CHAIRMAN’S REPORT: JOHN BIGLEY 3
Chairman’s
Report 2006
2006 was another year of change, what year isn’t in today’s environment? Our committees
and secretariat worked hard to develop the Association’s position as the European leader.
Following on from 2005 we continued to use Sustainable Development as the framework for
our activities. The reports which follow reflect our actions within the 3 main pillars of
Sustainable Development: Social, Environment & Economic.
Aerosol filling in the UK in 2005 continued to be stable
despite the continued general pressure in the UK
manufacturing sector. The UK kept its position as European
market leader filling over 27% of all European aerosols. This
demonstrates that our industry, underpinned by BAMA, has
done a good job in maintaining competitiveness in a difficult
economic and legislative environment.
The 2006 figures are still being collated but with the
continued proactive input from our
members I am confident that we will
maintain our strong position within
the global aerosol industry.
Legislatively we have continued to work proactively with
all the relevant authorities within the UK & Europe relating
to REACH (EU Chemicals Policy), Aerosols Directive, F-Gas
Regulations etc. Much of this legislation is due for
introduction in 2007.
Clearly we have seen very positive progress in the recycling
of aerosols which helps our message on the environmental
positioning of our products.
The UK kept its position as
European market leader filling over
27% of all European aerosols.
2006 also saw a huge amount of effort by the Association
in gearing up for Aerosols 2007 to be held in September in
Manchester. In line with our own strategy the Congress theme
will be Sustainable Development.
I would like to address my thanks to all our members for their
support during 2006. I am also particularly thankful to the
participants of all the committees, working groups and my
fellow committee chairmen for their invaluable contribution
over and above their normal jobs
within their own companies.
I mentioned continual change
earlier and I should like to thank
those committee members who
retired from office this year alongside the newcomers.
Finally, I wish to say a big thank you to the dedicated
BAMA secretariat headed by Sue Rogers. They continue to
provide a professional, responsive and dynamic hub for
our Association.
DIRECTOR’S REPORT: SUE ROGERS 5
Director’s
Report 2006
During 2006 BAMA has been investing on behalf of our members.
Firstly, we paid up front to secure the venue in Manchester at preferential rates for Aerosols
2007. The scene is now set for what we truly believe will be a successful and exciting event
from 18 – 20 September 2007. I am really looking forward to welcoming you all to Manchester
– particularly as its demands have meant I have not been able to get out to visit members as
often as I should over the last year or so. I plan for that to be remedied afterwards!
With the detailed preparations for Aerosols 2007 now in full
swing, 2006 has been an extraordinarily busy year for BAMA.
The Congress is developing into an exciting world class
programme. The three days themed around three pillars of
sustainability and our aim, ‘propelling aerosols worldwide’,
have attracted first class speakers from around the world.
The exhibition is already selling out rapidly and our active
promotion in person of Aerosols 2007 in Europe, the USA,
Latin America and China will, we
hope, bring delegates and visitors
from all over the world to share,
debate and learn from each other
on a wide number of issues. We
also hope to attract entries into the
first ever international aerosol
awards to celebrate the industry’s innovations and creativity.
Our other key area for investment was designed to assist
members with REACH, the European legislation for the
Registration and Authorisation of Chemicals. To help our
members to prepare for this mammoth task, BAMA has
developed the ‘BAMA model’. This is now widely
acknowledged as a simple to use but powerful tool,
The three days themed around three
pillars of sustainability and our aim,
‘propelling aerosols worldwide’, have
attracted first class speakers from
around the world.
independently validated by experts, to help produce the
exposure scenarios which will be required. Now the detail of
the Regulation is finalised, a working group has been set up
to produce guidance for members.
BAMA has commissioned hazard profiles on priority chemicals
commonly used in aerosols, which will be made available to
members. This will be a key benefit of BAMA membership in
the years to come as companies get to grips with the demands
of the legislation.
Some other regulatory issues
have reached conclusion in 2006.
