<strong>Part</strong> objective<br />
<strong>Part</strong> <strong>32</strong> sets out the requirements for seafarer certificates. It provides for domestic certificates and, in<br />
addition, certificates that correspond to those provided for in the International Convention on<br />
Standards of Training, Certification and Watchkeeping for <strong>Seafarer</strong>s, 1978, as amended (STCW).<br />
At the time this <strong>Part</strong> is made, <strong>New</strong> <strong>Zealand</strong> has not ratified the International Convention on Standards<br />
of Training, Certification and Watchkeeping for Fishing Ship Personnel, 1995 (STCW-F). The STCW-F<br />
certificates provided for in this <strong>Part</strong> are therefore domestic certificates but are separately described<br />
and provided for with reference to STCW-F as a suitable international standard.<br />
The authority for making <strong>Part</strong> <strong>32</strong> is found in section 36 (1)(b), (o), (s), and (u) of the <strong>Maritime</strong> Transport<br />
Act 1994.<br />

General<br />
<strong>32</strong>.01 Application<br />
This <strong>Part</strong> applies to persons seeking the issue, recognition, or revalidation of certificates or<br />
endorsements under the Act and the provisions of this <strong>Part</strong>.<br />
<strong>32</strong>.02 Definitions<br />
In this <strong>Part</strong>—<br />
Act means the <strong>Maritime</strong> Transport Act 1994:<br />
ancillary competence means a competence that is prescribed as an ancillary competence<br />
in rule <strong>32</strong>.04:<br />
ancillary certificate means a certificate that is prescribed as an ancillary certificate in rule<br />
<strong>32</strong>.05:<br />
approved means approved in writing by the Director for the relevant purpose:<br />
assessment standard means a standard in the Directory of Assessment Standards:<br />
certificate means a certificate of proficiency or a certificate of competency:<br />
certificate of competency means a maritime document that the table in rule <strong>32</strong>.02 indicates<br />
is a certificate of competency and which is provided for in the relevant rule in this <strong>Part</strong>:<br />
certificate of proficiency means a maritime document that the table in rule <strong>32</strong>.02 indicates<br />
is a certificate of proficiency and which is provided for in the relevant rule in this <strong>Part</strong>:<br />
chemical tanker has the meaning given to it in the Annex to STCW:<br />
coastal area means the area within the coastal limits as defined in rule 20.2 of <strong>Part</strong> 20 of the<br />
maritime rules:<br />
commercial ship means a ship that is not—<br />
(a) a pleasure craft; or<br />
(b) solely powered manually; or<br />
(c) solely powered by sail;<br />
and includes a naval vessel 1 , but does not include a warship:<br />
competence,—<br />
(a) means a competence that is prescribed or referred to in this <strong>Part</strong> as a competence that<br />
must be demonstrated as part of the eligibility requirements for the issue of a certificate<br />
or endorsement; and<br />
(b) includes a core competence or an ancillary competence:<br />
core competence means a competence that is prescribed as a core competence in a rule in<br />
this <strong>Part</strong> setting out the eligibility requirements for a certificate:<br />
crew means the persons employed or engaged in any capacity on board a ship (except a<br />
master, a pilot, or a person temporarily employed on the ship while it is in port):<br />
demonstrate, in relation to a competence, means demonstrate knowledge, understanding<br />
and proficiency to the required level or standard of competence:<br />

Navy sea service will only be counted by actual days at sea, not including time in port except when cargo<br />
operations are being undertaken.<br />

Directory of Assessment Standards means the Directory of Assessment Standards that is<br />
provided for under the Education Act 1989:<br />
domestic certificate means a certificate provided for in subpart A of this <strong>Part</strong>:<br />
enclosed area means the area within—<br />
(a) the enclosed water limits set out in the Appendix to <strong>Part</strong> 20; and<br />
(b) all <strong>New</strong> <strong>Zealand</strong> inland waters:<br />
endorsement—<br />
(a) means an endorsement to a certificate that is provided for in this <strong>Part</strong>; and<br />
(b) includes a notation on the certificate to the effect that a person has the privileges<br />
associated with the endorsement:<br />
equivalent means an equivalent that is acceptable to the Director, subject to—<br />
(a) any further requirements of this <strong>Part</strong>; and<br />
(b) any additional requirements that the Director considers necessary to achieve<br />
equivalence:<br />
examination—<br />
(a) means a test of whether a person meets a relevant standard of competence relating to<br />
a competence or to a certificate or endorsement that is set by the Director; and<br />
(b) includes—<br />
(i) a written examination:<br />
(ii) an oral examination:<br />
(iii) a practical test.<br />
examiner means the holder of a maritime document issued under <strong>Part</strong> 35 or the Director:<br />
final examination means an examination that—<br />
(a) is required by the Director to test whether a person meets the relevant standard of<br />
competence required for the issue of a certificate or endorsement; and<br />
(b) is conducted by an examiner:<br />
fishing ship means a ship that is required to be registered under section 103 of the<br />
Fisheries Act 1996:<br />
GMDSS means Global <strong>Maritime</strong> Distress and Safety System:<br />
GT means gross tonnage:<br />
high-speed ship means a ship that is between 20 to 35 metres in length overall and that is<br />
carrying more than 50 passengers and that is operating at 20 knots or more:<br />
inshore area means within—<br />
(a) the inshore limits set out in Appendix 1 of <strong>Part</strong> 20; and<br />
(b) any defined section of the coastal area not beyond the territorial sea of <strong>New</strong> <strong>Zealand</strong><br />
which has been assigned to that ship as an inshore limit by a surveyor in accordance<br />
with <strong>Part</strong> 20:<br />
inshore fishing area means the area within the inshore fishing limits as defined in rule 20.2<br />
of <strong>Part</strong> 20 of the maritime rules:<br />
kW means kilowatts:<br />
length means 96 percent of the total length on a waterline at 85 percent of the least<br />
moulded depth measured from the top of the keel, or the length from the fore side of the<br />
stem to the axis of the rudder stock on that waterline, if that is the greater length. In ships<br />

