Chairman’s<br />

Report <strong>2006</strong><br />

<strong>2006</strong> was another year of change, what year isn’t in today’s environment? Our committees<br />

and secretariat worked hard to develop the <strong>Association</strong>’s position as the European leader.<br />

Following on from 2005 we continued to use Sustainable Development as the framework for<br />

our activities. The reports which follow reflect our actions within the 3 main pillars of<br />

Sustainable Development: Social, Environment & Economic.<br />

<strong>Aerosol</strong> filling in the UK in 2005 continued to be stable<br />

despite the continued general pressure in the UK<br />

manufacturing sector. The UK kept its position as European<br />

market leader filling over 27% of all European aerosols. This<br />

demonstrates that our industry, underpinned by BAMA, has<br />

done a good job in maintaining competitiveness in a difficult<br />

economic and legislative environment.<br />

The <strong>2006</strong> figures are still being collated but with the<br />

continued proactive input from our<br />

members I am confident that we will<br />

maintain our strong position within<br />

the global aerosol industry.<br />

Legislatively we have continued to work proactively with<br />

all the relevant authorities within the UK & Europe relating<br />

to REACH (EU Chemicals Policy), <strong>Aerosol</strong>s Directive, F-Gas<br />

Regulations etc. Much of this legislation is due for<br />

introduction in 2007.<br />

Clearly we have seen very positive progress in the recycling<br />

of aerosols which helps our message on the environmental<br />

positioning of our products.<br />

The UK kept its position as<br />

European market leader filling over<br />

27% of all European aerosols.<br />

<strong>2006</strong> also saw a huge amount of effort by the <strong>Association</strong><br />

in gearing up for <strong>Aerosol</strong>s 2007 to be held in September in<br />

Manchester. In line with our own strategy the Congress theme<br />

will be Sustainable Development.<br />

I would like to address my thanks to all our members for their<br />

support during <strong>2006</strong>. I am also particularly thankful to the<br />

participants of all the committees, working groups and my<br />

fellow committee chairmen for their invaluable contribution<br />

over and above their normal jobs<br />

within their own companies.<br />

I mentioned continual change<br />

earlier and I should like to thank<br />

those committee members who<br />

retired from office this year alongside the newcomers.<br />

Finally, I wish to say a big thank you to the dedicated<br />

BAMA secretariat headed by Sue Rogers. They continue to<br />

provide a professional, responsive and dynamic hub for<br />

our <strong>Association</strong>.

Director’s<br />

Report <strong>2006</strong><br />

During <strong>2006</strong> BAMA has been investing on behalf of our members.<br />

Firstly, we paid up front to secure the venue in Manchester at preferential rates for <strong>Aerosol</strong>s<br />

2007. The scene is now set for what we truly believe will be a successful and exciting event<br />

from 18 – 20 September 2007. I am really looking forward to welcoming you all to Manchester<br />

– particularly as its demands have meant I have not been able to get out to visit members as<br />

often as I should over the last year or so. I plan for that to be remedied afterwards!<br />

With the detailed preparations for <strong>Aerosol</strong>s 2007 now in full<br />

swing, <strong>2006</strong> has been an extraordinarily busy year for BAMA.<br />

