8.7 Inspection<br />
A <strong>pool</strong> safety inspector must physically inspect a <strong>pool</strong> be<strong>for</strong>e deciding whether or not it complies<br />
with the <strong>pool</strong> safety st<strong>and</strong>ard. Exceptions may exist in specially declared remote areas.<br />
Once a <strong>pool</strong> safety inspector inspects the <strong>pool</strong>, they must issue either a <strong>pool</strong> safety certificate or a<br />
Form 26 within two business days from inspecting the <strong>pool</strong>.<br />
If a Form 26 is issued <strong>and</strong> the owner does not ask the <strong>pool</strong> safety inspector to reinspect the <strong>pool</strong><br />
within three months (reinspection period), the <strong>pool</strong> safety inspector must give the local government<br />
a copy <strong>of</strong> the Form 26 within five business days. A <strong>pool</strong> owner who engages a second <strong>pool</strong> safety<br />
inspector during the reinspection period without agreement <strong>of</strong> the PSC commits an <strong>of</strong>fence <strong>and</strong><br />
may be fined up to $5500.<br />
Once the local government is provided a copy <strong>of</strong> the Form 26 they may inspect the <strong>pool</strong> <strong>for</strong><br />
compliance with the relevant st<strong>and</strong>ard. If, following inspection, the local government finds the <strong>pool</strong><br />
does not comply with the applicable st<strong>and</strong>ard, the local government can take any necessary<br />
en<strong>for</strong>cement action to ensure the <strong>pool</strong> complies with that st<strong>and</strong>ard. This could include giving an<br />
en<strong>for</strong>cement notice, giving an infringement notice, prosecution, other legal proceedings or carrying<br />
out remedial work in accordance with the Local Government Act 2009 or City <strong>of</strong> Brisbane Act 2010.<br />
This action is separate to the <strong>of</strong>fence <strong>of</strong> failing to call the <strong>pool</strong> safety inspector to reinspect the <strong>pool</strong><br />
within three months.<br />
If the <strong>pool</strong> owner does get the <strong>pool</strong> safety inspector to reinspect the <strong>pool</strong> within the three months<br />
<strong>and</strong> the <strong>pool</strong> safety inspector still believes the <strong>pool</strong> does not comply with the <strong>pool</strong> safety st<strong>and</strong>ard,<br />
the three months recommences. (Note: This does not extend the 90-day compliance period from<br />
date <strong>of</strong> settlement that is required upon the sale <strong>of</strong> a <strong>property</strong>. The legislation does not allow this<br />
date to be extended in any circumstances).<br />
8.8 Con<strong>for</strong>mity<br />
If the <strong>pool</strong> safety inspector is satisfied the <strong>pool</strong> complies with the <strong>pool</strong> safety st<strong>and</strong>ard, they must<br />
give the owner a Form 23 − Pool safety certificate. The certificate must have a unique identification<br />
number <strong>and</strong> must be recorded on the <strong>pool</strong> safety register by the <strong>pool</strong> safety inspector.<br />
A <strong>pool</strong> safety inspector cannot refuse to give a <strong>pool</strong> safety certificate only on the following grounds;<br />
• that there is no development approval <strong>for</strong> the <strong>pool</strong> or barriers<br />
• the <strong>pool</strong> or barriers do not comply with the development approval<br />
• failure <strong>of</strong> a person to pay <strong>for</strong> the inspection or a contractual dispute.<br />
However, the local government or building certifier may take separate en<strong>for</strong>cement action <strong>for</strong><br />
matters relating to the need <strong>for</strong> a building development approval.<br />
8.9 Noncon<strong>for</strong>mity<br />
If the <strong>pool</strong> safety inspector is not satisfied the <strong>pool</strong> complies with the <strong>pool</strong> safety st<strong>and</strong>ard, they<br />
must give the owner a Form 26 within two business days <strong>of</strong> the inspection. The Form 26 states<br />
how the <strong>pool</strong> does not comply with the <strong>pool</strong> safety st<strong>and</strong>ard <strong>and</strong> what needs to be done to make it<br />
comply.<br />
The owner may appeal the <strong>pool</strong> safety inspector’s decision in the Form 26 to a building <strong>and</strong><br />
development dispute resolution committee. The appeal must be made within 20 business days<br />
after the Form 26 is given.<br />