designed with a rake of keel, the waterline on which this length is measured must be parallel<br />
to the design waterline:<br />
length overall means the length of the ship measured from the foreside of the head of the<br />
stem to the aftermost part of the transom or stern of the ship; and for the purposes of this<br />
<strong>Part</strong>—<br />
(a) does not include fittings (such as beltings, bowsprits, platforms, gantries, trim tabs, jet<br />
and outboard drive units) that project beyond these terminal points; and<br />
(b) includes structures (such as bulbous bows, deckhouses, free flooding bait tanks and<br />
buoyancy tubing) that project beyond these terminal points:<br />
liquefied gas tanker has the meaning give to it in the Annex to STCW:<br />
limited waters means waters within the combined area of the coastal limits and offshore<br />
limits, as those terms are defined in rule 20.2 of <strong>Part</strong> 20 of the maritime rules:<br />
management level means the level of responsibility associated with:<br />
(a) serving as a master, chief mate, chief engineer officer or second engineer officer; and<br />
(b) ensuring that all functions within the designated area of responsibility are properly<br />
performed:<br />
mile means a nautical mile:<br />
military ship—<br />
(a) means a ship that—<br />
(i) belongs to the armed forces of a State; and<br />
(ii) bears the external marks distinguishing the nationality of ships of that State; and<br />
(iii) is under the command of an officer duly commissioned by the Government of that<br />
State whose name appears in the appropriate service list or its equivalent; and<br />
(iv) is crewed by the crew subject to regular armed forces discipline; and<br />
(b) includes a ship requisitioned under section 10 of the Defence Act 1990:<br />
naval vessel means a ship that carries cargo or passengers or carries out operations that<br />
may be carried out by a commercial operator—<br />
(a) belonging to the armed forces of a State and bearing the external marks distinguishing<br />
the nationality of ships of that State, being a ship—<br />
(i) under the command of an officer duly commissioned by the Government of that<br />
State whose name appears in the appropriate service list or its equivalent; and<br />
(ii) crewed by crew subject to regular armed forces discipline; or<br />
(b) requisitioned under section 10 of the Defence Act 1990:<br />
near-coastal area means the combined area of the coastal limits and offshore limits, as<br />
those terms are defined in rule 20.2 of <strong>Part</strong> 20 of the maritime rules:<br />
<strong>New</strong> <strong>Zealand</strong> Qualifications Framework means the <strong>New</strong> <strong>Zealand</strong> Qualifications<br />
Framework that is provided for under the Education Act 1989:<br />
non-passenger ship means any ship that is not a passenger ship or a fishing ship, pleasure<br />
craft or a warship:<br />
NZQA registered standard means a standard listed in the Directory of Assessment<br />
Standards:<br />
offshore area means within the offshore limits defined in rule 20.2 <strong>Part</strong> 20 of the maritime<br />
rules:<br />
oil tanker has the meaning given to it in the Annex to STCW:<br />

operational level means the level of responsibility associated with maintaining direct control<br />
over the performance of all functions within a designated area of responsibility in accordance<br />
with proper procedures and under the direction of an individual serving at management level:<br />
<strong>Part</strong> means a group of rules made under the Act:<br />
passenger has the same meaning as in section 2 of the Act:<br />
passenger ship means a ship that carries more than 12 passengers on a voyage beyond<br />
restricted limits, or any passengers on a voyage within restricted limits:<br />
pleasure craft has the same meaning as in section 2 of the Act:<br />
proof means proof to the satisfaction of the Director:<br />
rating means a member of the ship’s crew other than the master or an officer:<br />
relevant standard of competence—<br />
(a) means, in relation to a certificate or endorsement, the overall level of proficiency<br />
reasonably to be expected for the proper and safe performance of functions and for the<br />
exercise of privileges associated with the relevant certificate or endorsement; and<br />
(b) includes any relevant prescribed levels or standards of competence for competencies<br />
that must demonstrated for the relevant certificate or endorsement to be issued:<br />
restricted area means the inshore and enclosed areas:<br />
revalidation—<br />
(a) in relation to a certificate, means renewal of the certificate in accordance with the<br />
applicable requirements of this <strong>Part</strong> and section 41 of the Act; or<br />
(b) in relation to an application for revalidation of STCW endorsements for masters, officers<br />
and radio officers in respect of tankers, means a renewal of the endorsement:<br />
sailing ship means a ship that—<br />
(a) is designed to be navigated under wind power alone and for which any motor provided<br />
is an auxiliary means of propulsion; or<br />
(b) ‘has a non-dimensional ratio of [sail area/(volume of displacement) 2/3] of more than 9:<br />
sea service means:<br />
(a) sea service on board one or more ships; and<br />
(b) includes seagoing service:<br />
seagoing service means sea service on board a seagoing ship:<br />
seagoing ship means a ship other than a ship that navigates exclusively within the<br />
restricted area (or, in relation to a fishing ship, the inshore fishing area), but does not include<br />
a ship that is less than 24 metres in length overall in the near-coastal area (or, in relation to a<br />
fishing ship, in limited waters):<br />
set, in relation to an examination, means—<br />
(a) to prescribe the questions for the examination; or<br />
(b) to prescribe a question framework against which questions for the examination must be<br />
asked and marked:<br />
STCW means the International Convention on Standards of Training, Certification and<br />
Watchkeeping for <strong>Seafarer</strong>s, 1978, as amended:<br />
STCW certificate means a certificate that is provided for in subpart B of this <strong>Part</strong>:<br />
STCW-F certificate means a certificate that is provided for in subpart C of this <strong>Part</strong>:<br />

STCW Code means the <strong>Seafarer</strong>s' Training, Certification and Watchkeeping Code as<br />
adopted by the 2010 Conference of <strong>Part</strong>ies to STCW, as amended:<br />
STCW-F means the International Convention on Standards of Training, Certification and<br />
Watchkeeping for Fishing Ship Personnel, 1995:<br />
support level means the level of responsibility associated with performing assigned tasks,<br />
duties or responsibilities on board a seagoing ship under the direction of an individual<br />
serving in the operational level or management level:<br />
unlimited area has the meaning given to it in rule 20.2 of <strong>Part</strong> 20 of the maritime rules:<br />
valid, in relation to an ancillary certificate, means valid in accordance with any restrictions or<br />
limitations placed on it by the issuer, including the period for which it is issued:<br />
warship has the same meaning as in section 2 of the Act.<br />

The holder meets NZQA-registered<br />
standards that relate to comprehensive first<br />
aid training to deal with life-threatening<br />
situations, offering assistance before more<br />
experienced help arrives and providing<br />
guidance to workplace colleagues, and that<br />
provide an appropriate standard for the<br />
maritime environment.<br />
<strong>32</strong>.06 Requirement to hold certificate or endorsement<br />
No person may, except under the authority of, and in accordance with, a valid certificate or<br />
endorsement issued or recognised under this <strong>Part</strong>,—<br />
(a) exercise the privileges relating to a certificate or endorsement issued under this <strong>Part</strong>; or<br />
(b) hold himself or herself out as a person who is entitled to exercise the privileges relating<br />
to a certificate or endorsement issued under this <strong>Part</strong>.<br />
Subpart A – Domestic certificates and endorsements<br />
<strong>32</strong>.20 Application for certificate of proficiency or certificate of competency<br />
An applicant for a certificate of proficiency or a certificate of competency provided for in this<br />
subpart must—<br />
(a) make an application in accordance with section 35 of the Act, in a form required by the<br />
Director, and<br />
(b) include such further relevant particulars and supporting information relating to the<br />
applicant that the Director may require; and<br />
(c) submit the application to the Director, with a payment of the appropriate application fee<br />
prescribed by the regulations made under the Act.<br />
<strong>32</strong>.21 Application for endorsement<br />
(1) An applicant for an endorsement provided for in this subpart must—<br />
(a) make an application in a form required by the Director; and<br />
(b) include such further relevant particulars and supporting information relating to the<br />
applicant that the Director may require; and<br />
(c) submit the application to the Director, with a payment of the appropriate application fee<br />
prescribed by the regulations made under the Act.<br />
(2) The privileges associated with the endorsement are additional privileges associated with a<br />
certificate that may be exercised, subject to any conditions or limitations stated in the<br />
endorsement.<br />
(3) For the avoidance of doubt, an endorsement provided for in this subpart is not a maritime<br />
document.<br />
<strong>32</strong>.22 Issue of certificates or endorsements<br />
(1) The Director must issue a certificate of competency if satisfied that the applicant meets the<br />
applicable requirements of this <strong>Part</strong> and the requirements of section 41 of the Act.<br />
(2) The Director must issue an endorsement if satisfied that the applicant meets the applicable<br />
requirements of this <strong>Part</strong>.<br />