The Congress is developing into an exciting world class<br />

programme. The three days themed around three pillars of<br />

sustainability and our aim, ‘propelling aerosols worldwide’,<br />

have attracted first class speakers from around the world.<br />

The exhibition is already selling out rapidly and our active<br />

promotion in person of <strong>Aerosol</strong>s 2007 in Europe, the USA,<br />

Latin America and China will, we<br />

hope, bring delegates and visitors<br />

from all over the world to share,<br />

debate and learn from each other<br />

on a wide number of issues. We<br />

also hope to attract entries into the<br />

first ever international aerosol<br />

awards to celebrate the industry’s innovations and creativity.<br />

Our other key area for investment was designed to assist<br />

members with REACH, the European legislation for the<br />

Registration and Authorisation of Chemicals. To help our<br />

members to prepare for this mammoth task, BAMA has<br />

developed the ‘BAMA model’. This is now widely<br />

acknowledged as a simple to use but powerful tool,<br />

independently validated by experts, to help produce the<br />

exposure scenarios which will be required. Now the detail of<br />

the Regulation is finalised, a working group has been set up<br />

to produce guidance for members.<br />

BAMA has commissioned hazard profiles on priority chemicals<br />

commonly used in aerosols, which will be made available to<br />

members. This will be a key benefit of BAMA membership in<br />

the years to come as companies get to grips with the demands<br />

of the legislation.<br />

Some other regulatory issues<br />

have reached conclusion in <strong>2006</strong>.<br />

The long running negotiations on<br />

greenhouse gases under the<br />

EU’s F-Gases Regulation were<br />

completed finally, with the only ban on use of HFCs in<br />

aerosols for novelty products from 2009. This was a major<br />

success for us as the original plans were to ban HFCs in all<br />

aerosols. The voluntary agreement to use HFCs only where<br />

strictly necessary, developed by BAMA, has been taken up<br />

by the European <strong>Aerosol</strong> Federation (FEA) and will need to<br />

remain in place to support the industry in the review of the<br />

legislation in several years’ time. The USA is also beginning

to adopt a similar approach despite<br />

its Government’s well publicised<br />

refusal to sign the Kyoto Protocol.<br />

Following changes to the ‘Ranges’<br />

Directive, prescribed quantities for aerosols will no longer be<br />

regulated but BAMA is involved in talks within FEA to produce a<br />

voluntary standard to ensure products are not sold underfilled.<br />

In contrast, the revision of the <strong>Aerosol</strong> Dispensers Directive<br />

