PRESIDENT’S MESSAGE
Reflecting on a year of
achievement for members
The following is an edited extract of the President’s
report to The Police Association Annual General Meeting
held on 14 September 2012.
Before delivering my annual report
I ask that you pause with me to
remember those of our members
who have passed away since the
last Annual General meeting:
The first and the most important duty
that I had as the incoming President of
The Police Association in October, last
year, was to preside over the finalisation
of an outstanding result to Eb 2011
negotiations. It contained outcomes that
were unprecedented and a pay rise that
was warmly embraced by the membership.
There are many key features of the success
of Eb 2011, which include significant salary
increases and a number of improvements
in the terms and conditions of our overworked
and, at times, underappreciated
members who do such a great job keeping
Victoria safe.
we were very pleased that The Police
Association’s Eb 2011 campaign was
formally recognised by the broader
union movement, by receiving a high
commendation at the recent ACTU national
union awards. we were lauded for our hard
work, professionalism and effectiveness in
carrying out what the ACTU deemed to be
one of the best communications campaign
strategies undertaken by an Australian
union in 2011.
The Police Association welcomed the
announcement by the Attorney General
in April this year that the government
will legislate to impose longer sentences
for people who attack Police Officers and
other emergency services workers whilst they
are carrying out their duties. This is an issue
of importance to The Police Association and
its members. we have strongly advocated
this stance for some time. The dismal
statistics around this issue has consistently
seen around 25% of all operational members
being assaulted every year, with one
member per day being seriously injured as a
result of an assault. In our view, an assault
on a Police Officer or other emergency
services worker is tantamount to an assault
on the community we serve.
In July, this year, The Police Association’s
work with regard to police pursuits was
recognised when the state government
expressed its support for a submission that
it had received from The Police Association.
Our submission called for the imposition
of tougher sentences for those who trigger
a police pursuit after failing to stop on the
direction of a Police Officer. we have asked
the government to consider making ‘evading
police in a motor vehicle’ a serious indictable
office, carrying an appropriate and lengthy
term of imprisonment.
In this regard, we believe that it is important
to shift the focus on to the law breakers,
PHIllIP PEarSon > PRESIDENT
rather than the focus being on our members,
which is currently the case.
As the President of The Police Association,
it has been my pleasure to support
a number of very worthwhile causes.
The wall to wall Ride, for example,
which is to be held again in September
this year, in the lead up to National Police
Remembrance Day, has a purpose for our
members and the community to remember
and honour our fallen colleagues and to
raise funds for police related charities
and to promote safe and lawful motor
cycle riding.
Police Legacy is also a very worthy cause.
Police Legacy has a responsibility to
provide for the partners and families of our
members who have died. Legacy is one of
the most worthwhile causes in the policing
family and as the President of The Police
Association, I am very proud to be part of
its board and to take part in encouraging
members to not only contribute, but to
contribute a little more, if they can afford it,
for the benefit of partners and families of
our members who have died.
A further worthy cause, of which I am
very proud to be part of and to represent
The Police Association, is the blue Ribbon
foundation. The blue Ribbon foundation
does a tremendous amount of work in
raising funds to provide new and improved
emergency facilities at public hospitals, in
the name of our members who have been
feloniously slain in the line of duty.
Thank you."
SECRETARY’S MESSAGE
Excellent wins for members
well worth the fight
The following is an edited extract of the Secretary’s report
to The Police Association Annual General Meeting held
on 14 September 2012.
We are pleased to report
that the past 12 months
has been a very satisfying
year of achievement for
The Police Association.
we have achieved an enterprise bargaining
outcome that has won unprecedented
support from our membership.
we are in better financial shape than at any
time in our history and we will use that base
to improve our services to members.
Our constant lobbying of the current and
past governments with regard to police
numbers is finally coming to fruition with a
net additional 1700 Police Officers and 940
Protective Services Officers to be appointed
in the current term of government.
I am also pleased to report that we have a
Chief Commissioner and government with
whom we can work effectively, not just for
the overall benefit of our members, but also
the Victorian community.
I am very proud of everyone who was
involved in the effort to achieve the Eb 2011
result, but I am particularly pleased that our
members were prepared to stick together in
an industrial action strategy that took place
over a five month period between may and
October, last year.
we, of course, cannot rest on our laurels
and, as is always the case, at the time
of sign-off of an enterprise bargaining
agreement, work has already commenced
in preparation for the next enterprise
bargaining negotiations which will take place
in the lead up to the expiry of the current
agreement on 1 December, 2015.
Also on the industrial relations front,
we are pleased to report that close to a
million dollars in unpaid salaries, penalties
and allowances have been recovered
by The Police Association on behalf of
hundreds of members since December
last year after being short-changed by
inadequacies in Victoria Police’s new
payroll system, HR Assist.
This massive recovery of unpaid
entitlements has meant that some
individual members have received
thousands of dollars in monies owed,
with one member receiving a lump sum
payment of over $7,000 in salary pay back.
The flaws in the beleaguered IT system
have also been responsible for selling
short various leave entitlements of
some members such as long service
leave and ATOs.