<strong>Part</strong> <strong>32</strong>: <strong>Seafarer</strong> Certification<br />
<strong>32</strong>.23 Knowledge of English<br />
Where this subpart requires an applicant to pass an examination or a final examination, the<br />
applicant must satisfy the examiner or the person conducting the examination (as applicable)<br />
that he or she is able to converse, read and write in the English language sufficiently well to<br />
perform the duties required of a holder of the relevant certificate or endorsement for which<br />
the candidate is to be examined or tested.<br />
<strong>32</strong>.24 Term of certificates and endorsements<br />
(1) A certificate may be issued for a period not exceeding 5 years from the date of issue but may<br />
be issued for a shorter period if the Director considers it appropriate in the interests of<br />
maritime safety.<br />
(2) An endorsement expires on whichever is the sooner of:<br />
(a) the date the certificate expires (as extended in accordance with any revalidation); or<br />
(b) an earlier date indicated on the certificate.<br />
Certificates of proficiency<br />
<strong>32</strong>.25 Qualified deck crew<br />
(1) This is a certificate of proficiency.<br />
(2) The eligibility requirements relating to Qualified deck crew (QDC) are the provision of proof<br />
of the matters set out in column 3 of the following table that correspond to an item in column<br />
2:<br />
Requirement for proof that the applicant:<br />
(a) Age is at least 16 years of age.<br />
(b) Prior <strong>certification</strong> none<br />
(c) Core competencies has demonstrated, at a support level, the following<br />
core competencies by an accepted means of<br />
demonstrating competence under rule <strong>32</strong>.180 or an<br />
equivalent:<br />
(a) safe operation of the ship<br />
(b) health and safety of all persons aboard the<br />
ship<br />
(c) safety of the ship in emergency situations<br />
(d) safe navigation of the ship.<br />
(d) Final examination has passed any final examinations that the Director<br />
may require, or equivalents.<br />
(e) Sae service has completed approved sea service involving, at a<br />
minimum, completion of an approved task book<br />
while on board a commercial or military ship.<br />
(f)<br />
Ancillary competencies and<br />
ancillary certificates<br />
has demonstrated the following ancillary<br />

The privileges of a certificate of proficiency as QDC are to perform the functions of a deck<br />
crew member on ships:<br />
(a) of less than 24 metres in length overall; and<br />
(b) carrying less than 250 passengers.<br />
Certificates of competency<br />
<strong>32</strong>.27 Skipper restricted limits<br />
(1) This is a certificate of competency.<br />
(2) The eligibility requirements for a Skipper restricted limits (SRL) are the provision of proof of<br />
the matters set out in column 3 of the following table that correspond to an item in column 2:<br />

(a) Age is at least 18 years of age.<br />
(b) Prior <strong>certification</strong> none.<br />
(c) Core competencies has demonstrated, at a management level, the<br />
following core competencies by an accepted<br />
means of demonstrating competence under rule<br />
<strong>32</strong>.180 or equivalent:<br />
(a) planning & conducting a ship passage:<br />
(b) knowledge of electronic navigational<br />
systems:<br />
(c) management of ship operations:<br />
(d) management of the ship, legal compliance<br />
and emergencies:<br />
(e) legal requirements for operation of a<br />
commercial ship:<br />
(f) operation of ship’s propulsion and auxiliary<br />
machinery, and systems:<br />
(g) maintaining propulsion and auxiliary<br />
machinery and systems.<br />
(d) Final examinations has passed any final examinations that the<br />
Director may require, or equivalents.<br />
(e) Sea service has completed approved sea service involving, at<br />
a minimum, seagoing service of at least 100<br />
hours on a powered ship of any kind, including a<br />
recreational ship, and completed an approved<br />
task book while on board a ship, which may<br />
include service on a recreational ship but only if<br />
acting in the capacity of skipper.<br />

<strong>32</strong>.29 Skipper coastal/offshore less than 24m (SCO)<br />
(1) This is a certificate of competency.<br />
(2) The eligibility requirements relating to Skipper coastal/offshore less than 24m (SCO) are the<br />
provision of proof of the matters set out in column 3 of the following table that correspond to<br />
an item in column 2:<br />

(a) Prior <strong>certification</strong> holds a certificate or competency as SRL<br />
endorsed to 24 metres or equivalent.<br />
(b) Core Competencies has demonstrated, at management level, the<br />

a minimum, seagoing service of at least 12<br />
months on a ship of 12 metres or more within any<br />
operational limit while holding a certificate as<br />
Skipper restricted limits.<br />

proof of the matters set out in column 3 of the following table that correspond to an item in<br />

Director’s waiver for sections of the task book if<br />
having completed shore-based engineering<br />
training acceptable to the Director.<br />

<strong>32</strong>.34 Privileges of Marine engineer class 6<br />
(1) The privileges of a certificate of competency as MEC 6 are to perform the functions of a:<br />
(a) second engineer on fishing ships of a propulsion power up to 750 kilowatts in any<br />
operating area; and<br />
(b) chief engineer on fishing ships of up to 750 kilowatts propulsion power in the coastal<br />
area for ships that have engine and system maintenance carried out ashore or under<br />
warranty; and<br />
(c) chief engineer on non-passenger ships of up to 750 kilowatts propulsion power in the<br />
coastal area for ships that have engine and system maintenance carried out ashore or<br />
under warranty; and<br />
(d) chief engineer on passenger ships of up to 750 kilowatts propulsion power in restricted<br />
limits for ships with less than four systems.<br />
(2) Privileges relate to ships powered by motor or by motor and steam in accordance with any<br />
permissions and limitations shown on the certificate.<br />
(3) For the purposes of subrule (1), in the case of any ship that is less than 24 metres in length<br />
overall operating in the near-coastal and unlimited areas, a reference to kilowatts is a<br />
reference to the kilowatts of the single largest propulsion engine.<br />

(1) This is a certificate of competency.<br />
(2) The eligibility requirements relating to Marine engineer class 5 (MEC 5) are the provision of<br />
proof of the matters set out in column 3 of the following table that correspond to an item in<br />
column 2:<br />

