Town of Hamburg Board of Zoning Appeals Meeting March 6, 2012 Minutes The Town of Hamburg Board of Zoning Appeals met for a Regular Meeting on Tuesday, March 6, 2012 at 7:00 P.M. in Room 7B of Hamburg Town Hall, 6100 South Park Avenue. Those attending included Chairman Brad Rybczynski, Commissioner Jack Rahill, Commissioner Louis M. Chiacchia, Commissioner Richard Dimpfl and Commissioner Joseph Sacco. Others in attendance included Planning Consultant Sarah desJardins. Excused: Vice-Chairman Shawn Connolly, Commissioner Paul Eustace Commissioner Rahill read the Legal Notice of Public Hearing. Tabled application # 5366 Save-A-Lot – Requesting an area variance for building signage at 6000 South Park Avenue Kevin Connolly, owner of the new Save-A-Lot store located at 6000 South Park Avenue, and Patrick Fino from Timoney Technology, Inc. appeared on behalf of the request. Mr. Fino stated that the “Save-A-Lot” portion of the sign on the building is up because it met the sign area requirements of the Town. He noted that the “Food Stores” portion of the sign requires a variance because the entire sign (“Save-A-Lot Food Stores”) exceeds the maximum area allowed for a building sign. He further stated that the applicant is requesting a 40 sq.ft. area variance. In response to a question from Chairman Rybczynski, Mr. Fino stated that the proposed signage is the corporate logo. He further stated that the signage covers approximately 25% to 30% of the building façade. Mr. Connolly stated that there are variations to the signage at other Save-A-Lot stores, but generally they look like the one on this building in Hamburg. Findings: Mr. Rahill made a MOTION, seconded by Mr. Chiacchia, to approve Application # 5366. On the question: Mr. Rahill reviewed the area variance criteria: Whether benefit can be achieved by other means feasible to applicant – no. Undesirable change in neighborhood character or to nearby properties – no. Whether the request is substantial – no. Whether request will have adverse physical or environmental effects – no. Whether alleged difficulty is self-created – no. All members voted in favor of the motion. GRANTED. 1
