Dear Friends,<br />
A powerful energy is created when individuals and community partners work together to meet<br />
a common goal — needs are met and lives are changed. I am proud <strong>of</strong> the integral role the <strong>Legal</strong><br />
<strong>Aid</strong> <strong>Society</strong> <strong>of</strong> <strong>San</strong> <strong>Mateo</strong> <strong>County</strong> continues to play, ensuring that vulnerable and low-income<br />
children, families and seniors living in our <strong>County</strong> are represented at all levels. Whether our staff<br />
provided direct legal services to our clients or advocated to make systemic changes on behalf<br />
<strong>of</strong> many; whether we provided educational outreach and training to government and non-pr<strong>of</strong>it<br />
employees to identify and resolve legal issues before they become deeper problems; or whether<br />
a volunteer became part <strong>of</strong> a <strong>Legal</strong> <strong>Aid</strong> program and <strong>of</strong>fered his or her services — <strong>Legal</strong> <strong>Aid</strong> was there.<br />
Last year our attorneys opened nearly 3,000 case files. It was also an incredible year <strong>of</strong><br />
pro bono service. In fact, nearly 400 attorneys volunteered over 13,000 hours providing<br />
legal representation to those in need. These talented attorneys joined together to provide<br />
urgent legal assistance at housing clinics, share-<strong>of</strong>-cost clinics, IEP hearings in local<br />
schools, and at domestic violence restraining order hearings and guardianship hearings<br />
at the <strong>San</strong> <strong>Mateo</strong> <strong>County</strong> Superior Court. Thank you all for your continued commitment<br />
to vulnerable and low-income people living in our community.<br />

One pro bono case received well-deserved attention from the State Bar <strong>of</strong> California and from the press. Niki Okcu, <strong>of</strong><br />
Cotchett, Pitre & McCarthy LLP, and her team, fought a complicated financial elder abuse case on behalf <strong>of</strong> a <strong>Legal</strong> <strong>Aid</strong><br />
client, Pauline Reade, for over two years. Pauline had been tricked by a scam artist handyman into signing a mortgage<br />
against her home. She came to <strong>Legal</strong> <strong>Aid</strong> after she received an eviction notice. The case involved multiple parties<br />
including an accountant, numerous banks, and mortgage lenders. In January <strong>of</strong> this year, an historic settlement was<br />
reached. Thanks to Niki and her team, the deed to Mrs. Reade’s home was restored to her. The State Bar <strong>of</strong> California<br />
recognized this remarkable work and, in September, presented the Cotchett, Pitre & McCarthy LLP team with its<br />
President’s Pro Bono Service Award.<br />
Last year, <strong>Legal</strong> <strong>Aid</strong> staff worked harder than ever to build on relationships with other service providers so that we<br />
could meet the needs <strong>of</strong> the community together. Our attorneys were called upon to provide educational training to<br />
government employees on the issues and legal rights <strong>of</strong> our clients in order to identify and resolve issues before they<br />
become systemic problems. Our attorneys were appointed by the <strong>San</strong> <strong>Mateo</strong> <strong>County</strong> Board <strong>of</strong> Supervisors to serve<br />
on the Community Health Reform Advocacy Committee, and we worked with the Children’s Health Initiative and the<br />
Health Plan <strong>of</strong> <strong>San</strong> <strong>Mateo</strong> in preparation for the new Low Income Health Program that is being implemented for the<br />
Medi-Cal Expansion population. And, through numerous seminars at community centers throughout the <strong>County</strong>,<br />
our Senior Advocates Program educated hundreds <strong>of</strong> our community’s seniors on how to spot scam artists.<br />
In the coming year, <strong>Legal</strong> <strong>Aid</strong>’s Board <strong>of</strong> Directors and I remain steadfast in our commitment to being leaders, planners,<br />
stewards, fundraisers, and partners so this vital community organization can continue its 53 year old heritage <strong>of</strong><br />
providing high quality legal services. Therefore, this year’s strategic planning process includes input from a wide
variety <strong>of</strong> stakeholders including community partners, the private bar, funders, donors, advisors and other legal<br />
service organizations and will act as a roadmap to guide us in our future program planning. We welcome back<br />
M. Stacey Hawver as she assumes the position <strong>of</strong> Executive Director once again. Stacey’s qualifications are well<br />
known throughout the community. Our Board is excited by her renewed vision for <strong>Legal</strong> <strong>Aid</strong>, and her leadership<br />
<strong>of</strong> our staff. The Board and I <strong>of</strong> course want to extend our thanks to the entire <strong>Legal</strong> <strong>Aid</strong> staff for their ongoing<br />
commitment and expertise.<br />
Like so many others, <strong>Legal</strong> <strong>Aid</strong> is experiencing funding shortfalls, and at the same time, more people need our help.<br />
We are doing all we can to respond to a predicted 10% shortfall in budgeted revenue, some <strong>of</strong> which comes from<br />
cities grappling with the impact <strong>of</strong> the State’s budget crisis on their own funds. Some private foundation funders who<br />
have experienced their own reduction in assets are continuing their loyal support <strong>of</strong> our work, but at a lesser level.<br />
Still, I believe in the powerful energy that is created when we work together, and I am confident our mutual investment<br />
will ensure <strong>Legal</strong> <strong>Aid</strong>’s continued financial health. Throughout this report you will see instances where our neighbors’<br />
needs were met and their lives changed, all because <strong>of</strong> the powerful energy and commitment <strong>of</strong> our staff, pro bono<br />
attorneys, volunteers, community partners, and you. The imperative for the delivery <strong>of</strong> legal services through the<br />
<strong>Legal</strong> <strong>Aid</strong> <strong>Society</strong> <strong>of</strong> <strong>San</strong> <strong>Mateo</strong> <strong>County</strong> is stronger than ever.<br />