(a) Prior <strong>certification</strong> holds a certificate of competency as MEC 6<br />
under seagoing service option (a) or equivalent.<br />
(b) Core competencies Has demonstrated, at operational level, the<br />
competencies required by regulation II/5 of<br />
STCW-F by an accepted means of<br />
demonstrating competence under rule <strong>32</strong>.180 or<br />
equivalent.<br />
(c) Final examinations has passed any final examinations that the<br />
Director may require, or equivalents.<br />
(d) Sea service has completed approved sea service involving, at<br />
a minimum, completion of seagoing service that<br />
is either:<br />
(a) of no less than 12 months on a ship of 100<br />
kilowatts propulsion power or more while<br />
holding a certificate as MEC 6; or<br />
(b) of no less than 24 months on a ship of 100<br />
kilowatts propulsion power or more while<br />
holding a certificate as ERWR; and has<br />
completed an approved task book while on<br />
board a ship; or<br />
(c) of no less than 36 months on a ship of 100<br />
kilowatts propulsion power or more,<br />
including 24 months on a ship with diesel<br />
propulsion power.<br />
(e) Ancillary competencies and<br />
ancillary certificates<br />
has demonstrated the following ancillary<br />
competencies:<br />
(a) STCW-F basic training:<br />

(i) chief engineer of non-passenger ships up to 750 kilowatts propulsion power in the<br />
coastal area; and<br />
(ii) chief engineer of passenger ships of up to 3000 kilowatts propulsion power in the<br />
inshore area on ships that have less than 4 systems and engine and system<br />
maintenance carried out ashore or under warranty; and<br />

(b) the privileges of second engineer of a fishing ship of 750kW or more in any<br />
operating area.<br />

(3) For the purposes of subrule (1), in the case of any ship that is less than 24 metres<br />
length overall operating in the near-coastal and unlimited areas, a reference to kilowatts<br />
is a reference to the kilowatts of the single largest propulsion engine.<br />
<strong>32</strong>.37 Marine engineer class 4 (MEC 4)<br />
(1) This is a certificate of competency.<br />
(2) The eligibility requirements relating Marine engineer class 4 (MEC 4) are the provision of<br />
proof of the matters set out in column 3 of the following table that correspond to an item in<br />
column 2:<br />
Requirement for proof that an applicant:<br />
(a) Prior <strong>certification</strong> holds a certificate of competency as MEC 5 or<br />
MEC 6 or equivalent.<br />
(b) Core Competencies has demonstrated, at operational level, the<br />
competencies required by regulation II/5 of<br />
STCW-F by an accepted means of<br />
demonstrating competence under rule <strong>32</strong>.180 or<br />
equivalent.<br />
(c) Final examinations has passed any final examinations that the<br />
Director may require, or equivalents.<br />
(d) Sea service has completed approved sea service involving, at<br />
a minimum:<br />
(a) seagoing service of no less than 12 months<br />
outside restricted limits on ships of 250<br />
kilowatts propulsion power or more while<br />
holding a certificate as MEC 5; or<br />
(b) seagoing service of no less than 12 months<br />
on ships of 250 kilowatts propulsion power<br />
or more outside restricted limits together<br />
with completion of approved shore-based<br />
engineering training.<br />
(e) Ancillary competencies and<br />
ancillary certificates<br />

(1) The privileges of a certificate of competency as MEC 4 are:<br />
(a) to perform the functions of a:<br />
(i) chief engineer of non-passenger ships of up to 3000 kilowatts propulsion power in<br />
restricted limits; and<br />
(ii) chief engineer of non-passenger ships of up to 750 kilowatts propulsion power in<br />
the offshore area; and<br />
(iii) chief engineer of passenger ships of up to 3000 kilowatts propulsion power in<br />
restricted limits; and<br />
(b) the privileges of a Chief engineer of a fishing ship of up to 3000 kilowatts in any<br />
operating area.<br />
(2) Privileges relate to ships powered by motor or by motor and steam in accordance with any<br />
permissions and limitations shown on the certificate.<br />
(3) For the purposes of subrule (1), in the case of any ship that is less than 24 metres in length<br />
operating in the near-coastal and unlimited areas, a reference to kilowatts is a reference to<br />
the kilowatts of the single largest propulsion engine.<br />
Endorsements<br />
<strong>32</strong>.39 Qualified deck crew (QDC) and Skipper restricted limits (SRL) with passenger<br />
endorsement<br />
(1) The privileges of QDC may be exercised on a ship carrying over 250 passengers if the<br />
relevant certificate of proficiency is endorsed with a passenger endorsement.<br />
(2) The privileges of SRL may be exercised on a ship of less than 12 metres in length overall<br />
carrying more than 12 passengers if the relevant certificate of competency is endorsed with<br />
a passenger endorsement.<br />
(3) The Director must endorse a certificate of proficiency for QDC or a certificate of competency<br />
as SRL with a passenger endorsement if satisfied that the applicant has—<br />
(a) in the case of QDC, demonstrated, at the appropriate level, the competencies that the<br />
Director considers relevant to the privileges associated with the endorsement; and<br />
(b) in the case of SRL, demonstrated, at management level, the competencies that the<br />
Director considers relevant to the privileges associated with the endorsement; and<br />
(c) has passed a final examination or equivalent.<br />
<strong>32</strong>.40 Skipper restricted limits with Cook Strait endorsement<br />
(1) The privileges of SRL may be exercised within an assigned Cook Strait limit as provided for<br />
by rule 20.20(4) of <strong>Part</strong> 20 of the maritime rules if the relevant certificate of competency is<br />
endorsed with a Cook Strait endorsement.<br />
(2) The Director must endorse a certificate of competency for SRL with a Cook Strait<br />
endorsement if satisfied that the applicant has passed a final examination.<br />
<strong>32</strong>.41 Skipper restricted limits endorsed to 24 metres<br />
(1) The privileges of SRL may be exercised on a ship of between 12 and 24 metres length<br />
overall (but carrying no more than 12 passengers) if the relevant certificate of competency is<br />
endorsed to 24 metres.<br />
(2) The Director must endorse a certificate of competency for SRL to 24 metres if satisfied that<br />
the applicant has completed approved sea service of no less than 6 months—<br />
(a) on a commercial ship of 12 metres; or<br />
(b) while holding as certificate as SRL and having completed an approved record book.<br />

