<strong>OF</strong>FICIAL <strong>PLAN</strong> AMENDMENT NO. 161<br />
TO THE CITY <strong>OF</strong> OSHAWA<br />
<strong>OF</strong>FICIAL <strong>PLAN</strong><br />
In accordance with Section 17 (23) <strong>of</strong> the Planning Act, R.S.O. 1990, as amended, be advised<br />
that By-law 55-2013 adopting Official Plan Amendment No. 161 to the <strong>City</strong> <strong>of</strong> <strong>Oshawa</strong> Official<br />
Plan was passed by the Council <strong>of</strong> the <strong>City</strong> <strong>of</strong> <strong>Oshawa</strong> on the twenty-first day <strong>of</strong> May, 2013.<br />
The amendment relates to certain lands located west <strong>of</strong> Simcoe Street North north <strong>of</strong> the<br />
Britannia Avenue extension.<br />
The purpose and effect <strong>of</strong> Amendment Number 161 to the <strong>Oshawa</strong> Official Plan is to:<br />
(a)<br />
(b)<br />
Amend the Part I <strong>Oshawa</strong> Official Plan to redesignate the north-south Type “C” Arterial<br />
Road between the east-west Collector Road and Winchester Road West to a Collector<br />
Road and to delete the north-south Type “C” Arterial Road between future Britannia<br />
Avenue and the east-west Collector Road and add a new Collector Road; and<br />
Amend the Windfields Part II Plan by redesignating the north-south Type “C” Arterial<br />
Road located between future Britannia Avenue and the east-west Collector Road to a<br />
Collector Road to the east, redesignating the Separate Elementary School to Low<br />
Density Residential; redesignating the Neighbourhood Park to Separate Elementary<br />
School; redesignating the Convenience Commercial Centre to Low Density Residential<br />
with a Storm Water Management Facilities symbol; redesignating the Public Elementary<br />
School to Neighbourhood Park; redesignating the Community Use Symbol to Low<br />
Density Residential; delete a part <strong>of</strong> a Recreational Trail and adding a new alignment <strong>of</strong><br />
the Recreational Trail; and redesignating certain lands from Low Density Residential to<br />
Open Space and Recreation generally west <strong>of</strong> Simcoe Street North, north <strong>of</strong> future<br />
Britannia Avenue.<br />
A copy <strong>of</strong> the Official Plan Amendment and any background material is available to the public<br />
for inspection in the Development Services Department (8 th Floor, Rundle Tower) at <strong>City</strong> Hall,<br />
50 Centre Street South between the hours <strong>of</strong> 8:30 a.m. and 4:30 p.m., Monday to Friday.<br />
The land to which the Official Plan Amendment applies is also subject <strong>of</strong> an application under<br />
the Planning Act for approval <strong>of</strong> Phase 1 <strong>of</strong> Draft Plan <strong>of</strong> Subdivision (File No. S-O-2012-01)<br />
and a related application to Amend Zoning By-law No. 60-94 (File No. Z-2012-03) to<br />
implement Phase 1 <strong>of</strong> the proposed draft plan for lands generally west <strong>of</strong> Simcoe Street North,<br />
north <strong>of</strong> the Britannia Avenue extension.<br />
The Amendment to the <strong>Oshawa</strong> Official Plan is exempt from approval by the Region <strong>of</strong><br />
Durham. The decision <strong>of</strong> Council is final if a notice <strong>of</strong> appeal in not received on or before the<br />
last day for filing a notice <strong>of</strong> appeal.<br />
The last day for filing a notice <strong>of</strong> appeal is June 18, 2013. A notice <strong>of</strong> appeal must be filed<br />
with the <strong>City</strong> Clerk <strong>of</strong> the <strong>City</strong> <strong>of</strong> <strong>Oshawa</strong> at <strong>City</strong> Hall, 50 Centre Street South. A notice <strong>of</strong><br />
appeal must set out the specific part <strong>of</strong> the proposed <strong>of</strong>ficial plan amendment to which the<br />
appeal applies and the reasons for the appeal and must be accompanied by the fee required<br />
by the Ontario Municipal Board.<br />
Only individuals, corporations or public bodies may appeal a decision <strong>of</strong> the municipality or<br />
planning board to the Ontario Municipal Board. A notice <strong>of</strong> appeal may not be filed by an<br />
unincorporated association or group. However, a notice <strong>of</strong> appeal may be filed in the name <strong>of</strong><br />
an individual who is a member <strong>of</strong> the association or the group on its behalf.
