smooth ceiling" is flat.<br />
What is Crown Moulding?<br />
Crown mouldings are generally one piece, one or two<br />
inch, pieces of wood that cover the edges where the<br />
sheetrock touches ceilings and floors.<br />
In custom homes, mouldings can be wider, with two,<br />
three or four pieces stacked on top of each other for a<br />
more elaborate effect.<br />
What is a Cathedral Ceiling and Vaulted Ceiling?<br />
A cathedral ceiling provides a high sloping line up to<br />
the top of the house. A vaulted ceiling extends a room<br />
upward. Both provide a spacious feeling and make<br />
rooms feel larger.<br />
Vaulted ceilings are more often found in first floor living<br />
or family rooms, they are also employed in dining<br />
rooms, master bedrooms and master baths.<br />
What is a Tray Ceiling?<br />
Less common in new homes, a tray ceiling (also called<br />
trey ceiling) is an artistic element added to select<br />
ceilings to give them personality and a unique attribute.<br />
Trey ceilings start horizontally at the wall intersection<br />
at a standard height and then are built upwards in a<br />
cut out resembling a tray. The cut can be vertical or<br />
angled, and the tray itself can be 6 inches to a foot or<br />

more deep. Sometimes there are a series of steps for<br />
an even more dramatic effect.<br />
A trey ceiling can either be "dropped" or "raised"<br />
depending on what is above the room, and what the<br />
ceiling height is.<br />
Decorative mouldings or lights may also be<br />
incorporated. The trey ceiling to the right is constructed<br />
in two layers, allowing you to place lights inside the<br />
deeper trey, if desired, for a soft, ethereal lighting effect.<br />
Trey ceilings can be even more impressive when paint<br />
is used to accentuate the ceiling and vertical steps.<br />
What is a Cove Ceiling?<br />
A cove ceiling has a rounded concave surface. This<br />
may be incorporated into arched doorways, hallways,<br />
or other areas where a fluid effect is desired.<br />

These types of ceilings are an extremely delightful and<br />
rare art form - it's difficult to create a perfectly curved<br />
ceiling, because most building materials are designed<br />
to provide flat surfaces, and it takes extra materials,<br />
time, skill and creativity to craft the symmetrical effect.<br />
Cove ceilings generally curve up from every wall.<br />
What is a Beam Ceiling?<br />
Made of wood or other substances which are typically<br />
laid across conventional ceilings to add dimension,<br />
colour, clarity or interest.<br />
They can either be load bearing (incorporated into the<br />
actual structure of the home) or lighter weight faux<br />
beams that are applied purely for visual effect. This<br />
type of ceiling effect is not as popular as the more
modern approaches and is more typically applied to<br />
rustic décor.<br />
A beam ceiling treatment, particularly a stained beam<br />
ceiling, can add a significant amount to your new<br />
custom home budget.<br />
What is a Barrel Vault Ceiling?<br />
A barrel vault ceiling, also known as a tunnel vault or<br />
wagon vault, is not commonly seen in homes, but can<br />
be a very unique architectural feature.<br />
Think of the curved section you'd have if you cut a<br />
barrel vertically into sections - this resembles the curve<br />
of a barrel vault.<br />
These curved ceilings or openings were common in<br />
Roman architecture. But the most famous example<br />
can be found in St. Peter's Basilica, which has a huge<br />
barrel vault spans nearly 90 feet across the nave.<br />
What is a Coffered Ceiling?<br />
A coffered ceiling is best described as, "creating a<br />
raised and indented checkerboard across the ceiling".<br />
A coffered ceiling is usually created by framing a series<br />
of interconnected vertical and horizontal lines across<br />
the ceiling.<br />
The lines are then covered in sheetrock and finished<br />
similar to a normal ceiling.<br />
The individual boxes are then often trimmed with<br />
moulding - layering of which can be wider and thicker<br />
as the price goes up, especially in very high-end estate<br />
homes. Stained coffered ceilings are firmly in the luxury<br />
price point.<br />

Living on the islands and certainly in most of Thailand, pork is a huge part of<br />
the daily diet – be it in market stalls or high-end restaurants. Ribs are a great<br />
way to serve pork and there are so many varieties and making ribs at home is<br />
easier than you think! So put some beers on ice and invite some friends around<br />
and indulge in a ribalicious feast!<br />
ROCKIN' ROASTED RIBS<br />
INGREDIENTS<br />
• 3 lbs pork back ribs<br />
• 1 (8 ounce) honey<br />
• 1 teaspoon paprika<br />
• 1/2 teaspoon garlic powder<br />
• 2 tablespoons all purpose seasoning<br />
• 1/2 teaspoon onion powder<br />
• 1/4 teaspoon celery salt<br />
• 1/2 cup dark brown sugar<br />
• 1/4 teaspoon fresh ground pepper<br />
• 1 medium onion, grated or finely chopped<br />
• 12 ounces barbecue sauce<br />
• 1/4 cup white sugar<br />
DIRECTIONS<br />
Place all ingredients together in large roasting pan.<br />
Cut ribs apart for easier serving.<br />
Mix together making sure to coat all ribs with this<br />
semi-dry paste.<br />
Spread ribs out evenly on bottom of pan and cover<br />
lightly with foil.<br />
Bake at 375 degrees for approximately 1 hour,<br />
turning or stirring occasionally.<br />
These ribs are also great finished on the grill for a few<br />
minutes on each side.<br />

