price regulation No. 134 which was issued '
March 28 by the Office of Price Stabilization
and became effective April 7. The
regulation establishes ceiling prices for the
sale of food items and beverages which
were formerly controlled by CPR No. 11.
Pi'ices are frozen at the highest level as of
Feb. 3 through 9, 1952.
The regulation does not apply to thea- :
tres selling only candy bars, nuts, popcorn,
i
gum, potato chips, pretzels, packaged confections,
cookies or crackers, ice cream
cones, prepacked individual portions of ice
cream, coffee, fruit juice or soft drinks
'Other than drinks containing ice cream).
It also does not apply where food items or
beverages are sold only by coin-operated
machines.
DRIVE-INS AFFECTED MOST
Outdoor theatres selling hot dogs, fountain
drinks made with ice cream and a
variety of other items will be affected most
by this regulation, but some indoor theatres
may also come under the regulation.
Frozen prices are subject to adjustment
up to June 1 if a theatre, during its most
recent four-month compliance period under
CPR No. 11 was charging prices lower than
those permitted by that regulation. Exhibitors
may make their own adjustment if they
apply it to all items. If adjustments are to
be made on only a liimted number of items,
application must be made to the nearest
OPS district office for a form to be filed
for this purpose. After June 1 no further
changes may be made in ceiling prices un-
specifically authorized by the OPS.
less
Special posters have been mailed to exhibitors
by the OPS, and are to be filled in
with the food items and beverages and
their ceiling prices. These posters must be
posted where they will be plainly seen.
RECORDS MUST BE KEPT
Ceiling price lists must be filed with the
district OPS office, and exhibitors or concessionaires
must keep all invoices and
other records covering the cost and sales of
items used to compute the food cost per
dollar of sales for the base period and any
compliance period under CPR No. 11, and
all future records relating to prices, food
costs and sales.
If a drive-in theatre was not open during
the week of Feb. 3, 1952, its ceilings are
the highest prices charged during the last
month of the most recent corresponding
seasonal period.
New establishments not in operation during
the base period are to use the same
ceilings as their nearest comparable establishment.
Circuits must treat each theatre concession
separately for the purposes of this
regulation.
