WHEREAS, agreements between Fayette County, Iowa (the “County”) and the owners (the “Property Owners’) of certain residential properties situated at 703 Christians Trail, 705 Christians Trail, 706 Christians Trail and 708 Collins Trail (the “Properties”) have been prepared (the “Agreements”), pursuant to which the Property Owners have agreed to construct and occupy residences on the Properties (the “Project”) and the County has agreed to provide rebates for a period of ten years of property taxes paid which are attributable to the County tax levy portion of the total property taxes levied; and WHEREAS, this Board of Supervisors, pursuant to Chapter 15A of the Code of Iowa, has published notice, has held a public hearing on the Agreements on December 10, 2012, and has otherwise complied with statutory requirements for the approval of the Agreement; and WHEREAS, Chapter 15A of the Code of Iowa (“Chapter 15A”) declares that economic development is a public purpose for which a County may provide grants, loans, tax incentives, guarantees and other financial assistance to or for the benefit of private persons; and WHEREAS, Chapter 15A requires that before public funds are used for grants, loans, tax incentives or other financial assistance, a Board of Supervisors must determine that a public purpose will reasonably be accomplished by the spending or use of those funds; and WHEREAS, Chapter 15A requires that in determining whether funds should be spent, a Board of Supervisors must consider any or all of a series of factors; NOW, THEREFORE, It Is Resolved by the Board of Supervisors of the Fayette County, Iowa, as follows: Section 1. Pursuant to the factors listed in Chapter 15A, the Board hereby finds that: (a) The Project will add diversity and generate new opportunities for the Coon Rapids and Iowa economies; (b) The Project will generate public gains and benefits, particularly in the creation of new jobs and residential development, which are warranted in comparison to the amount of the proposed property tax incentives. Section 2. The Board further finds that a public purpose will reasonably be accomplished by entering into the Agreement and providing the property tax rebates to the Property Owners Section 3. The Agreements are hereby approved and the Chairperson and County Auditor are hereby authorized and directed to execute and deliver the Agreements on behalf of the County, in substantially the form and content in which the Agreements have been presented to this Board of Supervisors, and such officers are also authorized to
make such changes, modifications, additions or deletions as they, with the advice of bond counsel, may believe to be necessary, and to take such actions as may be necessary to carry out the provisions of the Agreements. Section 4. All resolutions or parts thereof in conflict herewith are hereby repealed. On roll call, Rowland and Dolf voted aye, Tellin nay, and the resolution was adopted. Motion was made by Rowland and seconded by Dolf to open the public hearing regarding approving the 9 points and the submittal of the CDBG grant on behalf of the Kaleidoscope Kids at 10:30 A.M. On roll call, all voted aye, none nay, and the motion was carried. Motion was made by Rowland and seconded by Dolf to close the public hearing at 10:35 A.M. On roll call, all voted aye, none nay, and the motion was carried. Motion was made by Rowland and seconded by Dolf to adopt the following resolution: Resolution #219 A RESOLUTION of the COUNTY OF FAYETTE, IOWA AUTHORIZING the SUBMISSION of a CDBG APPLICATION to the IOWA ECONOMIC DEVELOPMENT AUTHORITY and the EXPENDITURE OF FUNDS to be applied to LOCAL MATCH for a Community Facilities and Services Fund Application for the construction of a 8,500 sq. foot daycare center at the site of the former city swimming pool along North Pine Street in West Union. WHEREAS, the County of Fayette will submit a CDBG Community Facilities and Services Fund Application to the Iowa Economic Development Authority in the amount of $800,000 and WHEREAS, the Iowa Economic Development Authority is requiring cities that provide funds for local effort pass a resolution authorizing such expenditure, pending approval of the application, and WHEREAS, the County of Fayette recognizes the benefits that would result from the approval of a Community Facilities and Services Fund Application. NOT, THEREFORE, BE IT RESOLVED, by the County of Fayette, Iowa as follows: 1. The City supports and endorses this CDBG application; and 2. The City authorizes appropriate public officials to submit this application on or before January 16, 2013 and 3. The County authorizes the administration of this grant to be performed by Upper Explorerland Regional Planning Commission. These funds will be applied to the Community Facilities and Services application pending approval of the application.
