• History & Background - In 1998 a communication tower was constructed at 3210 Dade Avenue and in June <strong>of</strong><br />

2008 the FDOTcondemned the communication tower to expand 1-4.<br />

• Request to erect a 150 ft. tall stealth tower within 300 ft <strong>of</strong> a residential zoning district.<br />

Andy McDowald, Sr. Pastor <strong>of</strong>the Florida Hospital Seventh Day Adventist Church and Children's Academy, spoke as an<br />

opponent, noting the following concerns:<br />

• Safety <strong>of</strong> the 225 children at the academy across the street<br />

• Future health problems the children may encounter<br />

• Negative impact on property values<br />

• Request the applicant/owner provide insurance<br />

Bob Chopra, representing the VCI Group, noted that no health effects are associated with the use <strong>of</strong> cell towers. The<br />

proposed tower will be designed and constructed to fall within the lease parcel if it were to collapse. Also, the distance<br />

between the tower and the school is 3 times the height <strong>of</strong> the cell tower. Mr. Chopra agreed to provide a report from an<br />

engineer attesting that the project meets FCC Limits and will not cause adverse health effects.<br />

Terry Briegel, 3003 Dade Avenue, spoke as an opponent <strong>of</strong> the project noting the following:<br />

• International precautionary standard recommends a 1,500 ft. separation<br />

• Safety/harmful effects on environment and health from radio frequencies

Kyle Shephard, Office <strong>of</strong> Legal Affairs, clarified that local governments may consider the physical construction and<br />

location <strong>of</strong> cell towers but may not consider the health effects <strong>of</strong> cell towers as part <strong>of</strong> their deliberation.<br />

After clarification. James Kelly MOVEDapproval <strong>of</strong> CUP2008-00019, subject to the conditions contained in the staff<br />

report. Gregory Lee SECONDED the motion. After discussion, the motion was voted upon and PASSED by a vote <strong>of</strong><br />

7 in favor and 2 opposed (Kha-Le-Huu and Mickey Barkett).<br />

• Location - 1046 W. Washington St., between N. Orange Blossom Trail and N. Westmoreland Dr.<br />

• Zoning - R-2B/T/SP (Residential Medium Intensity/Traditional <strong>City</strong>/W, Washington St. Special Plan)<br />

• History & Background - The residence on the subject property was constructed in 1925. Two commercial buildings<br />

were built in 1953. The current owners purchased the property in 2003.<br />

• Request - The applicant is proposing to convert one <strong>of</strong> the commercial buildings into a House <strong>of</strong> Worship and<br />

demolish the residence on the site and use the area for paved parking.<br />

• Recommended Conditions <strong>of</strong> Approval<br />

a) Church will not operate until permits are obtained for site improvements.<br />

b) Curb cuts along Dewitt shall be closed and landscaped.<br />

c) Expansion <strong>of</strong> U"1€ Church can be approved threugh a Planning Official Determinati-on.<br />

Donna King, representing the West Central Park Homeowners Association, spoke in opposition <strong>of</strong> the request, noting<br />

the following:<br />

• Petition from 10 neighbors<br />

• Parking<br />

• A/C business in area has disrupted neighborhood<br />

• Would like to make certain that the <strong>City</strong> follows through with their landscaping and site conditions <strong>of</strong> approval<br />

• Disagrees with Code Enforcement regarding the property being grandfathered.<br />

The following points were clarified:<br />

• The subject site is not in a historic area, but some <strong>of</strong> the homes in the immediate area are old enough to be<br />

considered historic.<br />

• Applicant not required to obtain a Certificate <strong>of</strong> Occupancy, rather the applicant is required to obtain a Certificate <strong>of</strong><br />

Completion<br />

Augusta Johnson, 1025 Dewitt Drive, spoke in opposition <strong>of</strong> the applicant's request.<br />

Renel Vincent, 4066 Winford Circle, representing the applicant, noted the following:<br />

• Church will comply with the conditions <strong>of</strong> approval<br />

• Apostolic Faith Church owns one bus; not many members will drive to the site<br />

leilma Woods, 1131 Dewitt Dr., spoke in opposition <strong>of</strong> the request, noting the following:

Leo Cruz explained that with the proposed paved parking area will improve conditions and reduce impacts to adjacent<br />

properties.<br />

Mr. Grandin, Executive Secretary, noted that the board could add a condition <strong>of</strong> approval when they make a motion to<br />

ensure that landscaping is completed in a timely manner or ask the church to cease operations until all the conditions<br />

<strong>of</strong> approval are met or face Code Enforcement fines.<br />

Colandra Jones, Project Planner, gave an overview <strong>of</strong> project usingoverhead visuals, highlighting the foHowing:<br />

• Location - North end <strong>of</strong> Warehouse Rd., south <strong>of</strong> Plaza Terrace Dr., and west <strong>of</strong> Woodcock Rd.<br />

