Admission Tickets

For the convenience of our Exhibitors, four (4) books

containing eleven (11) gate admission tickets are included in

the price of each 10 X 10 exhibit space. Any exhibit space

larger than a 10 X 10, or multiple 10 X 10's will receive eight

(8) books containing eleven (11) gate admission tickets. These

tickets can be picked up at the Exhibitor Services Office in the

rear of South Wing C beside E-16 overhead door along with

your Exhibitor Badges during move-in. Absolutely no tickets

will be mailed. Additional tickets may be purchased during the

run of the Fair in the Exhibitor Services Office. The cost of

each additional book containing eleven (11) tickets is $27.50.

A ticket will be required for each individual each time

entering the gate.

Exhibit Space Audit

The Kentucky State Fair policy requires all exhibit space

assignments to be audited by our on site auditors for size and

activities to ensure both aspects conform to the exhibit space

contract. If the auditors determine an additional charge is

warranted, each Exhibitor will be notified in writing, and must

clear all accounts prior to move-out.

Insufficient Fund/Declined Credit Card

There will be a penalty of $25.00 per transaction charged for

all insufficient fund checks or declined credit card payments.

There will be no exceptions. Failure to pay such charges will

result in the immediate loss of your location.

Insurance

Exhibitors/Concessionaires are required to provide Show

Management with a certificate of liability insurance with

minimum combined limits of liability of $500,000 for bodily

injury and/or property damage in any one occurrence and hold

harmless the Kentucky State Fair Board and its

representatives. Please see Official Rules, Regulations and

General Policies for complete details and requirements.

Kentucky Sales and Use Tax

Persons engaged in making sales of tangible personal property

such as T-shirts, records, buttons, pins, food, etc., are subject

to tax at the rate of 6%. Personnel with the Kentucky Revenue

Cabinet will be visiting each exhibit area throughout the Fair

if you have any questions. On the last day of the Fair the

Revenue Personnel will have a table set-up in the South Wing

C Lobby to collect any taxes owed by the

Exhibitor/Concessionaire.

Notice: UPS and Federal Express deliveries will be made

daily to the Kentucky Exposition Center. Deliveries will be

made to our warehouse by Cardinal Stadium. The warehouse

will deliver the packages to your booth space during show

hours. A normal drayage rate will apply. Absolutely no

C.O.D. parcels will be accepted and all parcels should be

addressed as follows:

Payments/Space Charges

Exhibit spaces available at the Kentucky State Fair are

standard 10 x 10 in-line and corner booths or bulk spaces

which are 400 sq. ft. or larger. Multiple 10 x 10’s are also

available. No less than fifty percent (50%) deposit will be

required upon return of the space contract to guarantee the

assigned exhibit space. Balance deadlines will be stated on the

contract.

Release Forms

A release form is required to remove any exhibit or any part

thereof from the grounds. No release form will be given until

9:00 p.m., August 25, 2013. THERE WILL BE NO

EXCEPTIONS. You may pick up release forms at the

Exhibitor Registration Office at the rear of South Wing C.

Booth/Exhibit Cleaning

The Kentucky Exposition Center provides general hall

cleaning at the close of the show each day. Exhibitors are

requested to place all trash and other debris in the aisles for

pick-up as general cleaning personnel are not allowed to enter

into an exhibit area. Additional booth cleaning, dusting and

vacuuming is available from the Kentucky Exposition Center

at an additional charge. Exhibitors should complete and return

Deliveries-Parcels

Parcels received prior to the 1 st day of the Fair will be

delivered to the booth and a normal drayage rate will be

charged. Once the Fair starts the packages will be delivered to

the Exhibitors booth and a normal drayage rate will be

charged.

Displays and Construction

(a) Standard Exhibit. (One or more exhibit units in a

straight line and no deeper than ten feet.) All standard

exhibits will be confined to a maximum height of eight

feet. All display fixtures over four feet in height and within

ten feet of an adjoining booth, must be confined to the

Exhibitors space within five feet of the backline. Show

Management must approve any exceptions.

(b) Bulk Exhibit. (Exhibit unit deeper than ten feet). All

bulk exhibits will be confined to a maximum height of

twelve feet in any portion of the exhibit. Bulk exhibits may

be allowed a higher height limitation with special

permission by Show Management. All display fixtures

over four feet in height and within ten feet of an adjoining

booth, must be confined to that area of the Exhibitor’s

space within five feet of the back-line. Please note that no

divider drapes between bulk exhibits shall exceed 3 feet

in height. Taller drapes may be used for cosmetic

reasons only and must be pre-approved by Show

Management. All display fixtures over four feet in height

and within ten feet of an adjoining booth, must be confined

to that area of the Exhibitor’s space within five feet of the

back-line.

(c) Character of Exhibits. Show Management reserves

the right to approve the character of all displays and to

prohibit any display which, because of noise or other

objectionable features, detracts from the general character

of the exhibit. Advertising signs and stunts which are

aggressively promotional in nature, intended for use in the

booths, the exhibit hall or the approaches thereto, must be

submitted to Show Management for approval. Canopies,

tents or overhead awnings, flammable or non-flammable,

cannot be used in any manner during the show. Also, bales

of hay, treated or untreated, are no longer acceptable.

Shredded mulch cannot be used in any landscaping or

decorative manner. Large bark nuggets are to be used

only.

(d) Signs. All Exhibitors are permitted to hang overhead

signage within the confines of their booth. However, signs

may be hung from structural steel only. Hanging signs

from sprinkler lines, water lines, gas or air lines, HVAC

ductwork, electrical BUSS ducts or lines is strictly

prohibited and will be removed at the owner’s expense.

All privately contracted signs on site must be approved by

Show Management. Two sided signs are strictly

prohibited.

(e) Exhibitor Presence. Booths must be open and

manned daily from 9:00 a.m. to 10:00 p.m. throughout the

11 days of the show. Failure to open & close during these

times will make your exhibit space subject to immediate

closure for the remainder of the show and non-renewal of

the contract for the following year.

Early Tear Down/Move-Out

The Exhibit Hall will close at 9:00 p.m. on the last day of the

show. Release forms will be distributed at Exhibitor

Registration at the duration of the show. Absolutely no

Exhibitor is to tear down and move their exhibit out before

this time. Any Exhibitor tearing down and moving their

exhibit out earlier than this time will lose their space for the

following year.

Electrical Service

No electrical outlet will be furnished to an Exhibitor without

charge. Exhibitors that need electricity must complete and

return the enclosed Electrical Service Order Form with

payment prior to the Fair. Advance orders must be postmarked

no later than twenty-one (21) days prior to first day of the

event. Any orders postmarked after that day will be charged at

the floor order rate.

Exhibitor Admittance/Non-Show Hours

Booth representatives will not be permitted to enter the exhibit

hall earlier than one and one half hour before scheduled

opening each day, except on opening day, and will not be

permitted to remain in the exhibit hall longer than one hour

after closing each night, with the exception of the final night.

This is to ensure maximum security for the open exhibits and

merchandise.


Exhibitor Conduct

Show Management reserves the right to modulate or remove

any amplification equipment, including public address systems,

television, phonographs, stereos or organs. Coin or token

operated games or machines, demonstrations, microphones,

music, bands, solicitations by Exhibitors and live animals are

strictly prohibited unless specifically authorized in writing by

Show Management. No sale of food or drink in individual

quantities or packages which lead themselves to on-the-spot

consumption or tobacco in any quantity will be permitted. No

paint, cement or mastics may be applied to the exhibit floor.

Noise, demonstrations or blocking of other Exhibitors display

or view will not be tolerated. Consideration will be given by

Show Management to Exhibitors for special set-up, if requested

in advance. ROVING SOLICITATION IS STRICTLY

PROHIBITED ANYWHERE ON THE GROUNDS. No

soliciting of registrants shall be permitted in the aisles or in

other Exhibitors booths. Samples, catalogues, pamphlets,

souvenirs, and other promotional items may be distributed by

Exhibitors and their representatives (including models) only

within the confines of their own booth. No roving vendor or

solicitor, acting from a profit, non-profit, religious, or other

organization, or on its behalf, shall be permitted on the ground.