<strong>Part</strong> <strong>32</strong>: <strong>Seafarer</strong> Certification<br />
<strong>32</strong>.42 Skipper restricted limits endorsed to 500GT<br />
(1) The privileges of SRL endorsed to 24 metres may be exercised on a ship that is greater than<br />
24 metres in length overall and less than 500GT if the relevant certificate of competency is<br />
endorsed to 500GT.<br />
(2) The Director must endorse a certificate of competency for SRL to 500GT if satisfied that the<br />
applicant:<br />
(a) has completed approved sea service of no less than 12 months on ships of 12 metres<br />
or more while holding a certificate of competency as SRL to 24 metres, that has<br />
included the completion of a record book and an approved task book while on board a<br />
ship; and<br />
(b) has, to the extent that the Director considers necessary, taking the applicant’s seagoing<br />
service into account,—<br />
(i) demonstrated, at the appropriate level, any additional competencies that the<br />
Director considers relevant to the privileges associated with the endorsement; and<br />
(ii) has passed a final examination or equivalent.<br />
<strong>32</strong>.43 Endorsement to operate ships between 500GT and 3000GT in restricted limits<br />
(1) The privileges of a certificate of competency issued under this subpart endorsed to between<br />
500GT and 3000GT may be exercised by having command of a ship of between 500 and<br />
3000GT operating exclusively in restricted limits where the ship or class of ships is specified<br />
in the endorsement.<br />
(2) The Director must endorse a certificate of competency issued under this <strong>Part</strong> to between 500<br />
and 3000GT if satisfied that the applicant—<br />
(a) holds a higher grade of certificate than Skipper restricted limits endorsed to 500GT or<br />
has demonstrated, at the appropriate level, the competencies required for a certificate<br />
of that type; and<br />
(b) has completed approved sea service that is appropriate for the privileges associated<br />
with the endorsement; and<br />
(c) has, to the extent that the Director considers necessary, taking the applicant’s seagoing<br />
service into account,—<br />
(i) demonstrated, at the appropriate level, any additional competencies that the<br />
Director considers appropriate for the exercise of privileges entitling the holder to<br />
command the ship or class of ships of the relevant type in restricted limits; and<br />
(ii) has passed a final examination or equivalent.<br />
<strong>32</strong>.44 Sailing ship endorsement<br />
(1) The privileges of a certificate of competency issued under this <strong>Part</strong> may be exercised on a<br />
sailing ship for which a sailing ship endorsement is required under <strong>Part</strong> 31 of the maritime<br />
rules if the certificate of competency is endorsed with a sailing ship endorsement.<br />
(2) The Director must endorse a certificate of competency with a sailing ship endorsement if<br />
satisfied that the applicant meets the requirements set out as route 1 in subrule (3) or the<br />
requirements set out in route 2 in subrule (4).<br />
(3) Route 1 is that the applicant—<br />
(a) has completed 1 month’s sea experience in a deck capacity on sailing ships; and<br />
(b) has demonstrated, at the appropriate level, the competencies that the Director<br />
considers relevant to the endorsement; and<br />
(c) has passed has passed a final examination.<br />

(4) Route 2 is that the applicant—<br />
(a) has completed 12 months’ sea service in the last 5 years as master on sailing ships to<br />
which this endorsement is applied; and<br />
(b) has a safe operating record.<br />
<strong>32</strong>.45 Square-rigged sailing ship endorsement<br />
(1) The privileges of certificate of competency issued under this <strong>Part</strong> may be exercised on a<br />
square-rigged sailing ship for which a square-rigged sailing ship endorsement is required<br />
under <strong>Part</strong> 31 of the maritime rules if the certificate of competency is endorsed with a<br />
square-rigged sailing ship endorsement.<br />
(2) The Director must endorse a certificate of competency with a square-rigged sailing ship<br />
endorsement if satisfied that the applicant meets the requirements set out as route 1 in<br />
subrule (3) or the requirements set out as route 2 in subrule (4).<br />
(3) Route 1 is that the applicant—<br />
(a) has completed 1 month’s sea experience in a deck capacity on square-rigged sailing<br />
ships; and<br />
(b) has demonstrated, at the appropriate level, the competencies that the Director<br />
considers relevant to the endorsement; and<br />
(c) has passed a final examination or equivalent.<br />
(4) Route 2 is that the applicant—<br />
(a) has completed 12 months’ sea service in the last 5 years as master on square-rigged<br />
sailing ships to which this endorsement is applied; and<br />
(b) has a safe operating record.<br />
<strong>32</strong>.46 High-speed ship endorsement<br />
(1) The privileges of a certificate of competency issued to a master or navigational watchkeeper<br />
under this <strong>Part</strong> may be exercised on a high-speed ship for which a high-speed ship<br />
endorsement is required under a Minimum Safe Crewing Document required by rule 31.82 of<br />
<strong>Part</strong> 31 of the maritime rules if the certificate of competency is endorsed with a high-speed<br />
ship endorsement under this rule.<br />
(2) The Director must endorse a certificate of competency with a high-speed ship endorsement<br />
if the Director is satisfied that the applicant meets the requirements set out as route 1 in<br />
subrule (3) or the requirements set out as route 2 in subrule (4).<br />
(3) Route 1 is that the applicant—<br />
(a) has demonstrated, at the appropriate level, the competencies that the Director<br />
considers relevant to the endorsement including demonstration of ancillary<br />
competencies in fire prevention and fire-fighting; and<br />
(c) holds a restricted radar certificate.<br />
(4) Route 2 is that the applicant—<br />
(a) has completed 12 months’ sea service in the last 5 years as an officer on a high-speed<br />
ship; and<br />
(b) has a safe operating record that is satisfactory to the Director; and<br />
(c) has demonstrated ancillary competencies in fire prevention and fire-fighting; and<br />
(d) holds restricted radar certificate.<br />

<strong>Part</strong> <strong>32</strong>: <strong>Seafarer</strong> Certification<br />
Revalidation requirements<br />
<strong>32</strong>.47 Application for revalidation of domestic certificates<br />
(1) An applicant who holds a certificate of proficiency or a certificate of competency issued<br />
under this subpart may, within 6 months prior to the date of expiry of the certificate,—<br />
(a) make an application in accordance with section 35 of the Act, in a form required by the<br />
Director for revalidation of the certificate; and<br />
(b) include such further relevant particulars and supporting information relating to the<br />
applicant that the Director may require; and<br />
(c) submit the application to the Director, with a payment of the appropriate application fee<br />
prescribed by the regulations made under the Act.<br />
(2) The Director must approve revalidation of a certificate if, in addition to any requirements<br />
under section 41 of the Act, the Director—<br />
(a) is satisfied that—<br />
(i) the applicant meets the medical fitness and eyesight standards relevant to the<br />
certificate or endorsement under <strong>Part</strong> 34; and<br />
(ii) the applicant continues to hold any ancillary certificates that are required as part of<br />
the eligibility requirements for the certificate; and<br />
(iii) the applicant has completed approved sea service that is of the minimum duration<br />
set out in subrule (3) and is of a kind that the Director would approve for the<br />
purposes of the issue of a new certificate or endorsement of that type; and<br />
(b) taking into account the matters that must be considered under rule <strong>32</strong>.181, is satisfied<br />
that the applicant has maintained the relevant standard of competence for the issue of<br />
the certificate.<br />
(3) The applicant must have completed approved sea service or an equivalent that is no less<br />
than—<br />
(a) 6 months’ duration during the period 5 years immediately before the application is<br />
made; or<br />
(b) 145 days during the period 3 months immediately before the application is made; or<br />
(c) in the case of non-seagoing service, 2.5 years in the 5 years immediately preceding the<br />
application.<br />
<strong>32</strong>.48 Term for which certificate may be revalidated<br />
A certificate may be revalidated for a term ending on the date that is 5 years after the date<br />
on which the certificate would otherwise have expired, or any earlier date as determined by<br />
the Director.<br />
Subpart B – STCW certificates and endorsements<br />
Applications<br />
<strong>32</strong>.60 Applications made under section 35 of the Act for certificates<br />
An applicant for a certificate of proficiency or a certificate of competency provided for in this<br />
subpart must—<br />
(a) make an application in accordance with section 35 of the Act, in a form required by the<br />
Director; and<br />
(b) include such further relevant particulars and supporting information relating to the<br />
applicant that the Director may require; and<br />
(c) submit the application to the Director, with a payment of the appropriate application fee<br />
prescribed by the regulations made under the Act.<br />