has been frustratingly – and familiarly – slow. This time<br />

Global Harmonisation (GHS) has intervened to obstruct<br />

progress but we are working our way through.<br />

We are proud that the BAMA Standard for Consumer Safety and<br />

Good Manufacturing Practice has achieved its first accreditation<br />

– Impress (formerly USC UK). A number of members from all<br />

sectors of the supply chain could achieve accreditation with<br />

little difficulty – or extra work – as the Standard has been<br />

designed to fit into existing management systems. The Standard<br />

is being updated again to keep step with legislative changes and<br />

is planned for relaunch as Issue 3 in September 2007.<br />

On the communications front, we have been delighted by the<br />

support we have received from retailers, who have added<br />

in-store messages to spread the word that empty aerosols can<br />

be recycled. We also reached a large number of consumers<br />

through specially arranged interviews on local radio.<br />

Our courses have proved very popular again in <strong>2006</strong> and<br />

we are very grateful to all the speakers who give their time<br />

the industry. At members’ request,<br />

we ran two extra Propellant Safety<br />

courses at plants around the UK<br />

with good attendance.<br />

We are, as always, immensely grateful to all the committee<br />

members and especially the committee chairmen – we<br />

recognise that members have fewer staff available and they<br />

have less time to dedicate to association work. We undertake<br />

as much of the work as we possibly can in the secretariat but<br />

we do need to call on members to add their input from time to<br />

time so we can check we are in step – and this happens best<br />

through the committees.<br />

Somewhat ironically, the better we manage issues, so that<br />

the industry can continue to operate safely and responsibly<br />

but with as little disruption as possible, the less obvious our<br />

success can be. However, those who have been involved in<br />

issues which have not been successfully managed will<br />

testify to our value!<br />

We thank you for your continued support. I would especially<br />

like to thank Jean Blottière for his hard work as Chairman<br />

over the last two years, our new Chairman John Bigley,<br />

Hon Treasurer, Richard Wells who has played an invaluable<br />

role for several years now, all the members of the Executive<br />

Committee and the BAMA staff who have tackled a vast<br />

workload with professionalism and enthusiasm. We wish<br />

Caroline Fuller every happiness in her new life in Australia<br />

and are only sorry that she won’t be in Manchester with us.<br />

The committee has met 5 times in <strong>2006</strong>.<br />

SUSTAINABLE DEVELOPMENT STRATEGY<br />

The Committee continued to focus on<br />

BAMA’s Sustainable Development<br />

programme. A message matrix has been<br />

developed which provides key messages<br />

about aerosols and their uses under the<br />

three pillars: economic, social and<br />

environmental. There are some very<br />

positive messages with supporting data<br />

on the BAMA Standard, health and<br />

environmental impacts and examples of<br />

innovation and recycling opportunities.<br />

The matrix will be available to members in<br />

time for the Congress in September 2007.<br />

BAMA STANDARD<br />

Issue 3 revision has started during the<br />

year. Data from the BAMA Guides was<br />

built into the manufacturing module.<br />

Revisions began on warehousing,<br />

FINANCIAL PLANNING &<br />

MEMBERSHIP RECRUITMENT<br />

The Committee reviewed the<br />

subscription rates and as a result<br />

subscriptions were increased in line<br />

with inflation.<br />

BAMA used some of its reserves to pay<br />

one year ahead to secure favourable<br />

rates on the hire of Manchester<br />

Central 2007.<br />

There are some very<br />

positive messages with<br />

supporting data on the<br />

BAMA Standard, health<br />

and environmental<br />

impacts and examples of<br />

innovation and recycling<br />

opportunities.<br />

The committee also considered a report<br />

from external advisors on the financial<br />

implications of moving out of the<br />

current offices during 2007 when there<br />

is a break in the lease. The conclusions<br />

were that there was no overall financial<br />

gain to be had from moving out. This<br />

will continue to be kept under review.<br />

BAMA has begun a programme of<br />

investment in literature reviews on a<br />

range of key ingredients used by BAMA<br />

members. These reviews will be made<br />

available to members to support their<br />

requirements under REACH and will be<br />