CHILLI GLAZED RIBS<br />
INGREDIENTS<br />
• 2 racks pork spareribs (about 6 pounds)<br />
• Kosher salt<br />
• 3 tablespoons packed light brown sugar<br />
• 2 cloves garlic, minced<br />
• 2 teaspoons fresh thyme<br />
• 3 tablespoons chilli powder (or more if you love<br />
a bit of fire!)<br />
• Freshly ground black pepper<br />
• ¼ teaspoon cayenne pepper<br />
• 3 cups apple cider<br />
• 3 tablespoons ketchup<br />
• 2 tablespoons Dijon mustard<br />
• 2 teaspoons Worcestershire sauce<br />
DIRECTIONS<br />
Make shallow cuts between the ribs on the bone<br />
side with a sharp knife, piercing just the membrane.<br />
Mix 1 tablespoon salt, the brown sugar, garlic,<br />
thyme, chilli powder, 1/4 teaspoon black pepper and<br />
the cayenne in a bowl. Rub the spice mixture evenly<br />
over the ribs. Place the ribs on a rack in a roasting<br />

Outdoor décor has to be more than merely attractive to withstand the<br />
elements and provide good value for your outdoor decorating dollar.<br />
Let's explore some things you should keep in mind<br />
when shopping for outdoor furnishings...<br />
Insist on Good Quality<br />
A close inspection will expose that great outdoor<br />
furniture bargain for what it really is -- a bad buy that<br />
probably won't last.<br />
It's easy to think of outdoor furnishings as somewhat<br />
less important than the stuff you buy for indoor use.<br />
In fact, the reverse is often true. What you buy to use<br />
outside has to stand up to sun exposure, wind and of<br />
course rain (and if you live by the beach, then salt water<br />
can have quite an impact too).<br />
Inspect every piece you're considering for flaws,<br />
especially if the deal sounds too good to be true. This is<br />
one area where a higher price is often a good indicator<br />
of better quality.<br />
Form Follows Function<br />
Choose wisely in regards to longevity and<br />
maintenance...<br />
• Aluminum, plastic and PVC -- These construction<br />
materials are rustproof, lightweight, relatively<br />
inexpensive and require very little weather treating. You<br />
can also wash them easily with a little soap and water.<br />
• Steel and wrought iron -- Both are heavy duty and<br />
sturdy but will rust if not weatherproofed or painted<br />
periodically.<br />
• Rattan, wicker and natural grasses -- It's pretty<br />
amazing how well natural materials like wicker look<br />
and last outdoors, especially when they are treated<br />
with a resin finish. They may require additional<br />
weatherproofing every couple of years, though.<br />
• Wood -- Natural wood looks very attractive in<br />
outdoor furnishings. It makes sturdy furniture that can<br />
be as comfortable as anything you use indoors. It does<br />
require regular treatment with a preservative and may<br />

also require UV protection. Choose weather-resistant<br />
woods like teak, redwood, cypress and cedar.<br />
Lush and Plush<br />
You may want steel or wood construction in your patio<br />
furniture for stability and longevity, but don't forget<br />
that without some homey comforts like soft, plush<br />
cushions, your outdoor furniture will go largely unused.<br />
Avoid pancake cushions. You know, those thin, puny<br />
little cushions that aren't plush or even very pliable.<br />
Opt for chubby cushions that feel light when you<br />
pick them up. Look for cushions with polyester filler,<br />
too. The more lightweight and springy the filler is, the<br />
more quickly it will dry out after exposure to moisture.<br />
That means it will resist mould and mildew and stay<br />
comfortable and sweet smelling longer.<br />
Check the Details<br />
An outdoor set can look attractive but have glaring<br />
flaws that can lead to problems after a few months:<br />
• When inspecting metal furniture, bring a magnet.<br />
Aluminium is not magnetic, but steel often is. Although it<br />
doesn't work with all types of steel, you can sometimes<br />
distinguish aluminium from steel construction (or<br />
fittings) by just testing them with a magnet. Remember,<br />
steel will rust while aluminium and stainless steel won't.<br />

• Look for aluminium loungers made with long,<br />
unsegmented framing pieces. They cost a little more,<br />
but they'll last longer.<br />
• Check chairs to make sure the legs are solid and<br />
sturdy. Sit in the chair to see if it shifts or flexes as it<br />
takes your weight. Award extra points to chairs that<br />
include cross bracing pieces.<br />
• Opt for furniture assembled using stainless steel<br />
screws.<br />
• Run your hands along wood pieces to make sure<br />
they're sanded smooth.<br />
• Check to make sure chair and table legs have<br />
rubber or plastic feet that won't scratch your deck<br />
or patio.<br />
Pay Attention to the Textiles<br />
Most textiles designed for indoor/outdoor use are<br />
made from all-weather materials that repel water or<br />
encourage moisture to evaporate quickly by remaining<br />
porous.<br />