The long running negotiations on
greenhouse gases under the
EU’s F-Gases Regulation were
completed finally, with the only ban on use of HFCs in
aerosols for novelty products from 2009. This was a major
success for us as the original plans were to ban HFCs in all
aerosols. The voluntary agreement to use HFCs only where
strictly necessary, developed by BAMA, has been taken up
by the European Aerosol Federation (FEA) and will need to
remain in place to support the industry in the review of the
legislation in several years’ time. The USA is also beginning
6 DIRECTOR’S REPORT: SUE ROGERS
to adopt a similar approach despite
its Government’s well publicised
refusal to sign the Kyoto Protocol.
Following changes to the ‘Ranges’
Directive, prescribed quantities for aerosols will no longer be
regulated but BAMA is involved in talks within FEA to produce a
voluntary standard to ensure products are not sold underfilled.
In contrast, the revision of the Aerosol Dispensers Directive
has been frustratingly – and familiarly – slow. This time
Global Harmonisation (GHS) has intervened to obstruct
progress but we are working our way through.
We are proud that the BAMA Standard for Consumer Safety and
Good Manufacturing Practice has achieved its first accreditation
– Impress (formerly USC UK). A number of members from all
sectors of the supply chain could achieve accreditation with
little difficulty – or extra work – as the Standard has been
designed to fit into existing management systems. The Standard
is being updated again to keep step with legislative changes and
is planned for relaunch as Issue 3 in September 2007.
On the communications front, we have been delighted by the
support we have received from retailers, who have added
in-store messages to spread the word that empty aerosols can
be recycled. We also reached a large number of consumers
through specially arranged interviews on local radio.
Our courses have proved very popular again in 2006 and
we are very grateful to all the speakers who give their time
We are proud that the BAMA
Standard for Consumer Safety and
Good Manufacturing Practice has
achieved its first accreditation
and expertise to train newcomers to
the industry. At members’ request,
we ran two extra Propellant Safety
courses at plants around the UK
with good attendance.
We are, as always, immensely grateful to all the committee
members and especially the committee chairmen – we
recognise that members have fewer staff available and they
have less time to dedicate to association work. We undertake
as much of the work as we possibly can in the secretariat but
we do need to call on members to add their input from time to
time so we can check we are in step – and this happens best
through the committees.
Somewhat ironically, the better we manage issues, so that
the industry can continue to operate safely and responsibly
but with as little disruption as possible, the less obvious our
success can be. However, those who have been involved in
issues which have not been successfully managed will
testify to our value!
We thank you for your continued support. I would especially
like to thank Jean Blottière for his hard work as Chairman
over the last two years, our new Chairman John Bigley,
Hon Treasurer, Richard Wells who has played an invaluable
role for several years now, all the members of the Executive
Committee and the BAMA staff who have tackled a vast
workload with professionalism and enthusiasm. We wish
Caroline Fuller every happiness in her new life in Australia
and are only sorry that she won’t be in Manchester with us.
Commercial and Planning Committee
The committee has met 5 times in 2006.
SUSTAINABLE DEVELOPMENT STRATEGY
The Committee continued to focus on
BAMA’s Sustainable Development
programme. A message matrix has been
developed which provides key messages
about aerosols and their uses under the
three pillars: economic, social and
environmental. There are some very
positive messages with supporting data
on the BAMA Standard, health and
environmental impacts and examples of
innovation and recycling opportunities.
The matrix will be available to members in
time for the Congress in September 2007.
BAMA STANDARD
Issue 3 revision has started during the
year. Data from the BAMA Guides was
built into the manufacturing module.
Revisions began on warehousing,
disposal and product development
modules. The BAMA Standard will
be launched by the BAMA Chairman
at the Congress in 2007.
FINANCIAL PLANNING &
MEMBERSHIP RECRUITMENT
The Committee reviewed the
subscription rates and as a result
subscriptions were increased in line
with inflation.
BAMA used some of its reserves to pay
one year ahead to secure favourable
rates on the hire of Manchester
Central 2007.
