The <strong>City</strong> <strong>of</strong> <strong>Stirling</strong> rangers will conduct inspections <strong>of</strong><br />
properties for restricted breed owners to ensure compliance<br />
with these regulations. A $50.00 fee is payable to assist with<br />
the cost <strong>of</strong> the inspections.<br />
<strong>Restricted</strong> <strong>Breed</strong> <strong>Dogs</strong><br />
Important information for owners <strong>of</strong><br />
restricted breed dogs<br />
• Are your fences constructed <strong>of</strong> material capable <strong>of</strong><br />
confining the dog?<br />
• Are your fences <strong>of</strong> adequate height to contain the dog?<br />
• Do the fences and gates prevent your dog from escaping?<br />
• Are the fences childpro<strong>of</strong> and secure?<br />
• Are all entrances to where the dog is kept signposted<br />
with the correct ‘Dangerous Dog’ signs?<br />
• Are all entrances secured with self-locking,<br />
self-closing gates?<br />
The <strong>City</strong> <strong>of</strong> <strong>Stirling</strong> can refuse or cancel a registration and<br />
seize and detain a dog if it believes that the means to confine<br />
the dog do not exist on the premises.<br />

The <strong>Restricted</strong> <strong>Breed</strong>s Regulations (2002) details restrictions<br />
regarding certain breeds <strong>of</strong> dogs. Under the laws a restricted<br />
breed dog is defined as one whose importation into Australia<br />
is prohibited under the Commonwealth Customs (Prohibited<br />
Imports) Regulations 1956.<br />

• Dogo Argentino (Argentinean Fighting Dog);<br />
• Fila Brasiliero (Brazilian Fighting Dog);<br />
• Japanese Tosa;<br />
• Perro de Presa Canario (Canary Dog);<br />
• American Pit Bull Terrier;<br />
• Pit Bull Terrier breeds; or<br />
• any dog which visibly contains traits <strong>of</strong> any <strong>of</strong> the<br />
above breeds.<br />

• historically been bred for fighting and have exceptional<br />
strength; and a<br />
• tendency to attack/fight beyond simple superiority over<br />
an ‘opponent’.<br />
While most dog owners responsibly train and control their dog,<br />
some do not. <strong>Restricted</strong> breeds have a documented history<br />
<strong>of</strong> aggressive attacks on people and other animals, and may<br />
present a threat to the community if not adequately controlled.<br />
The restrictions impose similar conditions to those that deal<br />
with dogs that have been declared dangerous under the Dog<br />
Act 1976. Owners <strong>of</strong> restricted breeds dogs must adhere to the<br />
following conditions:<br />
<strong>Restricted</strong> breed dogs must wear a prescribed collar at all<br />
times indicating that it is a restricted breed and to advise<br />
people that the dog may be dangerous.<br />
All access points to your home must display signs indicating<br />
that you have a restricted dog breed at your property. Signs<br />
need to meet standard specifications.<br />
Dangerous Dog signs and collars can be purchased from the<br />
<strong>City</strong> <strong>of</strong> <strong>Stirling</strong> at our Animal Care Facility located in Natalie<br />
Way, Balcatta.<br />
Owners are required to provide an enclosure in which to keep<br />
your dog that is capable <strong>of</strong> preventing a young child from<br />
entering and which prevents your dog from escaping the<br />
premises. The enclosure is to have a self-closing and selflatching<br />
gate that is capable <strong>of</strong> being locked.<br />
This includes in approved dog exercise areas.<br />
Persons in charge <strong>of</strong> a restricted breed dog in a public place<br />
must be over the age <strong>of</strong> 18 years.<br />
Before you sell or otherwise transfer ownership <strong>of</strong> your dog<br />
to another person you must inform the other person in writing<br />
that the dog is a restricted breed.<br />
<strong>Restricted</strong> breed dogs are to be sterilised from six months <strong>of</strong><br />
age unless there are extenuating circumstances relating to<br />
the animal’s physical condition or medical treatment.<br />
A seizure and destruction order may be obtained on your<br />
dog for failure to comply with these regulations. Provisions in<br />
the Dog Act 1976 provide for a maximum penalty <strong>of</strong> $5000.<br />
These regulations apply to all restricted breeds regardless <strong>of</strong><br />
temperament or behavioural history.