• Fabrics designed for use outdoors are usually fade<br />
resistant and UV protected, too. They'll look good<br />
and feel soft and comfortable for at least a couple of<br />
seasons.<br />
• When you're evaluating fabrics for outdoor furniture,<br />
check cushion seams for heavy duty thread and<br />
consistent, even stitches. Choose cushions with vents<br />
that encourage air flow and quick drying.<br />
• Invest in furniture with cushions that can be<br />
unzipped and taken apart for periodic airing, repair<br />
or replacement. It's also a good idea to buy outdoor<br />
furniture outfitted with cushions you can turn and flip.<br />
This will help them retain their shape, dry more quickly<br />
and fade evenly.<br />
• Acrylics, polyester, treated canvas and cotton<br />
duck are all comfortable, durable fabrics used in the<br />
construction of outdoor furnishings. Look for them in<br />
upholstered items, cushions, pillows, curtains, blinds<br />
and umbrellas.

in Bangkok and other cities who can ensure that what<br />
you are hoping to purchase is right for you and due<br />
care is taken to ensure you are protected as a buyer.<br />
It is unusual for an offer to be made on a property<br />
until your lawyer has carried out all of the relevant<br />
searches and if you do put in an offer before you<br />
have commissioned any legal help, do not hand over<br />
a deposit or sign anything – only do this when your<br />
lawyer gives you the go-ahead.<br />
When you are given the all-clear by your legal advisor,<br />
ensure that the name in which you purchase the<br />
property is exactly the same as that on your current<br />
passport in order to avoid any unnecessary future<br />
issues. Generally you will be required to pay a deposit<br />
until the purchase agreement is executed, but this is<br />
refundable (in most cases, but please check with your<br />
lawyer) if the purchase doesn’t go through – provided<br />
that it is not your fault.<br />
A final contract is signed on the date stated in the<br />
preliminary contract, when you will be required to<br />
pay the outstanding balance, as well as any relevant<br />
taxes. The deeds are then registered with the Land<br />
Department, making the purchase complete.<br />
LAND TITLES & OWNERSHIP<br />
In regard to freehold title, foreigners can own buildings<br />
in <strong>Samui</strong> and greater Thailand – but not land itself.<br />
As a result, apartments and condominiums (of which<br />
there are many new developments available in <strong>Samui</strong>)<br />
are becoming quite a popular choice amongst foreign<br />
investors and purchasers.<br />
If you are looking to purchase a villa or land there are<br />
a couple of ways which you can gain the freehold<br />
of the land. The first way is to set up a Thai limited<br />
company but you will still only hold a minority amount<br />
of the shares in the company with the rest of the<br />
shares owned by Thai nationals who will sign over<br />
their rights in the company to you. Again, your best<br />
option is to speak to a reputable law firm in <strong>Samui</strong> that<br />
deals primarily with property and land to ensure you<br />
understand the details and requirements that go along<br />
with this type of ownership.<br />
The second option is to lease the land that you have<br />
bought. This lease lasts for a maximum of 30 years,<br />
but you do have the right to renew the lease with a<br />
maximum of 90 years in total.<br />

an array of beautifully designed residential homes and estates, many of<br />
which are owned or leased by international residents and travelers, who<br />
have no doubt taken careful steps to plan the acquisition of their tropical<br />
homes in order to safeguard their interests. Perhaps not surprisingly, these<br />
same persons often prefer enjoying the comfort of their residences in<br />
favour of planning for the day when they can no longer enjoy such worldly<br />
pleasures. Nonetheless, it is safe to say that these same persons would<br />
prefer to freely choose who will share in their estate upon death, rather<br />
than let chance and the hand of government decide for them.<br />