used to demonstrate tangible benefits<br />

of BAMA membership.<br />

TRAINING<br />

BAMA courses remained popular<br />

during <strong>2006</strong>. Two extra Propellant<br />

Safety courses were held in <strong>2006</strong> at<br />

members’ requests.<br />

CHEMICALS REGULATORY FORUM (CRF)<br />

BAMA is a member of the Government’s<br />

Chemicals Regulatory Forum. BAMA<br />

members participated in a study to<br />

evaluate the Cumulative Burden of<br />

Regulations on industry. The study<br />

findings were taken up into the future<br />

work programme of CRF, launched in<br />

November.


PACKAGING AND CONTENTS COMMITTEE 11<br />

Packaging and Contents Committee<br />

The committee met four times during<br />

<strong>2006</strong> and members were also active in<br />

the corresponding FEA committee as we<br />

monitored the progress of legislation<br />

important to our industry.<br />

AEROSOL DISPENSERS DIRECTIVE (ADD)<br />

A proposed amendment to ADD was<br />

initiated by the European Commission<br />

under the procedure for Adaptation to<br />

Technical Progress in 2005 and it was<br />

expected that this would be finalised<br />

in <strong>2006</strong>. Unfortunately this has not<br />

happened due to issues raised during<br />

the interservice consultation on the<br />

proposed amendment within the<br />

Commission. There were two main areas<br />

of concern; firstly the legal service would<br />

not accept reference to the UN Manual<br />

on the Transport of Dangerous Goods<br />

within ADD as it was not an EU<br />

institution. This is an important<br />

part of the proposed amendment<br />

as it relates to the classification<br />

and labelling for flammability and<br />

aligns ADD with ADR/RID to<br />

ensure there is no conflict<br />

between legislation for the manufacture<br />

and transport of aerosols. Secondly DG<br />

SANCO required a stronger reference to<br />

the need to assess spray characteristics<br />

and particle size distribution in the new<br />

section dealing with risk assessment.<br />

Neither of these issues should jeopardise<br />

the proposed amendment as FEA have<br />

put forward proposals to address both of<br />

these concerns. However it appears that<br />

resolving the issues is not a high priority<br />

for the Commission and the situation has<br />

been complicated by the proposed<br />

introduction of GHS for the Classification<br />

and Labelling of Dangerous Goods into<br />

the EU. Meanwhile BAMA and FEA<br />

continue to work to make progress on<br />

this issue although the timing of a<br />

satisfactory outcome is uncertain.<br />

PRESCRIBED QUANTITIES (RANGES)<br />

DIRECTIVE (PQD)<br />

The Commission has completed the<br />

process of amending this legislation<br />

which has now been sent back to the<br />

European Parliament for approval.<br />

This should provide a satisfactory<br />

outcome for our industry as aerosols<br />

may continue to be labelled by volume<br />

only but they must be labelled with the<br />

brimful capacity of the container. There<br />

will no longer be a list of prescribed<br />

sizes and fills. BAMA is working with<br />

FEA to produce an FEA Standard on<br />

fill sizes as a guide to members and<br />

to help avoid instances of underfilling<br />

PLASTIC AEROSOLS<br />

Members continue to be active in the<br />

FEA Task Force which is working to<br />

produce data that would allow a<br />

relaxation of the current regulatory<br />

constraints on plastic aerosols and<br />

harmonise ADD with ADR/RID.<br />

The work is well advanced and it is<br />

expected that the Task Force will<br />

present its report during 2007.<br />

GLOBALLY HARMONISED SYSTEM OF<br />

CLASSIFICATION AND LABELLING OF<br />

CHEMICALS (GHS)<br />

During the year the Commission<br />

decided to implement GHS criteria into<br />

Community law. This will affect the<br />

classification and labelling of aerosols<br />

for flammability but the proposed<br />

amendment to ADD already<br />

incorporates GHS criteria in this area.<br />

However the Commission wish to<br />

implement GHS as a single regulation<br />

which would mean that ADD would not<br />

be the legal instrument for the<br />

regulation of flammability in aerosols.<br />

This is unsatisfactory as some major<br />

aerosol categories such as<br />

cosmetics, pharmaceuticals and<br />

food are not fully covered by<br />

GHS. Strong representations<br />

were made during the public<br />

consultation on this proposal<br />

but our arguments were not<br />

accepted. This issue will be a major<br />

part of the workload of the committee in<br />

the near future as we work within the<br />

industry and with Member States to<br />

retain the supremacy of ADD.


