Verdict in Jim Miller Murder Trial
Stutts: Jessica Kennedy Facing Possible 35 Years
On Monday evening, a
jury of eight women and
four men convicted Jessica
Lynn Kennedy in the
death of Sweetwater businessman
Jim Miller.
The jury found her
guilty of facilitation of
felony first-degree murder,
facilitation of aggravated
robbery, facilitation of setting
fire to personal property,
and facilitation of
abuse of a corpse.
Sentencing will take
place in Madisonville on
Wednesday, October 3.
In closing arguments
that took place Monday
morning, Assistant District
Attorney General Jim
Stutts reminded the jury
of Kennedy’s words in a
November 10, 2010, video
interview, “I know the
part I played and I am wiling
to do my time.”
Kennedy’s attorney,
John Eldridge, described
Kennedy as someone
whose life was “horrific”
and rife with drugs and
sexual abuse and who
would give persons in
power what they wanted
to hear, “just in order to
survive.”
Jim Miller died of three
gunshots wounds to the
head on July 17, 2010. He
was apparently killed at a
“yellow house” on Creek
Road and afterward his
body was loaded into the
trunk of his car and driven
five miles away to Sands
Road, where the car was
burned and along with it
his body.
The charges that came
down on Kennedy in a
January 2011 indictment
were felony murder, aggravated
robbery, setting fire
to personal property, and
abuse of a corpse. Months
before her indictment but
in weeks following the
homicide, Kennedy told a
myriad of stories about
Miller’s death, implicating
several individuals but always
altering a story and
the persons who were in it;
however, she placed herself
in each story and reported
eyewitness
accounts to investigators.
In his final arguments
to the jury, Stutts reiterated
that Kennedy did not
act alone. He called her
role in Miller’s death as
“part of a plan to rob Jim
Miller.”
“And she had money
the next day,” said Stutts.
“According to Paul Cain (a
prosecution witness),
more money than I’ve
ever seen in my life, a wad
as big as my fist. Where
did she get this money?”
Stutts reminded the
jury that on the day Miller
died his cousin said Miller
intended to buy cattle; another
witness saw Miller
with money later that day;
and a resident off Creek
Road reported hearing
gunshots in the vicinity of
the “yellow house” and
watched a car and van pass
her home afterward.
Eldridge, however, in
his closing remarks, said
forty or fifty dollars would
fill up a hand.
“But take the money
and leave the watch and
rings that you saw earlier
this week?” Eldridge
asked. “Could the murder
been a jealous husband or
boyfriend or a hit? And
what got Jim Miller to that
house in the first place?”
Eldridge asked the jury
if it was true, as Kennedy
said, that Sheriff Bill
Bivens and Captain Detective
Michael Morgan
were involved. He said
that placing Kennedy in a
“cage” in the jail would
make her life so miserable
that “she would blow and
crack.”
“She not only broke,
she gave up,” Eldridge
said. “She was used and
abused by the detectives
and she breaks down. In
her world, when you conform,
you give a person in
power what they want to
hear. She was saying that
what you want me to say I
will say for you, and I’ve
got a wild imagination.”
Eldridge said Kennedy
told so many stories she
couldn’t keep them
straight.
“But she wanted to satisfy
them,” he said, “so she
would get out of the cage.
And if I tell them I did, no
one – not even Brandon
Steele, Boonie Stokes, or
Michael Morgan – will be
after me.”
Shortly before he
ended his closing, Eldridge
actually admitted to the
jury that Kennedy was
present at Miller’s murder.
“You can conclude
properly that she was
there,” he said, “but she
didn’t know a thing about
what they were going to
do with the body.”
Then Eldridge beseeched
the jurors.
“Do this first kind deed
ever in her life,” Eldridge
implored the jury. “Set her
free. She’s been in jail almost
two years and it’s
been the first period of sobriety
since she was a
teenager. She might make
it if you set her free. You’d
be telling the authorities
to roll up their sleeves, get
to work, and find out who
killed Jim Miller.”
