part-time employee. Seniority credited on this basis shall apply only in <strong>the</strong> case <strong>of</strong> promotions<br />

and/or transfers.<br />

45. An employee shall have no seniority for <strong>the</strong> initial probationary period, but upon<br />

completion <strong>of</strong> <strong>the</strong> probationary period, seniority shall be retroactive to <strong>the</strong> date <strong>of</strong> hire.<br />

46. Seniority shall be broken (or terminated) when an employee:<br />

[a]<br />

[b]<br />

Quits or resigns;<br />

Is discharged for just cause;<br />

[ c] Is laid <strong>of</strong>f for a period <strong>of</strong> more than twenty-four (24) consecutive months;<br />

[ d] Is absent without leave for five (5) consecutive working days and fails to give<br />

proper excuse or notice <strong>of</strong> <strong>the</strong> reason(s) for such absence, unless <strong>the</strong> failure to<br />

give notice was beyond <strong>the</strong> reasonable control <strong>of</strong> <strong>the</strong> employee;<br />

Fails to report for work when recalled from lay<strong>of</strong>f within ten (10) working days<br />

from <strong>the</strong> date on which <strong>the</strong> City sends <strong>the</strong> employee notice by certified mail to <strong>the</strong><br />

employee's last known address as shown on <strong>the</strong> City's records;<br />

Is promoted to a non-bargaining unit position and successfully completes his<br />

promotional probationary period.<br />

47. Once every six (6) months, <strong>the</strong> City shall provide <strong>the</strong> Union with two (2) computergenerated<br />

copies <strong>of</strong> a current seniority list grouped by job classification in order <strong>of</strong> job<br />

classification seniority. This list shall contain name, social security number, organizational<br />

number, date <strong>of</strong> hire, job classification seniority date, employee identification number and hourly<br />

rate <strong>of</strong> pay. The City shall meet with <strong>the</strong> Union whenever necessary to correct any errors and<br />

within twenty (20) working days <strong>of</strong> <strong>the</strong> date <strong>the</strong> errors are brought to <strong>the</strong> City's attention,<br />

corrected copies <strong>of</strong> <strong>the</strong> list shall be provided to <strong>the</strong> Union.<br />

48. The City shall fumish a monthly list to <strong>the</strong> Union showing name, social security number,<br />

address, date <strong>of</strong> hire, employee's shift, work location, job classification seniority, organizational<br />

number, job classification and employee identification numbers <strong>of</strong> new bargaining unit<br />

employees. On a monthly basis, <strong>the</strong> City agrees to provide <strong>the</strong> Union with a list <strong>of</strong> all ADA<br />

placements within <strong>the</strong> bargaining unit.<br />

49. It is <strong>the</strong> obligation <strong>of</strong> each employee to keep <strong>the</strong> City advised <strong>of</strong> his current address and,<br />

for purposes <strong>of</strong> this Contract, <strong>the</strong> City shall rely on <strong>the</strong> last address supplied by <strong>the</strong> employee.<br />

CIVIL SERVICE<br />

50. An original appointment is <strong>the</strong> first appointment (hire) <strong>of</strong> an employee in <strong>the</strong> classified<br />

Civil Service <strong>of</strong> <strong>the</strong> City <strong>of</strong> Cleveland. The appointment shall be any appointment made from an<br />

eligible list. created as a result <strong>of</strong> ei<strong>the</strong>r a competitive or non-competitive entrance examination,<br />