No Exhibitor will be permitted to conduct any prize drawings

or awards for signing of names and addresses without prior

approval from Show Management. All signs, advertising,

literature and other promotional material must directly relate to

the exhibitor’s name, product and service as set forth and

approved in the exhibit space contract. Gummed labels, bumper

stickers or stickers for promotion are prohibited. Helium

balloons are also prohibited unless they are used for booth

decorating purposes only and attached to your exhibit space.

Products displayed are at the discretion of the Show

Management. No live animals are to be sold.

Show Management will not allow argumentative,

confrontational and hostile disregard for the show or Show

Management personnel as stated in the Rules & Regulations in

the Exhibitor Services Manual and the Terms & Conditions of

the exhibit contract.

Exhibitor Promotional Activities

Any Exhibitor wishing to conduct any type of drawing must

complete the Exhibitor Promotional Activities Service

Order Form. "ABSOLUTELY NO VACATION

GIVEAWAYS WILL BE PERMITTED”.

Exhibitor Registration – Security Badges

In order to insure maximum security of South Wing C and the

North Wing during non-public hours of the Kentucky State

Fair, admission to this area will be by Security Badge only. The

Security Badge will allow Exhibitors entrance to South Wing C

and North Wing one and one half hours before opening to the

public from 7:30 a.m. to 9:00 a.m. and one hour after closing to

the public from 10:00 p.m. to 11:00 p.m. with the exception of

the North Wing which will remain open until 11:00 p.m. This

time is for your convenience in cleaning up, restocking or

rearranging your display or exhibit.

SECURITY BADGES MUST BE ORDERED IN

ADVANCE TO ENSURE TIME TO PROCESS

NO ORDERS WILL BE PROCESSED AFTER

Only generic company badges will be issued with a limit of 10

exempt from this limitation. No personal name badges will be

Fire Marshal Requirements

The following are the State Fire Marshal’s minimum fire safety

requirements and shall be applied at all shows, trade,

commercial or otherwise, and shall apply whether the exhibit is

open or closed to the public.

(a) The display and operation of any cooking or heat

producing appliances, pyrotechnics, use or storage of

flammable liquids, compressed gases, or any other item or

process deemed hazardous by the State Fire Marshal must

have advance written approval by the State Fire Marshal’s

representative.

(b) Any motor vehicles, gasoline powered equipment,

tools, etc. on display shall have their batteries

disconnected. All fuel tanks that are not equipped with

locking gas caps should be sealed with tape. All such fuel

tanks shall be less than one-fourth full.

(c) Parking of any vehicle in the building without prior

approval is prohibited. Cars and trucks shall be removed

immediately after loading or unloading.

(d) Decorations and displays shall not block or impede

access to fire protection equipment (sprinklers, exit

markings, exit doors or emergency lighting equipment).

Canopies, fire retardant or non-fire retardant are prohibited

anywhere on the exhibit floor.

(e) Aisles and exit doors shall be maintained free of all

obstructions and unlocked for immediate use in the event

of an emergency, during hours of occupancy. The use of

chains and locks on doors equipped with panic hardware is

prohibited.

(f) Signs approved by the representative designating exits

and the direction of travel to exits shall be provided by the

lessee and in place prior to the show opening.

(g) Additional fire extinguishers may be required at the

discretion of the State Fire Marshal’s representative.


(h) All electrical devices and installation shall be made in

accordance with the applicable provisions of the National

Electrical Code. The Underwriters Laboratories must list

all devices.

(i) All electrical extension cords used shall be of the

heavy-duty type. Lightweight cords of the lamp cord

variety are prohibited and are subject to confiscation.

(j) All decorations shall be fire retardant. The decorating

companies shall be prepared to provide certificates of

flame spread on all decorations. Items that are not properly

fire retardant shall be removed. No straw or hay, flame

retardant or not, is allowed on the exhibit floor. When

landscaping, please use LARGE BARK NUGGETS

ONLY. SHREDDED MULCH IS PROHIBITED.

(k) All booths & displays will be open, i.e. no canopies or

covered tops, unless prior approval by Show Management

and the State Fire Marshal has been given.

(l) The use of open flames is permitted only for

reasonable purposes, when proper safeguards are taken and

must have advance approval by the State Fire Marshal’s

representative. The ignition of flammable or combustible

items to demonstrate fire extinguisher effectiveness is

strictly prohibited.

Health Permit

Any Exhibitor handing out food samples must obtain a

$30.00 food permit from the Kentucky Health Department.

You must attend a health class within the first three days of

the fair. Any Exhibitor without a permit will not be

permitted to hand out their food samples. Information

Internet Access/Networking

Internet Access or Networking is provided by Smart City. The

Kentucky Exposition Center and the Fair Board have no

control over the cost of service or installation. To order this

service, please complete the Internet Access/Networking

Service Order Form and return by the deadline to the address

on the form.

Labor and Equipment

The Kentucky Exposition Center offers general labor services

to Exhibitors during set-up and dismantling. To order this

service, please complete the Labor and Equipment Service

Order Form and return by the deadline.

Overnight Occupancy in Exhibit Area

No Exhibitor, employee or representative thereof shall be

permitted to remain in an exhibit space overnight unless

approved by Show Management prior to the opening of the

Fair. This policy is strictly enforced and any violation may

result in immediate termination of the exhibit space contract.

Prohibited Sale Items

Displaying or offering for sale any type of drug paraphernalia

is prohibited. Some examples of such paraphernalia are as

follows: Any instrument used, designated for use, or intended

for use in ingesting, smoking, administering, or preparing

marijuana, hashish, hashish oil or cocaine; and includes: metal,

wooden, acrylic, glass, stone, plastic or ceramic marijuana or

hashish pipes with or without screens, hashish heads or

punctured metal bowls; water pipes designated for use or

intended for use with marijuana, hashish, hashish oil, or

cocaine; carburetion tubes and devices; smoking and

carburetion masks; roach clips; separation gins designed for use

or intended for use in cleaning marijuana; cocaine spoons and

vials; chamber pipes; carburetor pipes; electric pipes; air driven

pipes; chilams; bongs; ice pipes or chillers etc. The provisions

of Chapter 218A of Kentucky Revised Statues are

vigorously enforced on the grounds. The title of this chapter

is “Controlled Substances”. Switchblade knives, stilettos,

pinpoint laser lights, pepper spray, smoke bombs, stun guns

and butterfly knives are also prohibited. These items will be

confiscated and your location may be in jeopardy of closure.

Satellite Dishes

The Kentucky Exposition Center does not allow the placing of

satellite dishes on the rooftop nor can there be any cable or

wire to the dish strung outside. This insures safe daytime traffic

and nighttime security by securing all pedestrian and overhead

doors. Show Management accepts no liability for satellite

dishes used on the ground. This includes vandalism, accidents,

theft or otherwise. Satellite dishes should be used for

“DISPLAY” purposes only. If you have a satellite dish you

must contact Show Management prior to set-up.

Security

Show Management provides general 24-hour security

beginning the first day of move-in through and including the

last day of move-out. Exhibitors requiring individual exhibit

security should complete the Security Service Order Form

and return by the deadline.

Signage

Exhibitors are responsible for providing their own booth

identification signs. Signs must be professionally made, and

must be placed in a prominent position in the booth. Felt pen

and stencil signs are not acceptable. Where price signs are

utilized, signs must be small, neat and inoffensive, and Show

Management shall have the right to require an Exhibitor to

remove any sign at which he considers, at his absolute

discretion, undesirable. Any signs hung from the ceiling must

be hung from structural steel only. Hanging signs from

sprinkler lines, water lines, gas or air lines, HVAC ductwork,

electrical BUSS ducts or lines is strictly prohibited and will be

removed at the owner’s expense.

Smoking

The Kentucky Exposition Center is a "Smoke-Free"

facility. Smoking within the exhibit hall is strictly prohibited.

Anyone needing to smoke please go outdoors or to one of the

designated smoking areas near you.