Stutts, in rebuttal, said
Kennedy was not powerless,
as Eldridge had portrayed
her, but was
“violent.”
“Remember her saying
‘crazy people do crazy
things’ to Agent Legg?” he
asked. “And how afraid
was she of Brandon Steele
and Boonie Stokes? She
was with both of them. If
they are the desperados
she would have you believe,
are they stupid
enough to take a witness
to a murder?”
Stutts said Kennedy,
during her time in custody
at the Monroe Count Jail,
was treated like any other
inmate.
“It was not like being in
a gulag,” Stutts said.
“That’s not the way it was
down there. Three days a
week she not in that ‘cage,’
but was with the rest of
the females. You, as jurors,
do not check your common
sense at the door.
Truth is, Jessica Kennedy
played a part, and she admitted
it. She said I know
the part I played and I’ll
do my time. Now that’s
Chiefs Blast Rockwood in Season Opener
Allen Roberts
The Sequoyah Chiefs
traveled to Roane County
on Friday to face the
Tigers of Rockwood in the
season opener for both
teams. The Tigers were
predicted to be a strong
team this year and were favored
against Sequoyah,
but it was the Chiefs who
came out and proved to be
the stronger team, jumping
all over the Tigers early
and completely dominating
the game from start to
finish and winning in convincing
fashion with a
score of 41-14.
Sequoyah received the
opening kick and with the
ball on its own 20-yard line
the Chiefs went on a
seven-play 80-yard scoring
drive for the game’s first
points. Casey Coon ran
for 13-yard on the first play
for a first down. Blake
Huffman rumbled for five
yards and then quarterback
Brett King hit his receiver
Garret Dalton for
14 yards and another first
down. Coon then had runs
of two, five, and two yards,
setting up a fourth and
one at the Tigers 40-yard
line. Drew Carson got the
first down and more, busting
up the middle and by
the defense for a 40-yard
touchdown. The extra
point was no good and
with 8:16 left in the first
quarter, the Chiefs led 6-0.
Rockwood started its
first possession on its own
24-yard line. The Tigers’
quarterback found his
wide receiver down the
left sideline on a fade pass
for 22 yards and a first
down, but the home team
fumbled the ball on the
next play as Sequoyahs'
Forrest McKane came up
with the loose pigskin and
the Chiefs were back in
business.
With the ball on the
Tigers 42-yard line, it only
took the Chiefs four plays
to find the end zone. King
completed passes of eight
yards to Coon, 22 yards to
Austin Lunsford, and
seven yards to Dalton.
Coon then took the handoff
and scampered up the
middle for the six-yard
touchdown. Huffman ran
in the two-point conversion
and, just like that, Sequoyah
led 14-0.
After a nice kick-off return,
Rockwood started
its next possession with
good field position at its
own 41-yard line but that
did not last long. On the
second play, Sequoyah's
Luke Knott intercepted
the Tigers’ quarterback
giving the Chiefs the ball
back at the Rockwood 40yard
line.
With the offense back
on the field, it only took
one play for Big Red to
again find paydirt. Quar-
terback King dropped
back and found Huffman
streaking down the right
sideline for a 40-yard
touchdown pass. King’s
extra point kick was good
and with 4:49 left in the
first Sequoyah led 21-0.
The Tigers started the
next possession on their
own 26- yard line and this
time the home team
picked up three first
downs and moved the ball
into Sequoyah territory,
but on fourth and six
punted the ball back to
the Chiefs and with the
first period coming to a
end Sequoyah led 21-0.
The Chiefs opened up
the second quarter with
the ball on their own 20yard
line and it looked like
they were going to put
more points on the board
moving the ball down the
field, picking up five first
downs and pushing the
ball deep into Tiger territory,
but the home team
held on a fourth and goal
at the five-yard line, turning
the ball over on downs.
Rockwood picked up
three first downs as its
pushed the ball out to
mid-field but once again a
turnover stopped the drive
August 21, 2012
as Sequoyah’s Huffman
picked off the Tigers quarterback,
giving the Chiefs
the ball on their own 36yard
line.