No person or public body shall be added as a party to the hearing <strong>of</strong> the appeal unless, before<br />
the plan was adopted, the person or public body made oral submissions at a public meeting or<br />
written submissions to Council or, in the opinion <strong>of</strong> the Ontario Municipal Board, there are<br />
reasonable grounds to add the person or public body as a party.<br />

FORM 1 - <strong>NOTICE</strong> <strong>OF</strong> THE PASSING <strong>OF</strong> A ZONING BY-LAW<br />
TAKE <strong>NOTICE</strong> that the Council <strong>of</strong> The Corporation <strong>of</strong> The <strong>City</strong> <strong>of</strong> <strong>Oshawa</strong> passed By-law<br />
Number 56-2013 on the 21st day <strong>of</strong> May, 2013 under Section 34 <strong>of</strong> the Planning Act, R.S.O.<br />
1990.<br />
AND TAKE <strong>NOTICE</strong> that any person may appeal to the Ontario Municipal Board in respect <strong>of</strong><br />
the by-law by filing with the Clerk <strong>of</strong> The Corporation <strong>of</strong> the <strong>City</strong> <strong>of</strong> <strong>Oshawa</strong>, not later than the<br />
18th day <strong>of</strong> June, 2013, a notice <strong>of</strong> appeal which must set out the objection to the by-law and<br />
the reasons in support <strong>of</strong> the objection. Forms and other information respecting appeals to the<br />
Ontario Municipal Board are available on the Ontario Municipal Board’s website at<br />
www.omb.gov.on.ca. The appeal must be accompanied by the Ontario Municipal Board's fee in<br />
the amount <strong>of</strong> $125.00 payable to the "Minister <strong>of</strong> Finance".<br />

EX<strong>PLAN</strong>ATORY NOTE<br />
EX<strong>PLAN</strong>ATION <strong>OF</strong> THE PURPOSE & EFFECT <strong>OF</strong> BY-LAW NUMBER 56-2013<br />
The purpose <strong>of</strong> By-law Number 56-2013 is to change the zoning for the lands generally<br />
located west <strong>of</strong> Simcoe Street North, north <strong>of</strong> future Britannia Avenue from AG-A (Agricultural)<br />
to appropriate zones to implement Phase 1 <strong>of</strong> a related draft plan <strong>of</strong> subdivision S-O-2012-01<br />
that includes single detached dwellings, semi-detached dwellings, a park, an elementary<br />
school, stormwater management facilities, a future development block and open space and<br />
valley lands.<br />
Appropriate holding symbols are applied to ensure that a Master Environmental Servicing Plan<br />
is approved and that appropriate arrangements are made for the provision <strong>of</strong> adequate<br />
services and facilities to serve the development and ensure appropriate subdivision<br />
agreements are executed. While the holding symbols are in place only model homes,<br />
temporary sales <strong>of</strong>fices, and uses permitted in the UR (Urban Reserve) Zone are permitted.<br />
The key map shows the location <strong>of</strong> the lands to which By-law Number 56-2013.<br />
The lands to which this Zoning By-law Amendment applies is also subject to Amendment<br />
Number 161 to the <strong>Oshawa</strong> Official Plan (File No. B-3100-0167) and to an application for<br />
approval <strong>of</strong> Phase 1 <strong>of</strong> a draft plan <strong>of</strong> subdivision (File No. S-O-2012-01).