There are some very
positive messages with
supporting data on the
BAMA Standard, health
and environmental
impacts and examples of
innovation and recycling
opportunities.
The committee also considered a report
from external advisors on the financial
implications of moving out of the
current offices during 2007 when there
is a break in the lease. The conclusions
were that there was no overall financial
gain to be had from moving out. This
will continue to be kept under review.
BAMA has begun a programme of
investment in literature reviews on a
range of key ingredients used by BAMA
members. These reviews will be made
available to members to support their
requirements under REACH and will be
used to demonstrate tangible benefits
of BAMA membership.
TRAINING
BAMA courses remained popular
during 2006. Two extra Propellant
Safety courses were held in 2006 at
members’ requests.
CHEMICALS REGULATORY FORUM (CRF)
BAMA is a member of the Government’s
Chemicals Regulatory Forum. BAMA
members participated in a study to
evaluate the Cumulative Burden of
Regulations on industry. The study
findings were taken up into the future
work programme of CRF, launched in
November.
PACKAGING AND CONTENTS COMMITTEE 11
Packaging and Contents Committee
The committee met four times during
2006 and members were also active in
the corresponding FEA committee as we
monitored the progress of legislation
important to our industry.
AEROSOL DISPENSERS DIRECTIVE (ADD)
A proposed amendment to ADD was
initiated by the European Commission
under the procedure for Adaptation to
Technical Progress in 2005 and it was
expected that this would be finalised
in 2006. Unfortunately this has not
happened due to issues raised during
the interservice consultation on the
proposed amendment within the
Commission. There were two main areas
of concern; firstly the legal service would
not accept reference to the UN Manual
on the Transport of Dangerous Goods
within ADD as it was not an EU
institution. This is an important
part of the proposed amendment
as it relates to the classification
and labelling for flammability and
aligns ADD with ADR/RID to
ensure there is no conflict
between legislation for the manufacture
and transport of aerosols. Secondly DG
SANCO required a stronger reference to
the need to assess spray characteristics
and particle size distribution in the new
section dealing with risk assessment.
Neither of these issues should jeopardise
the proposed amendment as FEA have
put forward proposals to address both of
these concerns. However it appears that
resolving the issues is not a high priority
for the Commission and the situation has
been complicated by the proposed
introduction of GHS for the Classification
and Labelling of Dangerous Goods into
the EU. Meanwhile BAMA and FEA
continue to work to make progress on
this issue although the timing of a
satisfactory outcome is uncertain.
PRESCRIBED QUANTITIES (RANGES)
DIRECTIVE (PQD)
The Commission has completed the
process of amending this legislation
which has now been sent back to the
European Parliament for approval.
This should provide a satisfactory
outcome for our industry as aerosols
may continue to be labelled by volume
only but they must be labelled with the
brimful capacity of the container. There
will no longer be a list of prescribed
sizes and fills. BAMA is working with
During the year the Commission
decided to implement GHS criteria
into Community law. This will affect the
classification and labelling of aerosols
for flammability
FEA to produce an FEA Standard on
fill sizes as a guide to members and
to help avoid instances of underfilling
which could attract adverse publicity
to our industry.
PLASTIC AEROSOLS
Members continue to be active in the
FEA Task Force which is working to
produce data that would allow a
relaxation of the current regulatory
constraints on plastic aerosols and
harmonise ADD with ADR/RID.
The work is well advanced and it is
expected that the Task Force will
present its report during 2007.
GLOBALLY HARMONISED SYSTEM OF
CLASSIFICATION AND LABELLING OF
CHEMICALS (GHS)
During the year the Commission
decided to implement GHS criteria into
Community law. This will affect the
classification and labelling of aerosols
for flammability but the proposed
amendment to ADD already
incorporates GHS criteria in this area.
However the Commission wish to
implement GHS as a single regulation
which would mean that ADD would not
be the legal instrument for the
regulation of flammability in aerosols.