When Mia was 14 years old, Chad, an adult man whose mother<br />
worked in her high school’s <strong>of</strong>fice, convinced Mia to date him.<br />
Very soon Mia was pregnant. During her pregnancy, Chad<br />
began abusing and raping her, telling her he had gang connections and<br />
would have Mia and her parents killed if she told anyone about the abuse.<br />
He also threatened he could have Mia and her entire family deported<br />
whenever he wished. Mia was terrified. She hid her injuries from her<br />
parents and remained silent. When Chad came to the hospital after her<br />
daughter’s birth, he slapped Mia in the face. Mia knew she had to protect<br />
her baby and finally told her parents about the abuse. Although Mia’s parents<br />
were afraid to go to the police, they did. With their encouragement, Mia<br />
told the police about the abuse and threats and made a “pretext call” to<br />
her abuser so the police could record his admissions. During the phone<br />
call, Chad told Mia he would kill her parents if she went to the police.<br />
The police issued an emergency protective order and referred Mia and<br />
her parents to a temporary restraining order clinic. The clinic helped Mia<br />
get a temporary restraining order and referred her to <strong>Legal</strong> <strong>Aid</strong>’s Teen<br />
Parents’ Project.<br />
For over a year, Mia’s <strong>Legal</strong> <strong>Aid</strong> attorney made multiple court appearances,<br />
while Mia’s abuser continued to violate the temporary restraining order<br />
and fight the permanent restraining order request. During the court<br />
appearances, Chad lied in court, saying Mia was hurting the baby, and<br />
he posted derogatory comments about Mia on her Facebook page. To<br />
keep Mia safe and protect her from further abuse, the attorney helped<br />
Mia transfer to a different high school.<br />
Finally, after a year, Mia’s abuser pled no contest to felony statutory rape<br />
and witness tampering. He is now in jail. The family court issued a threeyear<br />
restraining order protecting Mia, her daughter and her parents from<br />
her abuser and gave Mia sole custody <strong>of</strong> her daughter. In addition, the<br />
attorney helped Mia file for a U VISA for herself and her parents. The US<br />
Citizenship and Immigration Services approved Mia’s request and now<br />
Mia’s family is together and safe and Mia is a junior in high school planning<br />
to attend college.<br />

• Represented the low-income<br />
community at 115 meetings with<br />
community coalitions, government<br />
agencies and community based<br />
organizations aimed at increasing<br />
access to health care and health<br />
coverage for the low-income<br />
community<br />
Alicia is a severely disabled woman; she is deaf and unable to read<br />
or communicate. Since Alicia’s disabilities are so complex, her<br />
health care affairs are dealt with through an Independent Program<br />
Plan managed by the Golden Gate Regional Center. When the Regional<br />
Center tried to schedule a regular medical appointment for Alicia they were<br />
told Alicia’s Medi-Cal coverage had been discontinued. Apparently, the<br />
annual renewal form had not been completed. Upon further investigation,<br />
it was found that Medi-Cal had incorrectly mailed the renewal form to<br />
Alicia’s home instead <strong>of</strong> the Regional Center.<br />
As a result <strong>of</strong> <strong>Legal</strong> <strong>Aid</strong>’s Health Consumer Center’s (HCC) outreach<br />
into the community, the Regional Center knew to call <strong>Legal</strong> <strong>Aid</strong>. The<br />
HCC attorney immediately requested a Medi-Cal hearing concerning the<br />
discontinuance, and upon further research, discovered that Alicia qualified<br />
for a special Medi-Cal program called the Working Disabled Program. This<br />
program allowed Alicia to continue with Medi-Cal and only pay a small<br />
monthly premium rather than the large monthly share <strong>of</strong> cost she was<br />
previously paying. Once the attorney had Alicia enrolled in the Working<br />
Disabled Program, she provided the Regional Center with additional<br />
training and material on what to do in the future if Alicia’s Medi-Cal was<br />
cut <strong>of</strong>f again. Alicia and her representatives at the Regional Center are<br />
grateful that Alicia can now afford to obtain the medical care she needs.<br />