• Request - Amend Future Lane Use Element Subarea Policy S.15.12 to:<br />

a) Eliminate the alternate development scenario<br />

b) Modify the preferred development scenario to include ancillary retail for a multi-family development<br />

. c) Modify the preferred development scenario to change the transportation requirements<br />

• MPS approved GMP Subarea Policy S.15.12 in March 2007<br />

• Aerial Photo <strong>of</strong> subject property<br />

• Staff proposes to:<br />

a) Limit the development to a maximum <strong>of</strong> 2,855 daily trips<br />

b) Delete the alternate scenario<br />

c) Modify the condition that requires at least one additional public street access from Woodcock Rd.<br />

d) Require construction <strong>of</strong> the mitigation improvements identified in the traffic study and the mitigation plan.<br />

e) Allow for eating and drinking and light retailing as accessory uses within a residential or mixed use <strong>of</strong>fice<br />

development.<br />

Maureen Damiani, asked how the development could have only 265 peak hour trips if it had 450 dwelling units. She<br />

also expressed concern regarding only one entrance onto Woodcock Rd.<br />

Colandra Jones noted that the traffic study submitted by the applicant indicates 265 peak hour trips would be<br />

generated by 450 units. Other trips would be generated during non-peak hours. The applicant will also need to apply<br />

for a PD amendment to authorize a specific development.

Scott Martin, representing the applicant, noted that they are currently working with staff regarding the design <strong>of</strong> the<br />

proposed project. In the future, they will be looking to interconnect with adjacent properties. Mr. Martin also noted that<br />

the GMP amendment needs to be fairly general to accommodate different development options. However, at this time,<br />

the developer is proposing 450 multi-family dwelling units.<br />

Marueen Damiani noted that her main concern was leaving only one access to Maguire through Woodcock Rd.<br />

Adam Walosik, Transportation Planning, noted that Warehouse Rd. is going to be extended to the north, which will allow<br />

for a future connection to the east.<br />

GMP2008-00022* GMP amendment to change the future land use designation from Residential<br />

Medium Intensity to Public/Recreational/Institutional. The Public Hearing for this<br />

item was advertised in the local newspaper and courtesy notices were mailed to<br />

property owners within a 300 ft. radius <strong>of</strong> the subject property. This item was<br />

recommended for approval, subject to the conditions contained in the staff report.<br />

Maureen Damiani, asked for further clarification regarding the location <strong>of</strong> the properties around the subject site and<br />

the effects <strong>of</strong> the potential noise on residential areas,<br />

Colandra Jones, Project Planner, noted that adjacent uses include a multi-family development to the west, vacant<br />

property to the east, single-family homes to the north, and the 408 expressway to the south.<br />

Laurie Botts-Wright, Real Estate Manager for the <strong>City</strong> <strong>of</strong> <strong>Orlando</strong>, stated that this site is already a noisy site due to close<br />

proximity to the 408 expressway ramp. The site is larger than OUC needs today, but it will allow room to accommodate<br />

a landscape buffer wall to reduce the noise. Many alternative sites were considered, but the subject site was the only<br />

site that could readily serve the Events Center.<br />

Anthony Johnson, 420 S. Terry Avenue, spoke against the request, noting the following:<br />

• Concerns with how the Chiller Plant will fit in the community<br />

• Streets around area have no sidewalks<br />

• Questions whether a developer would want to come in and build on the adjacent vacant lots after the Chiller Plant<br />

is constructed<br />

• Drug problems on vacant property<br />

• Need for beautification<br />

Laurie Botts-Wright noted the following:<br />

• The <strong>City</strong> is the predominate land owner in the area<br />

• Site was selected because it would have the least impact on adjacent residential areas.<br />

• Chiller Plant will serve future development in the area, including the Events Center, Expo Center, future Creative<br />

Village and the Black Business Investment Fund.<br />

Mr. Johnson asked what the long term plan was for the other 11 acres that the <strong>City</strong> owns and noted that the area<br />

needs better lighting and sidewalks.

b) Maximum density <strong>of</strong> 39 du/ac (includes a Density Bonus <strong>of</strong> 9 dwelling units per acre)<br />

c) Mechanical parking system - The owner/developer shall provide sufficient documentation to the <strong>City</strong> Planning<br />

Division prior to permitting that shows that the design <strong>of</strong> the structure incorporates modifications and insulation so<br />

that the noise will not exceed the maximum permitted DB levels.<br />

d) Continual maintenance <strong>of</strong> the mechanical parking structure<br />

Scott Martin, the applicant, highlighted the following four main issues: height, density, traffic, and noise, using overhead<br />

visuals:<br />

• Development is currently allowed on the property under the approved PD<br />

• The new design will wrap Muriel and Harding Streets, and integrate the design into the scale <strong>of</strong> the<br />

neighborhood and the existing town homes. This design will activate the side streets while reducing the scale<br />

along Orange Avenue.<br />

• South Downtown Vision Plan encourages mixed-use development and housing.<br />

• Other properties in the area include a used car lot business and a surface parking lot across Orange Avenue.<br />

