Conclusions<br />
In accordance with Rule 15 in the International Regulations for Preventing Collisions at<br />
Sea, 1972, (the COLREGS) GOTLAND CAROLINA was the give-way vessel and<br />
CONTI HARMONY was not a vessel overtaking another vessel, GOTLAND CARO-<br />
LINA, in accordance with Rule 13. (6.2)<br />
GOTLAND CAROLINA did not fulfil the obligations in Rule 5 in the COLREGS, to maintain<br />
a proper look-out, and in Rule 7, to determine a risk of collision. (6.1)<br />
By not maintaining a proper look-out, and not detecting CONTI HARMONY, GOTLAND<br />
CAROLINA prevented itself from fulfilling its obligation as give-way vessel in accordance<br />
with Rule 15 and Rule 16 in the COLREGS. (6.2)<br />
CONTI HARMONY did not attempt to raise any communication with GOTLAND<br />
CAROLINA, and did not sound any signal by the whistle as prescribed in Rule 34, d, in<br />
the COLREGS. (6.1 and 6.2)<br />
As the stand-on vessel CONTI HARMONY did not take advantage of the possibility in<br />
Rule 17,(a),(ii), in the COLREGS, to take action to avoid collision by her manoeuvre<br />
alone. (6.2)<br />
Immediately before the collision CONTI HARMONY turned to starboard in accordance<br />
with Rule 17,(b), in the COLREGS. (6.2)<br />
The OOW on CONTI HARMONY was inexperienced, and it is very possible that he<br />
was physical tired and stressed, and that this has influenced his decision making up to<br />
the collision. (6.3)<br />

Position of collision