This is unsatisfactory as some major
aerosol categories such as
cosmetics, pharmaceuticals and
food are not fully covered by
GHS. Strong representations
were made during the public
consultation on this proposal
but our arguments were not
accepted. This issue will be a major
part of the workload of the committee in
the near future as we work within the
industry and with Member States to
retain the supremacy of ADD.
12 ENVIRONMENT COMMITTEE
Environment Committee
The Environment Committee met four
times during the year. There were also
meetings of the Scientific Panel.
BAMA representatives were also heavily
committed to the European Aerosol
Federation (FEA) Environment
Committee, the VOC Working Group,
the HFC Working Group, the Aerosol
Ingredients Working Group and
Integrated Product Policy Working
Group, (now known as the Sustainable
Aerosol Strategy WG).
EU CHEMICAL POLICY
In late 2006, the EU finally agreed on
the new European Chemical Regulation,
(REACH), the text of which was
published in the EU official journal in
January 2007.
During the year, BAMA supported
the completion of the PRODUCE project,
which was conducted by a number of
parties, including BAMA to ‘try out’
REACH. A huge number of lessons were
learned and more than 30 recommendations
highlighting the need for good
quality guidance for downstream usersto-be
were made.
To that end, BAMA has also been
actively supporting the development of
appropriate exposure modules in the
REACH Implementation Projects (RIPs)
(in conjunction with the FEA and AISE) –
specifically by promoting the use of the
BAMA Exposure Model.
We have also commissioned the Institute
of Environmental and Health (IEH) to
conduct reviews of published
toxicological/safety information, for
chemicals whose use is key to the
aerosol industry.
INDOOR AIR QUALITY
IAQ remains a significant issue and as
a follow-up to the BEUC report on
emissions from air fresheners, the Belgian
Government published a report of a study
by VITO measuring emissions from 20
different types of air fresheners. With the
exception of incense, the air fresheners
were given a clear bill of health and the
data measured and modelling work
appear complementary to the BAMA
modelling work.
During 2006, two health issues were
reported in relation to a waterproofing
spray and a sealing spray that was being
marketed as nano-technology.
BAMA has been actively
supporting the development
of appropriate exposure
modules in the REACH
Implementation Projects
An excellent presentation on the facts
of the issue was given at the BAMA
Autumn Forum highlighting a number
of mistakes made in the development
which resulted in a spray containing a
high level of particles that could enter the
lung. Unfortunately, this issue has led to a
proposal to amend the Aerosol Directive to
require marketers to conduct a health risk
assessment for all spray products. FEA
have issued a position paper, arguing that
this is not necessary, as the requirement is
covered by other, existing legislation, such
as the Cosmetics Directive and General
Product Safety Directive. Further work on
spray particle size distributions and
analysis is planned for 2007.
VOLATILE ORGANIC COMPOUNDS
The VOC issue remains on the agenda
of the Committee. The review of the
EU National Emissions Ceilings
Directive continues to target reductions
in VOC emissions (& subsequent
formation of ozone) – although
presently aerosols are not targeted
under this legislation. A study by UK
Government indicated that whilst
aerosol products are not currently a
significant source of VOC emissions,
they are not likely to reduce over the
next 15 years and so will be a
significant source by 2020. Despite
criticisms of the methodology used, this
would further appear to indicate that
aerosol emissions are highly likely to be
targeted in future regulations.
The FEA VOC WG concluded that
VOC reduction is likely to become more
of a target between 2010 and 2020,
(rather than now).
CLIMATE CHANGE
The major focus during the year was once
again the Fluorinated Gases Regulation
under the European Climate Change
Programme, and the EU F-Gas Regulation
and the Mobile Air Conditioning Directive
have now been published. This means
that from 2009 there will be a ban on
using HFCs in novelty aerosol products.
Other product formats are not impacted at
this time – although the Commission will
not be requiring Denmark and Austria to
amend their regulations prohibiting the use
of HFCs in aerosols – until 2012 – when
the Regulation will have been reviewed.
