Conclusion<br />

Although Burma is rich <strong>in</strong> <strong>oil</strong> <strong>and</strong> <strong>gas</strong>, military leaders have been<br />

export<strong>in</strong>g <strong>the</strong>se resources <strong>for</strong> over a decade, leav<strong>in</strong>g <strong>the</strong> people to suffer<br />

from chronic energy shortages <strong>and</strong> some of <strong>the</strong> lowest development<br />

<strong>in</strong>dicators <strong>in</strong> <strong>the</strong> world.<br />

How <strong>revenue</strong>s from <strong>the</strong> sale of <strong>gas</strong> resources are spent is not known,<br />

yet it is clear that government spend<strong>in</strong>g <strong>for</strong> social development is<br />

paltry while <strong>the</strong> military cont<strong>in</strong>ues to exp<strong>and</strong>. Inequitable shar<strong>in</strong>g of<br />

resource benefits is also contribut<strong>in</strong>g to ethnic conflicts.<br />

Although a new “civilian” government is now <strong>in</strong> place, under Burma’s<br />

new constitution, <strong>the</strong> military rema<strong>in</strong>s firmly outside <strong>the</strong> law <strong>and</strong><br />

beyond civilian control. <strong>The</strong> role of military companies <strong>in</strong> Burma’s<br />

economy <strong>and</strong> <strong>in</strong> access<strong>in</strong>g <strong>and</strong> manag<strong>in</strong>g Burma’s massive <strong>oil</strong> <strong>and</strong> <strong>gas</strong><br />

<strong>revenue</strong>s rema<strong>in</strong> unknown <strong>and</strong> unregulated. Foreign <strong>oil</strong> companies<br />

engag<strong>in</strong>g <strong>in</strong> Burma’s <strong>oil</strong> <strong>and</strong> <strong>gas</strong> sector also refuse to publish how much<br />

<strong>and</strong> how <strong>the</strong>y pay <strong>the</strong> military regime.<br />

It is urgently needed to ensure <strong>transparency</strong> <strong>and</strong> sound management<br />

of <strong>the</strong> country’s largest source of <strong>for</strong>eign <strong>in</strong>come - <strong>revenue</strong>s from <strong>the</strong><br />

export of <strong>oil</strong> <strong>and</strong> <strong>gas</strong> - <strong>and</strong> address military dom<strong>in</strong>ance <strong>in</strong> <strong>the</strong> economy.<br />

Without this, <strong>in</strong>stead of contribut<strong>in</strong>g to a susta<strong>in</strong>able development, <strong>oil</strong><br />

<strong>and</strong> <strong>gas</strong> resources <strong>in</strong> Burma will simply prolong <strong>the</strong> country’s resource<br />

curse.<br />

In order to ensure that <strong>oil</strong> <strong>and</strong> <strong>gas</strong> <strong>revenue</strong>s are managed properly,<br />

<strong>and</strong> to provide a benchmark <strong>for</strong> track<strong>in</strong>g <strong>the</strong> use of those <strong>revenue</strong>s,<br />

an accountable <strong>revenue</strong> management system is needed. This could<br />

take <strong>the</strong> <strong>for</strong>m of a constitutional m<strong>and</strong>ate followed by more specific<br />

national legislation, or simply national legislation that comprehensively<br />

regulates <strong>the</strong> use of funds. At m<strong>in</strong>imum, <strong>the</strong>re must be <strong>oil</strong> <strong>and</strong> <strong>gas</strong> fund<br />

laws that clearly cover <strong>the</strong> follow<strong>in</strong>g elements:<br />

1 Def<strong>in</strong>ition of <strong>the</strong> <strong>revenue</strong> streams <strong>in</strong>cluded <strong>in</strong> general <strong>oil</strong> <strong>and</strong> <strong>gas</strong><br />

<strong>revenue</strong>s;<br />

2 Instructions <strong>for</strong> deposit of <strong>oil</strong> <strong>and</strong> <strong>gas</strong> <strong>revenue</strong>s;<br />

3 Restrictions on who can access <strong>revenue</strong>s <strong>and</strong> how <strong>the</strong>y are used;<br />

4 Detailed <strong>in</strong>structions <strong>for</strong> remov<strong>in</strong>g <strong>and</strong> us<strong>in</strong>g deposited funds;<br />

5 Shar<strong>in</strong>g <strong>and</strong> distribution of <strong>oil</strong> <strong>and</strong> <strong>gas</strong> <strong>revenue</strong>s with people<br />

(affected communities <strong>and</strong> owner states) of Burma;<br />

6 Public report<strong>in</strong>g on <strong>in</strong>flows received, expenditures <strong>and</strong> <strong>in</strong>terest<br />

earned;<br />

7 Oversight, <strong>in</strong>clud<strong>in</strong>g <strong>in</strong>dependent audit<strong>in</strong>g.<br />
