I, FLORENCE NDEPELE MWACHANDE MUMBA, Judge <strong>of</strong> the Appeals Chamber <strong>of</strong><br />

the Internati<strong>on</strong>al Criminal Tribunal <strong>for</strong> the Prosecuti<strong>on</strong> <strong>of</strong> Pers<strong>on</strong>s Resp<strong>on</strong>sible <strong>for</strong><br />

NOTING the “Judgement <strong>an</strong>d Sentence” rendered in this case by Trial Chamber I <strong>on</strong> 1<br />

December 2003 (“Judgement”),


NOTING the “Order <strong>of</strong> the Presiding Judge Assigning Judges <strong>an</strong>d Designating the Pre-<br />

Appeal Judge”, <strong>file</strong>d <strong>on</strong> 10 December 2003, which designated me <strong>to</strong> serve as Pre-Appeal<br />

Judge in this case,<br />

NOTING that, by virtue <strong>of</strong> Rule 108bis (B) <strong>of</strong> the Rules <strong>of</strong> Procedure <strong>an</strong>d Evidence <strong>of</strong><br />

the Tribunal (“Rules”), “the Pre-Appeal Judge shall ensure that the proceedings are not<br />

unduly delayed <strong>an</strong>d shall take <strong>an</strong>y measures related <strong>to</strong> procedual matters, including the<br />

issuing <strong>of</strong> <str<strong>on</strong>g>decisi<strong>on</strong></str<strong>on</strong>g>s, orders <strong>an</strong>d directi<strong>on</strong>s with a view <strong>to</strong> preparing the case <strong>for</strong> a fair <strong>an</strong>d<br />

expeditious hearing”,<br />

BEING SEISED OF the “Notice <strong>of</strong> Moti<strong>on</strong> <strong>for</strong> <strong>an</strong> Extensi<strong>on</strong> <strong>of</strong> <strong>time</strong> <strong>to</strong> <strong>file</strong> Appell<strong>an</strong>t’s<br />

Notice <strong>of</strong> Appeal <strong>an</strong>d Brief Pursu<strong>an</strong>t <strong>to</strong> Rules 108, 111 & 116 <strong>of</strong> RPE” (“Appell<strong>an</strong>t” <strong>an</strong>d<br />

“Moti<strong>on</strong>” respectively) <strong>file</strong>d <strong>on</strong> 8 December 2003, in which the Appell<strong>an</strong>t notes that, he<br />

is unable <strong>to</strong> underst<strong>an</strong>d the Judgement rendered <strong>on</strong>ly in English <strong>an</strong>d that neither his Lead<br />

Counsel nor Legal Assist<strong>an</strong>t, speak French ; he there<strong>for</strong>e requests the Appeals Chamber :<br />

(i) To gr<strong>an</strong>t him a thirty (30) day extensi<strong>on</strong> <strong>of</strong> <strong>time</strong> <strong>to</strong> <strong>file</strong> the Notice <strong>of</strong> Appeals from the<br />

date that the French tr<strong>an</strong>slati<strong>on</strong> <strong>of</strong> the Judgement <strong>an</strong>d Sentence is served <strong>on</strong> the<br />

Appell<strong>an</strong>t,<br />

(ii) A seventy-five (75) day extensi<strong>on</strong> <strong>of</strong> <strong>time</strong> <strong>to</strong> <strong>file</strong> the Appell<strong>an</strong>t’s Brief from the date<br />

the Notice <strong>of</strong> Appeals is <strong>file</strong>d with the Registry,<br />

(iii) To direct the Registrar <strong>to</strong> produce the French tr<strong>an</strong>slati<strong>on</strong> <strong>of</strong> the Judgement <strong>an</strong>d<br />

Sentence without delay,<br />

(iv) To direct the Registrar <strong>to</strong> notify the Lead Counsel when the French tr<strong>an</strong>slati<strong>on</strong> <strong>of</strong> the<br />

Judgement is served <strong>on</strong> the Appell<strong>an</strong>t by faxing a copy <strong>to</strong> his <strong>of</strong>fice.<br />

NOTING the “Prosecuti<strong>on</strong> Resp<strong>on</strong>se <strong>to</strong> Defence Notice <strong>of</strong> Moti<strong>on</strong> <strong>for</strong> <strong>an</strong> Extensi<strong>on</strong> <strong>of</strong><br />

Time <strong>to</strong> File Apell<strong>an</strong>t’s Notice <strong>of</strong> Appeal <strong>an</strong>d Brief Pursu<strong>an</strong>t <strong>to</strong> Rules 108, 111 & 116 <strong>of</strong><br />

the RPE”, <strong>file</strong>d <strong>on</strong> 12 December 2003 (“Prosecuti<strong>on</strong> Resp<strong>on</strong>se”),<br />