12 ENVIRONMENT COMMITTEE<br />

Environment Committee<br />

The Environment Committee met four<br />

times during the year. There were also<br />

meetings of the Scientific Panel.<br />

BAMA representatives were also heavily<br />

committed to the European <strong>Aerosol</strong><br />

Federation (FEA) Environment<br />

Committee, the VOC Working Group,<br />

the HFC Working Group, the <strong>Aerosol</strong><br />

Ingredients Working Group and<br />

Integrated Product Policy Working<br />

Group, (now known as the Sustainable<br />

<strong>Aerosol</strong> Strategy WG).<br />

EU CHEMICAL POLICY<br />

In late <strong>2006</strong>, the EU finally agreed on<br />

the new European Chemical Regulation,<br />

(REACH), the text of which was<br />

published in the EU official journal in<br />

January 2007.<br />

During the year, BAMA supported<br />

the completion of the PRODUCE project,<br />

which was conducted by a number of<br />

parties, including BAMA to ‘try out’<br />

REACH. A huge number of lessons were<br />

learned and more than 30 recommendations<br />

highlighting the need for good<br />

quality guidance for downstream usersto-be<br />

were made.<br />

To that end, BAMA has also been<br />

actively supporting the development of<br />

appropriate exposure modules in the<br />

REACH Implementation Projects (RIPs)<br />

(in conjunction with the FEA and AISE) –<br />

specifically by promoting the use of the<br />

BAMA Exposure Model.<br />

We have also commissioned the Institute<br />

of Environmental and Health (IEH) to<br />

conduct reviews of published<br />

toxicological/safety information, for<br />

chemicals whose use is key to the<br />

aerosol industry.<br />

INDOOR AIR QUALITY<br />

IAQ remains a significant issue and as<br />

a follow-up to the BEUC report on<br />

emissions from air fresheners, the Belgian<br />

Government published a report of a study<br />

by VITO measuring emissions from 20<br />

different types of air fresheners. With the<br />

exception of incense, the air fresheners<br />

were given a clear bill of health and the<br />

data measured and modelling work<br />

appear complementary to the BAMA<br />

modelling work.<br />

During <strong>2006</strong>, two health issues were<br />

reported in relation to a waterproofing<br />

spray and a sealing spray that was being<br />

marketed as nano-technology.<br />

BAMA has been actively<br />

supporting the development<br />

of appropriate exposure<br />

modules in the REACH<br />

Implementation Projects<br />

An excellent presentation on the facts<br />

of the issue was given at the BAMA<br />

Autumn Forum highlighting a number<br />

of mistakes made in the development<br />

which resulted in a spray containing a<br />

high level of particles that could enter the<br />

lung. Unfortunately, this issue has led to a<br />

proposal to amend the <strong>Aerosol</strong> Directive to<br />

require marketers to conduct a health risk<br />

assessment for all spray products. FEA<br />

have issued a position paper, arguing that<br />

this is not necessary, as the requirement is<br />

covered by other, existing legislation, such<br />

as the Cosmetics Directive and General<br />

Product Safety Directive. Further work on<br />

spray particle size distributions and<br />

analysis is planned for 2007.<br />

VOLATILE ORGANIC COMPOUNDS<br />

The VOC issue remains on the agenda<br />

of the Committee. The review of the<br />

EU National Emissions Ceilings<br />

Directive continues to target reductions<br />

in VOC emissions (& subsequent<br />

formation of ozone) – although<br />

presently aerosols are not targeted<br />

under this legislation. A study by UK<br />

Government indicated that whilst<br />

aerosol products are not currently a<br />

significant source of VOC emissions,<br />

they are not likely to reduce over the<br />

next 15 years and so will be a<br />

significant source by 2020. Despite<br />

criticisms of the methodology used, this<br />

would further appear to indicate that<br />

aerosol emissions are highly likely to be<br />

targeted in future regulations.<br />

The FEA VOC WG concluded that<br />

VOC reduction is likely to become more<br />

of a target between 2010 and 2020,<br />

(rather than now).<br />

CLIMATE CHANGE<br />

The major focus during the year was once<br />

again the Fluorinated Gases Regulation<br />