Another significant success for The Police
Association in the past year has been
the numbers of additional police that are
starting to appear on the front line in police
stations throughout the state.
The work that The Police Association did
leading up to the November 2010 state
election, in speaking to all political parties
to secure additional police numbers, has
resulted in the current coalition government
strictly adhering to its pre-election
undertaking to employ a net additional 1700
police in its current term. This undertaking
has resulted in new Police Officers finally
reaching larger metropolitan and country
police stations and are flowing on to the
growth corridors of melbourne and our
bigger provincial cities.
we are also pleased to welcome our new
Protective Services Officer members, many
of whom will continue their traditional work
involving security in and around public
buildings. we are pleased that PSOs are
well trained when it comes to their duties
GrEG DaVIES > SECRETARY
and those critics who say otherwise are
simply wrong. The Police Association will do
all it can to ensure that our PSO members,
whether they be deployed on railways
stations or otherwise, remain an important
part of our membership.
Another successful outcome for The Police
Association has been the welcome
announcement during the past 12 months
that tasers will soon be rolled out to our
operational members.
This announcement is the culmination of
over a decade of solid campaigning by the
Association on this important issue.
The successful trial of tasers involving
our members at bendigo and morwell over
an 18 month period proved all the critics
wrong in that our members can, of course,
be trusted to operate these devices
responsibly and safely.
A further initiative of The Police Association
has been the introduction of the integrated
operational equipment vest. The IOEV has
a load carrying capacity that we hope will
alleviate the many injuries suffered by
our members as a result of wearing their
equipment on a belt. whilst there have
been issues with regard to the fit of the
vest, it is expected that these issues will be
resolved over time.
finally, I wish to acknowledge the support
of the Executive, the delegates, assistant
delegates and the Administration of
The Police Association, our Assistant
Secretary, bruce mcKenzie, our managers
and all staff members in their efforts and
support for our members."
LEGAL NEWS
Under what circumstances
does Legal Representation
funding cease?
It is not unusual for the Legal Section
to receive calls from members about
issues they are not quite sure about,
but ‘challenged’ their curiosity.
Interestingly, the Legal News article that
appeared in our September 2012 edition
of The Journal entitled "Accessing The
Association’s Legal Representation Cost
fund − Do you fully Understand your
Responsibilities?" has generated some
interest and as a result, we have fielded
a number of telephone calls surrounding
some issues arising out of the topic.
One common area of enquiry was; when
does access to the Legal Representation
Cost fund conclude?
Generally there are two specific events
that, if presented, will remove a previous
successful applicant’s access to the Legal
Representation Cost fund.
The first of these is when the applicant
member has been committed to stand trial
to answer the criminal charges alleged. The
second is where the member has changed
their ‘not guilty’ plea to that of ‘guilty’.
Access to The Association’s Legal
Representation Cost fund is not only
predicated on the satisfaction of the
relevant rule of the Constitution under
which the applicant member has applied,
but also on the condition that the applicant
member denies the charge or enters a
‘not guilty’ plea.
This condition is established under policy
that has been formulated and approved by
the Executive. The consideration of such a
policy is established by virtue of Rule 79 of
the Constitution and is specifically applicable
when considering an application to access
the Legal Representation Cost fund.
There are (through the process of criminal
proceedings), circumstances presented
where the members’ legal representative
believes that in order to achieve the best
outcome for the member the applicant
member may be better placed to alter his/
her plea to that of ‘guilty’.
Once the member changes his/her plea,
their access to the Legal representation Cost
fund immediately ceases, in accordance
with the Association’s policy.
The second and more common situation
where previously granted access to the Legal
Representation Cost fund ceases is when
the member is committed for trial to answer
the charges preferred. However, unlike the
‘change of plea’ situation, the member is
entitled to make a further application to
Cost fund for legal representation up to and
at his/her trial.
This "continuance" application is made
under the same rule that any original
application is made. This application must
be accompanied by a "memorandum of
advice" prepared by the member’s legal
counsel. This advice must set out events of
a contentious nature that are defensible at
trial and an overall considered opinion of the
counsel of the applicant members prospects
of success at his/her trial. The member is
again required to appear before the Legal
Representation Cost fund Committee where
he/she is to present those facts in support
of their application.
Should you have any other Legal/Discipline
matters please don’t hesitate to contact
the Legal Section for advice. If your query
is one that is frequently canvassed by other
members, we’ll be sure to expand on this
advice further on this page in future journals
for the benefit of the broader membership.
Q: As an operational police officer, why would you
consider attending or participating in this conference?
A: By attending this conference you will be exposed to lots of solutions
to problems that challenge you every day. You will meet like-minded
police and allied professionals tackling the same complex issues. You
may even wish to share your experiences in the Marketplace of Ideas.
But more importantly you will also meet lots of other creative thinkers
with whom you can explore creative solutions.
The activities of police have a crucial but largely unacknowledged role
in the protection and promotion of public health. Police are so often
key players in achieving positive public health outcomes through their
normal duties or joint partnerships with other agencies. In fact, police
often assume a leadership position in the advancement of public health.
The memory
of murdered
Police Officer,
David Edward
McGrath, lives on
in a rededication
ceremony
at Coburg
cemetery.
