6. Restriction in alienation.<br />
No State Land included in a Malay Reservation shall be sold,<br />
leased or otherwise disposed of ( otherwise than by Temporary<br />
Occupation Licence for a period not exceeding one year ) to any<br />
person not being a Malay, save as provided in this Enactment.<br />
7. (i) Restriction on transfer of interest. Amd. Ent. 3/49<br />
Amd. Ent. 8/40.<br />
No right or interest of any Malay Reservation land and no right or<br />
interest in such land acquired by virtue section 13A by any person<br />
not being a Malay shall be transferred to or transmited to or vest<br />
in any person not being a Malay provided that lease of reservation<br />
land shall be valid to the extent specified in subsection (ii) to (v)<br />
below, save as provided in this Enactment.<br />
(ii) Subs. Ent. 7.1938<br />
Every document purporting to be lease or agreement for lease from<br />
a Malay to a person not being a Malay of any Reservation land not<br />
situate within the boundaries of a town declared under the<br />
provision of the Land Enactment in force in the State of Kelantan<br />
shall be deemed to be lease or agreement for lease from month to<br />
month terminable by one month’s notice on either side and any<br />
lease or agreement for lease of any such land be valid and<br />
enforceable accordingly as a lease or agreement for lease from<br />
month to month.<br />
(iii) Sub. Ent. 7/1938<br />
Subject to the approval of His Highness the Sultan in any case it<br />
shall be lawful to register a lease for a period not exceeding three<br />
years from a Malay to a person not being Malay of any land situate<br />
within the boundaries if a town declared under the Land<br />
Enacment force in the State of Kelantan and any such lease shall<br />
be valid and enforceable; provided that no such lease shall be<br />
registered unless the lessee produces to the Land Officer a<br />
certificate signed by the State Secretary in the form of schedule A.<br />
Such certificate shall upon registration of the lease be attached to<br />
the Land Office copy of the lease.<br />
(iv) Subs. Ent 7/1938<br />
The provisions of subsection (ii) shall apply to all lease (not being<br />
leases registered under subsection (iii) and to all agreement for<br />
lease of land situate within the boundaries of any town declared<br />
under the Land Enacment in force in the State Kelantan.<br />
