immediate action against him for using his official position for personal benefits<br />

by adopting all illegal methods for continuous five years for his retention at Pune<br />

and now for change of posting from Ratnagiri to Circle Office Mumbai.<br />

Respected Sir,<br />

Vide letters under reference 1 & 3; SNEA (I) Maharashtra Circle has brought to<br />

your kind notice that how some individual officers from Pune are managing their<br />

retention at Pune for years together and how the BSNL management support such<br />

mischievous officers. We are sorry to say that such shameful acts by shameful<br />

executives are being supported by Circle management which is very tough with all<br />

other officers including senior level officers.<br />

We will put here classic example of Mr. H.V. Sovani who is presently working as<br />

PS to PGMT Pune which is illegal post and his duty is to carry out the works of<br />

Personal Assistant in pay scale of Sr SDE. We have already brought to your notice that<br />

so many PS are idle rather without any work & are compelled to work at lower grade of<br />

PA and one SDE level officer is posted to work as PS. Pune SSA has history that person<br />

posted as PS becomes so great “chamacha” and takes over grief of PGMT Pune that it<br />

appears that PS is acting in powers of PGMT Pune. This has been experienced by<br />

executives and staff of Pune and specially while allotment of IQs Mr Sovani was much<br />

biased and there are lot of complaints about him but Pune management has not taken<br />

any action in any of the complaint as Mr. Sovani used his expertise in settlement of the<br />

complaints well in advance. A detail inquiry in allotments of IQs will prevail truth and<br />

facts.<br />

It is important here that Mr. Sovani is long stayed officer in Pune since 2008. He<br />

was first transferred out of Pune in March 2008 to Ratnagiri and since then he has<br />

adopted all illegal tactics for his retention at Pune and management of Pune and Circle<br />

office is supporting all his illegal activities. Just look at his transfer orders and its<br />

cancellation will give clear picture how senior officers in BSNL are helpless and how<br />

Mr. Sovani is powerful and handling all senior officers, first for his retention at Pune<br />

for continuous Five years and after five years to change his posting from Ratnagiri to<br />

Circle office when all other officers are not given chance just to listen their grievances.<br />

1. The first transfer order of Shri. H.V.Sovani, was issued in Dec 2008 vide<br />

transfer order no- A/STA/AE-20/TES Gr B/IDT/2008/25 Dated 8/12/2008 and<br />

Mr. Sovani was transferred to Sangli. But Pune admn relived all other officers;<br />

name of Mr. Sovani was excluded from list of relived officers. Even though all<br />

other officers including women comrades were relived and forced to join new<br />

assignment since Dec 2008 then Mr Sovani is retained at Pune SSA till date by<br />

repeated orders, its cancellation and retention at Pune, then change of posting<br />

that to be without any specific reason as per transfer policy guidelines and just<br />

to favor him to recognize his personal services.<br />

2. Then again vide circle office order no- A/STB/AE-20/SDE/TFR/37 Dated<br />

23/04/2010, again, Shri. H.V.Sovani was transferred to Ratnagiri, but again he<br />

was not relived. No retention orders were issued by the circle, but PGMT, Pune<br />

in his own capacity, misusing the powers of CGMT, MH circle has issued their<br />

retention till 31 December 2010, vide Pune AGM orders no- PTA/SE-386/TES<br />

GR B Dated 01/07/2010, still after that they are not relieved till date.<br />

3. As per the orders no A/STB/AE-20/SDE/TFR/II/37 & 38 DATED 18/03/2011,<br />

the SDE’s were relieved by admin of Pune SSA vide orders no- PTA/SE-<br />

386/TRANSFERS (Executives)/11 dated 20/04/2011 including Mr Sovani but<br />

practically he was not relived from Pune even though circle office records were<br />

updated as if he is relived. These orders are just to show the Circle Office that<br />

the official has been relived from Pune in order to save the face of Pune<br />

management in the Circle management meeting.<br />

4. These are only classic examples and there are so many other cases wherein Mr.<br />

Sovani has taken personal advantage of his post as PS to PGMT Pune.<br />

5. Now after retention of five years in Pune, when he was to be relieved by 31 st<br />

March 2013, Mr. H V Sovani has written letter addressed to you wherein he has<br />

cried foul that he was not given chance to exercise the option on posting after<br />