Constable David Edward mcGrath
was tragically murdered while
on duty in October of 1915.
Since his death the Coburg
gravesite where he was originally
put to rest slowly deteriorated; time taking
its toll on the old gravestone.
Late last year, Herald-Sun reporter
Geoff wilkinson reported on
Government agencies spending up to
20 months and $88,000 to confirm Ned
Kelly’s identity, while the remains of
Constable David Edward mcGrath lay
under weeds, rubble and scrap timber
at Coburg cemetery.
At the time, Police Association Secretary
Greg Davies said the state of Constable
mcGrath’s grave was extremely
disappointing.
"It’s upsetting and distressing to find
that the Government would spend so
much money identifying a convicted

murderer’s remains, yet allow this situation
to continue," said Greg.
As a result of the publicity garnered from
wilkinson’s article and successful lobbying
action of The Police Association, and the
through the action of Police minister
Peter Ryan, the Government immediately
provided funding of $50,000 for the
restoration of several police gravesites.
Since then, The Police Graves Restoration
Committee has been coordinating the
restorations and managing the process
with former Ch. Insp. Ralph Stavely carrying
much of the load.
Thursday, 27 September saw the
first of the restorations complete,
the restoration of Constable David Edward
mcGrath’s gravesite. The restoration was
marked with a rededication ceremony
at Coburg cemetery.
"Since it was David mcGrath’s grave
that initially brought this issue to light,
it was our view that it should be the first
to be restored," said Greg.
Among those that attended the
rededication ceremony was Police
Association Secretary Greg Davies, Chief
Commissioner Ken Lay, the minister
for Veterans Affairs Hugh Delahunty,
several mcGrath descendants and the
Police Graves Restoration Committee.
"This ceremony is a timely reminder to
me and every police member just how
dangerous policing can be," said Chief
Commissioner Ken Lay.
"The Police Graves memorial fund is a
mark of respect for those Officers killed
while serving Victoria. The graves of these
[slain Officers] will give Victorians cause
to pause and to reflect on the very real
dangers faced by our police members on
a daily basis. I thank Police Officers for the
work they do for Victoria," said minister for
Veteran Affairs, Hugh Delahunty.
about Constable
David Edward
McGrath
Constable David Edward mcGrath
was killed while investigating a
burglary at Trades Hall in Carlton
on 1 October, 1915. He responded,
with other police, and discovered an
attempt had been made to open the
safe. David mcGrath confronted two
burglars in a hallway and a number
of shots were fired. John Jackson,
the offender who fired the fatal
shot, was convicted of murder
and hanged at the Old melbourne
Gaol, making him the last person
Delegates reunite at
September conference
Last month’s delegates’ conference presented another opportunity
for our delegates to reunite and discuss the important issues
affecting the broader membership.
Peter Ryan, Deputy Premier and
minister for Police & Emergency
Services, officially opened
the September conference,
congratulating delegates and
members on the good work they do for
the community.
"I have great regard for the blue; I’ve said it
with great pride over the years. I’ve formed
many associations with members, and it’s
given me an insight into the type of work
that you do. I pay regard to you and what
you’re engaged in," said mr Ryan.
following the opening addresses, a variety
of issues surrounding pay entitlements,
staffing levels and rosters emerged as key
themes. Police resourcing was a major
concern shared by all delegates, with many
concerned about various risks members
are exposed to due to poor resourcing and
under-staffing at station level despite more
police being recruited.
14 Protect Represent Support. www.tpav.org.au
Chief Commissioner Ken Lay, spoke before
the lunch break, providing delegates with a
brief overview of the current issues affecting
policing in Victoria. Amongst the challenges
mr Lay spoke about were state budget cuts,
sustainable government initiatives and
police resourcing.
"with 1,700 additional uniforms, we can’t
afford for those uniforms to be leaking into
the back office. we need to change the
way we do business to ensure that doesn’t
happen. This is going to be a challenge for
me, the Executive and the Organisation
to figure out how we’re going to pull these
numbers from the back office without
impacting on operations," said mr Lay.
The Chief Commissioner also spoke
about new police uniforms, as well as the
importance of supporting PSOs through the
initial rollout period.
A special presentation introducing the new
TPAV smartphone application, TPAV Assist, was
well received, sparking particular interest from
interstate and New Zealand police associations
who are yet to go down the ‘Smartphone’ path.
Our new smartphone app is now available
for all members to download from relevant
Apple and Android marketplaces.
Another keynote speaker was James
merlino, Deputy Leader of the Opposition
and Acting Shadow Police & Emergency
Services minister. mr merlino spoke about
past and future Labor policies and initiatives,
allowing delegates to hear views from both
sides of the political spectrum throughout
the course of the day.
Association Secretary, Greg Davies, provided
delegates a thorough overview of the past
six months from an Association perspective
in his Secretary’s report, while Reverend Jim
Pilmer and Reverend Dr John broughton
gave an important welfare presentation in
regards to what to do and how to prepare in
the event of a death. Any members wanting
more information on this topic can speak
to the welfare Officer at the Association.
following the conference at the delegates
dinner, former long-standing delegates
Alan wroblewski and Dave Tognon were
recognised for their years of service, while
Geoff Nash was formally recognised for
the special role he played during 2011
Eb campaign by allowing his image to be
used with great effect during last year’s
successful pay campaign. Lord mayor,
Robert Doyle, entertained delegates with
an after-dinner speech during which he
expressed his sincere gratitude to all
members for their efforts during the Occupy
melbourne protests late last year.