<strong>32</strong>.61 Application for endorsement<br />
(1) An applicant for an endorsement provided for in this subpart must—<br />
(a) make an application in a form required by the Director; and<br />
(b) include such further relevant particulars and supporting information relating to the<br />
applicant that the Director may require; and<br />
(c) submit the application to the Director, with a payment of the appropriate application fee<br />
prescribed by the regulations made under the Act.<br />
(2) The privileges associated with the endorsement may be treated as privileges under the<br />
relevant certificate that may be exercised subject to any conditions or limitations stated in the<br />
endorsement.<br />
(3) For the avoidance of doubt, an endorsement provided for in this subpart is not a maritime<br />
document.<br />
<strong>32</strong>.62 Issue of certificates or endorsements<br />
(1) The Director must issue a certificate of proficiency or a certificate of competency if satisfied<br />
that the applicant meets the applicable requirements of this <strong>Part</strong> and the requirements of<br />
section 41 of the Act.<br />
(2) The Director must issue an endorsement if satisfied that the applicant meets the applicable<br />
requirements of this <strong>Part</strong>.<br />
<strong>32</strong>.63 Knowledge of English<br />
Where this <strong>Part</strong> requires an applicant to pass an examination or a final examination, the<br />
applicant must satisfy the examiner or the person conducting the examination (as applicable)<br />
that he or she or he is able to converse, read and write in the English language sufficiently<br />
well to perform the duties required of a holder of the relevant certificate or endorsement for<br />
which the candidate is to be examined or tested.<br />
<strong>32</strong>.64 Term of certificate or endorsement<br />
(1) A certificate may be issued for a period not exceeding 5 years from the date of issue but may<br />
be issued for a shorter period if the Director considers it appropriate in the interests of<br />
maritime safety.<br />
(2) An endorsement expires on whichever is the sooner of:<br />
(a) the date the certificate expires (as extended in accordance with any revalidation); or<br />
(b) an earlier date indicated on the certificate.<br />
STCW Certificates of Proficiency<br />
<strong>32</strong>.65 Rating forming part of an engineering watch (ERWR)<br />
(1) This is a certificate of proficiency that corresponds to the STCW certificate under regulation<br />
III/4 of STCW.<br />
(2) The eligibility requirements relating to Rating forming part of an engineering watch (ERWR)<br />
are the provision of proof of the matters set out in column 3 of the following table that<br />
correspond to an item in column 2:<br />

(a) Age is at least 16 years of age.<br />
(b) Prior <strong>certification</strong> none.<br />
(c) Core competencies has demonstrated, at the level prescribed in<br />
STCW, the competencies in section A-III/4 of the<br />

demonstrating competence under rule <strong>32</strong>.180 or<br />

seagoing ship powered by main propulsion machinery of 750kW propulsion power or more.<br />
<strong>32</strong>.67 Deck watch rating (DWR)<br />
(1) This is a certificate of proficiency that corresponds to the STCW certificate under regulation<br />
II/4 of STCW.<br />
(2) The eligibility requirements relating to Deck watch rating (DWR) are the provision of proof of<br />
the matters set out in column 3 of the following table that correspond to an item in column 2:<br />
Requirement for proof that an applicant:<br />
(a) Age is at least 16 years of age.<br />
(b) Prior <strong>certification</strong> none.<br />
(c) Core competencies has demonstrated, at the level prescribed in<br />

(1) This is a certificate of proficiency that corresponds to the STCW certificate under regulation<br />
II/5 of STCW.<br />
(2) The eligibility requirements relating to Able seafarer deck (AB Deck) are the provision of<br />
proof of the matters set out in column 3 of the following table that correspond to an item in<br />
column 2:<br />

(2) The eligibility requirements relating to Able seafarer engine (AB Engine) are the provision of<br />
proof of the matters set out in column 3 of the following table that correspond to an item in<br />

The privileges of a certificate of competency as GMDSS radio operator are to perform the<br />
functions of a radio operator on a ship required to participate in the GMDSS.<br />
Endorsements<br />
<strong>32</strong>.115 Basic tanker endorsement (oil and chemical tankers)<br />
(1) The privileges of a person who holds a certificate of competency or certificate of proficiency<br />
as a master, officer or rating that is endorsed with a basic tanker endorsement (oil and<br />
chemical tankers) include the performance of designated duties related to cargo or cargo<br />
equipment on oil tankers, on board an oil tanker or a chemical tanker.<br />
(2) The Director must endorse the person’s certificate of competency or certificate of proficiency<br />
with a basic tanker endorsement (oil and chemical tankers) if the Director is satisfied that the<br />
applicant has:<br />
(a) completed at least 3 months of approved seagoing service on oil or chemical tankers;<br />
and<br />
(b) demonstrated, at the level prescribed in STCW, the competencies in section A-V/1-1,<br />
paragraph 1 of the STCW Code.<br />
<strong>32</strong>.116 Basic tanker endorsement (liquefied gas tankers)<br />
(1) The privileges of a person who holds a certificate of competency or a certificate of<br />
proficiency as a master, officer or rating that is endorsed with a basic tanker training<br />
endorsement (liquefied gas tankers) include the performance of designated duties related to<br />
cargo or cargo equipment on liquefied gas tankers, on board a liquefied gas tanker.<br />
(2) The Director must endorse the person’s certificate of competency or certificate of proficiency<br />
with a basic tanker training endorsement (liquefied gas tankers) if the Director is satisfied<br />
that the applicant has:<br />
(a) completed at least 3 months of approved seagoing service on oil or chemical tankers;<br />
and<br />
(b) has demonstrated, at the level prescribed in STCW, the competencies in section A-V/1-<br />
2, paragraph 1 of the STCW Code.<br />
<strong>32</strong>.117 Advanced tanker training endorsement (oil, chemical, or liquefied gas tankers)<br />
(1) The privileges of a person who holds a certificate of competency or a certificate of<br />
proficiency as a master, officer or rating that is endorsed is endorsed with an advanced<br />
tanker training endorsement (oil tankers), advanced tanker training endorsement (chemical<br />
tankers) or advanced tanker training endorsement (liquefied gas tankers) include the<br />
performance of the following duties:<br />