It only took the visitors
four plays to find the end
zone again. Huffman
busted loose for a run of 32
yards, then after a incomplete
pass and a run for no
gain, King hit his wide receiver
Dalton for a 32-yard
touchdown strike down
the left side line, and with
the extra point kick being
no good, the Chiefs had
pushed their lead to 27-0
with 3:12 left in the second
period.
With the ball on their
own 25-yard line the Tigers
offense came to life, picking
up four first downs and
moving the ball into
Chiefs territory but the
Chiefs defense once again
came up with the
turnover. Chiefs’ linebacker
Huffman stepped
in front of the Rockwood
pass attempt and picked it
off and streaked 65 yards
for the Sequoyah touchdown.
King's extra point
kick was good and with
the quarter coming to an
end the Chiefs held the
halftime lead 34-0.
Rockwood started the
first possession of the second
half on its own 15-yard
line. The Chiefs pushed
the Tigers back and forced
a punt from inside the 10yard
line, giving the Chiefs
the ball with great field
position on the Tigers’ 37.
KC Deherrera ran the
ball for three yards and
then one yard, the Chiefs
then fumbled the ball on
third down as the Tigers
recovered the loose
pigskin on their own 29yard
line.
The Tigers took advantage
of the great field po-
sition and five plays later
were in the end zone for
their first score of the
night, and with the extra
point kick being good,
Rockwood had cut the
Chiefs lead to 34-7 with
7:05 left in the third quarter.
The home team was not
done yet, as it recovered
the onside kick, giving it
the ball back at the Chiefs
41-yard line. From there
the Tigers scored six plays
later on a three-yard
touchdown run. The kick
was again good and with
4:17 left in the third, the
Chiefs led 34-14.
The Tigers tried another
on-sides kick but this time
the Chiefs recovered the
ball giving them great field
position on their own 44yard
line. Looking to seize
back some momentum,
the Chiefs’ offense went
to work and on the first
play answered in a big way.
King dropped back to
pass and found his receiver
Dalton in the left flats,
where he broke loose
The 2012-13 Sequoyah Chiefs Cheerleading Squad
down the sideline behind
some great down field
blocking for a 56-yard
touchdown. The extra
point kick was good and
Sequoyah had pushed its
lead to 41-14 with 3:56 left
in the third.
Both teams had the ball
two more times each but
neither team would score
throughout the remainder
of the fourth quarter,
bringing the game to a end
with the Chiefs winning in
convincing fashion 41-14.
The Chiefs had 456 yards
of total offense and rushed
25 times for 201 yards, led
by Coon with 12 carries for
72 yards with one touchdown.
Carson rushed
three times for 50 yards
with a touchdown, Huffman
rushed three times
for 43 yards, King rushed
three times for 26 yards,
Deherrera had five rushes
Sweetwater came out
swinging, and swinging
hard, knocking the Bears
for a loop. By the time the
Bears were able to muster
up a counterattack, it was
too little, too late. The
Wildcats emerged the victors.
Tellico won the cointoss
and the right to receive
to open the game,
but the Wildcats’ defense—comprised
of more
than a few tackles by a
host of Cats, as well as a
sack by Elijah Blomstrom—prevented
the
Bears from making any
headway. The Bears were
forced to kickoff on
fourth down.
But Sweetwater had no
such trouble on the offensive
end. Despite a yellow
flag penalty and a fumble
(which Eli Arwood recovered
for Sweetwater), the
Wildcats stormed their
way up the field. Hunter
Humphreys and Nick
Wicker ate up yard after
yard while rushing, and it
all culminated when Jordan
McGaughey found yet
another opening in the
Bears’ defenses. He
quickly sped away into the
end-zone for the first
touchdown of the night.
Garret Zickgraf added an
extra point to the board
with a successful fieldgoal.