All agreed that it was a successful and
productive conference, with time for
serious debate on a number of key issues.
The delegates will meet again in march 2013.
Veteran delegates awarded
Association Life Membership at AGM
The awarding of Life
Membership to longstanding
and highlyrespected
delegates, Keith
Patterson and Dave Mark,
headlined last month’s 2012
Police Association Annual
General Meeting (AGM).
The motion to bestow the Association’s
highest accolade to both Keith and
Dave was carried unanimously and
without hesitation by members present
in due recognition for their unwavering
commitment, dedication and personal
sacrifices they have made on behalf of the
Association members they’ve represented
in their local area for more than a decade.
Keith Patterson, who still serves as a
delegate, has been representing his local
constituent members in the wellington
Shire since 2000.
both he and Dave mark, who served as a
delegate representing members at Swan Hill,
Gannawarra and buloke between 2000 and
2011, worked tirelessly throughout all of the
Police Association’s major campaign successes
during this period. These included last
year’s EbA and the recent Save Our Streets
campaign which resulted in both sides of
politics committing to a record boost in police
numbers ahead of the 2010 state election.
Keith and Dave join an elite club as the
123rd and 124th person honoured with Police
Association Life membership throughout its
95-year history. That’s some achievement when
considering there have been over 30,000 former
and current serving members during this period.
Police Association Secretary, Greg Davies
was effusive in his praise for both
Association stalwarts.
"I’m really pleased for both men. Not only
are they thoroughly decent gentlemen,
they’ve done everything expected of them
as delegates and a whole lot more. Their
constituent members who work in the Sale
and Swan Hill areas have been fortunate
to be represented by them", said Greg.
Our newest Life members will be honoured at
this year’s annual Retired and Life members’
Dinner with a special presentation.
Apart from awarding life memberships, most
of the business dealt with at the 2012 AGm
was to report on The Police Association’s
key achievements and activities during the
2011/12 financial year.
This long list was dominated by the successful
EbA 2011 campaign, which produced an
outstanding outcome for members in terms
of substantial pay rises and other significant
improvements to their working conditions.
Secretary Greg Davies was particularly
praiseworthy of the united effort shown
by all concerned to achieve this result.
"I am very proud of everyone who was
involved in the effort to achieve the EbA
2011 result, but I am particularly pleased
that our members were prepared to stick
together in an industrial action strategy that
took place over a five month period between
may and October last year", reported Greg.
MEETING
AbOVE: Executive and Administration members
discuss key achievements at the AGm.
The AGm also heard that The Police Association
continues to remain in an extremely healthy
financial position, recording a net worth of over
$36 million at the end of the 2012 financial
year. This includes the Legal Representation
Cost fund is now valued at record highs
of in excess of $20 million.
The AGm officially welcomed Ron Iddles
as a newly elected member of The Police
Association Executive Committee. Ron
replaces Dermot Avon who was thanked
at the AGm for his contribution and service
to the Association in his capacity as an
Executive member, which included a twoyear
stint as Assistant Treasurer.
Prior to the AGm getting underway, all in
attendance paused in silence to remember
a number of serving members who had
passed away since last year’s Annual
General meeting.
COVER STORY
Stay informed about
counterfeit cash
The advice in this article is produced for the benefit
of TPAV members by the Reserve bank of Australia.
Australia has experienced low levels of counterfeit
activity for many years both in an absolute sense
− with fewer than 10,000 counterfeits detected in
circulation each year − and relative to experiences
in other countries.
However, with the proliferation of affordable
digital technologies, Australia’s rising currency
makes it more vulnerable to counterfeiting
attacks. This vulnerability was highlighted in
2010, when around 18,000 counterfeits from one
production source were detected in circulation.
18 Protect Represent Support. www.tpav.org.au
for some time now, the Reserve
bank of Australia (RbA) has been
working closely with the AfP
and state police on a number
of initiatives that will assist the
law enforcement community in fighting
counterfeit crime. The police investigation
in 2010 resulted in the arrests of several
people and the seizure of more than 1,800
counterfeits. The effectiveness of these
initiatives highlights the important role
that the police play in preserving public
confidence in Australia’s currency.
In the first instance, the RbA’s Counterfeit
Examination Laboratory can assist police
investigations by providing considerable
information about the counterfeits that
have been detected and seized in Australia.
This includes information about the
techniques used to produce the counterfeits,
how the counterfeits can be readily
identified including the serial numbers used
and information relating to where and how
the counterfeits have been passed.
There are many other ways, however, that
the RbA is able to provide support and
assistance. Over the past year, for example,
RbA counterfeit examiners have provided
64 witness statements and, in some
instances, have testified in court.