five simple legal tips to consider if you have assets in Thailand and wish<br />
to plan your estate wisely.<br />
1. HAVE YOUR WILLS IN ORDER<br />
People often assume that a Will executed in their home jurisdiction will<br />
protect assets located in other countries; however, this may not always<br />
be the case. According to international law, the distribution of immovable<br />
property, such as freehold condominiums, leasehold interests and villas,<br />
is generally governed by the laws of the country in which that immoveable<br />
property is located. Conversely, the transfer of movable property such as<br />
jewellery and furniture is governed by the laws of the country in which the<br />
deceased was domiciled at the time of death.<br />
It is important to note that if an individual invests in real estate using a<br />
company structure, the asset which will form the subject matter of his or<br />
her estate will be the shares in the limited company and not the real estate<br />
assets themselves. Shares in limited companies may be deemed to be<br />
moveable property and not immoveable property.<br />
Nonetheless, if you have any significant assets located in Thailand,<br />
moveable or immovable, it is recommended that you execute a valid<br />
Thai will. The distribution of moveable or immovable property located<br />
in Thailand will be administered in some way by a Thai court, and it is<br />
possible or event likely that no party will claim or allege that a foreign law<br />
should apply.<br />
In this event, if there is no valid Thai Will, it is possible that all property<br />
located in Thailand will be distributed according to the “Thai law” of<br />
intestate succession, which is a scheme set-out by statute that mandates
that your property be distributed to the following people according to a set formula: spouse; children; parents;<br />
siblings; grandparents; aunts/uncles.<br />
Only true legally valid spouses are permitted to share in one’s estate according to intestate succession. Therefore,<br />
without a valid Thai Will, common law spouses and long-time partners will be totally disinherited of your Thai<br />
estate. It is also highly recommended that you consult a lawyer in the jurisdiction of your home or domicile, in<br />
order to properly address any movable assets located in Thailand.<br />
Subject to certain alternatives, in order to be valid, your Thai Will must be in writing, dated, signed, and witnesses<br />
by at least two other people, and should be executed within Thailand. While this process appears to be relatively<br />
simply, you should retain a legal professional to advise you on your Will. The law pertaining to the interpretation of<br />
Wills is complex, and requires adherence to specific language.<br />
2. SELECT YOUR ExECUTOR WISELY<br />
In your Will, you must appoint an “executor”, who will gather and distribute your assets when you die. It is generally<br />
imprudent to simply name a sibling or close friend as executor, simply because you trust that person. Often, the<br />
executor must come to Thailand, liaise with lawyers and Thai officials, and execute an abundance of Thai-language<br />
documents, and your executor should have the capacity to deal with these issues, in addition to being trustworthy.<br />
You may have to consider other options, such as naming a law firm or another company to act as your executor.<br />
3. CHECK YOUR CONTRACTS<br />
In Thailand, contract rights, including certain leasehold rights, generally terminate upon the death of the entitled<br />
party, and may not automatically pass onto their estate. However, in certain cases, you may include a clause into<br />
any contract explicitly providing that your entitlements will pass onto your heirs.<br />
Therefore before entering into a long-term contract, such as a long-term lease, it is important to ensure that<br />
the contract contains a clause directing that your rights will pass to your heirs. You should also review existing<br />
contracts for the same clause, and if that clause is missing, then it is recommended that you take steps to amend<br />
the contract.<br />
4. REVIEW PERIODICALLY<br />
It is important to review the foregoing matters with your legal counsel periodically and after you acquire additional<br />
assets. The laws in any country may change on occasion, often without notice to the general population. Therefore<br />
it is imperative that you routinely ensure that you testamentary wishes are still protected.<br />

2012 saw the beginning of a significant reduction of the corporate income<br />
tax rate in Thailand. The long established 30% rate was reduced to 23%<br />
for the year 2012 and further reduced to 20% for the years <strong>2013</strong> and 2014<br />
for all companies.<br />
As recently as late 2012, the current government had announced that<br />
it would not also reduce Thailand’s personal income tax (“PIT”) rates.<br />
However, shortly thereafter the government reconsidered its position and<br />
announced that the PIT rates in Thailand also would be reduced with<br />
effect from <strong>2013</strong> forward.<br />
As you may be aware, any person who derives income from services,<br />
employment or property in Thailand is required to pay PIT on that amount.<br />
The total amount due is calculated for each calendar year and payable<br />
by the end of March of the following year. It should be noted that the tax<br />
liability for any such income is the same regardless of whether or not the<br />
income was actually paid within or outside of Thailand.<br />
Furthermore, anyone who stays in Thailand for a total of 180 days or<br />
more in any calendar year is considered a “resident” for Thai income tax<br />
purposes. Such an individual is then required to pay PIT on income that:<br />
(1) is derived from employment or property situated abroad; and (2) that<br />
is brought into Thailand during the calendar year in which the income was<br />
received. Here, once again, it makes no difference if such income is paid<br />
within or outside of Thailand.<br />
The PIT rates prior to <strong>2013</strong> (after adjustments for any applicable exemption<br />
and/or deduction) were:<br />

The new system introduced more tax brackets and further reduces the PIT rates for certain tax brackets. The new<br />

PIT on wages is initially taxed by way of requiring your employer to withhold the relevant amount of such PIT<br />
and pay it to the Revenue Department on a monthly basis. Therefore, if you are a monthly salaried employee in<br />
Thailand you should be experiencing the benefits of this PIT reduction from your first monthly salary payment in<br />
<strong>2013</strong> forward.<br />
There is further good news with regard to PIT for married couples. Previously, the Revenue Department considered<br />
and taxed any non-wage income made by a wife as additional income of the husband. This meant that income<br />
was possibly subject to being taxed at a higher PIT rate than it would have been if the income were taxed as the<br />
wife’s sole income.<br />
However, last year the Constitutional Court held that this practice violates Thailand’s Constitution because it<br />
does not treat men and women equally. Thus, it is legally invalid. The Revenue Department has now formally<br />
accorded its regulator scheme and husband and wife are able to file their PIT tax returns separately. Please note,<br />
however, if husband and wife decide to file their PIT returns separately, each remains liable for any unpaid PIT<br />
by the other.<br />