Individual plays by
Dakota Reinhart, Robert
Vandervort, Adam Reece,
and Garrett Reno bought
Tellico a couple of first
downs. The Bears soon
made it to within striking
distance of the end-zone.
But Sweetwater’s defense
once again came to
its rescue. Zack Neil
recorded a sack, handing
the Bears a loss in several
yards, and several other
Wildcats prevented not
one, but two passes to an
awaiting R. Vandervort—
including one on a fourth
and seventeen. The ball returned
to the home team
on downs.
And the Cats wasted
no time in making the
Bears pay for the gamble.
J. McGaughey once again
slipped and slid his way
through the Tellico defense,
and did not stop
running until he was safe
in the end-zone. G. Zickgraf
kicked home another
field goal soon afterward,
giving Sweetwater a lead
of 0-14.
The Bears faced the
same brick-wall of a defense
in the ensuing possession,
forcing them to
kickoff. The pair of teams
then exchanged the ball
on a pair of fumbles. The
football eventually ended
up in Sweetwater’s hands,
but it was then that the
Bears’ defense finally
roared to life. This time, it
was Sweetwater who was
knocked for something of
a loop, as a host of Bears
continually pushed them
back, until a tackle by G.
Reno placed the Cats at a
third and long. The buzzer
sounded not long after.
The score at the end of
the first quarter was 0-14.
Sweetwater retained
possession to open the
second quarter, but they
did not have it for long.
Colton Carr batted away
an attempted pass on a
third down, and when
Sweetwater attempted to
go for it on the fourth
down, still more Bears
stepped up to stop the
would-be play. The attempt
ended with an incomplete
pass. Possession
went over to Tellico on
downs.
But the Bears were unable
to take advantage of
the opportunity. They suffered
two back-to-back
fumbles, and finally
From then on, it was
the Wildcats Show. Sweetwater
scored four touchdowns
in the second
quarter. One came off yet
another rush by J. Mc-
Gaughey. The second was
a rushing-touchdown by
H. Humphreys, and the
third came after a bobbing
and weaving carry by E.
Arwood. The final touchdown
came at the buzzer,
courtesy of J. McGaughey.
G. Zickgraf added still
more points with his precision
kicking after each
touchdown.
The run gave Sweetwater
an imposing lead going
into halftime, with the
scoreboard blazing 0-42.
The third quarter and
August 21, 2012
second half opened with
possession in Sweetwater’s
hands. Despite the pounding
they took in the second,
the Bears pulled
together.
The renewed effort
paid off. Tellico not only
forced a fumble out of
Sweetwater, but also recovered
the football.
For the rest of the quarter,
the Bears steadily
made their way up the
field towards the endzone.
The hard work all
paid off when A. Reece
stole his way through a
mass of Wildcat defenders
for the Bears’ first touchdown
of the night.
Instead of going for a
field goal, the Bears attempted
a two-point conversion
play. They
The Bears kicked off, giving
possession back to the
Wildcats.
But the Wildcats, too,
faced some tough D. Tackles
by TJ Pike, Bryce
Carter, Bubba Laws, and
A. Reece soon brought
them to a fourth and
seven. Sweetwater, with
nothing to lose, went for
it, but A. Reece stepped
up again to end the play
with another tackle. The
ball went over to the Bears
on downs.
It did not take long for
Tellico to act on the opportunity.
Some pin-point
passing by D. Reinhart to
Tyler Peeler and then R.
Vandervort ended in a second
touchdown for the
Bears. Tellico tried another
two-point conversion
play, and once again
were successful.
But neither team was
able to score again in the
time remaining. The game
ended with Sweetwater
taking a knee.
After the jury brought
by the BUZZ.
“We’re extremely
he said. “Under this
Jessica is very excited,
for someday there will be
another life for her.”
Stutts, on the other
hand, said he was appreciative
for the hard work
of the jury for holding
Kennedy responsible for
Miller’s death. He said all
the agencies involved in
the investigation cooperated
well and in agreement.
“I am happy the jury
found her responsible for
said. “In a week or two we