(a) designated duties as a master, chief engineer officer, chief mate or a second engineer<br />
officer on a tanker of the relevant type, if the person holds a relevant certificate of<br />
competency; or<br />
(b) designated duties as a person with immediate responsibility for loading, discharging,<br />
care in transit, handling of cargo, tank cleaning or other cargo-related operations on a<br />
tanker of that type.<br />
(2) The Director must endorse the person’s certificate of competency with the relevant advanced<br />
tanker training endorsement if the Director is satisfied that the applicant:<br />
(a) met the requirements for a basic tanker training endorsement (for oil and chemical<br />
tanker cargo operations or for liquefied gas tankers, as applicable); and<br />
(b) while holding a certificate with the relevant basic tanker training endorsement has:<br />
(i) at least 3 months of approved seagoing service on a relevant type of tanker, or<br />
(ii) at least 1 month of approved on-board training on a relevant type of tanker, in a<br />
supernumerary capacity, which includes at least 3 loading and 3 unloading<br />
operations and is documented in an approved training record book taking into<br />
account guidance in section B-V/1; and<br />
(iii) demonstrated the relevant competencies at the level prescribed in STCW.<br />
(3) The relevant competencies are:<br />
(a) for oil tanker cargo operations, the competencies in section A-V/1-1, paragraph 2 of the<br />
STCW Code; and<br />
(b) for chemical tanker cargo operations , the competencies in section A-V/1-1, paragraph 3<br />
of the STCW Code; and<br />
(c) for liquefied gas tanker cargo operations , the competencies in section A-V/1-2,<br />
paragraph 2 of the STCW Code.<br />
Revalidation requirements<br />
<strong>32</strong>.118 Application for revalidation of certificates or endorsements issued under this subpart<br />
(1) An applicant who seeks to have a certificate of proficiency or certificate of competency or<br />
endorsement revalidated under this subpart may, within 6 months before the date of expiry<br />
of the certificate,—<br />
(a) make the application in a form required by the Director; and<br />
(b) include such further relevant particulars and supporting information relating to the<br />
applicant that the Director may require; and<br />
(c) submit the application to the Director, with a payment of the appropriate application fee<br />
prescribed by the regulations made under the Act.<br />
(2) Except for an application for a revalidation of a tanker endorsement, an application is made<br />
in accordance with section 35 of the Act.<br />
(3) An application may be made for revalidation of a tanker endorsement issued to a master,<br />
officer or radio operator, but not to a tanker endorsement issued to a rating.<br />
<strong>32</strong>.119 General requirements for revalidation<br />
The Director must revalidate a certificate or endorsement issued under this subpart if the<br />
Director—<br />
(a) is satisfied that:<br />
(i) the applicant meets the medical fitness and eyesight standards relevant to the<br />
certificate or endorsement under <strong>Part</strong> 34; and<br />
(ii) the applicant continues to hold any ancillary certificates that are required as part of<br />
the eligibility requirements for the certificate; and<br />
(iii) in the case of an application for revalidation of a certificate of competency, the<br />
applicant has completed approved seagoing service that is of the minimum<br />

duration specified in rules <strong>32</strong>.121 and is of a kind that the Director would approve<br />
for the purposes of the issue of a new certificate or endorsement of that type; and<br />
(iv) in the case of an application for revalidation of a tanker endorsement, the applicant<br />
has completed approved seagoing service that is of the minimum duration<br />
specified in rules <strong>32</strong>.122 and is of a kind that the Director would approve for the<br />
purposes of the issue of a new certificate or endorsement of that type; and<br />
(iv) any further applicable requirements of rules <strong>32</strong>.120 to <strong>32</strong>.122 are met; and<br />
(b) taking into account the matters that must be considered under rule <strong>32</strong>.181, is satisfied<br />
that the applicant has maintained the relevant standard of competence for the issue of<br />
the certificate.<br />
<strong>32</strong>.120 Revalidation of certificates of proficiency issued under this subpart —particular<br />
ancillary competencies to be considered on revalidation<br />
In considering an application for revalidation of a certificate of proficiency issued under this<br />
subpart, the Director must give particular consideration to whether the applicant has<br />
maintained the required standard in relation to the following ancillary competencies:<br />
(a) fire prevention and fire-fighting; and<br />
(b) personal survival techniques; and<br />
(c) in the case of an application for revalidation of a certificate of proficiency for Able<br />
seafarer deck, survival craft and rescue boats other than fast rescue boats.<br />
<strong>32</strong>.121 Revalidation of STCW certificates of competency issued under this subpart —duration<br />
of seagoing service and particular ancillary competencies to be considered on<br />
revalidation<br />
(1) Where an applicant applies to revalidate a certificate of competency issued under this<br />
subpart, the applicant must have completed approved seagoing service—<br />
(a) of no less than—<br />
(i) 12 months duration during the period 5 years immediately before the application is<br />
made; or<br />
(ii) 3 months duration during the period 6 months immediately before the application is<br />
made; or<br />
(b) in the case of any approved non seagoing service equivalent in an operational position<br />
ashore of no less than 30 months duration during the period 5 years immediately before<br />
the application is made.<br />
(2) In considering an application for revalidation of a certificate of competency issued under this<br />
subpart, the Director must give particular consideration to whether the applicant has<br />
maintained the required standard in relation to the following ancillary competencies:<br />
(a) fire prevention and fire-fighting; and<br />
(b) personal survival techniques; and<br />
(c) where required for issue of a new certificate of the relevant type, survival craft and<br />
rescue boats other than fast rescue boats; and<br />
(d) where required for issue of a new certificate of the relevant type, fast rescue boats; and<br />
(e) where required for issue of a new certificate of the relevant type, advanced fire-fighting.<br />
<strong>32</strong>.122 Revalidation of STCW endorsements for masters, officers and radio operators in<br />
respect of tankers—duration of seagoing service<br />
Where an applicant applies to revalidate a tanker endorsement issued to a master, officer or<br />
radio operator under this subpart, the seagoing service must be no less than 3 months<br />
duration during the period 5 years immediately before the application is made.<br />
<strong>32</strong>.123 Term for which certificate may be revalidated<br />
(1) If an application for revalidation is made within 6 months before the expiry of the certificate,<br />
the certificate may be revalidated for a term ending on the date that is 5 years after the date<br />

on which the certificate would otherwise have expired, or any earlier date as determined by<br />
the Director.<br />
(2) In any other case, a certificate may be revalidated for a term not exceeding 5 years from the<br />
date of revalidation.<br />
Subpart C – STCW-F certificates of competency<br />
Applications<br />
<strong>32</strong>.150 Applications made under section 35 of the Act for certificates<br />
An applicant for a certificate of proficiency or a certificate of competency provided for in this<br />
subpart must—<br />
(a) make an application in accordance with section 35 of the Act, in a form required by the<br />
Director, and<br />
(b) include such further relevant particulars and supporting information relating to the<br />
applicant that the Director may require; and<br />
(c) submit the application to the Director, with a payment of the appropriate application fee<br />
prescribed by the regulations made under the Act.<br />
<strong>32</strong>.151 Issue of certificates<br />
The Director must issue a certificate of competency if satisfied that the applicant meets the<br />
applicable requirements of this <strong>Part</strong> and the requirements of section 41 of the Act.<br />
<strong>32</strong>.152 Knowledge of English<br />
Where this <strong>Part</strong> requires an applicant to pass an examination or a final examination, the<br />
applicant must satisfy the examiner or the person conducting the examination (as applicable)<br />
that he or she or he is able to converse, read, and write in the English language sufficiently<br />
well to perform the duties required of a holder of the relevant certificate or endorsement for<br />
which the candidate is to be examined or tested.<br />
<strong>32</strong>.153 Term of certificate or endorsement<br />
(1) A certificate may be issued for a period not exceeding 5 years from the date of but may be<br />
issued for a shorter period if the Director considers it appropriate in the interests of maritime<br />
safety.<br />
(2) An endorsement expires on whichever is the sooner of:<br />
(a) the date the certificate expires (as extended in accordance with any revalidation); or<br />
(b) an earlier date indicated on the certificate.<br />
<strong>32</strong>.154 Eligibility requirements for certificates and endorsements applied for under section 35<br />
A person is eligible for a certificate issued under this subpart if, in addition to meeting the<br />
requirements prescribed section 41 of the Act, the applicant satisfies the eligibility<br />
requirements for the certificate or endorsement that are set out in this subpart.<br />
Certificates of proficiency<br />
<strong>32</strong>.155 Advanced deck-hand – fishing (ADH-F)<br />
(1) This is a certificate of proficiency that corresponds to the recommendations under resolution<br />
4 of the Conference of the <strong>Part</strong>ies to STCW-F.<br />
(2) The eligibility requirements relating to Advanced deck-hand – fishing (ADH-F) are the<br />
provision of proof of the matters set out in column 3 of the following table that correspond to<br />
an item in column 2:<br />