On request, the RbA also conducts short
counterfeit deterrence and banknote
awareness presentations for police. Police
in New South wales, Queensland, Victoria,
South Australia and the Northern Territory
have all taken advantage of this offer.
In addition, a new one-day counterfeit
deterrence workshop, which is open to
federal and state police officers, is scheduled
for 21 November in Sydney and will
cover topics relating to legislation, media
management and counterfeit detection.
for more general information about
banknotes and counterfeit detection,
the RbA has also launched a new website
(banknotes.rba.gov.au) aimed at increasing
the public’s knowledge in this area.
Along with this website, a dedicated law
enforcement Portal has been developed
for inclusion on police intranet sites.
The Portal, which was developed with the
input of the AfP, contains all the information
police need for identifying, handling and
submitting counterfeits (see breakout 1
for an example of the type of information
contained in the Portal).
If police wish to access the services
mentioned above or have any suggestions
and feedback, the RbA is available at any
time (see details opposite).
What to do with Suspect banknotes
Non-Evidentiary Counterfeits
If you have in your possession a suspected counterfeit banknote that is not the subject
of a criminal investigation or prosecution, fill out a suspect counterfeit banknote form,
available on the AFP website (www.afp.gov.au), and send it along with the suspected
counterfeit banknote(s) via registered mail to the AFP Currency Team postal address:
Australian federal Police
Locked Bag 4817, Somerton VIC 3062
A property receipt will be forwarded to your property office once the property is received.
Evidentiary Counterfeits
Any seized article (i.e. counterfeits, or material or equipment connected to the production
of counterfeits such as printers, tools, paper, etc.), may be retained for 90 days after
the seizure. If a prosecution for an offence against the Crimes (Currency) Act 1981 is
instituted before that date, then the evidence can be retained. Qualified RBA examiners
are able to provide expert witness statements if required.
Following a successful prosecution and where the court is satisfied that an article is
forfeited under Section 29 of the Crimes (Currency) Act 1981, a condemnation order
should be sought for the disposal of the articles. The articles, together with a copy of
the order, should then be sent to the AFP Currency Team who will coordinate their
destruction in accordance with the Crimes (Currency) Act 1981.
Where a prosecution has not been instituted before the expiration of 90 days after the
seizure of articles connected to the making of counterfeits, those articles should be sent,
together with a completed a suspect counterfeit banknote form available on the AFP
website (www.afp.gov.au), via registered mail to the AFP Currency Team postal address
(given above). A property receipt will be forwarded to your property office once the
property is received.
Where to go for advice
The AFP Currency Team may be able to assist with your questions related to
investigations into counterfeiting, such as how to respond to counterfeiting incidents,
obtaining warrants and handling of suspect counterfeit banknotes. The AFP Currency
Team also has an information package that can be provided to law enforcement agencies
considering undertaking an investigation into currency counterfeiting.
Originally formed in 1949,
Victorian Police Soccer Club
provides those interested in
soccer an opportunity to play
amongst peers while raising
funds for those less fortunate. The club
places a great emphasis on community
and charity events, and with a long list of
achievements it is easy to see why this club
took out the big title for the fifth time at the
recent 2012 Police Sports Awards.
In february of this year, the Soccer Club
travelled to Vietnam and Cambodia on a
‘Good will’ charity tour, then flew direct to
New Zealand to win Gold at the Australasian
Police and Emergency Services Games.
while in Vietnam, the team played a round
then delivered a similar donation to ‘Pacific
rehabilitates girls from sexual slavery.
As a result of the successful ‘Good will’
tour, the club was invited to compete in
the 2012 Association of South East Asian
Nations Cup in Vietnam. Subsequently the
Soccer Club has extended an invitation to
a number of Asian teams to compete in
the work that the club has done with
The Premier, in presenting this award,
The Journal chats to Victoria Police Soccer
Club President, Senior Sergeant ron Sinclair
to find out more about Victorian Police
Soccer Club and the great work they do in the
community, local and abroad.
How important is charity
to The Victoria Police
Soccer Club?
The vast majority of the Club’s events
are based around community or charity
work and I believe this is why the Club is
so successful. The combination of sport
and community service gives players
and administrators a wonderful sense
of achievement, making all the work
needed to make these events happen so
worthwhile.
What are some of the more
memorable ‘Soccer Club’
experiences of the past year?
There have been so many, with games
played at venues ranging from local
parks to AAMI Park! The Good Will tour
of Vietnam and Cambodia in February
was a fantastic trip, but to be invited
back in August, when we had the
opportunity to see the positive results
from our initial work at Birla orphanage
and Pacific Links, then to compete in a
truly International tournament, was a
life changing experience for our players.
How often does the club
meet up/practice/play during
the year?
The Club does not play in a regular
league. Our busiest times are between
August and April each year, but we have
events throughout the year.
What do people need to do
if they want to get involved
with the club?
Victoria Police Soccer Club always
welcomes new players, administrators
and supporters, regardless of age,
gender, rank or ability. If anyone is
interested in being involved with the
Club, they are welcome to contact
Long lost war medals
find their way back to
their rightful family,
by bronwyn gardiner.
fifteen years ago, Police Association
President Phil Pearson, was
performing a police operation in
an office located out at Essendon
Airport. As a result an Aero Club
closure, a large amount of aero-related
paraphernalia was dumped into a skip
bin shared by the occupants of the building
Phil was working in.