Sound Devices

The sound volume must be maintained at a level so as to avoid

any interference with neighboring Exhibitors. When objections

are noted, it may be necessary for Show Management to

prohibit the use of sound devices or limit operation to short

time periods. Use of sound slides, sound motion pictures, loud

speakers and other sound devices is subject to the approval of

Show Management. Use of motion pictures and slides will be

permitted only if they are directly related to products, services,

techniques, or application.


Structural/Support Columns

Some exhibit spaces include or are adjacent to structural and/or

support columns. Electrical and utility service panels on

columns may be covered or screened, but any covering must be

readily removable for access to the panels at all times. Fire

alarm boxes, fire hoses and extinguishers, and Fire Department

access doors on the columns may not be covered, screened or

blocked in any way at any time. Exhibitors who block access to

utility service panels (telephone or electrical), fire alarm boxes,

extinguishers or fire hoses, will be required to immediately

correct these violations. Carpenter labor required to correct

these violations will be charged to the Exhibitor. Sides of

columns (without fire, electrical, service panels or equipment)

may be covered or screened and incorporated into your display.

Do not staple or tack directly into the column wall.

Subleases

The exhibiting company signing the space contract cannot sublease

any portion of their exhibit area to any distributor or manufacturer

unless the contract holder is the manufacturer of equipment or

merchandise to be displayed in the exhibit area

Telephones

Telephone service is provided by Smart City. The Kentucky

Exposition Center and the Fair Board have no control over the

cost of service or installation. To order this service, please

the deadline stated on the form.

Concession Space Audits

All outside vendors will be audited by our on staff Auditors for

exact square footage used. Any overage will be billed after the

Fair for this extra space.

(a) Storage Areas. Concessionaires are allowed storage

areas at the rear of their trailers at no extra charge. All

storage areas are required to be boxed in with lattice to

make the area attractive. We do not want bun racks, soft

drink cylinders, etc. to be visible on the front sidewalk.

(b) Ice Chests. Ice chests will not be measured. Ice

chests are a convenience to Show Management as well as

Concessionaire.

(c) Seating Areas. Seating areas should not be audited. We

encourage Concessionaires to setup and maintain large

seating areas at their own cost. Once again, this service

helps both the Concessionaire and Show Management.

(d) Grill Attachments. Grill attachments should not be

audited in addition to the Concessionaires trailer. Most

items are sold through the window of the trailer not directly

off of the grill. In many instances these are show pieces that

create aroma and atmosphere to the public.

(e) Decorative Items. Any Concessionaire who wishes to

make his presentation more professional and decorative

should not be audited for items such as picket fences or pole

and chains to create lines to the trailer, etc.

(f) Hitches & Awnings. Although most concession trailer

hitches slide back into the trailers and are covered by bally

for flash, some trailer hitches are permanent. No vendor will

be charged for his trailer hitch or any oversized awnings

that cover his serving area.

These are general guidelines. Each Concessionaire will be

judged on a one to one basis. They are subject to review of the

location after setup. Show Management must approve all

locations and the space they have occupied before the Fair

begins.

Display and Construction

(a) All operations must be in good working order and

appearance. This includes all lights working, canopies in

good repair, fresh paint job and any other item which Show

Management deems necessary. No nail-up type concession

stands will be allowed on the Fair Grounds without the

permission of Show Management. Proof of appearance

must be furnished to Show Management in the form of

photographs or artist’s renderings when application for

space is made.

(b) All concession items must remain in the stands with the

exception of soda canisters that are in a presentable

condition.

(c) Concessions containing deep fryers must have

sprayable 10 B.C. chemical fire extinguishers.

(d) All food concessions operated under this contract shall

be constructed and screened in a manner approved by state,

county and city public health agencies, shall be subject to a

daily inspection by the state, county and city public health

agencies, and shall conform to such regulations as any

governmental agency may require.

(e) Concessionaire agrees to post complete price lists for

all items served on signs 18” x 12” in size and to post as

many signs as are necessary to be easily visible from all

service counters.

(f) No voice or sound amplification, amateur or

professional entertainment shall be used without consent

from Show Management. Such permission, if granted, may

be rescinded at any time by Show Management.

Electricity/Plumbing

The Show Electrician will install electrical service, plumbing,

etc., on a first come first serve basis. No electrical outlet will be

furnished without charge. Once installation of your unit is

complete, please notify the Exhibitor Services Office in the rear

of Freedom Hall to arrange for hookup. Concessionaires needing

electricity must complete the enclosed Electrical Service Order

Form and return by the deadline date stated on the form.

Discount orders must be postmarked no later than twenty-one

(21) days prior to the opening day of the Fair. All orders

received after the deadline will be charged the regular rate. A

standard charge will be made per location for the amperage you

select. If greater amperage is required, the additional installation

may be had at an additional charge, based on the fixed and

quoted rates of the Maintenance Department. Concessionaire

must provide 100 feet of proper size and approved cable to

connect to distribution panels.

Exhibit Space Audit

An auditor for the Kentucky State Fair, at some unannounced

time, will actually measure your total space use. Concession

operators found using more space than their contract allows

shall be assessed an additional charge after the Fair.

Health Inspection

All concession units, where applicable, must follow all Health

Department regulations to the letter and attend one scheduled

class. A schedule of classes will be mailed to each

Concessionaire. No concession operation shall be allowed to

begin operation until these health regulations have been met.

Holding Tanks/Grey Water

All Concessionaires must operate with an adequate sized

holding tank that will last for one 24 hour period. There are no

exceptions. Holding tanks cannot be emptied at anytime into any

sewer or drainage ditch. Hoses running from concession units

directly to sewers are also prohibited. Concessionaire is

responsible for the cost of grey water pumping. All vendors are

Vendors are responsible for paying all charges for holding tank

services. KEC is not responsible for or included in this third

party transaction. It is the sole responsibility of the vendor to

settle all debts with the provider.

Holding tanks cannot be emptied at anytime during Fair hours.

Grey water cannot be dumped into any sewer or any other

place that is located on the grounds of the Kentucky

Exposition Center. All holding tanks will be emptied between

midnight and 6:00 a.m. If your tank becomes full and spills on

the grounds, you may be fined, or told to cease operation until

the following day.

Purveyors

Show Management will issue to local wholesale suppliers,

non-exclusive permits allowing them to solicit sales to

Concessionaires during the Fair. Concessionaires are not

required to purchase their supplies from these suppliers but we

highly recommend you check their prices first before using

another outlet. Concession operations using fresh or frozen

meat, poultry and/or seafood are required to purchase those

supplies from one or more of the approved purveyors on the

grounds only. Failure to follow this policy will result in

immediate termination of a concession contract unless a

concession operation has been granted an exemption from the

policy in unity by Show Management.

Dear KY State Fair Vendor:

The Louisville Metro Department of Public Health and Wellness would like to welcome

you to the 2013 Kentucky State Fair. We would like to take this opportunity to explain

the parameters in which food and/or retail concessionaires will be asked to purchase a

temporary permit and be inspected by KY Public Health representatives each day. Any

retail food establishment that is sampling or serving potentially hazardous food items,

(food required to be kept hot or cold), will need to purchase a temporary food permit

unless you posses a statewide mobile permit and are operating in the approved mobile

unit. Potentially hazardous food items include dips, spreads, cut melon, meats, cooked

vegetables, etc. Stands that must wash utensils and other food equipment will also be

expected to purchase a temporary food permit. Minimum requirements will include the

use of a three compartment set-up to wash, rinse and sanitize dishes and equipment. A

hand wash station which is equipped with water, soap and disposable paper towels, is

also required to ensure safe food handling. Please see the enclosed handout detailing

proper equipment and set up when operating.

Representatives from each vendor booth will be required to attend a one hour temporary

food service training class. The course will be taught in Freedom Hall VIP room #2. A

list of dates and times is enclosed. Permits may be purchased starting on Tuesday August

13, 2013; no permits will be sold prior to that date. Each booth operating is required to

maintain a temporary food service permit. The Food Safety Trailer is located in the

middle of the Midway adjacent to the permanent restroom facility.

immediate left again towards the signs designating VIP room. Go down

hallway, and stop at door before the VIP room. This is the entrance to two

rooms. The door on the left is the VIP room #2. Follow the signs!

class, picking up your certificate and returning to your food booth to get ready

for the 2013 Kentucky State Fair ! )

Initial Set-up for your Temporary Foodservice

A. Set up a wash, rinse, and sanitizing container system to properly clean your equipment and

utensils. The containers should be at least 2 ½ gallons and labeled.

