ABSENT :None. the Decree of Superior Court in and for Alameda County in Case numbered 5406, entitled William P. Toler, et al, vs. Jose C. Peralta, Administrator, et al, on file in the office of the County Clerk of the said County of Alameda, are hereby ratified, confirmed and approved. SECTION 2. The proceedings of this Board whereby the aforesaid Tormey Estate Company has quitclaimed to the City of Oakland by.a deed dated July 30th, 12 .5, and whereby the City of Oakland has acquired from the said Company by said deed all of its riht, title, claim or interest in or to the real property located in the port area of the City of Oakland, County of Alameda, State of California, particularly described in Section 4 of Port Ordinance No. 34 heretofore ado p ted by this Board, are hereby ratified, confirmed and approved. SECTION 5. It is hereby found and determined that the real properties referred to in the aforesaid Sections No. 1 and 2 are necessary and convenient for the purposes set forth in said Port Ordinance No. 34. SECTION 4. The acquisition by the City of Oakland, pursuant to Port Ordinance No. 34, by deed of the real properties referred to in Section 3 of said Ordinance, subject to the taxes now existing on said property and also to a lien for mort , age indebtedness in favor of M. J. Fontana, which mortga ge indebtedness the grantors to said deed, expressly agreed to assume and pay in full, and those certain written agreements under dates of July 12, 1128 and August 6th, 1125, entered into by the President of this Board with said grantors in connection with the acquisition of said properties, are hereby ratified, confirmed and approved. SECTION 5. This ordinance shall take effect imme iately. AT a regular meettg held August 20th, 1928. That he is now and at all times hereinafter mentioned, was the principal clerk of the TRIBUNE PUBLISHING COMPANY, a corporation, the publisher and printer of the OAKLAND TRIBUNE, which was during all the time hereinafter mentioned, and now is a newspaper of general circulation, as that term is defined by Section 4460 of the Political Code, and as provided Iry said Section, is printed and published in the City of Oakland, County of Alameda, State of California, for the dissemination of local and telegraphic news and intelligence of a general character, having a bona fide subscription list of paying subscribers, and is not devoted to the interests or published for the entertainment or instruction of a particular class, profession, trade, calling, race or denomination or for any number of such classes, professions, trades, callings, races or denominations, and as such clerk has now and at all of said times had charge of all advertisements in said newspaper.
