Licensed Class (A,B or C) Virginia Contractor No. Specialty: __________________________ If the Bidder shall fail to provide this information on his bid or on the envelope containing the bid and shall fail to promptly provide said Contractor license number to Fauquier County in writing when requested to do so before or after the opening of Bids, he shall be deemed to be in violation of Section 54-1115 of the Code of Virginia (1950), as amended, and his bid will not be considered. 7.0 Evaluation and Award: 7.1 Bid Form: Bids shall be made and signed on the Bid Form furnished to Bidders. Bid prices shall be in the form of a firm fixed lump sum price to complete the project and the additional work as noted on the Bid Form. Prices shall include ALL taxes, including sales and other taxes levied by all government agencies as relating to the project. Bidders shall also include the estimated time for completion of this project in days after receipt of Notice to Proceed, where indicated on the Bid Form. Time may be a factor in the award of this solicitation. 7.2 Award: The Contract, if awarded, will be awarded to the lowest responsive and responsible Bidder, if any, provided his bid is reasonable, time of completion is acceptable, and both are in the best interest of the Owner to accept it and subject to the Owner’s right to reject any and all bids and to waive informality in the bids and in the bidding. The award document will be a Fauquier County Purchase Order incorporating by reference the contract documents specified herein. 7.3 Qualification of Bidder: 7.3.1 It is required, as a condition for bidding, that all Bidders complete the attached Contractor Data Sheet and show sufficient evidence of previous satisfactory experience in constructing at least three projects of comparable size. If the Bidder is deemed to be the apparent low Bidder, the Owner reserves the right to require a listing of such projects, including more specific information to adequately permit checking of references for such project(s). The Owner reserves the right to reject any bid if evidence submitted by, or investigation of, any Bidder fails to satisfy the Owner that the Bidder is properly qualified to carry out the obligations of the contract to complete the work contemplated. 7.4 Negotiations with the Low Bidder: 7.4.1 In the event the low bid exceeds the construction estimate on file with the Procurement Division, prior to advertising, the Owner may elect to negotiate with the low Bidder to try to effect a mutually agreeable price that can be funded with the approved funds that are available for the project. 7.4.2 In the event the Owner elects to negotiate, the low Bidder will be notified in writing. Further, the low Bidder must agree to submit his work papers which document the cost of the elements making up the Bid. 7.5 Rejection of Bids: The Owner reserves the right to cancel the invitation for bids or to reject any and all bids when such rejection is in the interest of the Owner, and to reject the bid of a bidder who is not in a position to perform the contract. amended). 8. Instructions for Submitting Bids: 8.1 Examination of Contract Documents and Site: It is the responsibility of each Bidder before submitting a Bid, to (a) examine the Contract Documents thoroughly, (b) visit the site to become familiar with local conditions that may affect cost, progress, performance or furnishing of the work, (c) consider federal, state and local laws and regulations that may affect cost, progress, performance or furnishing the work, (d) study and carefully correlate Bidder’s observations with the Contract Documents. No allowance will be made subsequently in this connection for failure to comply with the above. The General Contractor is responsible for seeing that all subcontractors comply with the above site visitation requirements. 8.2 Preparation of Bids: 8.2.1 All blank spaces for bid prices must be filled in, in ink or typed, in both words and figures, with the lump sum for which the bid is made. 8.2.2 Identification of Bid Envelope The signed bid should be returned in a separate envelope or package, sealed and identified as follows: From: IFB#104-13sm Heat Pump/AC Unit Replacement, Taylor Middle School Name of Bidder Due Date Time Street or Box Number IFB No. City, State, Zip Code IFB Title Licensed Class VA Contractor License Number Specialty The envelope should be addressed as directed above. If a bid is not contained in an envelope and addressed as indicated above, the Bidder takes the risk that the envelope may be inadvertently opened and the information compromised which may cause the bid to be disqualified. 8.2.3 If forwarded by mail, the sealed envelope containing the proposal, marked as directed above, must be enclosed in another outside envelope addressed as specified in the bid form, preferably by registered mail. 8.2.4 Facsimile or Electronically submitted Bids will not be accepted and will result in rejection of the bid. 8.3 Receipt and Opening of Bids: 8.3.1 Bids will be received at the time and place designated in the Instructions to Bidders, then be publicly opened and read aloud. Bids shall be submitted in duplicate on the forms furnished, or copies thereof, and shall be signed in ink or typed. Erasures or other changes in a bid must be explained or noted over the signature of the Bidder. Bids containing any conditions, omissions, unexplained erasures, alterations or items not called for in the proposal, or irregularities of any kind, may be rejected by the Owner. 8.3.2 Bids by corporations must be executed in the corporate name by the president or vicepresident (other corporate officers may be required to provide evidence of authority to sign) and the corporate seal must be affixed and attested by the secretary or assistant secretary. 5