B. Designate an area to wash your hands (away from food, paper, and utensils). Always provide soap

and disposable hand towels. Water coolers with a spigot are to be used as a hand sink (remember to

use a bucket to catch the wastewater!).

ITEMS NEEDED:

1. Food Permit must be posted in a prominent location, which is visible to the public.

2. Three buckets for your wash, rinse, and sanitize ware-washing system.

3. Cooler with a spigot for hand washing and a bucket to catch dirty water.

4. Bucket for sanitizer solution to store wiping cloths

5. Waste tank large enough to support your operation

6. Metal stem thermometer to check cold foods (41 F or less) and hot foods (135 F or more). Do

not forget to frequently calibrate the thermometers.

7. Bleach or quaternary ammonia for ware washing and wiping cloth buckets.

8. Test Strips for the appropriate sanitizer used at your facility. Bleach solutions for ware washing

should read between 50-100ppm. Quaternary ammonia solutions should read between 200-

400ppm.

9. Soap and disposable hand towels for your hand washing station.

10. Thermometer in each refrigerated unit and cooler.

11. Hair restraint for each food handler.

12. Gloves or utensil to use as a barrier with ready-to-eat food

POINTS TO REMEMBER:

1. Ware washing, hand washing and sanitation bucket for wiping cloths must be set up

BEFORE you begin to operate.

2. No bare hand contact with ready-to-eat food is permitted

3. Food and single service items must be stored 6” off the floor/ground.

4. No drinking or eating in food prep area.

5. Label food and toxic items (such as spray bottles and ware wash buckets).

6. Do not save leftover potentially hazardous food at the end of the day.

7. All food must be prepared on site or at a permitted kitchen

9. Provide screening of food when necessary.

If cloths are used for wiping counters and

cutting boards the cloths must be placed in

sanitizing solution of 100-200 ppm when

not in use to prevent the growth of

microorganisms. Do not use sponges as

they may harbor bacteria.

Foods prepared from a home kitchen cannot be sold




Wild Game or any meat not inspected by USDA or other official

Governmental Regulatory Agency.

Pastries filled with cream or synthetic cream, custards, and similar products.

Other food items or ingredients, which may constitute a high risk in a temporary setting

WORKER REQUIREMENTS:

• Workers shall wear clean clothing and aprons.

• Workers shall wear hair restraints.

• Children and infants shall be restricted from food preparation and service areas.

• Persons who are ill or exhibiting symptoms of illness shall not prepare or serve food.

• It is the responsibility of the permit holder to ensure food workers are free from illness.

• Food workers shall routinely wash their hands and have easy access to acceptable hand wash stations

equipped with soap, water, and sanitary towels.

NOTE: ALL TEMPORARY FOOD SERVICE ESTABLISHMENTS SHALL BE PERMITTED BY THE DEPARTMENT PRIOR TO OPERATION

PLEASE POST IN CONCESSION

FOOD PROTECTION:

‣ Keep potentially hazardous foods (meats, poultry, sea foods, milk,

eggs, coffee creamers-both dairy and non-dairy types,

mayonnaise, salad dressing, or any foods containing such

products at 41F or above during storage, display and

transportation. (Item 3)

‣ Provide adequate facilities for maintaining foods at safe

temperatures during preparation, storage, display, service and

transportation. (Item 4)

‣ Ready-to eat food shall be dated marked if not serve within 24 hrs

‣ Provide visible thermometers in all hot and cold food units

(including freezers) and metal-stemmed thermometers for

monitoring internal temperatures of potentially hazardous foods

during storage, service preparation and display. (Item 5)

‣ Store containers of food single service off the floor, a minimum of

6 inches. (Item 20)

‣ Store coffee creamers (both dairy and non-dairy types), sodas,

bottle drinks and other packaged foods in drained ice; do not

allow them to rest in the water. (Item 3 & 8)

‣ Provide counter protector devices, cabinet cases, containers or

other protective equipment where unwrapped food is placed on

display (Item 8)

‣ Cover all foods from contamination (dust, flies, coughs, sneezes,

overhead drippings, etc.) during preparation, storage display,

service and transportation. Uncover only when actually preparing

or serving to customers. (Item 8)

‣ Provide and use scoops for handling edible ice, store scoop with

handle out of ice. Do not store containers or foods in edible ice.

PERSONNEL

‣ No smoking, drinking or eating is allowed in food preparation,

serving and ware washing areas. (Item 11)

‣ All persons engaged in the preparation of foods and ware washing

must wear effective hairnets or hats. (Item 12)

‣ All persons shall use a barrier when handling ready-to-eat foods.

FOOD EQUIPMENT & UTENSIL

‣ Food contact surfaces or utensils must be smooth, in good repair,

not chipped or cracked. Enamelware and graniteware are not

acceptable. (Item 14)

‣ Food and non-food contact surfaces of equipment must be

smooth, not worn, in good repair and of approved material. Do

not use towels, foil, linoleum, oilcloths, etc., to cover such

surfaces. (Item 14 & 15)

‣ Non-food contact surfaces (stoves, refrigerators, shelves, tables,

counter deep fat fryers, etc.) must be kept clean. (Item 23)

‣ Ice contact surfaces must be smooth, easily cleaned. Do not use

Styrofoam or similar containers for ice or food storage. (Item 14)

‣ Single service articles (cups, forks, spoons, straws, etc.) must be

stored, dispensed and handled so that they are protected from

contamination (Item 15 & 25)

‣ Ware washing facilities: Three (3) containers for wash-rinsesanitize,

must be provided. (Item 16)

‣ Chemical Test Kit Provided. A test kit or device shall be provided

that accurately measures the parts per million (ppm)

concentrations of sanitizing solution. (Item 16)

‣ Cleaned and sanitized utensils and equipment must be stored so

that there is no danger of becoming contaminated. Do not towel

dry utensils. (Item 20)

HAND WASHING

‣ Proper hand wash station with a spigot type water supply for

hands free washing shall be provided with soap, paper towels and

a bucket to catch waste water. (Item 11 & 25)

‣ Provide and use hand cleaners and approved sanitary towels for

hand washing. (Item 26)

GARBAGE & REFUSE

‣ Store garbage and rubbish in durable, washable containers. Do

not use boxes, paper bags, or similar absorbent material. Empty

containers so that they do not overflow. (Item 34)

‣ Keep all garbage and rubbish containers covered with lids when

not in actual use. (Item 27)

‣ Dispose of liquid and solid waste in designated areas only. Do not

create a nuisance by disposing of such water adjacent to food

service establishments. (Item 22)

FLY & PEST CONTROL

‣ Prevent the entrance of flies by use of effective screening or

similar material. KEEP FLIES OUT. (Item 28)

POISONS AND TOXIC ITEMS

‣ Store poisonous compounds (insect spray, oven cleaner, polishes,

etc) and bactericide and cleaning compounds (bleach, cleaners,

soaps, detergents, etc.) so that there is no danger of

contaminating food, food contact surfaces of utensils. Do not

store poisonous compounds near bactericide and cleaning

compounds. (Item 33)

FLOOR CLEAN

‣ Floor must be kept free of dirt, grease and other soil. Do not use

sawdust on floors. (Item 30)

LIGHT SHIELDS

‣ Shield all lighting fixtures located over, by, or within food storage,

preparation and display facilities to protect against broken glass

falling into food; provided that this requirement shall not apply to

heat lamps or when using approved “Tuff Skin” bulbs. (Item 32)

2013 Kentucky State Fair

Official Rules, Regulations and General Policies

The following terms and conditions are incorporated into the contract for exhibit space.

1. Admission/Non-Show Hours. Each Exhibitor will

furnish to Show Management the number of personnel who

will need entry to the exhibit hall during non-show hours.