NOTING that Rule 108 <strong>of</strong> the Rules provides that “a party seeking <strong>to</strong> appeal a judgement<br />

or sentence shall, not more th<strong>an</strong> thirty days from the date <strong>on</strong> which the judgement or the<br />

sentence was pr<strong>on</strong>ounced, <strong>file</strong> a <strong>notice</strong> <strong>of</strong> appeal, setting <strong>for</strong>th the grounds”,<br />

NOTING that Rule 116 <strong>of</strong> the Rules provides that :<br />

(A) The Appeals Chamber may gr<strong>an</strong>t a moti<strong>on</strong> <strong>to</strong> extend a <strong>time</strong> limit up<strong>on</strong> a showing <strong>of</strong><br />

good cause.<br />

(B) Where the ability <strong>of</strong> the accused <strong>to</strong> make full <strong>an</strong>swer <strong>an</strong>d defence depends <strong>on</strong> the<br />

availability <strong>of</strong> a <str<strong>on</strong>g>decisi<strong>on</strong></str<strong>on</strong>g> in <strong>an</strong> <strong>of</strong>ficial l<strong>an</strong>guage other th<strong>an</strong> that in which it was originally<br />

issued, that circumst<strong>an</strong>ce shall be taken in<strong>to</strong> account as a good cause under the present<br />

Rule.<br />

CONSIDERING that Article 31 <strong>of</strong> the Statute <strong>of</strong> the Tribunal provides that “the working<br />

l<strong>an</strong>guages <strong>of</strong> the Internati<strong>on</strong>al Tribunal <strong>for</strong> Rw<strong>an</strong>da shall be English <strong>an</strong>d French”,


CONSIDERING that Article 30(4)(a) <strong>of</strong> the Statute <strong>of</strong> the Tribunal provides that in<br />

determinati<strong>on</strong> <strong>of</strong> <strong>an</strong>y charge against the accused, the accused shall be entitled <strong>to</strong> be<br />

“in<strong>for</strong>med promptly <strong>an</strong>d in detail in a l<strong>an</strong>guage which he or she underst<strong>an</strong>ds <strong>of</strong> the nature<br />

<strong>an</strong>d cause <strong>of</strong> the charge against him or her”,<br />

CONSIDERING that “good cause” within the me<strong>an</strong>ing <strong>of</strong> Rule 108(A) <strong>of</strong> the Rules has<br />

not been shown, given that the Lead Counsel <strong>for</strong> the Appell<strong>an</strong>t speaks English fluently<br />

<strong>an</strong>d is able <strong>to</strong> underst<strong>an</strong>d the Judgement rendered in English <strong>on</strong> 1 December 2003, <strong>an</strong>d is<br />

able <strong>to</strong> discuss possible grounds <strong>of</strong> appeal with the Appell<strong>an</strong>t <strong>an</strong>d <strong>to</strong> advise him <strong>of</strong><br />

potential errors <strong>of</strong> fact <strong>an</strong>d law c<strong>on</strong>tained therein,<br />

CONSIDERING that <strong>an</strong> applicati<strong>on</strong> <strong>for</strong> leave <strong>to</strong> vary the grounds <strong>of</strong> appeal may be<br />

gr<strong>an</strong>ted after the Judgement becomes available in French, where good cause is shown,<br />

CONSIDERING however, that it is in the interests <strong>of</strong> justice <strong>to</strong> allow the Appell<strong>an</strong>t a<br />

reas<strong>on</strong>able <strong>time</strong> <strong>to</strong> read the Judgement in a l<strong>an</strong>guage he underst<strong>an</strong>ds <strong>an</strong>d <strong>to</strong> c<strong>on</strong>sult with<br />

his counsel be<strong>for</strong>e filing his Appell<strong>an</strong>t’s brief,<br />

FINDING that, pursu<strong>an</strong>t <strong>to</strong> Rule 116 (B) <strong>of</strong> the Rules, “good cause” is shown <strong>to</strong> gr<strong>an</strong>t <strong>an</strong><br />

extensi<strong>on</strong> <strong>of</strong> <strong>time</strong> <strong>of</strong> 45 days, from the date <strong>of</strong> filing <strong>of</strong> the French tr<strong>an</strong>slati<strong>on</strong> <strong>of</strong> the<br />

judgement, <strong>for</strong> the filing <strong>of</strong> the Appell<strong>an</strong>t’s brief,<br />

FOR THE FOREGOING REASONS,<br />

ORDER the Appell<strong>an</strong>t <strong>to</strong> <strong>file</strong> his <strong>notice</strong> <strong>of</strong> appeal no later th<strong>an</strong> 31 December 2003, <strong>an</strong>d <strong>to</strong><br />

<strong>file</strong> his Appell<strong>an</strong>t’s brief no later th<strong>an</strong> 29 March 2004.<br />

DIRECT the Registrar <strong>to</strong> have the tr<strong>an</strong>slati<strong>on</strong> <strong>of</strong> the Judgement available in French <strong>an</strong>d<br />

served <strong>on</strong> the Accused no later th<strong>an</strong> 11 February 2004.<br />

D<strong>on</strong>e in French <strong>an</strong>d English, the English text being authoritative.<br />
