The Restricted Breeds Regulations (2002) details restrictions
regarding certain breeds of dogs. Under the laws a restricted
breed dog is defined as one whose importation into Australia
is prohibited under the Commonwealth Customs (Prohibited
Imports) Regulations 1956.
restrIcteD BreeDs InclUDe:
• Dogo Argentino (Argentinean Fighting Dog);
• Fila Brasiliero (Brazilian Fighting Dog);
• Japanese Tosa;
• Perro de Presa Canario (Canary Dog);
• American Pit Bull Terrier;
• Pit Bull Terrier breeds; or
• any dog which visibly contains traits of any of the
above breeds.
restrIcteD BreeDs HAve:
• historically been bred for fighting and have exceptional
strength; and a
• tendency to attack/fight beyond simple superiority over
an ‘opponent’.
While most dog owners responsibly train and control their dog,
some do not. Restricted breeds have a documented history
of aggressive attacks on people and other animals, and may
present a threat to the community if not adequately controlled.
The restrictions impose similar conditions to those that deal
with dogs that have been declared dangerous under the Dog
Act 1976. Owners of restricted breeds dogs must adhere to the
following conditions:
Restricted breed dogs must wear a prescribed collar at all
times indicating that it is a restricted breed and to advise
people that the dog may be dangerous.
All access points to your home must display signs indicating
that you have a restricted dog breed at your property. Signs
need to meet standard specifications.
Dangerous Dog signs and collars can be purchased from the
City of Stirling at our Animal Care Facility located in Natalie
Way, Balcatta.
Owners are required to provide an enclosure in which to keep
your dog that is capable of preventing a young child from
entering and which prevents your dog from escaping the
premises. The enclosure is to have a self-closing and selflatching
gate that is capable of being locked.
This includes in approved dog exercise areas.
Persons in charge of a restricted breed dog in a public place
must be over the age of 18 years.
Before you sell or otherwise transfer ownership of your dog
to another person you must inform the other person in writing
that the dog is a restricted breed.
Restricted breed dogs are to be sterilised from six months of
age unless there are extenuating circumstances relating to
the animal’s physical condition or medical treatment.
A seizure and destruction order may be obtained on your
dog for failure to comply with these regulations. Provisions in
the Dog Act 1976 provide for a maximum penalty of $5000.
These regulations apply to all restricted breeds regardless of
temperament or behavioural history.