Entry to the exhibit hall will be permitted by security badge

only and will be limited to one and one half hour before and

one hour after show hours.

2. Amendment. This contract shall only be amended or

modified upon written consent of both Show Management and

the Exhibitor/Concessionaire excepting those provisions

expressly providing otherwise.

3. Cancellations.

(a) Refunds. Refunds of deposit will be made if Show

Management receives written notice of cancellation thirty

(30) days prior to the first day of the show and if Show

Management is able to resell the exhibit space.

(b) Damages. The Exhibitor/Concessionaire expressly

waives any recourse for damages against Show

Management in the event this agreement is revoked or

cancelled by Show Management for violation of any

promises hereof. In case of acts of God, or conditions

necessitating the canceling of the show, Show

Management may revoke this agreement and refund any

monies paid in advance.

4. Concessions. The serving of alcoholic beverages

and/or food or other beverages by the Exhibitor or

Concessionaire within the exhibit hall is prohibited unless

special permission is received from Show Management.

5. Contract Procedure. Space is assigned on an

invitation/contractual basis only. In the best interest of the

show, certain limits on some items must be enforced. No

company or individual, however, has an exclusive contract as

to product or items sold or distributed.

Please note that all exhibit contracts are a one year contract.

Show Management has the right to renew or not renew a

contract to any Exhibitor/Concessionaire whose conduct is

deemed disruptive to the show. Exhibitors/Concessionaires

who show habitual delay in meeting contract deadlines are

subject to non-renewal also. Products displayed are at the

discretion of Show Management and anything deemed

unsuitable for the show will not be allowed.

6. Contractor Services. All services, including but not

limited to furniture, carpeting, labor, drapery, electrical,

telephone, storage and other special required services can be

ordered through the Service Desk. (See Service Order

Forms)

7. Damages. Exhibitors will be liable for any damages

caused by fastening fixtures to floors, walls, or columns of the

Exposition Center and for any damages to equipment

furnished by Show Management or service suppliers

designated by them.

8. Exhibit Installation. Installation of exhibits or

concessions may begin at 8:00 a.m., Saturday, August 10,

2013. All exhibits/concessions must be in place and ready for

display no later than 9:00 a.m., Thursday, August 15, 2013.

No alterations to the exhibit/concession set-up shall occur

during show hours. No dismantling shall commence before

9:00 p.m., Sunday, August 25, 2013.

9. Floor Plan. Show Management may, at any time,

change the size or location of the Exhibitor/Concessionaries

space layout if Show Management deems it necessary for the

good of the show.

10. Forklifts. Exhibitor/Concessionaires may use their own

forklifts to setup their display. Any Exhibitor/Concessionaire

loading or unloading for any company besides their own will

jeopardize their future participation in the show and/or lose

their forklift privileges. All forklift operators must have

certification from their employer showing they are certified to

operate a forklift. A copy of your certification must be on file

with the Exposition Sales Office at P.O. Box 37130,

Louisville, KY 40233 to the attention of James Johnson prior

to set-up. All Exhibitors/Concessionaires are required to carry

proof of liability & property insurance to cover any damage to

the building, Exhibitors/Concessionaires or persons caused by

the operation of the forklift.

11. Insurance and Indemnity

(a) Insurance. Exhibitor/Concessionaire, for itself and

on behalf of decorators, contractors, service people, or

others employed by the Exhibitor during the entire term

of the lease shall secure, furnish and maintain insurance

as follows:

1. Workman’s Compensation Insurance in the

minimum amounts required by the State of Kentucky.

This is by the discretion of the Exhibitor and a

certificate is not required by Show Management.

2. Comprehensive General Liability Insurance with

minimum combined limits of liability of $500,000.00

for bodily injury and/or property damage in any one

occurrence.

Such insurance coverage shall name the Kentucky State

Fair Board, the officers, agents and employees as

additional insured. Such policy shall be issued by an

insurance company authorized to transact business in the

State of Kentucky. The Exhibitor/Concessionaire shall

furnish Show Management with the appropriate

Certificate of Insurance, reflecting such coverage.


(b) Indemnity. The Exhibitor/Concessionaire, on

behalf of itself, its agents, servants, employees, customers

and guests hereby agrees to assume, defend at all times,

indemnify, protect, save and hold harmless the Kentucky

State Fair Board and all its members, agents, servants and

employees against claims or demands arising or resulting

from the use by the Exhibitor/Concessionaire of the space

provided by Show Management. This includes, without

limitation, the claims of any employee or agent of the

Exhibitor/Concessionaire, the claims of anyone attending

the exhibit, and the claims of any other person for

damages for bodily injury, sickness, mental anguish or

death, and claims for damages to the property of any such

employee, agent or persons. Show Management shall not

be liable for any loss, damage or injury to the property of

the Exhibitor/Concessionaire, which is sustained during

the use by the Exhibitor/Concessionaire of the space

provided by Show Management.

12. Kentucky Sales and Use Tax. Persons engaged in

making sales of tangible personal property such as t-shirts,

records, buttons, pins, jewelry, food, etc. are subject to tax at

the rate of 6%. Personnel with the Kentucky Revenue Cabinet

will be visiting each exhibit area throughout the Fair if you

have any questions. On the last day of the show the Revenue

personnel will be set-up in the South Wing C Lobby to collect

any taxes owed by the Exhibitor/Concessionaire.

13. Labor. All labor performed by Maintenance

Department personnel, including repairs and tracing

malfunctions, will be charged at those rates set forth on the

Labor and Equipment Service Order Form. Orders must

be postmarked no later than twenty-one (21) business days

prior to the first day of the show. Any orders received after

this date will be at the floor order rate.

14. Landscaping. When landscaping, only LARGE

BARK NUGGETS can be used due to State Fire Marshal’s

regulations. Shredded mulch is strictly prohibited. Also, any

bales of hay or straw, even those that are fire retardant are also

prohibited.

15. Management. Show Management reserves the right to

close any exhibit leased herein, without liability, should the

Exhibitor/Concessionaire or any employee thereof engage in

acts that are substantially disruptive and against the best

interest of the show.

Management. Said policies and items are hereby made a part

of this agreement as if copied in full herein.

18. Security. Show Management will provide 24-hour

security beginning the first day of move-in through and

including the last day of move-out. No outside security

personnel will be allowed in the immediate exhibit area during

non-public hours unless circumstances warrant. Show

Management reserves the right to reject any commercial firm

provided by the Exhibitor. See Security Service Order Form

to order individual security for your exhibit space.

19. Structures. No two story modular exhibits will be

permitted due to height restrictions and safety regulations.

20. Use of Sound Devices. The sound volume must be

maintained at a level so as to avoid any interference with

neighboring Exhibitors and when objections are noted, it may

be necessary for Show Management to prohibit the use of

sound devices or limit the operation to short time periods. Use

of sound slides, sound motion pictures, loud speakers and

other sound devices are subject to the approval of Show

Management. Use of motion pictures and slides will be

permitted only if they are directly related to products, services,

techniques or application.

21. Use of Golf Carts, City Cars, and Motor

Powered Bikes Operated on KEC Premises. The

owner/operator of the vehicle (including golf carts, city cars

and motor powered bikes) shall, on behalf of itself, its agents,

servants, employees, customers and guests hereby agrees to

assume, defend at all times, indemnify, protect, save and hold

harmless the Kentucky State Fair Board and all its members,

agents, servants and employees against claims or demand

arising or resulting from the use by the owner/operator of the

vehicle operated on KEC premises. This includes, without

limitation, the claims of any employee or agent of the

owner/operator, the claims of anyone riding with the

owner/operator of the vehicle and the claims of any other

person for damages for bodily injury, sickness, mental anguish

or death, and claims for damages to the property of any such

employee, agent or person. Kentucky State Fair Show

Management shall not be liable for any loss, damage or injury

to the property of the owner/operator, which is sustained

during use of the vehicle.

16. Noise. No band or musical group will be permitted in

the exhibit area. While the operation of displayed products is

encouraged, such operation must be accomplished without

creating a sound factor, which could be objectionable to

neighboring booths. This includes the operation of power

equipment and construction work during show hours. Show

Management reserves the right to cancel any exhibit space

contract, without penalty, in the event that such noise becomes

disruptive to the show.