"I was out there one day and I found two
war medals lying near the bin, they looked
interesting so I took them home with me
for a closer inspection," says Association
President, Phil Pearson.
what Phil found were two war medals from
the Second world war; the war medal 1939-
1945, a british medal awarded to british and
Commonwealth forces, and the Australian
Service medal 1939-1945.
"I looked at the front and back and couldn’t
locate an owner. I then put them in a drawer,
where they sat for 15 years," says Phil.
It was only after recently listening to a radio
segment on 3Aw that Phil was able to track
down the original owner of the medals.
"I heard a story on war medals and
discovered that the recipient’s details
were usually engraved around the edges.
After some research it was then I discovered
that the medals belonged to a Sydney
woman by the name of Joyce Ruth muirhead,
one of Australia’s first female pilots."
with the help of Paul murray’s afternoon
drive show on popular Sydney talk radio
station 2UE, and a friendly listener, Phil was
able to get in touch with David muirhead,
one of Joyce’s sons.
David, who now lives in Queensland, was
introduced to Phil on Paul murray’s radio
program. He remembers his mother fondly,
who unfortunately passed away in 1980.
"She was very proud of her military service,
and one of the first women in Australia to
learn how to fly!" says David.
Joyce’s husband, bob muirhead, was equally
delighted with the find, and goes on to
describe how they first met all those years
ago; "because I was a fairly senior flight
Commander at the time, the Commanding
Officer invariable chose me to fly her to
parades and meetings at neighbouring Air
force Stations. I would do the take-offs
and landings and hand it over to her for
the straight and level flying. She was a
wonderful wife and mother, as well as a
tremendous supporter of me in my career,"
says bob.
Phil is happy to see that the medals are
finally back with its rightful owner, thanking
those involved in making the introduction
possible, "Joyce Ruth murihead was a
great pioneer in Australian aviation history
and I’m pleased that we’re able to honour
her memory."
About Joyce Ruth Muirhead
(4/11/1916 to 2/8/1980)
Joyce Muirhead, originally Joyce Grouse, was born in
Marrickville, Sydney on the 4th of November 1916, she
sadly passed away on the 2nd of August, 1980. In January
1942, at age 25, she enlisted as an Airwoman in the Royal
Australian Air Force and successfully rose through the
ranks, eventually becoming a Section Officer within the
air training division. She was part of the Women’s
Auxiliary Australian Airforce branch and was called up
for the duration of the war and for a period of 12 months
thereafter. She was discharged on compassionate grounds
on 31 July, 1943.
The Police
Association
partners with
Simply Energy
The Police Association has recently teamed up with
Simply Energy, enabling Association members to save a
substantial 18 per cent on electricity usage rates and a
further 14 per cent on gas usage rates*.
Members who switch to Simply
Energy for their electricity
usage will also receive $100
credit on their first Simply
Energy electricity bill (in
addition to the discount). This can mean
an additional 5 per cent discount to your
electricity bill if your household power bill is
currently around $2,000 per year.
These discounts have been negotiated
as part of a Police Association push
to try and ease cost of living pressures
on members.
"Electricity and gas usage is a significant
household expense. This deal offers another
way for members to counter rising energy
prices and to receive even more value from
their Police Association membership," says
Association Secretary, Greg Davies.
member access to this offer is available
after energy broker, Power Group
Purchasing, secured them through the
buying potential of the Association’s
more than 13,000 members.
28 Protect Represent Support. www.tpav.org.au
members can apply for the offer from
Simply Energy by calling 1800 068 141 or
by completing an online form found on the
TPAV website, www.tpav.org.au. Simply
follow the links on the homepage.
Certain conditions do apply to the offer,
including a requirement that bills be paid on
time as well as a commitment to a two-year
fixed-term contract. However, The Police
Association has made a point of ensuring
that the offer comes with a minimum of
associated conditions. for example, there
are no requirements for paperless billing or
direct debit payments, as is sometimes the
case with similar energy deals.
while this deal will offer substantial savings
for many members, it may not be the best
available in all cases. Variables such as
usage patterns and where you live can
impact upon your energy bill.
Association members are therefore advised
to look closely at the discounts on offer from
Simply Energy. Interested members should
read the fine print of the offer critically,
as well as the Q & A information (opposite).
The Police Association website − www.tpav.
org.au − also explains some of the finer
details of this offer.
If you are unsure that this offer is the
best option for you, call Simply Energy on
1800 068 141 with your most recent energy
bills on hand, and ask how the rates offered
by Simply Energy compare with those that
you are currently paying.
"The Police Association’s core focus remains
the improvement and safeguarding of
our members’ pay and conditions, legal
protection and welfare support. However,
the Association is always on the lookout for
opportunities to secure additional benefits
for our members, in order to provide added
value to your Association membership,"
TPAV/Simply Energy Discount Q&A
What are members entitled to under this offer?
Simply Energy is offering Police Association members and their
friends and family discounts of 18 per cent on electricity usage rates
and 14 per cent on gas usage rates when you pay your bills on time.
