GOVERNING BODY PROFILE

Form of Government

The City of Shawnee is a City of the 1st class. As such, it has the authority of home rule,

which allows cities to determine many policy issues on their own. Shawnee’s charter form of

government is the Mayor-Council-Manager form, which vests the policy making authority in

the City Council with veto power given to the Mayor. The Governing Body is comprised of a

Mayor, elected at large to a four-year term,* and eight (8) Councilmembers, two (2) from

each of the four (4) wards, elected to staggered four-year terms.*

Mayor and Councilmembers

The Mayor is the titular head of the City and presides over all Council meetings. He or she

signs all ordinances and resolutions passed by the Council and can veto any ordinance or

resolution except charter ordinances. The Mayor represents the Governing Body at official City

functions. The Mayor may make recommendations to the Council concerning City policies,

practices, and activities.

The role of the Councilmember encompasses a broad range of activities with the level of

participation being established individually by each Councilmember. Some Councilmembers

view their role as that of ombudsmen and focus primarily on constituency services, acting as

a conduit between their constituency and the City administration. Other Councilmembers

view their role as that of a community leader who promotes the welfare and development

of Shawnee. The Municipal Code charges all Councilmembers with the role of policy maker.

Collectively, the Council determines what the City is or wants to be and determines the

direction to take to achieve a constantly redefined goal.

Wards and Precincts

The City is divided into four (4) wards. Wards are determined by the City Council and are

comprised of precincts which are established by the Johnson County Election Commission

based on population. Pursuant to Charter Ordinance, each ward is to be as nearly equal in

population and as compact and contiguous as practical.

*Municipal Elections

Charter Ordinance No. 40 passed in July of 2009 moves the municipal election cycle to

correspond with the County election cycle. Those elected in 2012 will serve three year terms.

The 2013 municipal election, and all those following, will elect City officials to four year terms.

Elections from 2013 will be in staggered odd-numbered years and are staggered so that one

Councilmember from each ward is elected at each election.

HOW TO FILE FOR CITY OFFICE

Filing Location

Candidates wishing to file for office may do so at the City Clerk’s Office, Shawnee City Hall,

11110 Johnson Drive, Shawnee, Kansas 66203, beginning December 3, 2012.

Deadline

The deadline to file or withdraw for the 2013 Spring Elections is 12:00 noon on January 22, 2013.

Candidates may not file or withdraw after this date.

Forms

Three forms are required (all are included in this packet):

• Candidates must complete the Declaration of Intention form and file it with the required

filing fees with the City Clerk before the filing deadline on January 22, 2013, 12:00 noon. This

form must be signed by the candidate in front of the City Clerk or the City Clerk’s designee.

KSA 25-2106; KSA 25-2109.

• Candidates must complete the Statement of Substantial Interest form and file it with the

City Clerk no later than ten (10) days after the filing deadline (Friday, February 1, 2013 at

5:00 p.m.).

• After filing, the Biographical Data form should be completed and filed with the City Clerk.

The City Clerk will forward a copy to the Johnson County Election Office for publication on

the Johnson County Election web site.

After filing the Declaration of Intention form with the City Clerk, the candidate will

receive additional information and forms (see page 12) directly from the Kansas

Governmental Ethics Commission (GEC). These forms must be filed in accordance with

GEC rules and regulations. More information regarding the GEC can be obtained by visiting

www.accesskansas.org/ethics.

Fees

Two fees are required:

• Filing fee: $10.00

Make checks payable to the Johnson County Election Commission. In lieu of paying the $10

fee, a candidate may file by signature petition. (See “Filing by Petition.”)

• Report fee: $35.00

Make checks payable to the City of Shawnee. This is a report fee and will be forwarded by the

City Clerk to the Kansas Commission on Governmental Standards and Conduct.

Filing by Petition

Candidates may file by petition in lieu of paying the $10 filing fee. Candidates must have

signatures of 1% of ballots cast in the district at the last general city election (see chart on

page 11) or 50 signatures whichever is less. The report fee of $35 is still required.

General City Election

The top section of the Nonpartisan Nomination Petition (see page 21), stating the candidate’s

name (as it is to appear on the ballot), address, office sought, etc., must be completed

before the petition can be circulated and signed. The candidate may circulate the petition

throughout the ward or for the Mayor throughout the City. Other circulators must be registered

voters and may only carry the petition in their county or, if for a ward office, the circulator must

reside within the ward.

The circulator of each page of the petition must witness every signature placed on the page.

No one may sign more than one petition for any office. Petition signers must include their

printed name, their signature, address, city, zip and date signed. All address information should

be the same as that by which the person is registered to vote. If more than one form is being

circulated for the same candidate, all must be submitted as a group to the City Clerk’s office

at one time. Every petition page must be completed on the reverse side and notarized.

Questions regarding nomination petitions should be directed to the Elections Division of the

Office of Secretary of State, Kris W. Kobach, (785) 296-4561.

The Johnson County Election Commissioner will verify that all persons signing the petition are

both registered voters and also live in the ward in which the candidate is filing. The county

recommends turning in the petition several days early and with more signatures than required.