• Proposed front yard setback will meet the <strong>City</strong>'s vision and streetscape requirements for Orange Avenue.<br />

• The reduction in <strong>of</strong>fice will allow 11 additional dwelling units in approximately the same volume <strong>of</strong> space.<br />

• Access from Harding St. and Muriel St. is a cross-access drive. The surface lot will be used for retail only and<br />

the stackable parking for residential only. Residential will consist <strong>of</strong> one bedroom and efficiencies only.<br />

• Ground level retail will be provided along Orange Avenue, with a couple <strong>of</strong> dwelling units, on each side <strong>of</strong><br />

Harding St. and Muriel St. to create architecture and reduce the scale <strong>of</strong> the building. The upper floor <strong>of</strong> the<br />

residential units are small efficiency and l<strong>of</strong>t units at approximately 800 sq. ft.<br />

• Photos <strong>of</strong> site showing all elevations<br />

• Enclosing the mechanical parking structure is a possibility<br />

• Providing trellis and landscaping on rear <strong>of</strong> the retail building space<br />

• Explanation <strong>of</strong> how the mechanical parking system works<br />

Lisa Schott, Acoustical Consultant with QUietly Making Noise, noted that she was retained by the applicant to ensure<br />

that the project meets all noise ordinance requirements. She stated that the anticipated noise levels are not excessive<br />

and should be treatable through engineering and design. Levels <strong>of</strong> about 70 are comparable to the traffic on Orange<br />

Ave. The project may include enclosures around the elevator motors.<br />

• Concerns <strong>of</strong> compatibility, original design was a Brownstone Design - now it is more <strong>of</strong> a Contemporary Design<br />

Barbara Betz, 114 E. Harding St, Townhome Owner, at subject property<br />

• Not enough parking in area<br />

• Pulse nightclub disrupts neighborhood<br />

Scott Martin noted that the applicant would have a service contract with local people nearby in the event <strong>of</strong> a parking<br />

system breakdown. The parking system is not like a typical elevator; if there is a problem, it would probably only affect<br />

<strong>of</strong> portion <strong>of</strong> the stacked vehicles.

After a discussion. Gregory Lee MOVED approval <strong>of</strong> ZON2008-00023. subject to the conditions contained in the staff<br />

report and addendum. adding an additional condition as follows: The propertY owner shall enter into a service contract<br />

that provides for the continual maintenance <strong>of</strong> the mechanical parking system to ensure that the mechanical parking<br />

system functions properly. Further. the propertY owner shall maintain insurance on the mechanical parking system to<br />

cover significant maintenance. service and repair costs. Billy Newton SECONDED the motion. which was voted upon<br />

and PASSED by a vote <strong>of</strong> 8 in favor and 1 opposed (David Bass).<br />

Roger Chapin was not present for this motion.<br />

GMP2008-00021* The Evaluation and Appraisal Report (EAR) was adopted in October 2007 and is a<br />

state-mandated, periodic review <strong>of</strong> the <strong>City</strong>'s Growth Management Plan. The purpose<br />

<strong>of</strong> the EAR is to assess the <strong>City</strong>'s progress in implementing the adopted Growth<br />

Management Plan and to identify changes needed to address new conditions, issues,<br />

trends, projections and state regulations. The recommendations <strong>of</strong> the EAR form the<br />

basis for Growth Management Plan amendments being considered at this meeting.<br />

Due to the large number <strong>of</strong> amendments, today's meeting will include a short<br />

presentation and time for questions and answers. IVIPB members will be asked to<br />

review the amendments over the next month and to vote on the amendments at the<br />

September 16 meeting. The public is invited to review and comment on the<br />

Elisabeth Holler noted that CD's were given to each board member in their packets. The purpose <strong>of</strong> the meeting today<br />

is to respond to Board member questions. The MPB will vote on GMP amendments at the September MPB meeting.<br />

The amendments will then go to <strong>City</strong> Council and thento the Florida Department <strong>of</strong> Community Affairs (DCA).<br />

OTHER BUSINESS<br />

• Update and Status <strong>of</strong> Appealed MPB cases - Kevin Tyjeski, Chief Planning Manager, reported the following:<br />

Eola Park Centre, 200 E. Robinson Street. The hearing <strong>of</strong>ficer recommended approval <strong>of</strong> the project subject to a<br />

maximum building height <strong>of</strong> 295 ft.; the final site plan must be submitted within 1 year; and the loading area may<br />

not face Lake Eola Park. Both sides now have until August 25, 2008 to file their exceptions.<br />

Villages at Moss Park. An appeal was filed by a resident <strong>of</strong> the East Park neighborhood who had concerns<br />

regarding building height and buffer areas. A pre-hearing date has been scheduled for August 21,2008.<br />

• Nominating Committee<br />

Kha Le Huu made a motion to elect Mickey Barkett as Chairman and Maureen Damiani as Vice Chairman. David<br />

Bass SECONDED the motion which was voted upon and PASSED by unanimous voice vote.<br />
