The owner of any building or structure for which sewage disposal is required and which is connected to an approved public or private sewer shall not disconnect the building or structure from such public or private sewer. 6. If the public or private sewer system provider does not have the necessary capacity to permit the connection to the sewer system, the landowner may install an individual sewage disposal system upon the grant of a special exception pursuant to section 3- 330 of the County Zoning Ordinance and any other approval required under this Code or the Zoning Ordinance. 7. For an existing lot of record, either residential or commercial, where the public or private sewer system provider does not have the necessary capacity to permit the connection to the sewer system and the anticipated wastewater flow rates are no greater than 900 gallons per day, the landowner may apply for an administrative permit to install an individual sewage disposal system. The landowner shall record an agreement with WSA to cease using the individual sewage disposal system and connect to the public or private sewer immediately when capacity becomes available. This agreement shall include any additional conditions as necessary to protect both ground and surface waters and public health. Sec. 17-6. Permit and Plat Requirements 1. No individual sewage disposal system shall be constructed or installed without an approved construction permit. The construction permit shall include all details and specifications necessary for construction of the system. After the individual sewage disposal system has been properly installed and passed all required inspections and tests, the Health Department shall issue an operation permit authorizing the use of the system. 2. The following statement shall be included on the drainfield plat: “Drainfield and reserve area(s) must be surrounded by safety fence prior to land disturbance and throughout site construction. Safety fence shall be installed 20 feet outside of drainfield and reserve area(s). If the drainfield and/or reserve area(s) are located less than 20 feet off of a property line, safety fence shall be installed on the property line.” 3. Subdivision A. Plans and specifications of the sewer system or sewage disposal system to be used, together with plans for the anticipated water system to be used in the structure or structures, shall be provided prior to the start of any new subdivision for which individual sewage disposal systems are required. These plans and specifications shall be submitted with the first submission of the Preliminary Plan. The Licensed Conventional Onsite Evaluator (LCOSE) or Licensed Alternative Onsite Evaluator (LAOSE), who shall also be a Virginia Certified Professional Soil Scientist (CPSS), providing the 4

plans and specifications for the sewage disposal systems shall sign the following certification statement and seal, with both LCOSE or LAOSE and CPSS seal, the Preliminary Plan sheet showing the location of the individual sewage disposal system(s). The plans and specifications for the sewage disposal system and anticipated water system must be approved by the Health Department and the Fauquier County Soil Scientist’s Office before the Preliminary Plan is approved. I hereby certify that my soil and site evaluation(s), sewer disposal system design(s) and/or size(s) and location(s) of the sewage disposal field(s) as shown on sheet __ of the Preliminary Plan complies with all applicable laws, regulations and policies implied by the Virginia Department of Health and Fauquier County. Furthermore, I certify that all required statements concerning said individual sewage disposal systems have been include on sheet ___ of the _____________________ Preliminary Plan. ____________________________________________________________ Signature Date B. The LCOSE or LAOSE/CPSS shall review the Construction Plans. The LCOSE or LASOE/CPSS shall ensure that the grading plan and final location of the infrastructure does not impact the sewage disposal system or its required buffer zones. The LCOSE or LAOSE/CPSS shall sign and seal, with both LCOSE or LAOSE and CPSS seal, the following statement: I hereby certify that my soil and site evaluation(s), sewer disposal system design(s) and/or size(s) and location(s) of the sewage disposal field(s) as shown on sheet __ of the Construction Plan complies with all applicable laws, regulations and policies implied by the Virginia Department of Health and Fauquier County. Furthermore, I certify that all required statements concerning said individual sewage disposal systems have been include on sheet ___ of the _____________________ Construction Plan. ____________________________________________________________ Signature Date C. In the case of a new subdivision, before a Final (Record) Plat is approved, the LCOSE or LAOSE/CPSS shall review the Final Plat, ensuring that the sewage disposal systems are accurately located on the plat and that all required statements concerning the sewage disposal systems are included on the plat. The LCOSE or LAOSE/CPSS shall sign and seal, with both LCOSE or LAOSE and CPSS seal, the following statement: 5