An 18 and 14 per cent discount off what?
members and their family and friends who choose to take up this
offer receive a discount off Simply Energy’s market usage rates.
To find out what these are, you can go to our website, www.tpav.org.
au or call them directly, as these rates will vary depending on where
you live. Simply Energy’s rates are generally very competitive in most
areas and are subject to change.
What other benefits are Simply Energy offering members
as part of this deal?
members and their family and friends who switch to this offer will
also receive $100 credit on their first Simply Energy electricity bill
in addition to the discount.
This credit could, for example, represent an additional 5 per cent
discount off your annual household electricity usage bill if it’s
currently around $2,000.
How can I access this offer?
members and their friends and family can apply for the offer from
Simply Energy by calling 1800 068 141 or by completing an online
form found on the TPAV website, www.tpav.org.au. Simply follow
the links on the homepage.
Does this offer come with any conditions?
yes. In order to qualify for the maximum discount, members must
pay their bills on time and commit to a two-year fixed-term contract
with Simply Energy.
However, the offer does not carry any of the other pre-conditions
that energy deals often entail, such as a requirement to move
to paperless billing or having to pay your bills only by direct debit.
In securing this deal, the Police Association insisted that the
discounts be not conditional upon having to meet additional
requirements that could adversely impact on members.
If members like the offer, can they recommend it to their family
members and close friends?
while it has always been The Police Association’s primary intention
to negotiate a special deal for our members, members should feel
free to recommend this offer to the broader policing family such as
their close family members and friends. Retired police officers are
also welcome to take advantage of this offer.
How can I be sure this deal is right for me?
while this deal will offer substantial savings for many members and
their family and friends, it may not provide the best rates available
in all cases. Variables such as usage patterns and where you live can
impact upon your energy bill.
you are therefore advised to look closely at the discounts on offer
from Simply Energy. Interested members should read the fine print
of the offer critically.
If you are still unsure if this offer is the best option for you, call Simply
Energy on 1800 068 141 with your most recent energy bills on hand,
and ask how the rates offered by Simply Energy compare with those
you have been paying.
Does the Police Association receive any commission or any other
kind of financial benefit if members take up this offer?
No. from a Police Association perspective, this offer is all about
members and their family and friends getting a membership
competitive energy deal.
Does anyone receive any commission if members switch
to this deal?
yes. The energy broker retained by the Police Association to secure this
deal, Power Group Purchasing, will receive a commission from Simply
Energy for every member that takes up the offer. The Association will
not receive any trailing commissions or any other payment from either
Simply Energy or Power Group Purchasing. The Police Association has
not been charged by Power Group Purchasing for the time and effort
it has expended to secure this deal on behalf of our members. Its only
remuneration will be by way of the commission it receives from Simply
Energy for every member that accepts this offer.
In securing this deal, has The Police Association given Simply
Energy my contact details?
No. The Police Association never divulges details of its membership
database to any third party and has not done so in this instance. If
members are interested in this deal they need to call Simply Energy
directly and provide their details themselves. Police Association
members should not expect to receive any unsolicited calls from
Simply Energy as a result of this offer.
Mirror, mirror on the wall ...
A van crew was responding to a job, but
were struggling to locate the right address.
After a short while, the crew arrived
and requested another crew to attend
and assist.
believing they found the right address,
a member radioed to the rest of the shift
and said, "I’ve got the right address because
I can see another van crew parallel to where
we’re parked."
He then asked the first attending officer
to come to the door and let the rest of the
team in, but it quickly became apparent
that the members were in the wrong place
when a colleague realised that the ‘other’
car the officer had seen was in fact a mirror
reflection of their own vehicle he’d parked
out the front. Thankfully the correct address
was found a short time later.
It’s not only members in the big smoke who
are called upon to combat serious crime and
A sinister turn of events recently unfolded
in a small country town where there were
several reports of pedestrians and cars being
struck by a variety of fruit and vegetables
thrown by youths in a passing car.
The police took this seriously and the local
Sergeant went public, seeking help to track
down the miscreants. Some locals didn’t
exactly take it as seriously with some
emailing the station saying "Is this a driveby
fruiting?" Another said, "Lettuce not carrot
away. Peas help beet this. I hope no one’s
bean hurt." One wag even offered: "They’ll
definitely do thyme for this."
Not quite, all aboard
A routine twilight shift foot patrol at
Dandenong Rail Station became eventful
one evening.
when a train arrived a member and his
partner were set to hop on board. One
member entered the front carriage, but his
partner − who had not yet entered the train
- became distracted when he saw a group of
teenagers laying back with their feet up on
the seat and drinking from Vb cans. when
the member looked at one of the young
males, the smart alec raised his can and
gave him a ‘cheers’.
At this point the member heard the train
doors closing and the train started to move.
He stood there on the platform watching
the train head off trying to work out what he
should do. He phoned the Dandenong police
station and spoke to a young Constable and
explained his predicament, highlighting the
word discretion and asking if there was a
spare unit to drive him to the Springvale
train station.