PACKAGING & PACKAGING WASTE
Importantly, BAMA continues to support
the recycling of tinplate and aluminium
aerosol cans – particularly used, empty
cans, and we are happy to report that
76% of UK Local Authorities accept
empty aerosols as a part of their
recycling operations. We were very
pleased when a number of major
retailers agreed to carry point-of-sale
information, communicating to the
consumer that empty aerosols are
recyclable.
INTEGRATED PRODUCT POLICY
The EU’s approach to IPP appears to
be changing and the focus of this issue
seems to be transferring to the new
Sustainable Consumption and
Production Policy and Green
Procurement issues.
On behalf of BAMA, I would like to
extend my grateful thanks for the
support and expertise of all those
members of the Committee and Working
Groups for the efforts they put in to
further the environmental interests
of our industry. We lost a number
of members during the last year and
we would warmly welcome any new
member who wishes to help us to
improve the environment for us all.
14 OPERATIONAL SAFETY COMMITTEE
Operational Safety Committee
The committee continues to be a strong
group of specialist representatives
from the BAMA membership. As always
we are indebted to Martin Castle of
PIRA International who gives us much
appreciated support in the area of
Transport.
The committee dealt with relatively
straightforward legislative issues this
year. The regulatory reform Fire Order
2005 came into force. We have already
contributed to the guidance relevant
to our industry. An authorisation
was obtained to allow the
adoption of the alternative
to the hot water bath test in
advance of implementation of
ADR 2007 in the UK. A Guide
was published for members
showing how to apply for
permission to use the alternative.
The committee continues to watch
developments closely in the area of
Transport of Limited Quantities by
Road. A proposal has been made that
would require marking of vehicles
carrying over a threshold quantity.
The UK Government is supporting our
opposition to this proposal. An FEA
response has been developed and will
be taken to meetings in early 2007.
The committee assembled data to
support the statements in the BAMA
Sustainable Development Message
matrix. It is important to be able to
show that the safe working practices
defined in BAMA guidance are
successful in preventing accidents. The
committee carried out an exercise using
the HSE Health & Safety Performance
Indicator system provided by Business
Link. This will be used to develop
further guidance and to help revise the
BAMA Standard during 2007.
An authorisation was obtained
to allow the adoption of the
alternative to the hot water bath
test in advance of implementation
of ADR 2007 in the UK.
The committee continued to support
the FEA project to set up a consortium
to test the application of High
Expansion Foam to control fires in
aerosol storage. Sufficient companies
have now expressed a desire to join the
consortium, which will be established
in early 2007.
The BAMA Guide to the PPC Regulations
and Aerosol Filling continued to provide
useful information to members for use in
discussions with the Environment Agency.
The Guide was revised to reflect Agency
guidance which effectively exempts the
filling of hairsprays.
VOLATILE SUBSTANCE ABUSE 15
Volatile Substance Abuse
The VSA Committee met 4 times in
2006. Thanks are due to committee
members for their continued support on
this important issue. Special thanks are
extended to external members Warren
Hawksley, Richard Ives, Steve Lambert
and John Ramsey for the passion and
energy they bring to the Committee.
The number of BAMA members on this
committee has dwindled for a variety of
reasons. Members are being asked to
join the committee as this continues to
be an important issue for the industry.
VSA STATISTICS
According to the latest data issued,
there were 47 deaths associated with
volatile substance abuse in 2004, the
lowest annual total recorded since data
collection methods were stabilized in
1983. The number of deaths in 2003
has been revised to 53, bringing the
total number of VSA deaths in the UK
since 1971 to 2,152.
Since 1992 there has been a significant
fall in deaths, from an average of 77 per
year in 1993 – 1998, to an average of
62 per year in 1999-2004.
lighter refills, the sale of which to
under-18s is prohibited by legislation.
VSA deaths continue to be more
common among males than females.
In 2004 there were over four times as
many male as female deaths overall,
but in the under-18 year olds, this ratio
fell to just over two to one.