17. Rules and Regulations. The Exhibitor

/Concessionaire agrees to abide by and adhere to all laws of

the Commonwealth of Kentucky, all pertinent ordinances of

Jefferson County, and all show policies adopted by Show

The Kentucky Exposition Center is located at the junction of I-65 and I-264 (937 Phillips Lane) in Louisville. Signs reading "Fair/Expo Center" on both

interstates lead to the main gate. Visitors may want to beat the traffic by entering Gates 2 & 4 on Crittenden Drive or Gate 6 on Preston Highway.

Visitors traveling from out of state will find getting to the Kentucky Exposition Center easy as we are located just minutes from the Louisville

International Airport.

Standard

Booth

Important:

Space dimensions shown on floor plan are from center line of booth equipment such as

side rails and/or back drape. Exhibit structures must be constructed to allow sufficient

tolerance on each side for this equipment and for utility service at rear of booth.

Intent:

Any portion of an exhibit extending above the 8' high draped booth background will

detract from the overall impact of the exhibit directly behind that booth regardless of

how the rear of the offending exhibit is finished.

To provide reasonable sightline from aisle to the neighboring exhibit as described in

the depth section.

Height:

All booths will be confined

to a maximum height of 8'.


Standard

Booth

Definition:

One or more standard units in a straight line.

Intent:

Each exhibitor is entitled to a reasonable sightline from the aisle regardless of the size of

his exhibit. Exhibitors with a larger space should also be able to effectively use as much

of the total floor space as possible as long as they do not interfere with the rights of

others. The limitation on display fixtures is intended to accomplish both these aims.

Booth

Important:

Space dimensions shown on floor plan are from center line of booth equipment such as

side rails and/or back drape. Exhibit structures must be constructed to allow sufficient

tolerance on each side for this equipment and for utility service at rear of booth.

Note:

Peninsula booths are normally "faced" toward the cross aisle. Any portion of the exhibit

bordering another exhibitor's booth must have the back side of that portion finished

and not carry identification signs or other copy that would detract from the adjoining

exhibit.

Depth:

All display fixtures over 4' in height and

placed within 10 lineal feet of a neighboring

exhibit must be confined to the area within

5' of the center line to avoid blocking the

sightline from the aisle to the adjoining

booth.

Intent:

Exhibitor's adjoining peninsula exhibits are

entitled to the same reasonable sightline

from the aisle as they would expect if they

were adjacent to an exhibitor with a standard

booth.

Peninsula

Booth

Definition:

Two or more standard units back to back on three sides.

Intent:

When an exhibit in a peninsula booth configuration exceeds 8', it does not interfere with other

exhibitors because it does not back up against another exhibitor's back wall. The extra height is

often needed to permit the open walk through approach normally used in this type of location.


Perimeter Wall

Booth

Intent:

Each exhibitor is entitled to a reasonable sightline from the aisle regardless of the size of his

exhibit. Exhibitors with a larger space should also be able to effectively use as much of the total

floor space as possible as long as they do not interfere with the rights of others. The limitation on

display fixtures over 4' and within 10 lineal feet of a neighboring exhibit is intended to

accomplish both these aims.

Depth:

All display fixtures over 4' height and placed

within 10 lineal feet of an adjoining exhibit must

be confined to that area of the exhibitor's space

which is within 5' of the backline.


Island

Booth

Important:

Definition:

Four or more standard units back-to-back with aisles on all 4 sides.

Intent:

The "Cubic Content" of an island space may be used. Height restrictions are determined by

ceiling or beam and decorations. They vary with individual locations. Exhibitors having exhibit

materials, equipment or construction that exceed 8' must have prior approval of Show

Management.

Demonstrations or

Entertainment

Regulation:

Do not place your demonstration areas on the aisle line of

your exhibit if you expect many people to congregate at

one time. Leave space within your own exhibit area to

absorb the majority of the crowd. Should spectators interfere

with the normal traffic flow in the aisle or overflow

into the exhibits of your neighbors on each side or across

the aisle, the Show Management will have no other alternative

but to request that you limit or eliminate the

presentation.

CORRECT

Sound:

Police your own booth to be sure the noise level from any

demonstrations or sound systems is kept to a minimum

and does not interfere with others. Remember the use of

sound systems or equipment producing sound is an

exception to the rule, not a right. Show Management

reserves the right to determine at what point sound constitutes

interference with others and must be

discontinued.

Intent:

The aisles are the property of all the exhibitors, therefore

INCORRECT

each exhibitor has the responsibility to insure proper flow

of traffic through the entire show. When large crowds gather to watch a demonstration or entertainment

and interfere with the flow of traffic down aisles or create excessive crowds in neighboring

booths, this is an infringement on the exhibitor's rights. Aisles must not be obstructed at any time.

RECEIVING AND HANDLING IN-BOUND SHIPMENTS









Freight handling charges (drayage) will be applied to all shipments received by KEC.

The charges are the responsibility of the exhibitor for whom the shipment is addressed.

Boxed, crated or palletized shipments will be received up to two (2) weeks prior to the first official show day. Early arrivals will be

charged an additional $7 per CWT for all freight that has to be stored up to an additional 14 days at our facility warehouse, either

in-bound or out-bound.

Loose shipments will only be received during official move-in hours.

All shipments must arrive prepaid and have a bill of lading attached. Bill of lading should contain the following information: the number

of pieces, type of merchandise and certified weight.

Drayage is based on incoming weight only.

KEC reserves the right to estimate the weight on shipments received without a bill of lading. In such cases, the estimated weight will be

billable and if a certified weight receipt is not provided prior to move-out.

KEC will deliver the shipment to the exhibit booth as labeled, based on the installation schedule. KEC will not be responsible for

shipments after they have been placed in the booth.

EMPTY CONTAINER STORAGE AND RETURN




KEC will provide storage labels for empty crates. The exhibitor is responsible for filling out the labels and affixing label to the crates.

KEC will remove and store the empty crates during the show.

KEC will return all empty containers at the end of the show.

OUTBOUND SHIPPING







KEC will have shipping labels, bills of lading and shipping information available prior to move-out.

The exhibitor will be responsible for packing, labeling and returning completed bills of lading to the service desk / office.

The exhibitor will be responsible for contracting carriers if other than the official show carrier.

KEC will move shipments from the exhibitors’ booth onto the outbound carrier.

KEC reserves the right to assign shipments to official carrier if not picked-up at conclusion of exhibitors’ move-out times.

Commercial carriers will not pick-up uncrated shipments. KEC reserves the right to bill exhibitors for labor and materials needed to crate or

palletize materials left for shipment.

GENERAL CONDITIONS




KEC reserves the right to correct the number of pieces the exhibitor declares to be actual pieces in the booth at time of pick-up.

KEC will not be responsible for concealed damages or loss of exhibit material left in booth for shipment at close of event.

KEC will not be responsible for items after tendered to common carrier.

KEC – Telephone & Internet / Network Services

Terms and Conditions / Payment Options

1. Smart City is the exclusive provider and installer of all Voice,

Data and Network services (wired and wireless) including

communications cabling. This includes all cabling to meeting rooms,

booths, within booths (under carpet and flooring), fiber optic, twisted

pair (Category 3, 5 and 6), coaxial and all other data and

telecommunications related cabling.

2. The use of the network connection(s) provided by Smart City may be

used only by the directors, officers and employees of the Company,

its guests, its agents and consultants while performing service for the

Company and cannot be resold or distributed to other companies

or individuals.

3. All devices for which Smart City directly or indirectly provides Internet

/ Network connectivity must pay a device charge or purchase a Smart

City assigned IP address.

4. Incentive Price applies when a completed order with payment is

received no later than 14 days prior to the first day of show move-in.

Base Price applies to (a) all orders received from One (1) to Thirteen

(13) days before show move-in has started or (b) orders received on

or before the 14 day Incentive Deadline without payment (c) orders

placed on site or after show move-in has started will be at Base

Price plus an additional 20% X Base Price.

