Article 43*<br />
Internati<strong>on</strong>al cooperati<strong>on</strong><br />
1. States Parties shall cooperate in criminal matters in accordance with articles 44 to 50 of<br />
this C<strong>on</strong>venti<strong>on</strong>. Where appropriate and c<strong>on</strong>sistent with their domestic legal system, States<br />
Parties shall c<strong>on</strong>sider assisting each other in investigati<strong>on</strong>s of and proceedings in civil and<br />
administrative matters relating to corrupti<strong>on</strong>.<br />
2. In matters of internati<strong>on</strong>al cooperati<strong>on</strong>, whenever dual criminality is c<strong>on</strong>sidered a<br />
requirement, it shall be deemed fulfilled irrespective of whether the laws of the requested<br />
State Party place the offence within the same category of offence or denominate the offence<br />
by the same terminology as the requesting State Party, if the c<strong>on</strong>duct underlying the offence<br />
<str<strong>on</strong>g>for</str<strong>on</strong>g> which assistance is sought is a criminal offence under the laws of both States Parties.<br />

Asset recovery. In a major breakthrough, countries agreed <strong>on</strong> asset-recovery,<br />
which is stated explicitly as “a fundamental principle of the C<strong>on</strong>venti<strong>on</strong>…” This<br />
is a particularly important issue <str<strong>on</strong>g>for</str<strong>on</strong>g> many developing countries where highlevel<br />
corrupti<strong>on</strong> has plundered the nati<strong>on</strong>al wealth, and where resources are<br />
badly needed <str<strong>on</strong>g>for</str<strong>on</strong>g> rec<strong>on</strong>structi<strong>on</strong> and the rehabilitati<strong>on</strong> of societies under new<br />
governments. Reaching agreement <strong>on</strong> this chapter has involved intensive<br />
negotiati<strong>on</strong>s, as the needs of countries seeking the illicit assets had to be<br />
rec<strong>on</strong>ciled with the legal and procedural safeguards of the countries whose<br />
assistance is sought. Several provisi<strong>on</strong>s specify how cooperati<strong>on</strong> and<br />
assistance will be rendered. In particular, in the case of embezzlement of<br />
public funds, the c<strong>on</strong>fiscated property would be returned to the state<br />
requesting it; in the case of proceeds of any other offence covered by the<br />
C<strong>on</strong>venti<strong>on</strong>, the property would be returned providing the proof of ownership<br />
or recogniti<strong>on</strong> of the damage caused to a requesting state; in all other cases,<br />
priority c<strong>on</strong>siderati<strong>on</strong> would be given to the return of c<strong>on</strong>fiscated property to<br />
the requesting state, to the return of such property to the prior legitimate<br />
owners or to compensati<strong>on</strong> of the victims. Effective asset-recovery provisi<strong>on</strong>s<br />
will support the ef<str<strong>on</strong>g>for</str<strong>on</strong>g>ts of countries to redress the worst effects of corrupti<strong>on</strong><br />
while sending at the same time, a message to corrupt officials that there will<br />
be no place to hide their illicit assets.<br />

General provisi<strong>on</strong><br />
The return of assets pursuant to this chapter is a fundamental principle of this C<strong>on</strong>venti<strong>on</strong>,<br />
and States Parties shall af<str<strong>on</strong>g>for</str<strong>on</strong>g>d <strong>on</strong>e another the widest measure of cooperati<strong>on</strong> and assistance<br />
in this regard.<br />