In 2004 for the UK, among those aged
10 – 15 years there were eight deaths
associated with VSA compared with
three deaths from drug misuse.
STAKEHOLDER FORUM
The Department of Health has
produced a Volatile Substance
Framework. As part of this framework
four ‘Priorities for Action’ were identified,
■ Better education
■ Dealing with VSA Better Locally
■ Minimising the Opportunities
for Abuse
■ Research
Progress on the Stakeholder Forum has
been disappointing as a result of the
low priority of VSA on the DoH agenda.
The VSA Committee has lobbied the
required to deliver the VSA framework.
Progress is being made albeit slow.
UPDATED VSA LEAFLET
As updated VSA leaflet has been
prepared which delivers a hard hitting
message about the dangers of VSA. The
leaflet is aimed at BAMA members for
distribution to their companies and can
be used as part of corporate social
responsibility actions.
SPONSORSHIP
BAMA sponsored the Scottish Drugs
Forum newsletter on VSA again in 2006
and has made a financial contribution
to the Solve-It national conference on
VSA which will take place in 2007.
EUROPE
BAMA used data from the ESPAD
(European Schools Project on Alcohol
and Drugs) to demonstrate to other
aerosol trade associations across
Europe the growing evidence that
VSA is a problem everywhere, not
just in the UK.
Gas fuels continue to be associated with
the majority of deaths. In 2004, butane
from all sources, including aerosol
propellants, accounted for 79% of VSA
deaths (37 of the 47 deaths).
VSA deaths in under-18 year olds have
risen from nine in 2003 to thirteen in
2004, eight of these thirteen deaths
were associated with butane cigarette
Since 1992 there has been a significant
fall in deaths, from an average of 77 per
year in 1993 – 1998, to an average of
62 per year in 1999 – 2004.
that the future status of the VSA
framework, the Stakeholder Group and
action), are clarified including resources
16 PUBLIC RELATIONS
Public Relations Committee
The PR Group met four times in 2006.
SUPPORTING BAMA MEMBERS
BAMA continued to drive and develop
the annual programme of Events and
Training. Forums were held in both
spring and autumn and we were
delighted yet again to welcome expert
speakers covering such a broad
spectrum of aerosol-related subjects.
For the Autumn Forum the format was
changed to a one day programme of
lectures followed by a Forum dinner;
feedback received from this new format
was positive. The 2006 AGM and
Annual Lunch took place on
the 14 June. The event was
well attended and we were
delighted to welcome Sir
Digby Jones as our key note
speaker. Training courses on
Introduction to Aerosol Technology,
Safe Handling of Aerosol Propellants,
Labelling of Aerosols and the Transport
of Aerosols took place over the year.
These BAMA courses continue to be
extremely popular and we would
particularly like to thank all those
members that assist in the running of
the courses. Publication of the quarterly
update ‘Press for Success’ continues
and we are pleased that this is
recognised to be such an important
vehicle for ensuring members are kept
up to date on all matters affecting the
industry. The new BAMA website was
launched in the summer and has been
well received. We are actively driving
the use of the website as an effective
route for communication and reference
for members.
PROMOTING INNOVATION
As part of our drive to encourage
innovation within the industry, we have
continued our involvement with the
British Design and Art Direction (D&AD)
Student Design Awards. A new aerosol
brief for the 2007 Awards was
launched in April. Events have also
been held with design students from
DeMontfort University and Central St
Martins with the support of various
members. We are also continuing our
links with the Association for Science
Educators (ASE) and the website
www.schoolscience.co.uk. The ‘Aero
We are delighted that a number of retailers
have agreed to point-of-sale signage to
promote the recycling of aerosols.
Dynamics’ newsletter was produced
twice in the year. It continues to be
an effective way to showcase new
technology and highlight new
developments to both packaging
decision makers and the press.
We would like to take this opportunity
to thank all members for their
contributions to the publication.