under the European Climate Change<br />

Programme, and the EU F-Gas Regulation<br />

and the Mobile Air Conditioning Directive<br />

have now been published. This means<br />

that from 2009 there will be a ban on<br />

using HFCs in novelty aerosol products.<br />

Other product formats are not impacted at


this time – although the Commission will<br />

not be requiring Denmark and Austria to<br />

amend their regulations prohibiting the use<br />

of HFCs in aerosols – until 2012 – when<br />

the Regulation will have been reviewed.<br />

PACKAGING & PACKAGING WASTE<br />

Importantly, BAMA continues to support<br />

the recycling of tinplate and aluminium<br />

aerosol cans – particularly used, empty<br />

cans, and we are happy to report that<br />

76% of UK Local Authorities accept<br />

empty aerosols as a part of their<br />

recycling operations. We were very<br />

pleased when a number of major<br />

retailers agreed to carry point-of-sale<br />

information, communicating to the<br />

consumer that empty aerosols are<br />

recyclable.<br />

INTEGRATED PRODUCT POLICY<br />

The EU’s approach to IPP appears to<br />

be changing and the focus of this issue<br />

seems to be transferring to the new<br />

Sustainable Consumption and<br />

Production Policy and Green<br />

Procurement issues.<br />

On behalf of BAMA, I would like to<br />

extend my grateful thanks for the<br />

support and expertise of all those<br />

members of the Committee and Working<br />

Groups for the efforts they put in to<br />

further the environmental interests<br />

of our industry. We lost a number<br />

of members during the last year and<br />

we would warmly welcome any new<br />

member who wishes to help us to<br />

improve the environment for us all.


14 OPERATIONAL SAFETY COMMITTEE<br />

Operational Safety Committee<br />

The committee continues to be a strong<br />

group of specialist representatives<br />

from the BAMA membership. As always<br />

we are indebted to Martin Castle of<br />

PIRA International who gives us much<br />

appreciated support in the area of<br />

Transport.<br />

The committee dealt with relatively<br />

straightforward legislative issues this<br />

year. The regulatory reform Fire Order<br />

2005 came into force. We have already<br />

contributed to the guidance relevant<br />

to our industry. An authorisation<br />

was obtained to allow the<br />

adoption of the alternative<br />

to the hot water bath test in<br />

advance of implementation of<br />

ADR 2007 in the UK. A Guide<br />

was published for members<br />

showing how to apply for<br />

permission to use the alternative.<br />

The committee continues to watch<br />

developments closely in the area of<br />

Transport of Limited Quantities by<br />

Road. A proposal has been made that<br />

would require marking of vehicles<br />

carrying over a threshold quantity.<br />

The UK Government is supporting our<br />

opposition to this proposal. An FEA<br />

response has been developed and will<br />

be taken to meetings in early 2007.<br />

The committee assembled data to<br />

support the statements in the BAMA<br />

Sustainable Development Message<br />

matrix. It is important to be able to<br />

show that the safe working practices<br />

defined in BAMA guidance are<br />

successful in preventing accidents. The<br />

committee carried out an exercise using<br />

the HSE Health & Safety Performance<br />

Indicator system provided by Business<br />

Link. This will be used to develop<br />

further guidance and to help revise the<br />

BAMA Standard during 2007.<br />

An authorisation was obtained<br />

to allow the adoption of the<br />

alternative to the hot water bath<br />

test in advance of implementation<br />

of ADR 2007 in the UK.<br />

The committee continued to support<br />

the FEA project to set up a consortium<br />

to test the application of High<br />

Expansion Foam to control fires in<br />

aerosol storage. Sufficient companies<br />

have now expressed a desire to join the<br />

consortium, which will be established<br />

in early 2007.<br />

The BAMA Guide to the PPC Regulations<br />

and <strong>Aerosol</strong> Filling continued to provide<br />

useful information to members for use in<br />

discussions with the Environment Agency.<br />

The Guide was revised to reflect Agency<br />

guidance which effectively exempts the<br />

filling of hairsprays.