long stay. He has further mentioned that his daughter has completed BE and<br />

coming years she will get admission in IIT Mumbai. He has not mentioned any<br />

other justified ground in his letter and we are surprised to know that same is<br />

directly approved by you and staff section has immediately issued orders well in<br />

advance.<br />

6. This is limit of malpractices by Mr. H. V. Sovani and we are surprised to see<br />

that on the name that daughter of Mr. Sovani is getting admission for ITI<br />

Mumbai his case is approved wherein so many other cases with such<br />

background are pending in Maharashtra Circle and not considered by your<br />

office. Even the reasons for which provision exists in transfer policy are ignored<br />

and Mr. Sovani is favored by giving undue advantage.<br />

SNEA (I) Maharashtra has always opposed such malpractices by some<br />

individuals in Pune and with our letters all other executives who were adopting illegal<br />

practices are now transferred except super power man Mr. Sovani who last year<br />

managed his retention at Pune with political support and his retention is valid up to<br />

31 st March 2013. We have received information from Pune that he was challenging to<br />

in Pune that he is having direct relation with Shri. V. K. Mahindra & he have done lot<br />

for you since last four years & he will be saved from this transfer also as you have<br />

saved him in all earlier cases and at any cost he will not join Ratnagiri. We kept quiet<br />

assuming that you are strong enough and your image is of Mr. Clean, and will not<br />

come in blackmailing trap of Mr. Sovani, but it is unfortunate that we are wrong and<br />

results shows that whatever he was saying is true.<br />

But during last year Mr. Sovani adopted all the ways for his retention at Pune by<br />

applying to WTR, WTP, ITPC Pune and recently for Wireless Nodal Centre Pune. But<br />

BSNL Corporate Office did not consider his any of the request but Maharashtra Circle<br />

management is helplessly issuing his retention in Pune for continuous five years and<br />

now by adopting extreme shameless way his request for exercising his option for<br />

posting on transfer under longest stay is accepted by Circle management that to be<br />

in case of only for Mr. Sovani after completion of five years and not for any other<br />

comrade including ladies comrades.<br />

When the matter was brought to our notice by our Pune comrades we have<br />

taken up matter with GM HR & Admn Mumbai who was firm enough and he himself<br />

has protested such illegal idea and he informed us that anyhow Mr Sovani will have to<br />

join Ratnagiri SSA and Circle office will not change his posting. But it has also came<br />

under pressure created by Mr. Sovani perhaps may be through your good self and you<br />

have used your supreme power and now changed posting on transfer from Ratnagiri to<br />

Circle Office. SNEA (I) Maharashtra strongly condemns such misuse of powers and<br />

extreme misuse of personal relations in official position for illegal works and<br />

personal benefits by Mr. Sovani and its support by the circle management under<br />

your leadership.<br />

Sir, since March 2008, about five years have passed and more than 150 officers<br />

are transferred out of Pune on the name of longest stay which includes comrades<br />

having very genuine reasons on family grounds. Some of officers who were having very<br />

hard family problems have left Pune alone and faced lot of problems by maintaining<br />

dual establishment, some of officers were forced to spoil the carrier of their children by<br />

keeping themselves away from family during crucial educational period, some<br />

individual were having medical problems, but your office did not listen to cry of any<br />

one and transferred all of them without any mercy except Mr. Sovani. In recent<br />

orders all ladies officers are also transferred to different corners of Maharashtra and<br />

some of officers are posted to Gadchiroli at extreme difficult posting in BSNL. Your<br />

office has not shown any mercy to these ladies comrades even who are widow and<br />

having no one to take care of their children at Pune and were forced to join tenure<br />

stations alone. We have seen that Circle Office has not shown any mercy to<br />

anyone else for retention at Pune except Mr. Sovani. No doubt Sir, in the retention<br />

of Mr. Sovani at Pune your good self has helped him lot in these five years and now<br />

your use of VETO Power for posting of Mr. Sovani in Circle Office Mumbai has<br />

created unrest among all executives in Maharashtra Circle.<br />

Sir, we are unable to understand a clean person like you is taking such illegal<br />

decision and is forced to use Veto Power & it makes us to feel that Mr. Sovani is<br />

blackmailing you by using some your personal information available with him or by<br />

bringing pressure from sources which are controlling you. Otherwise Mr. Clean like<br />

you will not have dared to take such illegal decision that to be when few days are left<br />

for the retirement and support illegal activities continued by Mr. Sovani for last five<br />

years by using his official position. We know being your PS as PGMT Pune he may<br />

have done some of your personal works and he may have gained some personal<br />

information and this should have been secrete and it should not have resulted in<br />