For those of you unaware of what Songkran entails, from 13-15th<br />
<strong>April</strong>, (Songkran falls in the hottest time of the year in Thailand, at<br />
the end of the dry season) the whole of Thailand celebrates it’s<br />
‘Water Festival/Thai New Year’ where life is celebrated through the<br />
enjoyment of water where passers-by throw water onto each other<br />
- be it via a hose, a bucket or even a water pistol! It has become<br />
a party for foreigners and locals alike and an additional reason for<br />
many to visit Koh <strong>Samui</strong> and Koh <strong>Phangan</strong> to enjoy this amazing<br />
time of year. This year Songkran is celebrating on Saturday 13th<strong>April</strong>,<br />
where you will see the streets filled with people and plenty, oh yes,<br />
plenty of water!<br />
The date of the festival was originally set by astrological calculation,<br />
but it is now fixed. If these days fall on a weekend, the missed days<br />
off are taken on the weekdays immediately following. Songkran<br />
falls in the hottest time of the year in Thailand, at the end of the dry<br />
season. Until 1888 the Thai New Year was the beginning of the year<br />
in Thailand; thereafter 1 <strong>April</strong> was used until 1940. 1 January is now<br />
the beginning of the year. The traditional Thai New Year has been a<br />
national holiday since then.<br />
Songkran was traditionally a time to visit and pay respects to elders,<br />
including family members, friends, neighbours, and monks. During<br />
this time, people celebrating Songkran as a Buddhist festival may<br />
also go to a Wat (Buddhist monastery) to pray and give food to<br />
monks. They may also cleanse Buddha images from household<br />
shrines as well as Buddha images at monasteries by gently pouring<br />
water mixed with a Thai fragrance over them. It is believed that doing<br />
this will bring good luck and prosperity for the New Year.<br />
With the most obvious celebration of Songkran being the throwing<br />
of water - get yourself ready for people at the side of roads with a<br />
garden hose ready to drench you from head to toe! The throwing<br />
of water on anyone that moves, people lining the streets with water<br />
pistols and buckets – is one of the most spectacular times to visit<br />
Koh <strong>Samui</strong> and see in the Thai New Year whilst getting some relief<br />
from the stifling summer heat!<br />

There are many homes as well as hotels and resorts on Koh <strong>Samui</strong> and Koh<br />
<strong>Phangan</strong> that have their own private pools, be they large or small.<br />
With this in mind and being that we live in the day and<br />
age of eco-friendly, there are ways to help your pool<br />
go green, or at least contribute to a more sustainable<br />
environment.<br />
If you’ve owned a pool for any length of time, it’s quite<br />
likely you’ve had to deal with the occasional flair-up of<br />
algae or other pool contaminant (that’s not the green<br />
we like to see). It’s also likely that your prescription<br />
for a cure included a fair amount of pool chemicals<br />
such as chlorine, bromine, and copper algaecide.<br />
While they do the trick, these pool chemicals can be<br />

a bit rough on our environment (not too mention your<br />
skin and clothes!) as they go off into the air, mix with<br />
soil when water is vacuumed out, or even from the<br />
occasional spill.<br />
Even if you’re the best among us and you’ve kept<br />
your pool clear 100% of the time, it’s virtually<br />
impossible to avoid using heavy doses of chemicals<br />
for maintenance…or is it?<br />
Below are a few ideas/products to help you find a little<br />
more balance between enjoying your pool and keeping<br />
our environment healthy as can be.
ULTRAVIOLET POOL CLEANERS<br />
By harnessing the unique power of ultraviolet light,<br />
these pool cleaners blast contaminating particles as<br />
water flows through them. It’s true that these wont<br />
allow your pool to be 100% chlorine free, but they<br />
can greatly decrease the amount of chlorine, bromine,<br />
or other pool chemicals that you might need to use.<br />
These systems have been around in other countries<br />
for quite awhile now and popularized due to their<br />
efficiency.<br />
The Intellichlor chlorine generator is a great example<br />
of an eco-friendly pool cleanser. It creates chlorine<br />
naturally from salt water pool systems, reducing the<br />
amount of additional chlorine.<br />
SALT WATER POOLS<br />
Often misunderstood – salt-water pools do not<br />
function by utilising extremely high levels of salt to<br />
maintain water balance. Instead, salt is added to the<br />
pool water and then utilised by a chlorine generator<br />
(such as the IntelliChlor chlorine generator) to create<br />
chlorine naturally. If you’re interested in utilising a<br />
salt water system, be sure you have a complete<br />
understanding of how the system works and are<br />
prepared to carefully watch your pools levels.<br />
OzONE POOL CLEANING SYSTEMS<br />
Pools utilising ozone-cleaning systems do need to<br />
utilise chlorine, but as with ultraviolet cleaning systems,<br />
the amount can be greatly reduced. Essentially ozone<br />
is generated through a variety of ultraviolet light and<br />
mixed in with pool water via jets or other circulation<br />
systems. The generated ozone breaks down into the<br />
pool water and then destroys unwanted contaminants<br />
mixed into the water.<br />
While no system is perfect, each of these three<br />
common chlorine alternatives/reducers can help you<br />
move away from a heavy dependence on common<br />
pool chemicals.<br />
USE YOUR POOL PUMP MORE EFFICIENTLY<br />
Standard pool pumps are single speed and big<br />
enough to pump at the highest flow rate when needed,<br />
including jets for your luxury spa. The problem is that<br />
this big, honking pump uses way more energy than it<br />
needs to because it probably doesn’t need to pump as<br />
much water most of the time it’s on. Make sure you put<br />
in a variable speed pump.<br />
Variable speed pumps adjust to pump the amount of<br />
water needed, using less power in the process. You<br />
should also put your pump on a timer so it runs only<br />
when you need it. Depending on how much swimming<br />
you do, your pool may work fine with the pump running<br />
six to 18 hours a day instead of full time. More energy<br />
saved!<br />
There are other unique options such as aquatic plant<br />
pools and self-sustaining pools that can allow you<br />
to enjoy natural beauty and a great chemical-free<br />
swimming experience as well. Although not readily<br />
available in Thailand, it won't be long until we too can<br />
enjoy our sunshine, our swimming pools...and all with<br />
less impact on the planet!<br />