VOLATILE SUBSTANCE ABUSE 15<br />

Volatile Substance Abuse<br />

The VSA Committee met 4 times in<br />

<strong>2006</strong>. Thanks are due to committee<br />

members for their continued support on<br />

this important issue. Special thanks are<br />

extended to external members Warren<br />

Hawksley, Richard Ives, Steve Lambert<br />

and John Ramsey for the passion and<br />

energy they bring to the Committee.<br />

The number of BAMA members on this<br />

committee has dwindled for a variety of<br />

reasons. Members are being asked to<br />

join the committee as this continues to<br />

be an important issue for the industry.<br />

VSA STATISTICS<br />

According to the latest data issued,<br />

there were 47 deaths associated with<br />

volatile substance abuse in 2004, the<br />

lowest annual total recorded since data<br />

collection methods were stabilized in<br />

1983. The number of deaths in 2003<br />

has been revised to 53, bringing the<br />

total number of VSA deaths in the UK<br />

since 1971 to 2,152.<br />

Since 1992 there has been a significant<br />

fall in deaths, from an average of 77 per<br />

year in 1993 – 1998, to an average of<br />

62 per year in 1999-2004.<br />

lighter refills, the sale of which to<br />

under-18s is prohibited by legislation.<br />

VSA deaths continue to be more<br />

common among males than females.<br />

In 2004 there were over four times as<br />

many male as female deaths overall,<br />

but in the under-18 year olds, this ratio<br />

fell to just over two to one.<br />

In 2004 for the UK, among those aged<br />

10 – 15 years there were eight deaths<br />

associated with VSA compared with<br />

three deaths from drug misuse.<br />

STAKEHOLDER FORUM<br />

The Department of Health has<br />

produced a Volatile Substance<br />

Framework. As part of this framework<br />

four ‘Priorities for Action’ were identified,<br />

■ Better education<br />

■ Dealing with VSA Better Locally<br />

■ Minimising the Opportunities<br />

for Abuse<br />

■ Research<br />

Progress on the Stakeholder Forum has<br />

been disappointing as a result of the<br />

low priority of VSA on the DoH agenda.<br />

The VSA Committee has lobbied the<br />

required to deliver the VSA framework.<br />

Progress is being made albeit slow.<br />

UPDATED VSA LEAFLET<br />

As updated VSA leaflet has been<br />

prepared which delivers a hard hitting<br />

message about the dangers of VSA. The<br />

leaflet is aimed at BAMA members for<br />

distribution to their companies and can<br />

be used as part of corporate social<br />

responsibility actions.<br />

SPONSORSHIP<br />

BAMA sponsored the Scottish Drugs<br />

Forum newsletter on VSA again in <strong>2006</strong><br />

and has made a financial contribution<br />

to the Solve-It national conference on<br />

VSA which will take place in 2007.<br />

EUROPE<br />

BAMA used data from the ESPAD<br />

(European Schools Project on Alcohol<br />

and Drugs) to demonstrate to other<br />

aerosol trade associations across<br />

Europe the growing evidence that<br />

VSA is a problem everywhere, not<br />

just in the UK.<br />

Gas fuels continue to be associated with<br />

the majority of deaths. In 2004, butane<br />

from all sources, including aerosol<br />

propellants, accounted for 79% of VSA<br />

deaths (37 of the 47 deaths).<br />

VSA deaths in under-18 year olds have<br />

risen from nine in 2003 to thirteen in<br />

2004, eight of these thirteen deaths<br />

were associated with butane cigarette<br />

Since 1992 there has been a significant<br />

fall in deaths, from an average of 77 per<br />

year in 1993 – 1998, to an average of<br />

62 per year in 1999 – 2004.<br />

Public Relations Committee<br />

The PR Group met four times in <strong>2006</strong>.<br />

SUPPORTING BAMA MEMBERS<br />

BAMA continued to drive and develop<br />

the annual programme of Events and<br />

Training. Forums were held in both<br />

spring and autumn and we were<br />

delighted yet again to welcome expert<br />

speakers covering such a broad<br />

spectrum of aerosol-related subjects.<br />

For the Autumn Forum the format was<br />

changed to a one day programme of<br />

lectures followed by a Forum dinner;<br />

feedback received from this new format<br />

was positive. The <strong>2006</strong> AGM and<br />

Annual Lunch took place on<br />

the 14 June. The event was<br />

well attended and we were<br />

delighted to welcome Sir<br />

Digby Jones as our key note<br />

speaker. Training courses on<br />

Introduction to <strong>Aerosol</strong> Technology,<br />

Safe Handling of <strong>Aerosol</strong> Propellants,<br />

Labelling of <strong>Aerosol</strong>s and the Transport<br />

of <strong>Aerosol</strong>s took place over the year.<br />

These BAMA courses continue to be<br />

extremely popular and we would<br />

particularly like to thank all those<br />

members that assist in the running of<br />

the courses. Publication of the quarterly<br />

update ‘Press for Success’ continues<br />

and we are pleased that this is<br />

recognised to be such an important<br />

vehicle for ensuring members are kept<br />

up to date on all matters affecting the<br />

industry. The new BAMA website was<br />

launched in the summer and has been<br />

well received. We are actively driving<br />

the use of the website as an effective<br />

route for communication and reference<br />

for members.<br />

PROMOTING INNOVATION<br />

As part of our drive to encourage<br />

innovation within the industry, we have<br />

continued our involvement with the<br />

<strong>British</strong> Design and Art Direction (D&AD)<br />

Student Design Awards. A new aerosol<br />

brief for the 2007 Awards was<br />

launched in April. Events have also<br />

been held with design students from<br />

DeMontfort University and Central St<br />

Martins with the support of various<br />

members. We are also continuing our<br />

links with the <strong>Association</strong> for Science<br />

Educators (ASE) and the website<br />

www.schoolscience.co.uk. The ‘Aero<br />

We are delighted that a number of retailers<br />

have agreed to point-of-sale signage to<br />

promote the recycling of aerosols.<br />

Dynamics’ newsletter was produced<br />

twice in the year. It continues to be<br />

an effective way to showcase new<br />

technology and highlight new<br />

developments to both packaging<br />

decision makers and the press.<br />

We would like to take this opportunity<br />

to thank all members for their<br />

contributions to the publication.<br />

AEROSOL RECYCLING<br />

Following feedback from consumer<br />

research that was commissioned early<br />

in the year it was agreed that we would<br />

drive a consumer PR campaign to<br />

promote both the recycling of aerosols<br />

and CFC-free messages. The research<br />

clearly showed that these are key<br />

messages that we need to promote from<br />

a consumer PR perspective. We have<br />

continued to place adverts to promote<br />

aerosol recycling in Waste Management<br />

and Recycling industry publications.<br />

We also encourage members to include<br />

the recycling and CFC-free message on<br />

aerosol packaging.<br />

WORKING WITH RETAILERS<br />

BAMA continued to drive the direct<br />

communication link with the major<br />

retailers and two meetings of the Retail<br />

Liaison Group took place within the<br />

year. We are delighted that a number of<br />

retailers have agreed to point-of-sale<br />

signage to promote the recycling of<br />

aerosols. We will be continuing to drive<br />

this initiative in 2007.<br />

WORKING WITH THE PRESS<br />

A series of press releases was<br />

sent out during the year and<br />

all opportunities to drive positive<br />

communication were taken. In order<br />

to drive the recycling of aerosols and<br />

CFC message, 15 interviews were given<br />

with local radio over a one day event<br />

in the autumn. We received excellent<br />

exposure from this new initiative.<br />

Working closely with BFA, CTPA and<br />

UKCPI, BAMA’s monitoring of media<br />

coverage concerning aerosols has<br />

continued throughout the year. Action<br />

continues to be taken to ensure that<br />

the industry is correctly represented<br />

when required.

