the Decree <strong>of</strong> Superior Court in and for Alameda<br />
County in Case numbered 5406, entitled William<br />
P. Toler, et al, vs. Jose C. Peralta, Administrator,<br />
et al, on file in the <strong>of</strong>fice <strong>of</strong> the County<br />
Clerk <strong>of</strong> the said County <strong>of</strong> Alameda,<br />
are hereby ratified, confirmed and approved.<br />
SECTION 2. The proceedings <strong>of</strong> this Board whereby the<br />
aforesaid Tormey Estate Company has quitclaimed to the City <strong>of</strong> <strong>Oakland</strong><br />
by.a deed dated July 30th, 12 .5, and whereby the City <strong>of</strong> <strong>Oakland</strong><br />
has acquired from the said Company by said deed all <strong>of</strong> its<br />
riht, title, claim or interest in or to the real property located<br />
in the port area <strong>of</strong> the City <strong>of</strong> <strong>Oakland</strong>, County <strong>of</strong> Alameda, State<br />
<strong>of</strong> California, particularly described in Section 4 <strong>of</strong> <strong>Port</strong> Ordinance<br />
No. 34 heret<strong>of</strong>ore ado p ted by this Board, are hereby ratified, confirmed<br />
and approved.<br />
SECTION 5. It is hereby found and determined that the<br />
real properties referred to in the aforesaid Sections No. 1 and 2<br />
are necessary and convenient for the purposes set forth in said <strong>Port</strong><br />
Ordinance No. 34.<br />
SECTION 4. The acquisition by the City <strong>of</strong> <strong>Oakland</strong>, pursuant<br />
to <strong>Port</strong> Ordinance No. 34, by deed <strong>of</strong> the real properties referred<br />
to in Section 3 <strong>of</strong> said Ordinance, subject to the taxes now existing<br />
on said property and also to a lien for mort , age indebtedness in<br />
favor <strong>of</strong> M. J. Fontana, which mortga ge indebtedness the grantors to<br />
said deed, expressly agreed to assume and pay in full, and those<br />
certain written agreements under dates <strong>of</strong> July 12, 1128 and August<br />
6th, 1125, entered into by the President <strong>of</strong> this Board with said<br />
grantors in connection with the acquisition <strong>of</strong> said properties,<br />
are hereby ratified, confirmed and approved.<br />
SECTION 5. This ordinance shall take effect imme iately.<br />