5. Internet / Network – 10 / 100 Mbps, half / full-duplex, auto-sensing

Ethernet access to our backbone, with shared or dedicated Internet

access up to 128 Kbps or greater (depending on service ordered) via

an RJ-45 jack, is provided for each connection ordered.

6. Shared Internet Services Specific: Routers, Streaming

Applications, VoIP, DHCP, NAT or Proxy Servers are not allowed

with any of our shared Internet / Network services. This includes,

but is not limited to, NetPremium, NetStandard, NetBasic, and

NetExpress. Smart City can engineer a custom dedicated network(s)

to accommodate such special requests. Please call for quote.

7. Rates listed include a single IP address, standard installation to the

booth in the most convenient manner and does not include computer

equipment, NIC card, TCP / IP software or power to the booth.

8. Limited Availability: T-1 / DS-3 and other special circuit orders must

be placed 45 days prior to show move-in date due to limited

availability and to avoid additional charges.

9. Wireless Specific: (a) Smart City is the exclusive provider of voice,

wired and wireless data service(s) for the Facility. Wireless Devices

not authorized by Smart City are strictly prohibited. Customer(s)

that desire to showcase their wireless products must contact Smart

City 21 days in advance of show move-in to investigate the potential

of Smart City engineering a customized cohesive network to operate

without interference to other Customer(s), (applicable charges may

apply). (b) The use of any wireless device that interferes with the

facility’s 2.4 / 5.8 GHz wireless data frequency range is prohibited and

subject to disconnection at the Customer expense.

10. Unless otherwise directed, Smart City is authorized to cut floor

coverings to permit installation of service.

11. Internet Performance Disclaimer: Smart City does not guarantee the

performance, routing, or throughput; either expressed or implied, of any

data circuit(s) connectivity with regards to the Internet and / or Internet

backbone(s) beyond the Facility.

12. Only Smart City personnel are authorized to modify system wiring or

cabling. Material and equipment furnished by Smart City for this service

contract shall remain the property of Smart City.

13. CANCELLATION – There is a minimum $150 or 10% Cancellation fee

(whichever is greater). Cancellations must be in writing. Additional

cancellation charges will apply for orders that have already incurred

processing, labor, material, and / or engineering costs. Some broadband

services and special circuits cannot be cancelled once ordered and will

incur full charges listed / quoted. Credit will not be given for service(s)

installed and not used.

14. Service problems must be reported to the Smart City Service Desk.

Service claims will not be considered unless filed in writing by Customer

prior to close of show.

15. Any additional cost incurred by SMART CITY to: 1) assist in trouble

diagnosis or problem resolution found not to be the fault of SMART

CITY or 2) collect information required to complete the installation

that customer fails to provide (i.e. floor plans or special circuit

numbers) may be billed to the Customer at the prevailing rate.

16. Equipment Management: (a) Customers should pick up hubs,

wireless devices, telephone instruments and other rental equipment at

the Smart City Service Desk. (b) The Customer will be fully responsible

for the protection and safekeeping of rental equipment and will be

responsible for returning all rental equipment to the Smart City Service

Desk within one (1) hour following close of the show.

17. The prices listed on this contract do not include Federal, State, Local or

Other Taxes and Tax surcharges. Taxes / Tax surcharges will be

included on your final bill. Federal Tax ID is 65-0524748.

18. NOTE: THE CUSTOMER IS RESPONSIBLE FOR ALL

INTERNATIONAL LONG DISTANCE AND OTHER APPLICABLE

19. All Single Line, Multi-Line, and Dedicated Line Telephone services

include Directory Assistance, Information, “0+”, Operator assisted,

1-800, 950, credit card type call usage and unlimited Domestic Long

Distance. International Call charges will apply.

20. Long Distance (International Calls) and Line Restrictions: (a) Credit

Card restriction will only allow Local, “1-800” and Credit Card calling. Intl

restriction will block all International calling but allow all other type calls.

(b) All lines will be blocked from “976” and “900” dialing unless otherwise

requested. Additional deposits may be applicable. (c) Smart City will

provide a detailed listing of all toll / billable type calls made from

applicable services. Additional LD deposits required for Intl companies.

21. A per line move fee starting at $100 (Telephone), $200 (Internet) may

apply to relocate the line(s) after it is installed.

22. Prices are based upon current rates and are subject to change without

notice.

(1) All Customer contracts and agreements are solely between SMART CITY and the prospective Customer; (2) SMART CITY is not the employee, agent or

partner of the Facility; (3) The Facility is not a party to, nor shall it have any obligations or liabilities whatsoever to any Customer, under any Customer Contract

including without limitation, the obligation to provide any of the services covered by such Customer Contract; (4) No representations or warranties are being made

by the Facility with respect to any Customer Contract or any Communications Services; (5) The right of the Customer to receive any Communications Service will

be terminated if this Agreement is terminated for any reason provided therein; and the Facility will have no obligation to continue providing such service unless the

Facility elects in its sole discretion to continue to provide such services itself or through a third party; (6) The provisions of the Customer Contract are separate and

independent from the provisions of the Customer’s lease space in the building and shall not affect the Customer’s obligations under such lease and without limiting

the foregoing, in no event shall any default by SMART CITY under the Customer Contract or any failure with respect to any Communications Services have any

effect on any Customer’s obligations to the Facility under any lease or any other occupancy agreement between such Customer and the Facility.

23. A valid Credit Card number with signature MUST be on file regardless of payment method.

For your convenience we will use this authorization to charge your credit card for any

additional amounts incurred.

24. Smart City accepts payments in US dollars, Checks drawn on a US bank, Wire Transfers or the

following Credit Cards: (Amex, MasterCard, Visa,). Make all checks payable to: Smart City.

25. Due to the cost of processing checks, any refunds due in the amount of $10.00 or less will not be

refunded except upon written request.

The Network Security Policy implemented for this Facility requires Customer(s) adherence to several necessary precautions in order for

Smart City to maintain a healthy, viable network for all Customers. This declaration of compliance with the security requirements as

noted herein is an acknowledgement of Smart City’s filtering policies and must be completed, signed by an authorized Customer

representative and mailed or faxed to Smart City prior to the requested network service(s) being activated for Customer’s usage.

Network Security Policy:

Smart City requires that all devices directly or indirectly accessing Smart City’s network(s) have the latest virus scan software,

Windows® security updates, system patches, and any other technological precautions necessary to protect the Customer(s) and others

from viruses, malicious programs, and other disruptive applications. Any device(s) which adversely impacts Smart City’s network(s) may

cause service interruptions to Customer(s) which can lead to disconnection of the Customer’s equipment from the network(s), with or

without prior notice at Smart City’s sole discretion. The device(s) in question will remain disconnected until all issues are adequately

resolved. All charges will apply and no refunds will be given. Additional charges may apply for trouble diagnosis and / or problem

resolution.

Smart City has implemented filtering policies on all Internet routers. These filters block all inbound Internet Control Message Protocol

(ICMP) -- Ping, Traceroute, etc. -- destined to any Smart City Network(s). Smart City understands that Ping and Traceroute are valuable

troubleshooting tools; therefore Smart City’s Policy does allow ICMP (Ping & Traceroute) packets sourced from any Smart City

network(s).

Further, to avoid infection by common Internet worms (Nachi, MSBlaster, LoveSAN, etc.), Smart City has implemented similar filters on

the following TCP and UDP port numbers: UDP – 137, 138, 402, 1434 and TCP – 135, 139, 402, 445, 4444.

Customers requiring inbound or outbound access to any of the filtered ports, should contact a Smart City customer service

representative in advance of the event with details of the specific requirements so that Smart City may consider the potential of a

customized alternative.

Each Customer’s business is important to Smart City and with advanced and timely notification of a Customer’s needs we are confident

that we can provide network services that perform as expected for all clients.

Voice and Data communications cabling. Smart City is the exclusive installer of Voice and Data communications

cabling. Smart City provides cabling to booths, within booths (under carpet and flooring) and from booth-to-booth. Fiber Optic, twisted

pair (Category 3, 5 and 6), coaxial and all other data and telecommunication cable fall under Smart City’s area of expertise.