opportunities. However, our thanks<br />

must always go to the full-time BAMA<br />

staff – who always manage to keep their<br />

over 75% of stand spaces at the<br />

exhibition sold, <strong>Aerosol</strong>s 2007 is<br />

already shaping up to be a memorable<br />

in place already. It will take on a new<br />

format but will still focus on the relevant<br />

scientific, regulatory and<br />

COMMITTEE’S RESPONSIBILITIES<br />

The Executive Committee are responsible<br />

for preparing the financial statements in<br />

accordance with applicable law and<br />

regulations.<br />

Company law requires the Executive<br />

Committee to prepare financial statements<br />

for each financial year. Under that law the<br />

Executive Committee have elected to<br />

prepare the financial statements in<br />

accordance with United Kingdom Generally<br />

Accepted Accounting Practice (United<br />

Kingdom Accounting Standards and<br />

applicable law). The financial statements are<br />

required by law to give a true and fair view of<br />

the state of affairs of the <strong>Association</strong> and of<br />

the surplus or deficit of the <strong>Association</strong> for<br />

that period. In preparing these financial<br />

statements, the Executive Committee are<br />

required to<br />

• select suitable accounting policies and<br />

then apply them consistently;<br />

• make judgements and estimates that are<br />

reasonable and prudent;<br />

• prepare the financial statements on the<br />

going concern basis unless it is<br />

inappropriate to presume that the<br />

<strong>Association</strong> will continue in business.<br />

The Executive Committee are responsible<br />

for keeping proper accounting records<br />

which disclose with reasonable accuracy<br />

at any time the financial position of the<br />

<strong>Association</strong> and to enable them to ensure<br />

that the financial statements comply with<br />

the Companies Act 1985. They are also<br />

responsible for safeguarding the assets of<br />

the <strong>Association</strong> and hence for taking<br />

reasonable steps for the prevention and<br />

detection of fraud and other irregularities.<br />

STATEMENT AS TO DISCLOSURE OF<br />

INFORMATION TO AUDITORS<br />

So far as the Executive Committee are<br />

aware, there is no relevant audit<br />

information (as defined by Section 234ZA<br />

of the Companies Act 1985) of which the<br />

<strong>Association</strong>’s auditors are unaware, and<br />

each member of the Executive Committee<br />

has taken all the steps that he or she ought<br />

to have taken as a member of the Executive<br />

Committee in order to make himself or<br />

herself aware of any relevant audit<br />

information and to establish that the<br />

<strong>Association</strong>'s auditors are aware of<br />

that information.<br />

We have audited the financial statements<br />

BASIS OF AUDIT OPINION<br />

We conducted our audit in accordance<br />

with International Standards on Auditing<br />

(UK and Ireland) issued by the Auditing<br />

Practices Board. An audit includes<br />

examination, on a test basis, of evidence<br />

relevant to the amounts and disclosures<br />

in the financial statements. It also includes<br />

an assessment of the significant estimates<br />

and judgements made by the Executive<br />

Committee in the preparation of the<br />

financial statements, and of whether the<br />

accounting policies are appropriate to the<br />

<strong>Association</strong>'s circumstances, consistently<br />

applied and adequately disclosed.<br />

We planned and performed our audit so<br />

as to obtain all the information and<br />

explanations which we considered<br />

necessary in order to provide us with<br />

sufficient evidence to give reasonable<br />

assurance that the financial statements are<br />

free from material misstatement, whether<br />

caused by fraud or other irregularity or<br />

error. In forming our opinion we also<br />

evaluated the overall adequacy of the<br />

presentation of information in the<br />

1 ACCOUNTING POLICIES<br />

Accounting convention<br />

The financial statements have been prepared under the historical<br />

cost convention and in accordance with the Financial Reporting<br />

Standard for Smaller Entities (effective January 2005).<br />

Turnover<br />

Turnover represents net sales of goods and services, excluding<br />

Value Added Tax.<br />

Tangible fixed assets<br />

Depreciation is provided at the following annual rates in order to<br />

write off each asset over its estimated useful life or, if held under<br />

a finance lease, over the lease term, whichever is the shorter.<br />

Office & general equipment – office and computer equipment<br />

33.3% on cost, furniture 20% on cost<br />

Deferred tax<br />

Deferred tax is recognised in respect of all timing differences that<br />

have originated but not reversed at the balance sheet date.<br />

Foreign currencies<br />

Assets and liabilities in foreign currencies are translated into<br />

sterling at the rates of exchange ruling at the balance sheet date.<br />

Transactions in foreign currencies are translated into sterling at<br />

the rate of exchange ruling at the date of transaction. Exchange<br />

differences are taken into account in arriving at the operating result.<br />

Hire purchase and leasing commitments<br />

Assets obtained under hire purchase contracts or finance leases are<br />

capitalised in the balance sheet. Those held under hire purchase<br />

contracts are depreciated over their estimated useful lives. Those<br />

held under finance leases are depreciated over their estimated useful<br />

lives or the lease term, whichever is the shorter.<br />

Factors that may affect future tax charges<br />

Losses of £39,660 (2005 – £35,912) are available for corporation<br />

tax purposes.<br />

The interest element of these obligations is charged to the income<br />

and expenditure account over the relevant period. The capital<br />

element of the future payments is treated as a liability.<br />

Pensions<br />

The <strong>Association</strong> operates a defined contribution pension scheme.<br />

Contributions payable for the year are charged in the income and<br />

expenditure account.<br />

International <strong>Aerosol</strong>s Congress and Exhibition 2007<br />

In September 2007 the <strong>Association</strong> is to host an international<br />

congress and exhibition in Manchester on behalf of the European<br />

<strong>Aerosol</strong> Federation (FEA). Deposits are already being received from<br />

exhibitors and expenditure is being incurred. These items are to<br />

be carried forward until the accounting period in which the event<br />

takes place, when they will be credited/charged to income and<br />

expenditure account.<br />

attributable to the one principal activity of the <strong>Association</strong>.

9 PENSION COMMITMENTS<br />

Until 31 May 2002, those of the <strong>Association</strong>'s staff who were<br />

employees of the Chemical Industries <strong>Association</strong> (CIA) enjoyed<br />

terms of employment providing for retirement benefits based on final<br />

pensionable pay. On that date this 'defined benefits' scheme ceased<br />

and was replaced by a defined contribution scheme.<br />

There is a funding shortfall on CIA's defined benefits scheme that is<br />

due to be eliminated by March 2013. CIA invoices the <strong>Association</strong><br />

monthly in respect of the <strong>Association</strong>'s staff costs including pension<br />

scheme contributions and this currently includes £1,048 per month<br />

to make good the element of the shortfall that relates to <strong>Association</strong><br />

staff. It is understood however that future contributions cannot be<br />

calculated accurately at this time.<br />

Contributions are charged to Income and Expenditure Account as<br />

invoiced by CIA. Amounts charged during the year were:<br />

Defined benefits – £12,576 (2005 – £12,576)<br />

Defined contribution – £22,430 (2005 – £19,232)<br />

At the balance sheet date the amount provided in respect of unpaid<br />

contributions was £5,901 (2005 – £2,907).<br />

10 OTHER FINANCIAL COMMITMENTS<br />

The <strong>Association</strong> occupies premises under a lease with five-yearly<br />

rent reviews; the review due in February 2007 has not yet been<br />

finalised. Current annual charges are: Rent £44,000, Service Charge<br />

£7,000 and Management Charge £16,000.<br />

The <strong>Association</strong> is committed to hosting the International <strong>Aerosol</strong>s<br />

Congress and Exhibition on behalf of the European <strong>Aerosol</strong><br />

Federation (FEA), to be held at the Manchester International<br />

Convention Centre in September 2007. The cost of the venue is<br />

£305,060, all of which had been paid by the balance sheet date.<br />

The <strong>Association</strong> is also committed to a consultancy agreement with<br />

Axiom Communications at a cost of £28,000 for 2007.
