PRICES:<br />

All prices are F.O.B. <strong>Fairway</strong> <strong>Nursery</strong>, Clackamas, Oregon. Orders will be processed on a “first<br />

come, first serve” basis. Prices are subject to change without notice.<br />

TERMS OF PAYMENT:<br />

Terms are cash in advance unless credit has been established. Terms on account sales are Net 30<br />

days following invoice date. Open accounts over 60 days will be cash only until credit has been<br />

reestablished. Past due accounts are subject to a 1.5% per month service charge (18% annual rate).<br />

DISCOUNTS:<br />

Discounts are based on total sales throughout the Fall 2010/Spring 2011 shipping year and are<br />

applicable only when invoices are paid within terms. The discount schedule is as follows:<br />

SHIPPING:<br />

All shipping will be the responsibility of the customer unless prior arrangements have been made.<br />

For orders over $1,000.00, <strong>Fairway</strong> will arrange transportation for the customer’s materials from<br />

Oregon provided that freight is either paid in advance or order ships C.O.D.<br />

CLAIMS:<br />

<strong>Fairway</strong> <strong>Nursery</strong> warrants all plants to be true to name, and to be healthy at the time of shipment.<br />

This nursery is regularly inspected by the State of Oregon Department of Agriculture’s Plant Division.<br />

Plant material is certified to be apparently free of dangerous pests and diseases. No guarantee<br />

is given, either expressed or implied concerning the suitability of plants for your intended use,<br />

or for viability under your growing conditions. Any plants purchased from us and shipped to<br />

our customers are healthy; however, once they are loaded, the plants are dependent on the care<br />

given by truck and driver, those offloading plants, and, finally, the immediate plant environment<br />

(including watering needs, local weather, shade and/or shelter).<br />

Therefore, any claims must be submitted to <strong>Fairway</strong> <strong>Nursery</strong> in writing (either via fax or mail)<br />

within 20 days of customer’s receipt of plants. Please contact us immediately if there is a problem<br />

with any plant material!<br />

F.O.B. means that plants which you have ordered become yours upon delivery to the carrier. Damages<br />

due to handling during shipment, failure to deliver within a carrier’s guaranteed time period, or<br />

loss of plant material must be claimed against the carrier. In order for us to help you with a shipping<br />

claim, it is the customer’s responsibility to note any shortages or damages to plant material<br />

on the bill of lading – do not sign this document until you have inspected the load! Failure to<br />

follow these instructions will forfeit your right to obtain credit for shorted or damaged material!