This allows time for verifications, and if the petition is not valid, time for the candidate to pay

the filing fee by the filing deadline. Extra signatures can help in the case that some are not

valid.

CAMPAIGN FINANCE REPORTS

Campaign Finance Report Forms are provided by the Governmental Ethics Commission and

are mailed directly to the candidate. The forms and reports are filed with the Johnson County

Elections Office pursuant to KSA 25-4148 and 25-901. The Johnson County Election Officer will

forward a copy of the completed form to the Governmental Ethics Commission. Questions

may be directed to (913) 782-3441 or election@jocoelection.org. The following forms must be

filed by the candidate.

Appointment of Treasurer Form

• Candidates have ten (10) days after filing to file the Appointment of Treasurer Form.

• Candidates may not take in or spend any campaign funds until the Appointment of

Treasurer Form is filed.


Affidavit of Exemption from Filing Receipts and Expenditures Reports

• Completed form is due nine (9) days prior to the primary election.

• If a candidate anticipates receiving and spending less than $500 in the Primary Election and

anticipates receiving and spending less than an additional $500 in the General Election,

he/she can file an Affidavit of Exemption. All candidates are strongly encouraged to track

their spending and receiving.

• Candidates must appoint a treasurer and file an Appointment of Treasurer Form even if an

Affidavit of Exemption is filed.

Receipts and Expenditures Report

• During an election cycle, three (3) Receipts and Expenditures Reports are required for

candidates: (1) a pre-primary election report; (2) a pre-general election report; and (3) an

early January wrap-up report.

POLITICAL SIGNS

The following is an excerpt of the Shawnee Municipal Code (05.64.054 Political/Non-Commercial

Point of View Signs) that establishes the regulations on political signs:

A. Notwithstanding any other provision of this Chapter 5.64 to the contrary, any sign that is

or would be allowed as a commercial or business sign may express a political on noncommercial

point of view or message in lieu of the commercial or business message.

Excepting as to the content of the message, the sign shall in all other respects comply with

this Chapter. Excepting for signs to which the foregoing sentence applies a permit will not

be required for political and non-commercial point of view signs, however, it shall not be

construed as relieving the owner of the sign from complying with the requirements of this

chapter in the areas of placement and appearance.

B. Maximum size six square feet per face on residentially zoned properties and agricultural

properties used solely for residential uses, and twenty square feet per face on commercial,

office, and industrially zoned properties on agriculturally zoned properties developed with

non-residential uses, however, such signs no greater than 32 square feet may be placed

on those commercial, office and industrially zoned properties and on agriculturally zoned

properties developed with non-residential uses adjacent to frontages on streets with a

posted speed limit of 55 mph or greater;

C. Location:

1. Ten feet from curb or edge of pavement in residential districts and agricultural districts

with permission of owner;

2. Ten feet from curb or edge of pavement in commercial, office and industrial districts

unless the building is less than ten feet from the curb or edge of pavement in which

case the sign may be located at the building line with permission of owner;

3. Prohibited on street or highway rights-of-way;

D. Any political sign found by the Director of Planning to be in violation of the provisions

of this section shall be abated, removed or made to conform with the provisions of this

Section within twenty-four hours of after notice of such violation is given to the candidate,

candidate’s representative or political organization.

E. Non-commercial viewpoint, ideological or political signs may be displayed inside window

areas at any time.

STATEMENT OF SUBSTANTIAL INTERESTS FOR LOCAL OFFICE

DEFINITIONS

“Business” means any corporation, association, partnership, proprietorship, trust, joint venture, and

every other business interest, including ownership or use of land for income.

“Candidate for Local Office” means any candidate for nomination or election to any elective office

of a governmental subdivision.

“Compensation” means any money, thing of value or economic benefit conferred on, or received by,

any person in return for services rendered, or to be rendered, by that person or another.

“Governmental Subdivision” means any city, county, township, school district, drainage district or

other governmental subdivision of the state having authority to receive or hold public moneys or

funds.

“Preceding Calendar Year” has its usual meaning, except that in the case of candidates and

individuals newly appointed to office or employment, it means the 12 months immediately preceding a

required filing date.

WHO SHALL FILE AND WHEN

Statements of Substantial Interests shall be filed by the following individuals at the times specified:

1. By a candidate for local office who becomes a candidate on or before the filing deadline for the

office, not later than 10 days after the filing deadline, unless before that time the candidacy is

officially declined or rejected.

2. By a candidate for local office who becomes a candidate after the filing deadline for that office,

within five days of becoming a candidate, unless within that period the candidacy is officially

declined or rejected.

3. By an individual appointed between January 1 and April 30 to fill a vacancy in an elective office

of a governmental subdivision, between April 15 and April 30, inclusive, of that year.

4. By an individual appointed after April 30 of any year to fill a vacancy in an elective office of a

governmental subdivision, within 15 days after the appointment.

5. By an individual holding an elective office of a governmental subdivision, between April 15 and

April 30, inclusive, of any year if, during the preceding calendar year, any change occurred in

the individual’s substantial interests.