Official Dealing in illegal way.<br />

We have discussed this issue with your good self on 8 th March 2013 and you<br />

have assured for corrective action even though you have justification that one JTO is<br />

being transferred from Mumbai to Pune so Mr. Sovani is transferred to Mumbai in her<br />

place. We never expected such childish explanation from highest authority of<br />

Maharashtra Circle because Mr Sovani is SDE and there cannot be mutual between<br />

JTO and SDE.<br />

Surprisingly your office has intentionally neglected the waiting list register<br />

maintained for transparency in transfers and posting in which request of Mrs. N.M.<br />

Mahadik JTO from Pune is pending for Circle Office since Oct 2012. If it was just<br />

mutual transfer it should have been between two JTOs and Mrs. Mahadik should have<br />

been posted to Circle Office and not Mr. Sovani as approved by you and followed<br />

without any query by your office. Your office has not given any consideration of request<br />

of Com. A.K. Yadav JTO Chandrapur who is having serious family medical problems<br />

and serving in naxlite affected area since last seven years and all of sudden name of<br />

Mr. Sovani is inserted in the transfer list by giving illegal preference and his order is<br />

issued for Circle Office. This is serious violation of transfer policy guidelines and it<br />

happened due to misuse of official position by Mr. Sovani and its is supported by<br />

administration under your leadership.<br />

It can be seen that since last 2-3 years about 13 JTOs & 11 SDEs have<br />

requested for own cost request transfer to Circle Office, but your office has never<br />

given any consideration to any request quoting that there are excess executives<br />

in Circle Office and what happened that Mr. Sovani is being transferred to Circle<br />

Office that to be in interest of service by violating basic principles of transfer<br />

policy and spoiling transferency maintained by Circle Office for long time.<br />

Mr. Sovani is working in Pune from his entry in the Department i.e.<br />

03/11/1980 and you are well aware that in entire span of 33 years of service he has<br />

never served out of Pune City. He has managed his posting and escaped from rural<br />

transfers by adopting such illegal practices and lifelong he is working in higher HRA<br />

area. It is important that he has done nothing special or exceptional except booking<br />

air/rail tickets for senior officers, reserving BSNL IQs for special person by depriving<br />

BSNL officers/employees for their right of getting IQ at Pune and doing private works<br />

of some individual officers at Pune, and officers coming to Pune on personal tour. Out<br />

of these works, none of work will justify his retention for five years and now very<br />

special favour by changing his posting to Circle Office Mumbai from Ratnagiri that to<br />

be after retention for five years in 30 % HRA area.<br />

Since last five years many of the officers transferred to Pune from Ratnagiri were<br />

not relived as Mr. Sovani was substitute for them. Each and every officer who has<br />

completed tenure for which Mr. Sovani was substitute was not relived as Mr. Sovani<br />

did not joined and managed his retention at Pune. In March 2008 Mr. Kapare was<br />

transferred along with Mr. Sovani to Ratnagiri, Mr. Kapare obeyed orders and joined<br />

Ratnagiri and Mr. Sovani managed his retention. When Mr. Kapare completed his<br />

tenure of two years in Years then Mr. Sovani was his substitute. But this time also Mr.<br />

Sovani was successful in managing his retention and Mr. Kapare was forced to serve<br />

for more than three years at Ratnagiri tenure station.<br />

Sir, your office has not yet shown any mercy to officers serving to remote areas<br />

like Jalna, Buldhana, Osmanabad and about 35 officers are still waiting for justice.<br />

Their requests are neglected by Circle management that they have not completed seven<br />

years in service in that SSA. The difficulties faced by all these comrades and their<br />

family members are neglected by Circle management under your leadership even<br />

though they are facing much more problems than Mr. Sovani. We would like to put on<br />

records that your office has forcibly transferred some officers from locations like<br />

Parbhani, Osmanabad, Dhule where their acute of executives in all cadres on the name<br />

of transfer policy guidelines and transparent working. Your office was so cruel in some<br />

of cases that concerned executives were forced to take untimely VRS but not helped by<br />