As the member waited for his transport, he
heard on the police radio, "Dandenong 900,
is there any unit clear to transport a Transit
member to Springvale as he missed his train
and left his colleague on board".
A Dandenong HwP member then arrived
laughing at the member’s predicament.
The journey from Dandenong to Springvale
didn’t get any better for the stranded
member, as his driver was in tears of laughter
while he was being told the full story.
In the mountains of franklin County, Virginia, the bondurant brothers are the stuff of legend. The
eldest, Howard (Jason Clarke), managed to survive the carnage of the Great war. His brother forrest
(Tom Hardy) nearly died from the Spanish flu that took his parents. Jack (Shia Labeouf) is the youngest
sibling, impressionable, sensitive, smart. Times are tough and jobs are scarce, but the bondurants are
entrepreneurs and have built a thriving local business by concocting a popular brand of moonshine.
However, the new "law" Special Deputy Charlie Rakes (Guy Pearce) brings in is lethal and corrupt and
will challenge everything the brothers have built and represent. Opens at the movies October 11.
Renovating or
moving house?
With the warmer months almost
here, you may be thinking about
renovating your home, putting in
a pool, or upgrading to the home
you’ve always dreamed of. At PC,
we have a whole range of home
loans and refinancing options to
help you along the way.
Renovating or
improving your home
Renovating can improve your lifestyle, but it
can also be one of the biggest investments
you’re ever likely to make. So the most
important part of a renovation is planning,
and there’s a lot to consider. Think about
what you need (rather than what you want),
then do the sums and see what you can
afford. be smart about your design choices
and make sure they’re cost effective.
Choose a reputable licensed builder and get
references before you sign anything. Look at
similar properties in your area and perhaps
speak with local real estate agents to make
sure you don’t over-capitalise.
Upgrading to another home
Perhaps you’d prefer to save the hassle
of renovating and upgrade to another home,
either in your suburb or somewhere else.
LEGAL ADVICE
Protect what matters to you most
with a watertight succession plan
Wills and succession planning specialist Rod Cunich of Slater & Gordon Lawyers
discusses the intricacies of succession planning where drawing up a will is just
the beginning.
Whether through accident,
disease or death, the day
will come when you can no
longer personally provide
for the financial, health
and emotional wellbeing of those you love.
These issues are too important to leave to
chance. fortunately, you can plan for that
time and put structures in place to help
secure their future.
This process is called succession planning,
sometimes called ‘estate planning’.
A well-structured succession
plan can give you great
peace of mind that
your loved ones will
be provided for as
you intended.
Preparing a will is
an integral part of any
succession plan as it
determines how your
assets are to be divided
in the event of your
death. This may include
physical belongings
such as cash,
clothes, jewellery,
cars and the family
home, as well as
investments such as
your superannuation
or share portfolio. but there are many
other factors to consider. These may
include the protection of inheritances
should beneficiaries face a failed marriage,
remarriage, bankruptcy, loss of mental
incapacity, drug or gambling dependency,
spending problems or family disputes. It
might also include the minimisation of the
tax burden for your beneficiaries once they
take ownership of your property as well
as deciding on guardians to care for your
children if they are still minors when you
pass away.
36 Protect Represent Support. www.tpav.org.au
Succession planning is not all about
planning for the time you pass and the
preparation of a will. It’s also about the here
and now. To protect you, your family and
your property, you should take into account
problems that you, or they, may face during
your lifetime such as a failed marriage,
remarriage, bankruptcy, physical incapacity
or loss of mental capacity.
with the advice of a succession planning
lawyer you can put legal safeguards in
place to prepare for these and life’s other
contingencies to ensure you and your loved
ones will be provided for. In doing so, you will
find security and certainty, not just for you,
but for those you care about most.
The legal components of succession
planning are only part of your broader
succession planning strategy. A well
thought-out plan should include legal
documents that are coordinated with
your retirement, investment and wealth
accumulation strategies.
when there are several parties involved
in your succession planning, including
a number of professional advisors and
family members with differing interests
and objectives, it can be easy for waters
to become muddied. Careful structuring
and preparation of your plan and its proper
documentation ensures each stage will be
followed accurately in the years to come,
minimising future disputes, and ensuring
that all parties are on the same page. your
succession planning lawyer can develop
an integrated succession plan for you by
working cooperatively with your
accountant, financial planner
and insurance advisor.
Don’t be penny wise
and pound foolish −
spending time and
money now on the right
legal advice will save you
and your family in the
future.
for further information
about putting together
a comprehensive
succession plan, you can
contact the Association
on 03 9468 2600 about
making a time to speak with
one of Slater & Gordon’s lawyers
with expertise in this field.

Dear Phil,
On the 4th of September 2012 I will retire
from the job after 38 years. I would like to
thank the TPA Executive, past and present
for their assistance to me over the journey.
I had the need to use your services a few
times in relation to discipline matters and
the support I received from the Association
was excellent. I was fortunate enough not to
require the need for the TPA welfare services
and applaud you and the Executive in the
manner you assist members and families
when the need arises. I cannot understand
why some members feel the need not to be
part of the TPA.
I would like to thank you all for your help
and hard work over the years and wish
The Police Association and all members
whom I have worked with and forged great