IMPORTANT!! Prior to installation of service, a complete floor plan is required. Please utilize this grid should you not have your own

floor plan to send us. You may use a different floor plan for each service group (Telephone, Internet, etc.) or combine all services on one

floor plan. For a floor plan to be considered complete it must include all the information listed below (Main Distribution Location “MDL”,

designated location of items within the booth, surrounding booths, scale-length and width).

Smart City AUDIO/VISUAL EXHIBITOR SERVICE AGREEMENT

GENERAL TERMS AND CONDITIONS OF RENTAL OR SALE

HOURS OF OPERATION: Our AV office hours are 8am – 5pm Monday through Friday with emergency hotline available. Our offices are

closed New Years Day, Memorial Day, Independence Day, Labor Day, Thanksgiving, and Christmas.

24-HOUR SERVICE: A technician is on call 24-hours to serve our customers. Our AV Emergency Tech number is on our voice mail

recording and may be issued to clients, as necessary, to ensure the comfort level they require. Services required on short notice may be subject

to minimum labor charges and equipment substitution based on availability.

LABOR POLICY: Overtime (1.5x) rates are charged Monday through Friday before 8AM and after 5PM, weekends, and holidays. Hourly

Rate Daily Scale: After 10 hours worked, hourly rates increase (1.5x). After 12 hours worked, hourly rates increase (2.0x). Day rates are billed

at a 10 hour rate. After 10 hours worked in one day, labor rates are calculated hourly at an increased rate (1.5x). After 12 hours worked, the

hourly rate increases (2.0x). Labor is calculated in hour and half-hour increments only. Weekend labor requests are subject to a 4 hour

minimum call.

PRICING: Quoted prices may not include tax or variable expenses such as shipping, delivery or labor charges. The customer agrees to pay

SMART CITY for the total charges.

PAYMENT: All orders are to be paid in ADVANCE. If not paid within these terms, customer agrees that the invoice shall be subject to

interest from the due date: and if not paid, customer agrees to pay all of SMART CITY’S cost of collection, including attorney’s fees.

Acceptable forms of payment are cash, company check, Mastercard, Visa, or American Express. Personal checks are accepted with proper

identification. The customer agrees to pay a service charge of $50.00 applied to each returned check accepted for payment by SMART CITY.

EXCEPT AS EXPRESSLY PROVIDED, THERE IS NO WARRANTY OR GUARANTY OF MERCHANTABILITY OR FITNESS FOR A

PARTICULAR PURPOSE; OR ANY OTHER KIND, EXPRESSED OR IMPLIED, WITH RESPECT TO THE SERVICES PERFORMED

OR EQUIPMENT PROVIDED BY SMART CITY.

RENTAL TERMS AND CONDITIONS

RESPONSIBILITY: The customer accepts full financial responsibility for rental items and accessory items from the time of receipt or delivery

until the time of return to SMART CITY personnel. The customer has inspected and has found all equipment delivered under this agreement to

be in good condition and working order. The customer agrees to return said equipment to SMART CITY in the same good condition and

working order as upon delivery. Customer agrees to immediately notify SMART CITY of any and all problems or concerns; or will accept all

financial responsibility for the equipment in their possession. SMART CITY will use reasonable efforts to assist Customer in complying with

its corporate policies as furnished to SMART CITY; provided, that SMART CITY will not be held liable to the Customer or any other party for

failure to adhere to the Customer's corporate policies, except due to SMART CITY’s willful misconduct or gross negligence.

CHARGES: The customer agrees to pay all rental charges for the equipment delivered at the daily rates set forth in the agreement for each day

or partial day until the equipment is returned to SMART CITY.

CANCELLATIONS: Exhibitor orders cancelled upon delivery will be charged 100% of the rental charge for SMART CITY’s equipment,

sublet items, applicable delivery and labor charges. In the event that the rental includes labor and is cancelled upon delivery or day of delivery,

SMART CITY will invoice customer for all labor charges ordered. Credit will not be given for service(s) installed but not used.

DELIVERY: Delivery and pick up service is available. The delivery charge is based on dollar amount of rental and delivery site. Customer

pick-up rental orders may be picked up after 3pm on the day prior to usage date and need to be returned before 10am on the day following

usage to avoid any additional rental charges. Any deviation must be pre-authorized.

DEPOSITS: A security or damage deposit may be required. Deposits may be applied to invoice, refunded upon return or applied to late return

charges, loss or damage.

CUSTOMER SERVICE ISSUES: Service claims must be reported to a Smart City representative. Service claims will not be considered

unless filed in writing by customer prior to close of show.

SALE TERMS AND CONDITIONS

TITLE: Title to goods or materials covered by this agreement remains with SMART CITY until the full purchase price is paid.

PAYMENT: Some items may require a 100% pre-payment or a deposit of up to 50% of the purchase price. Orders for items not normally

stocked will require full pre-payment and are non-refundable after the date the item is ordered. Any deviation must be pre-authorized.

RETURNS: Sold merchandise may not be returned without prior authorization and is subject to SMART CITY’s inspection. All original

packaging is required. Return freight charges must be prepaid. A minimum handling or re-stocking fee of 10% will be charged on all returned

goods unless the return is due to the error of SMART CITY. Credit may also be subject to factory approval and the credit shall be the lower of

the purchase price or SMART CITY’s selling price at the time of return.

SHORTAGES: Shortages and/or claims must be made within seven (7) days of receipt.

1. Wall, column and permanent building utility outlets are not a part of booth

space and are not to be used by exhibitors unless specified otherwise.

2. All equipment regardless of source of power must comply with all national,

state and local safety codes.

3. Claims will not be considered unless filed by exhibitor prior to close of

show.

4. Prices based on current wage rates and are subject to change without notice.

5. Special equipment requiring company engineers or technicians for assembly,

servicing, preparatory work and operation may be executed without “house

electrician”. However, all service connections and overload protection to such

equipment must be made by “house electrician”.

6. All equipment must be properly tagged and wired with complete information

as to type of current, voltage, phase, cycle, horsepower, etc.

7. All material and equipment furnished by K.E.C. for this service order shall

remain K.E.C.’s property and shall be removed ONLY by K.E.C. at the

close of the show.

8. Unless otherwise directed, K.E.C. electricians are authorized to cut floor

coverings to permit installation of service.

9. All exhibitor’s cords must be the 12/3 wire grounded type. All exposed noncurrent

carrying metal parts of fixed equipment, which are liable to be

energized, shall be grounded.

10. Rates quoted for all connections cover only the bringing of service to the

booth in the most convenient manner and do not include connection

equipment or special wiring.

11. Discount orders must be postmarked a minimum of twenty-one (21) days prior

to first show day.

12. All fountains and pumps should have Ground Fault Interruption (G.F.I.)

CONDITIONS & REGULATIONS

1. Wall, column and permanent building utility outlets are not a part of booth space

and are not to be used by exhibitors unless specified otherwise.

2. All equipment regardless of source of power must comply with all national, state

and local safety codes.

3. Claims will not be considered unless filed by exhibitor prior to close of exhibit

ion.

4. Prices based on current wage rates and are subject to change without notice.

5. Special equipment requiring company engineers or technicians for assembly,

servicing, preparatory work and operation may be executed without “house

electrician”. However, all service connections and overload protection to such

equipment must be made by “house electrician”.

6. All equipment must be properly tagged and wired with complete information as

to type of current, voltage, phase, cycle, horsepower, etc.

7. All material and equipment furnished by K.E.C. for this service order shall

remain K.E.C.’s property and shall be removed ONLY by K.E.C. at the close

of the show.

8. All exhibitor’s cords must be the 12/3 wire grounded type. All exposed

noncurrent carrying metal parts of fixed equipment, which are liable to be

energized, shall be grounded.

9. Rates quoted for all connections cover only the bringing of service to the booth in

the most convenient manner and do not include connection equipment or special

wiring.

10. Discount orders must be postmarked a minimum of twenty-one (21) days prior to

first show day.

11. Any service supplied where normally unavailable add labor and materials costs to

electrical service connection charge.

12. All fountains and pumps should have Ground Fault Interruption (G.F.I.) protection.