Circle management. No one is able to understand under what circumstances the<br />

request of Mr. Sovani is considered with assumption that his daughter will get<br />

admission in IIT Mumbai for M Tech before entrance examination is taken by IIT.<br />

But all these transfer policy guidelines and transparency in working is moulded<br />

in a shameful approach in case of Mr. Sovani. Sir this is not first time that he is<br />

favoured out of turn by you, but our Pune unit has brought to our notice such earlier<br />

incidents when Mr. Sovani was favoured by your good self for reasons best known to<br />

you.<br />

It to bring to your notice that in a recent letter No. 400-57/2012-Pers.I Dated<br />

21 st March 2012 from BSNL Corporate Office which is endorsement of DoT orders for<br />

taking serious view on the political and VIP pressure and treating it as misconduct on<br />

behalf of employee. It is evident that Mr. Sovani is expert in such practise and your<br />

office also has given undue consideration may be due to involvement of such VIP<br />

person is such cases and at least this time your office. It is need of time that action is<br />

initiated against Mr. Sovani for such VIP and political pressure as misconduct as per<br />

BSNL CDA rules and latest guidelines issued by letter under reference 2 by BSNL CO.<br />

When such officers become successful, in managing their transfers it becomes<br />

precedence and BSNL CO & DoT is compelled to issue such instructions. We hope you<br />

will take serious note of illegal ways, unethical means adopted by Mr Sovani for<br />

retention at Pune & change of posting to Mumbai with fake justification and give clear<br />

signals to others for such unofficial means and ways and at the same time you will<br />

take care to settle mass unrest among the executive community in entire Maharashtra<br />

Circle for such “chamchagiri” practices.<br />

Sir, our members would like to know what are the special expertise of Mr Sovani<br />

and what are special works done by him in the interest of company so that he is given<br />

out of way treatment by Pune SSA and your esteemed office, so that all other officers<br />

will take expertise training from him and will follow their steps for saving their<br />

transfers and BSNL will get more “chamchas” in competition with Mr. Sovani. Please<br />

provide us this valuable information for motivation of our members.<br />

We have already demanded special inquiry in case of favoritism to Mr.<br />

Sovani in out of way, which we doubt has serious financial involvement without<br />

which it is not possible to have such out of track setting. However, since last two<br />

years, no action has been taken by your office on this letter, which gives scope to<br />

doubt that someone from your office is also involved in such malpractices. We<br />

again demand to have detail inquiry on the transferred managed by Mr. Sovani<br />

and the officers who helped him in such malpractices and involvement of<br />

finincail dealings such illegal transfers and out of way favoritism. We further like<br />

to know what action was been taken against Mr. Sovani when he has brought<br />

political pressure during last year for his retention at Pune by violating BSNL<br />

CDA rules and latest guidelines issued by BSNL CO.<br />

We have doubt that Mr. Sovani is dealing some financial dealings<br />

unofficially with some officers and hence demand for inquiry of assets of Mr.<br />

Sovani and officers linked to him. It is further requested to make public all the<br />

requests made by Mr. Sovani along with relevant documents and office remarks<br />

in note sheets on the files in which his transfer orders are issued cancelled,<br />

modified but not implemented during last five years.<br />

Hoping for immediate cancellation of transfer order of Mr. Sovani issued for<br />

Circle Office and give clear signal that Circle management in your leadership will not<br />

tolerate such unethical ways and assure for transparency in dealing with HR Issues.<br />

OR<br />

If it is not possible to cancel transfer of Mr. Sovani to Circle office, due to special<br />

obligation done by Mr. Sovani or pressure created by Mr. Sovani cannot be sustained<br />

by you during last 20 days of your service, then please consider all other pending<br />

request transfer of executives to Circle Office and maintain transparency and give<br />

justice to the all other comrades.<br />

It is also requested to show such special approach as shown to Mr. Sovani for<br />

other comrades waiting for long time for their transfers to choice station and presently<br />

servicing at very difficult conditions and with lots of family problems and give them<br />

justice.<br />

We are confident that you will maintain your image of Mr. Clean and will not<br />

involve yourself in such illegal transfers and show courage to sustain pressure created<br />

or any type of inveiglement by Mr. Sovani for his personal benefits and keep roadmap<br />

with lesson to all such corrupt offices and let our executives and employees know that<br />

you never tolerated such corrupt practices and Circle management is till clean and<br />

transparent in dealing with transfers.<br />
