<strong>Prior</strong> <strong>compliance</strong> <strong>list</strong> <strong>of</strong> <strong>aircraft</strong> <strong>operators</strong> <strong>specifying</strong> <strong>the</strong> administering Member State<br />
for each <strong>aircraft</strong><br />
The Commission must publish a <strong>list</strong> <strong>of</strong> <strong>aircraft</strong> <strong>operators</strong> which on or after 1 January 2006<br />
performed an aviation activity <strong>list</strong>ed in Annex I <strong>of</strong> Directive 2003/87/EC that specifies <strong>the</strong><br />
administering Member State for each <strong>aircraft</strong> operator ("<strong>the</strong> <strong>list</strong>").<br />
The Commission adopted <strong>the</strong> <strong>list</strong> <strong>of</strong> <strong>aircraft</strong> <strong>operators</strong> on 28th January 2010.<br />
It is important to stress that <strong>the</strong> inclusion in <strong>the</strong> EU emissions trading scheme (EU ETS) is<br />
linked to <strong>the</strong> performance <strong>of</strong> an aviation activity only and is not subject to inclusion on <strong>the</strong><br />
<strong>list</strong>. That means that <strong>aircraft</strong> <strong>operators</strong> that perform an aviation activity <strong>list</strong>ed in Annex I to<br />
Directive 2003/87/EC are covered by <strong>the</strong> EU ETS whe<strong>the</strong>r or not <strong>the</strong>y are on <strong>the</strong> <strong>list</strong> <strong>of</strong><br />
<strong>operators</strong> at <strong>the</strong> time <strong>of</strong> <strong>the</strong> activity. Likewise <strong>operators</strong> which cease performing an aviation<br />
activity are excluded from <strong>the</strong> scheme once <strong>the</strong>y cease to perform an aviation activity <strong>list</strong>ed in<br />
Directive 2003/87/EC and not at <strong>the</strong> point <strong>the</strong>y are removed from <strong>the</strong> <strong>list</strong>.<br />
On <strong>the</strong> o<strong>the</strong>r hand, <strong>the</strong> <strong>list</strong> is legally binding regarding <strong>the</strong> determination <strong>of</strong> <strong>the</strong> administering<br />
Member State made in <strong>the</strong> <strong>list</strong>. It ensures that each operator knows which Member State it<br />
will be regulated by. It also ensures that Member States are clear on which <strong>operators</strong> <strong>the</strong>y<br />
should regulate.<br />
Some un<strong>list</strong>ed <strong>aircraft</strong> <strong>operators</strong> have requested <strong>the</strong>ir inclusion in <strong>the</strong> <strong>list</strong>. The Commission<br />
understands that <strong>the</strong>se <strong>operators</strong> are currently excluded from <strong>the</strong> EU ETS as <strong>the</strong>ir flight<br />
activities fall outside <strong>of</strong> <strong>the</strong> scope <strong>of</strong> Directive 2003/87/EC, <strong>the</strong>refore it is not possible to<br />
include <strong>the</strong>m on <strong>the</strong> <strong>list</strong> at this point in time. However, <strong>the</strong>se <strong>operators</strong> are <strong>of</strong> <strong>the</strong> view that<br />
<strong>the</strong>ir activities will fall within <strong>the</strong> scope <strong>of</strong> <strong>the</strong> Directive by <strong>the</strong> start <strong>of</strong> <strong>the</strong> initial monitoring<br />
in 2010. A decision has been requested at this stage as to who will regulate <strong>the</strong>m, so that <strong>the</strong>y<br />
can set up <strong>the</strong> appropriate monitoring and reporting arrangements before 2010.<br />
These <strong>aircraft</strong> <strong>operators</strong> are <strong>list</strong>ed here ("<strong>the</strong> prior <strong>compliance</strong> <strong>list</strong>") on a preliminary basis<br />
based on <strong>the</strong> nationality <strong>of</strong> <strong>the</strong>ir operating licence, <strong>the</strong>ir past aviation activity or forecasts <strong>of</strong><br />
future aviation activity. Additional explanation <strong>of</strong> <strong>the</strong> prior <strong>compliance</strong> <strong>list</strong> is provided in <strong>the</strong><br />
frequently asked questions on <strong>the</strong> <strong>list</strong> <strong>of</strong> <strong>operators</strong> available on <strong>the</strong> Commission's website.<br />
It is possible that fur<strong>the</strong>r <strong>aircraft</strong> <strong>operators</strong> will request such a preliminary allocation. Such<br />
requests should be sent to <strong>the</strong> following functional e-mail address:<br />
env-eu-ets-aviation-prior-<strong>compliance</strong>-<strong>list</strong>@ec.europa.eu<br />
In <strong>the</strong> event <strong>of</strong> additional requests, <strong>the</strong> Commission will update <strong>the</strong> prior <strong>compliance</strong> <strong>list</strong><br />
before January 2010.<br />
A final determination <strong>of</strong> <strong>the</strong> administering Member State based on aviation activities<br />
performed during <strong>the</strong> first year <strong>of</strong> operation under <strong>the</strong> EU ETS will be made by 1 February in<br />
<strong>the</strong> year following <strong>the</strong> first calendar year <strong>of</strong> operation. Therefore <strong>the</strong> administering Member<br />
State may change for <strong>the</strong> <strong>aircraft</strong> <strong>operators</strong> <strong>list</strong>ed on this prior <strong>compliance</strong> <strong>list</strong> without an EU<br />
operating licence.<br />