AEROSOL RECYCLING
Following feedback from consumer
research that was commissioned early
in the year it was agreed that we would
drive a consumer PR campaign to
promote both the recycling of aerosols
and CFC-free messages. The research
clearly showed that these are key
messages that we need to promote from
a consumer PR perspective. We have
continued to place adverts to promote
aerosol recycling in Waste Management
and Recycling industry publications.
We also encourage members to include
the recycling and CFC-free message on
aerosol packaging.
WORKING WITH RETAILERS
BAMA continued to drive the direct
communication link with the major
retailers and two meetings of the Retail
Liaison Group took place within the
year. We are delighted that a number of
retailers have agreed to point-of-sale
signage to promote the recycling of
aerosols. We will be continuing to drive
this initiative in 2007.
WORKING WITH THE PRESS
A series of press releases was
sent out during the year and
all opportunities to drive positive
communication were taken. In order
to drive the recycling of aerosols and
CFC message, 15 interviews were given
with local radio over a one day event
in the autumn. We received excellent
exposure from this new initiative.
Working closely with BFA, CTPA and
UKCPI, BAMA’s monitoring of media
coverage concerning aerosols has
continued throughout the year. Action
continues to be taken to ensure that
the industry is correctly represented
when required.

STATEMENT OF EXECUTIVE
COMMITTEE’S RESPONSIBILITIES
The Executive Committee are responsible
for preparing the financial statements in
accordance with applicable law and
regulations.
Company law requires the Executive
Committee to prepare financial statements
for each financial year. Under that law the
Executive Committee have elected to
prepare the financial statements in
accordance with United Kingdom Generally
Accepted Accounting Practice (United
Kingdom Accounting Standards and
applicable law). The financial statements are
required by law to give a true and fair view of
the state of affairs of the Association and of
the surplus or deficit of the Association for
that period. In preparing these financial
statements, the Executive Committee are
required to
• select suitable accounting policies and
then apply them consistently;
• make judgements and estimates that are
reasonable and prudent;
• prepare the financial statements on the
going concern basis unless it is
inappropriate to presume that the
Association will continue in business.
The Executive Committee are responsible
for keeping proper accounting records
which disclose with reasonable accuracy
at any time the financial position of the
Association and to enable them to ensure
that the financial statements comply with
the Companies Act 1985. They are also
responsible for safeguarding the assets of
the Association and hence for taking
reasonable steps for the prevention and
detection of fraud and other irregularities.
STATEMENT AS TO DISCLOSURE OF
INFORMATION TO AUDITORS
So far as the Executive Committee are
aware, there is no relevant audit
information (as defined by Section 234ZA
of the Companies Act 1985) of which the
Association’s auditors are unaware, and
each member of the Executive Committee
has taken all the steps that he or she ought
to have taken as a member of the Executive
Committee in order to make himself or
herself aware of any relevant audit
information and to establish that the
Association's auditors are aware of
that information.
AUDITORS
The auditors, Cooksey, Perry & Co, will be
proposed for re-appointment in accordance
with Section 385 of the Companies
Act 1985.
This report has been prepared in
accordance with the special provisions
FINANCIAL REPORT AND STATEMENTS 19
REPORT OF THE INDEPENDENT AUDITORS TO THE MEMBERS OF
BRITISH AEROSOL MANUFACTURERS’ ASSOCIATION
We have audited the financial statements
of British Aerosol Manufacturers’
Association for the year ended
31 December 2006 on pages 20 to 23.
These financial statements have been
prepared in accordance with the
accounting policies set out therein and
the requirements of the Financial
Reporting Standard for Smaller Entities
(effective January 2005).
This report is made solely to the
Association's members, as a body, in
accordance with Section 235 of the
Companies Act 1985. Our audit work has
been undertaken so that we might state to
the Association's members those matters
we are required to state to them in an
auditors' report and for no other purpose.
To the fullest extent permitted by law, we
do not accept or assume responsibility to
anyone other than the Association and the
Association's members as a body, for our
audit work, for this report, or for the
opinions we have formed.
