CONDITIONS OF CONTRACT. 1. The normal working hours will be 8 hours a day from 8.00 A.M. to 5.00 P.M. with one hour lunch break from 12.00 Noon to 1.00 PM subject to staggering of duty hours as per actual requirement. 2. Minimum one supervisor is to be engaged for above 15 Nos. of staff. The Contractor must engage one full time supervisor who preferably should be an experience. 3. The contractor should maintain attendance and other records of the manpower engaged by him required under labour law and must observe all the formalities under the labour act. 4. The contractor shall provide uniform as decided by the Site – Incharge / Dy. Suptdg. Horticulturist at own cost. 5. The department will provide a suitable place to store for T & P articles 6. The Contractor will provide and utilize the garden equipment etc. including their repair and required fuel ( Diesel / Petrol) 7. The Contractor is forbidden to sell or gift any item from the garden area to any person or organization with out the prior written permission of the department. 8. All the materials like good earth, manure, chemical fertilizer, insecticides, pesticides, seasonal flower seeds, water for irrigation and earthen / cement pots will be provided by the department as and when required. 9. Contractor will follow the minimum wages act. 10. The whole garden area should be kept neat and clean and maintained to its optimum level through out the year and garden area should be kept ready for inspection by judges at the time of garden competition. 11. The maintenance will be carried out under supervision of the Dy. Suptdg. Horticulturist, or his representative i.e. Site Incharge. . 12. The instructions of Garden Incharge to be carried out promptly. In case of any difference of opinion / interpretation of specifications and conditions, the matter is to be referred by the Contractor to the Divisional Head for his decision, which shall be final and binding. 13. If any litigation arises through laboureres engaged by him through labour court or labour commissioner & any other court etc. on account of litigation. The contractor will be fully responsible, for payment of such claim. 14. In case of non – satisfactory maintenance found in any area of the garden, the amount will be deleted at the time of payment according under intimation to the contractor with full opportunity, failing which the Dy. Suptdg. Horticulturist is competent to terminate the full agreement or party agreement on account of non-proper maintenance of the garden by the contractor. 15. Labour not to be engaged below 18 year and above 60 years. 16. Overall total amount is considered for approval of tender. 17. Works should be carried out as per directions of garden incharge. 18. The rates given for works should be inclusive of all taxes, leads and lifts etc. Nothing extra shall be paid over the rates quoted by the Contractors. / Firm. 19. It shall be the responsibility of the Contractor / Firm to ensure that no damage is caused to Govt. Property at the site by his / their vehicle or labour party. Cost of such damages, if any will be assessed at the discretion of the Dy. Suptdg. Horticulturist and same will have to be made good by the Contractor / Firm. 20. The Contractors / Firm shall not sublet any portion of Contract. Failing which the undersigned shall serve a notice, rescinding the contract, where upon the Earnest Money and Security Money shall be forfeited. 21. The agreement can be cancelled at any time due to technical reasons or financial complications. In these circumstances no claim and no any compensation on this account shall be made on Department. 22. The running payment will be made as per rules of ASI. 23. Error / Omission if any shall be rectifiable with no claim. 24. The Contractor Shall arranged to his own expenses for clear drinking water, housing, medical facilities necessary for the welfare of the labour employed at his work. 25. The Deptt. Reserve the option of take away any item of the work or part thereof any time during the occurrence of the contract and reallot it to another agency with due notice to the Contractor / Firm without liability or compensation. 26. The contractor will be held responsible for any loss of Govt. property due to negligence of Watch & Ward and same will be replace by his at his own cost. 27. The contract is subject to availability of funds, if funds are exhausted, then tender can be terminated at any time after serving one month notice. 28. The filed staff to be engaged for One Man/ 2Acre for extensive area & one man/Acre for intensive area and the staff should have an experienced. 29. Payment will be made as per survivality of trees shrubs at site. 30. Letter of award can be withdrawn if the funds are not available after issuing one month notice.