A<br />
few years ago, Tuan, his wife and their children lived in a twobedroom<br />
apartment, working hard every day to pursue their<br />
dreams. But all that changed very quickly when Tuan was in a<br />
serious car accident and suffered a traumatic brain injury. Tuan was no<br />
longer able to work, and although the family had a housing subsidy voucher<br />
that helped cover a portion <strong>of</strong> the monthly rent, it was not enough. The<br />
family fell behind on their rent, and Tuan’s wife and children left him,<br />
leaving Tuan alone, disabled and unable to pay the rent. Eventually, Tuan’s<br />
landlord threatened to evict him. Tuan was at risk <strong>of</strong> losing his housing<br />
subsidy voucher because, under the Housing Authority rules, a tenant<br />
cannot keep the voucher if back rent is owed. Fortunately, through Tuan’s<br />
Vietnamese community, Tuan learned about <strong>Legal</strong> <strong>Aid</strong> and the housing<br />
clinic held at Fair Oaks Community Center in Redwood City.<br />
With the help <strong>of</strong> a <strong>Legal</strong> <strong>Aid</strong> attorney who is fluent in Vietnamese, Tuan<br />
was able to communicate his needs and the attorney could explain clearly<br />
what was happening at every step <strong>of</strong> the way. The attorney negotiated<br />
with the landlord to forgive all the back rent in return for Tuan’s departure<br />
by a certain date. Even though Tuan had nowhere to live, his housing<br />
subsidy voucher was saved. However, because <strong>of</strong> Tuan’s inability to speak<br />
or read English fluently, and because <strong>of</strong> his mental disability and lack <strong>of</strong><br />
income, he had tremendous difficulty finding a new home. Eventually the<br />
Housing Authority advised Tuan the time for him to use the voucher for<br />
new housing had expired and he would no longer receive the housing<br />
subsidy. Once again, Tuan contacted <strong>Legal</strong> <strong>Aid</strong>. The attorney intervened<br />
on his behalf and successfully argued that Tuan’s voucher should not<br />
be taken away because the delay in finding housing was caused by his<br />
disability; and therefore, he was entitled to accommodations under the<br />
fair housing laws that protect people with disabilities. The argument was<br />
successful and the Housing Authority extended the time for Tuan to find a<br />
home. On the last day <strong>of</strong> the extension, Tuan found an apartment to rent,<br />
only to face one more hurdle — Tuan did not have money for the $1200<br />
deposit. Because <strong>of</strong> a partnership with another community agency in <strong>San</strong><br />
<strong>Mateo</strong> <strong>County</strong>, <strong>Legal</strong> <strong>Aid</strong> was able to help Tuan with the deposit. Tuan<br />
finally received the keys to his new home and is no longer homeless.<br />

Training & Resource Fair, in English<br />
and Spanish, for families <strong>of</strong> children<br />
with special needs<br />
Marta was worried about her 5 year old son, Gabriel. Gabriel’s<br />
speech and cognitive behaviors seemed to be delayed and<br />
he was not making progress at school. She had taken Gabriel<br />
to Lucile Packard Children’s Hospital for an assessment and his medical<br />
team recommended the school district provide Gabriel with an Individualized<br />
Education Program (IEP) with specific services to meet his special needs.<br />
As a result <strong>of</strong> trainings provided by <strong>Legal</strong> <strong>Aid</strong>’s Peninsula Family Advocacy<br />
Program on the topic <strong>of</strong> educational rights <strong>of</strong> children with disabilities,<br />
Gabriel’s medical providers at Lucile Packard Children’s Hospital referred<br />
Marta to <strong>Legal</strong> <strong>Aid</strong> for help.<br />
When Marta came to <strong>Legal</strong> <strong>Aid</strong> she brought many documents she had<br />
received from the school district. Marta only spoke Spanish and could<br />
not read or write in any language, so she did not understand any <strong>of</strong> the<br />
documents. She only knew she loved her son and wanted to help him.<br />
Through a translator, the <strong>Legal</strong> <strong>Aid</strong> attorney explained to Marta that she<br />
and Gabriel had legal rights to help him access the educational services<br />
he needed. The attorney gave Marta a handbook about the IEP process<br />
written in Spanish, and helped Marta to identify a family member who<br />
could read through the booklet with her so she could learn about the<br />
IEP process. Marta was surprised that she and Gabriel had so many<br />
legal rights.<br />
While representing the family at the IEP meetings, the <strong>Legal</strong> <strong>Aid</strong> attorney<br />
explained to Marta at every step what was happening and why, not only<br />
serving as her advocate but also empowering Marta to have her own<br />
voice. At the final IEP meeting, Marta eloquently explained to the school<br />
district why Gabriel needed certain specialized services.<br />
As a result <strong>of</strong> <strong>Legal</strong> <strong>Aid</strong>’s help, the school agreed to give Gabriel the<br />
placement and services recommended by the specialists at Lucile Packard<br />
Children’s Hospital. Marta later reported that she was seeing her son<br />
make progress in school and, because she understood their rights, was<br />
no longer afraid to speak up and help her son get the educational services<br />
he needed.<br />