When you're thinking about what goes into a green<br />
roof, the terminology can really get in the way – we're<br />
not talking about a garden on your roof! To be really<br />
eco-friendly, you want your roof to be cool...<br />
Some of the great producers of the greenhouse effect<br />
are the roofs over our heads. The sun hits the roof,<br />
and the roof reflects light back into the atmosphere.<br />
The intensity and angle of that reflected light create the<br />

so-called "heat island" effect in cities and can erode<br />
the atmosphere.<br />
Further, if the roofing material doesn't have insulating<br />
properties, it can create a secondary environmental<br />
issue by requiring the inhabitants of the building to<br />
crank up the climate control.<br />
So to be green, you have to be cool. What are some of<br />
your options when it comes to roofs?<br />
TILE<br />
If you want a roof that will last up to a hundred years,<br />
you might want to look at tile. It's favored in warm<br />
climates, and the key to its status as a green material<br />
lies in its composition, its shape and its ability to be<br />
recycled.<br />
"The curved shape helps with ventilation," says Jessica<br />
Clark, marketing liaison for the Cool Roof Rating<br />
Council.<br />
Roofing tile comes in a wide range of colors, including<br />
those lighter colors that reflect less heat into the<br />
atmosphere. As an added eco-bonus, they're heavy:<br />
That superior thermal mass keeps the cool air inside<br />
on a hot, hot day.
SINGLE-PLY THERMOSET<br />
Basically, a single-ply thermoset roof consists of a<br />
roof membrane derived from oil and natural gas that's<br />
cured and bonded to roofing materials. These roofs<br />
are well-sealed and insulate the buildings they cover.<br />
They're constructed in the factory as opposed to roofs<br />
that are constructed and sealed at the site. According<br />
to the Single Ply Roofing Association, they have a more<br />
consistent quality because they're not constructed<br />
on site.<br />
According to the association, thermoset membranes<br />
are good at withstanding the damaging effects of<br />
sunlight. Usually the membranes are black, but<br />
manufacturers also make them in white, which is the<br />
best colour for a cool roof.<br />
SINGLE-PLY THERMOPLASTIC<br />
Thermoplastic membranes have a different chemical<br />
composition from thermoset, which means that they<br />
don't necessarily have to be bound to the same type<br />
of material. They're welded shut and can contain fire<br />
retardants and materials to absorb ultraviolet light.<br />
According to manufacturers, this type of roof is a<br />
good choice for restaurants and businesses that<br />
push oils out through ventilation systems because the<br />
membranes are highly resistant to oils, animal fats and<br />
bacterial growth. The membranes can also be installed<br />
over older types of roofs when a full tear-down isn't<br />
practical.<br />
Typically, these rolls of plastic come in the cool colours<br />
grey or white, and that slick single surface improves the<br />
roof's ability to reflect light.<br />
FACTORY-APPLIED OR FIELD-APPLIED<br />
COATING<br />
This is a material that can be applied to virtually any<br />
type of existing roof -- even metal. It's either applied at<br />
the factory or on site. Generally, the products are bright<br />
white or contain reflective pigment.<br />
The National Roof Coatings Institute reported that<br />
after the roofs on an entire city block in Philadelphia<br />
were coated with "highly reflective white coatings," the<br />
surrounding air temperature dropped by 1 degree in<br />
summer heat.<br />