RESPECTIVE RESPONSIBILITIES OF
EXECUTIVE COMMITTEE AND AUDITORS
The Executive Committee's responsibilities
for preparing the financial statements in
accordance with applicable law and United
Kingdom Accounting Standards (United
Kingdom Generally Accepted Accounting
Practice) are set out on page 18.
Our responsibility is to audit the financial
statements in accordance with relevant
legal and regulatory requirements and
International Standards on Auditing
(UK and Ireland).
We report to you our opinion as to whether
the financial statements give a true and
fair view and are properly prepared in
accordance with the Companies Act 1985.
We also report to you whether in our
opinion the information given in the Report
of the Executive Committee is consistent
with the financial statements.
In addition, we report to you if, in our
opinion, the Association has not kept
proper accounting records, if we have
not received all the information and
explanations we require for our audit, or
if information specified by law regarding
Executive Committee remuneration and
other transactions is not disclosed.
We read the Report of the Executive
Committee and other information
accompanying the financial statements
and consider the implications for our report
if we become aware of any apparent
misstatements within them.
BASIS OF AUDIT OPINION
We conducted our audit in accordance
with International Standards on Auditing
(UK and Ireland) issued by the Auditing
Practices Board. An audit includes
examination, on a test basis, of evidence
relevant to the amounts and disclosures
in the financial statements. It also includes
an assessment of the significant estimates
and judgements made by the Executive
Committee in the preparation of the
financial statements, and of whether the
accounting policies are appropriate to the
Association's circumstances, consistently
applied and adequately disclosed.
We planned and performed our audit so
as to obtain all the information and
explanations which we considered
necessary in order to provide us with
sufficient evidence to give reasonable
assurance that the financial statements are
free from material misstatement, whether
caused by fraud or other irregularity or
error. In forming our opinion we also
evaluated the overall adequacy of the
presentation of information in the
financial statements.
OPINION
In our opinion:
• the financial statements give a true
and fair view, in accordance with
United Kingdom Generally Accepted
Accounting Practice applicable to
Smaller Entities, of the state of the
Association's affairs as at 31
December 2006 and of its deficit
for the year then ended;
• the financial statements have been
properly prepared in accordance with
the Companies Act 1985; and
• the information given in the Report of
the Executive Committee is consistent
with the financial statements.
9 PENSION COMMITMENTS
Until 31 May 2002, those of the Association's staff who were
employees of the Chemical Industries Association (CIA) enjoyed
terms of employment providing for retirement benefits based on final
pensionable pay. On that date this 'defined benefits' scheme ceased
and was replaced by a defined contribution scheme.
There is a funding shortfall on CIA's defined benefits scheme that is
due to be eliminated by March 2013. CIA invoices the Association
monthly in respect of the Association's staff costs including pension
scheme contributions and this currently includes £1,048 per month
to make good the element of the shortfall that relates to Association
staff. It is understood however that future contributions cannot be
calculated accurately at this time.
Contributions are charged to Income and Expenditure Account as
invoiced by CIA. Amounts charged during the year were:
Defined benefits – £12,576 (2005 – £12,576)
Defined contribution – £22,430 (2005 – £19,232)
At the balance sheet date the amount provided in respect of unpaid
contributions was £5,901 (2005 – £2,907).
10 OTHER FINANCIAL COMMITMENTS
The Association occupies premises under a lease with five-yearly
rent reviews; the review due in February 2007 has not yet been
finalised. Current annual charges are: Rent £44,000, Service Charge
£7,000 and Management Charge £16,000.
The Association is committed to hosting the International Aerosols
Congress and Exhibition on behalf of the European Aerosol
Federation (FEA), to be held at the Manchester International
Convention Centre in September 2007. The cost of the venue is
£305,060, all of which had been paid by the balance sheet date.
The Association is also committed to a consultancy agreement with
Axiom Communications at a cost of £28,000 for 2007.