Last August, 63 year old Elena Delgado walked into <strong>Legal</strong> <strong>Aid</strong>’s<br />
Daly City Housing Clinic clutching a 60-Day Notice to vacate her<br />
Daly City home. She met with a Spanish speaking clinic volunteer<br />
and a <strong>Legal</strong> <strong>Aid</strong> attorney who quickly ascertained there was much more<br />
going on than a typical eviction — this notice had been issued to Mrs.<br />
Delgado by her sister!<br />
Ten years ago, Mrs. Delgado’s husband passed away and soon after<br />
she suffered a severe stroke. Feeling overwhelmed and believing she<br />
needed help managing her finances, Mrs. Delgado gave her sister power<br />
<strong>of</strong> attorney for her estate and they created a trust. They bought and sold a<br />
few houses together until several years ago when they bought the home<br />
in Daly City where Mrs. Delgado was living. Then, Mrs. Delgado’s sister<br />
decided she wanted to sell the Daly City house. Mrs. Delgado initially<br />
agreed and was going to move into an apartment that her sister owned,<br />
but things went sour. Her sister claimed Mrs. Delgado owed her $80,000<br />
but had no pro<strong>of</strong> or receipts to back up the claim. Unfortunately, the Daly<br />
City home was in her sister’s name and it didn’t look like Mrs. Delgado<br />
could stop the sale.<br />
<strong>Legal</strong> <strong>Aid</strong>’s senior advocate attorney met with Mrs. Delgado and<br />
immediately knew this was a financial elder abuse case; a case that<br />
would require the power and resources <strong>of</strong> a pro bono attorney and law<br />
firm. The case began as an unlawful detainer but was dismissed by the<br />
sister after the pro bono attorney filed a civil complaint for several causes<br />
including elder abuse and quiet title. A temporary restraining order was<br />
then granted by the Court stopping Mrs. Delgado’s sister from selling<br />
the property. After 10 months and 674 firm wide pro bono hours, Mrs.<br />
Delgado’s sister decided it would be in her best interest to resolve the case<br />
through mediation and Mrs. Delgado now has full ownership <strong>of</strong> her home.<br />

The <strong>Legal</strong> <strong>Aid</strong> <strong>Society</strong> <strong>of</strong> <strong>San</strong> <strong>Mateo</strong> <strong>County</strong> is a private<br />
non-pr<strong>of</strong>it law firm created in 1959 to provide free civil<br />
legal services to low-income residents <strong>of</strong> <strong>San</strong> <strong>Mateo</strong><br />
<strong>County</strong> who are particularly vulnerable due to age,<br />
disability, language, or family violence.<br />
<strong>Legal</strong> <strong>Aid</strong>’s mission is to help disadvantaged people<br />
improve their lives through equal access to justice.<br />
<strong>Legal</strong> <strong>Aid</strong> provides individual representation, community<br />
education, systemic advocacy and strategic collaborative<br />
approaches to address legal issues and resolve problems<br />
in important areas <strong>of</strong> basic need including health, housing,<br />
income, and freedom from violence.<br />
<strong>Legal</strong> <strong>Aid</strong> is an integral part <strong>of</strong> <strong>San</strong> <strong>Mateo</strong> <strong>County</strong>’s<br />

<strong>Legal</strong> <strong>Aid</strong> leverages its resources by recruiting, training,<br />
and supervising nearly 400 pro bono attorneys and legal<br />
workers who provide thousands <strong>of</strong> hours <strong>of</strong> free legal<br />
services each year. As an independent legal service provider,<br />
the <strong>Legal</strong> <strong>Aid</strong> <strong>Society</strong> <strong>of</strong> <strong>San</strong> <strong>Mateo</strong> <strong>County</strong> is not bound by<br />
restrictions imposed by federal legal services funding.