Is a picture really worth a thousand words? Probably a<br />
bit more! One really good picture of your holiday home<br />
can sell it on an immediate, emotional level, and then a<br />
renter will forgive any negatives that may follow. It's like<br />
love at first sight - you can't explain it, you just know<br />
when it's happened...<br />
If you are not planning on using a professional<br />
photographer (highly recommended and worth the<br />
cost!) here are some hot tips on how to get the best<br />
photos of your home if you are planning on selling or<br />
renting it -<br />
You MUST take photos on a sunny day, no ifs or buts:<br />
don't let renters think they'll have anything but perfect<br />
weather.<br />
The best time of day for photos is during the 'golden<br />
light' of early morning or early evening, especially for<br />
exterior shots.<br />
People or no people? There are two schools of thought<br />
on having people in your pictures. On the one hand, a<br />
pleasant, smiling face makes a property more personal<br />
and that may make someone hit the enquiry button. On<br />
the other hand - do the people in the picture make you<br />
want to be there? Or do they put you off your dinner?<br />
Make sure they are in tune with the spirit of your home<br />
and 'adding to the dream'.<br />
Think about focal points in pictures: comfortable<br />
furniture, beautiful windows with views are all good<br />
focal points. TVs and fridges are usually bad focal<br />
points.<br />
For empty houses, try to capture rooms that are<br />
together, like a master bedroom and bathroom, to add<br />
interest to the image.<br />
Use props such as fruit, drinks, magazines, flowers<br />
and towels. This will make the space look as if<br />
someone was just there and feel more inviting.<br />

Use odd numbers for your accessories, like three or<br />
five, in different sizes. For instance, on a bedside table,<br />
put flowers, a few books and a small clock.<br />
Fluff the pillows, so you don't have an imprint of where<br />
people sat on the bed or sofa.<br />
Shoot two walls only, with a bit of floor and ceiling.<br />
Shooting three walls creates a shoebox effect.<br />
Outside, remove garbage cans, cars, seasonal<br />
decorations, flags and plaques. Inside, put away toys<br />
and clothes on hooks.<br />
If the best thing about your home is its location, for<br />
instance because it is two minutes from the ocean -<br />
why not use one of your pictures to show that? Give<br />
people something to dream about.<br />

Don't just show interiors of your home, no matter how<br />
beautiful it is. If you don't show outside photos, it looks<br />
like you are hiding something. If the exterior of your<br />
home is nothing special, what about the view?<br />
Don't use the flash (unless you really know what you<br />
are doing). Get as much natural light into a room as<br />
possible.<br />
To get everything in the picture. If you haven't got one,<br />
stand on a chair in a corner, so you're looking down<br />
at the room.<br />
Show your strengths. If your kitchen is cramped, show<br />
something else; if your main bedroom is vast, show<br />
that. People will look for the good things and fill in the<br />
blanks in their minds.<br />
Never photograph a house dead on, or when it's<br />
backlit by the sun.<br />
Take exterior pictures from a ladder, or the top of your<br />
car, especially if you are using a wide-angle lens.<br />
Compose photos so corners aren't in the center of<br />
the frame.<br />
If an interior is empty, stand back as far as you can to<br />
show how large the space is.<br />
Figure out where the sun rises and set, and shoot when<br />
the sun is 45 degrees from the angle you want to take<br />
the shot. If a façade faces north, shoot just before<br />
sunset or on a cloudy day.<br />
Don't use a wide angle lens in an interior shot. They<br />
make rooms look smaller.<br />
Turn off your camera's flash; it will make the most<br />
spectacular room look like a scary, semi-lit dungeon.<br />
Don't tilt the camera up or down; it gives objects odd,<br />
unnatural shapes.

Koh <strong>Samui</strong>’s enduring appeal as one of the world’s<br />

LAND TITLE DEEDS IN THAILAND<br />
There are two main types of land ownership in Thailand which we should explain<br />
RIGHTS OF POSSESSION<br />
Firstly there is the right of possession, for example, land that has been used by a family for generations to the<br />
benefit of the land and they have possession rights of the land under the civil and commercial code. Such titles<br />
are Sor Kor 1,Tor Bor 5 , 6 or Sor Por Gor 4. These titles basically are only family possession rights and generally<br />
only used for farming. These titles can not be bought or sold and no building rights or legal acts would be allowed<br />
on the land. I do know of cases where families being in possession of certain pieces of land for generations have<br />
been able to upgrade them to regular land title deeds but this is not generally the case and any serious investor<br />
would not normally give any credibility to these titles of possession.<br />
RIGHTS OF OWNERSHIP<br />
Usually we are looking for land title deeds giving right of ownership not possession. Here there are basically three<br />
title deeds:- Chanote, Nor Sor 3 and Nor Sor 3 Gor. The most sought after titles are the Chanote and the Nor Sor<br />
3 Gor as both these titles have legal documents of Rights of Ownership and can be sub-divided into smaller plots<br />
and planning permission and any such legal acts can be carried out immediately on the land.The only difference<br />
with the Nor Sor 3 is that although legal documents are issued for the land it has not been accurately surveyed<br />
which can lead to problems in verifying actual land area. And if any legal act is to take place on this land it must<br />
be published for at least 30 days.<br />
As we have been saying all the way through if it is not clear 100%, seek the advice of a legal professional in this<br />
field, as there are also many other issues that are important to consider such as servitude, access and rights<br />
of way.<br />

