I responded to Sam's Club on Park Boulevard reference to a retail theft.<br />
Upon arrival, I spoke with the Loss Prevention, Sascha Vanderwaall, who stated he observed Karen attempting to leave the store<br />
with the aforementioned book, covered with a store flyer, and her purse in the store cart. They observed her pass all points of sale<br />
with this item in the cart. When Karen went through the point of sale, she paid for all other items in her cart, but not the book.<br />
I spoke with Karen and her Post Miranda statement was that she forgot that she had the book in the cart. Karen stated she was<br />
having her tires rotated on her boyfriend's vehicle and she knew she was going to be in the store for a while, so she grabbed a<br />
book to read and forgot to put it back.<br />
Karen denied any intent to steal the book. In my presence, Karen called her attorney, and the attorney tried to have me drop any<br />
charges and he was advised that I could not do that, that Sam's Club prosecutes all shoplifters.<br />
I issued Karen a Notice to Appear with a date of 11-17-00, at 1000 hours, at the Criminal Courts Complex. I changed the date and<br />
advised her attorney that I changed the date on the arrest affidavit to read the 17th day of November and both Karen and I initialed<br />
the date on the NTA.<br />
Karen was issued a Trespass Warning in my presence by Sascha.<br />
Disposition: Case closed with arrest and Trespass Warning issued.<br />