Land in Thailand is measured in Rai, Ngan and Talang Wah.<br />

TIPS FOR STARTING A NEW BUSINESS<br />
Are you planning to start your own business for the first time in Thailand? If so, we hope this useful information<br />
will help put your business on the right track.<br />
The simplest and easiest sort of company for foreigners to form with a small business is a Thai Limited Company.<br />
In Thailand, a Limited Company is a company with up to 100 shareholders, who share the same business<br />
purpose and is formed with a Capital divided into equal shares.<br />
GETTING STARTED<br />
To set up a company, you must first have the memorandum that can be acquired at the registration office. To<br />
properly register, you are required to provide the authorities with details of your company and list a minimum<br />
of three shareholders (who can either be Thai or foreign nationals or both). At least seven days after you first<br />
approach the department, you can call a shareholder’s meeting to reach an agreement on the purpose of your<br />
business and set up the company’s operational rules.<br />
Having agreed on the purpose of your business, you can then apply for business registration at the same<br />
department. If you cannot agree on company rules, you can refer to those stated in the Civil and Commercial<br />
Code’s partnership and companies section.<br />
SHARES<br />
Besides the issues of business registration, you must also make sure that your company’s shares are worth no<br />
less than 5 baht each. These shares can be transferred or even sold if the company has no regulations on this<br />
matter.<br />
Every shareholder must be given a share certificate, a document that guarantees their status as a shareholder.<br />
Should anyone wish to transfer their shares to another party; they have to fill in the share transfer form that<br />
confirms the deal between the transferor and transferee.<br />
The company also has to have in its possession a register of shareholders that contains a record of all the<br />
company’s shareholders. The book is evidence that will identify the company’s shareholders.<br />
SHAREHOLDERS AND CHAIRPERSON<br />
A Limited Company’s shareholders can be either Thai or foreign nationals or both, but the percentage of shares<br />
held by foreign national plays a significant role in determining the nationality of your company, which may impose<br />
serious limitations on the company’s rights, such as landownership.<br />
If less than 49% of your company’s shares are held by foreigners, your company is considered a Thai company.<br />

However, if foreign nationals hold more than 49% of the shares, your company is a foreign company.<br />
The significant differences between Thai and foreign companies operating in Thailand lie in their rights to buy and<br />
own properties or other businesses. It is therefore important, especially for those in real estate and development<br />
businesses, to know and remember that unless your company is Thai, you are restricted in the ability to possess<br />
and obtain land and property in this country without an exemption granted by the government.<br />
Foreign companies are also restricted to certain activities and to proceed with certain operations the company<br />
will have to apply for permission from the government. In such instances, applications will be considered case<br />
by case. They will also face tough scrutiny and strict restrictions on their right to operate and ability to run their<br />
business. These companies will be treated in the same way as foreign nationals seeking jobs in Thailand.<br />
If you are registered as a Thai company, you are automatically granted the right to purchase and own properties<br />
and other business and will be treated the same way as a Thai citizen. However, according to new legislation that<br />
has recently come into effect, the Land Department’s staff are now required to thoroughly investigate your Thai<br />
shareholders’ sources of income. Thai shareholders in a company wishing to purchase properties in Thailand<br />
have to declare their income and provide the authorities with evidence that proves their ability to co-invest with<br />
other foreign shareholders in the same company. Only those successful in convincing the authorities are granted<br />
the right to purchase and possess land. Companies with approval from the Land Department can then proceed<br />
with their applications for land title deeds or other certificates of use and possession.<br />
LITTLE THINGS THAT MATTER<br />
A company limited has to have its own board of directors to act on behalf of the company. This panel will,<br />
however, act under the regulations and agreements approved by the shareholders. Appointing directors or<br />
removing any of them requires shareholders approval.<br />
At the end of the company’s financial year, within five months, it shall be the duty of the company to present the<br />
balance sheet to the Department of Business Development (DBD). If your company fails to present the balance<br />
sheet, the company will be fined up to 50,000 baht and the company’s board of directors may also be fined up<br />
to 50,000 baht. If the committee refuses to pay the fine, the police can appeal to the court for a warrant and file a<br />
lawsuit against the resilient parties. Withdrawal of the company’s business registration is also another penalty the<br />
company may face, should they not provide the authorities with the necessary statement.<br />

BUILDING REGULATIONS ON KOH SAMUI<br />
In order to build on Koh <strong>Samui</strong> you must first obtain a building permit from the municipality office<br />
and your building must meet certain requirements, depending on the location of the land on which<br />
you wish to build.<br />
There are 4 defined areas for land depending on its distance from the beach.<br />
(See diagram on opposite page)<br />
STAGE 1. Land up to 10 Meters from the beach. The law states that no construction is permitted<br />
within this area.<br />
STAGE 2. Land up to 50 Meters from the beach. Within this area you are permitted to construct a<br />
single storey building only It’s height cannot exceed 6 Meters (including the roof) and the<br />
building cannot exceed the maximum allowed area of 75 Square Meters.<br />
STAGE 3. Land up to 200 Meters from the beach. Within this area you are permitted to build up to<br />
a maximum height of 12 Meters (including the roof). The maximum allowed size is 2000<br />
Square Meters.<br />
STAGE 4. Land located more than 200 Meters from the beach. Within this area, building of up to<br />
12 Meters in height (including the roof) can be constructed.<br />
In addition, all buildings must now be constructed with peaked roofs, flat roofs are no longer permitted.<br />