approved task book while on board a ship.<br />

(1) This is a certificate of competency that corresponds to the STCW-F certificate under<br />
regulation II/4 of STCW-F.<br />
(2) The eligibility requirements relating to Mate fishing ship between 24m and 45m limited<br />
waters (MFV) are the provision of proof of the matters set out in column 3 of the following<br />
table that correspond to an item in column 2:<br />

waters (SFV) are the provision of proof of the matters set out in column 3 of the following<br />

(1) This is certificate of competency that corresponds to the STCW-F certificate under regulation<br />
II/5 of STCW-F.<br />
(2) The eligibility requirements relating to Chief engineer of a fishing ship of 750kW to 3000kW<br />
propulsion power (Chief Eng FV) are the provision of proof of the matters set out in column 3<br />
of the following table that correspond to an item in column 2:<br />
Requirement for proof that an applicant:<br />
(a) Age is at least 18 years of age.<br />
(b) Prior <strong>certification</strong> holds a certificate of competency as MEC 5 or<br />
MEC 6 or equivalent.<br />

competencies required by regulation II/5 of<br />
STCW-F by an accepted means of<br />
demonstrating competence under rule <strong>32</strong>.180<br />

The privileges of Chief Eng FV are:<br />
(a) to perform the functions of a chief engineer on fishing ships of between 750 and 3000<br />
kilowatts propulsion power in any operating area; and<br />
(b) the privileges of Marine Engineer Class 4.<br />
Revalidation requirements<br />
<strong>32</strong>.169 Application for revalidation of certificates of competency<br />
(1) An applicant who holds a certificate of competency issued or recognised under this <strong>Part</strong><br />
may, within 6 months prior to the date of expiry of the certificate,—<br />
(a) make an application in accordance with section 35 of the Act, in a form required by the<br />
Director for revalidation of the certificate.<br />
(b) include such further relevant particulars and supporting information relating to the<br />
applicant that the Director may require; and<br />
(c) submit the application to the Director, with a payment of the appropriate application fee<br />
prescribed by the regulations made under the Act.<br />
(2) The Director must approve revalidation of a certificate if, in addition to any requirements<br />
under section 41 of the Act, the Director—<br />
(a) is satisfied that—<br />
(i) the applicant meets the medical fitness and eyesight standards relevant to the<br />
certificate or endorsement under <strong>Part</strong> 34; and<br />
(ii) the applicant continues to hold valid ancillary certificates that are required as part<br />
of the eligibility requirements for the certificate; and<br />
(iii) the applicant has completed approved seagoing service that is of the minimum<br />
duration specified in subrule (3) and is of a kind that the Director would approve for<br />
the purposes of the issue of a new certificate or endorsement of that type; and<br />
(b) taking into account the matters that must be considered under rule <strong>32</strong>.181, is satisfied<br />
that the applicant has maintained the relevant standard of competence for the issue of<br />
the certificate.<br />
(3) The applicant must have completed approved seagoing service of no less than—<br />
(a) 12 months duration during the period 5 years immediately before the application is<br />
made; or<br />
(b) in the case of any approved non seagoing service equivalent in an operational position<br />
ashore, of no less than 30 months duration during the period 5 years immediately<br />
before the application is made.<br />
(4) In considering an application under this rule, the Director must give particular consideration<br />
to whether the applicant has maintained the required standard in the following ancillary<br />
competencies:<br />
(a) fire prevention and fire-fighting; and<br />
(b) personal survival techniques; and<br />
(c) where required for issue of a new certificate of the relevant type, survival craft and<br />
rescue boats other than fast rescue boats; and<br />
(d) where required for issue of a new certificate of the relevant type, advanced fire-fighting.<br />

<strong>Part</strong> <strong>32</strong>: <strong>Seafarer</strong> Certification<br />
Subpart D – Demonstration of competencies, sea service and other<br />
miscellaneous matters<br />
<strong>32</strong>.180 Accepted means of demonstrating competency<br />
(1) This rule applies where—<br />
(a) the eligibility requirements relating to a certificate or endorsement require an applicant<br />
to demonstrate one or more competencies; or<br />
(b) the revalidation requirements relating to a certificate require an applicant to have<br />
maintained a relevant standard of competence; or<br />
(c) the Director is empowered to approve a sea service equivalent that involves the<br />
demonstration of one or more competencies, in accordance with rule <strong>32</strong>.184; or<br />
(d) the Director has identified specific needs for certain classes of applicants for the issue<br />
or revalidation of a certificate or the issue of an endorsement.<br />
(2) The Director may determine that in all applicable cases the Director will treat a requirement<br />
under this <strong>Part</strong> for an applicant to demonstrate a competence or to have maintained the<br />
relevant standard of competence as having been met if an applicant provides proof that he<br />
or she—<br />
(a) has been assessed as meeting a particular NZQA-registered standard by an institution<br />
that has consent under the Education Act 1989 to assess against the standard; or<br />
(b) holds a particular qualification that is listed on the <strong>New</strong> <strong>Zealand</strong> Qualifications<br />
Framework; or<br />
(c) has successfully completed a particular training scheme that is approved under the<br />
Education Act 1989.<br />
(3) The Director must publish any determinations under subrule (2) in advisory material and on<br />
the <strong>Maritime</strong> <strong>New</strong> <strong>Zealand</strong> website.<br />
<strong>32</strong>.181 Competency and examination requirements relating to revalidation<br />
(1) This rule applies to any consideration by the Director of whether an applicant has maintained<br />
the relevant standard of competence in relation to a certificate or endorsement, for the<br />
purposes of the revalidation of a certificate or endorsement under this <strong>Part</strong>.<br />
(2) The Director must take into account evidence provided by the applicant that the applicant<br />
has completed—<br />
(a) sea service or experience; or<br />
(b) refresher training; or<br />
(c) updating training.<br />
(3) If, after considering the matters in subrule (2), the Director considers that the applicant has<br />
not maintained the relevant standard of competence for the certificate or endorsement, the<br />
Director may require the applicant, as a condition that must be fulfilled before the Director<br />
will revalidate the certificate, to do any of the following:<br />
(a) demonstrate that the applicant has maintained the relevant standard of competence in<br />
the relevant areas by an accepted means of demonstrating competency under rule<br />
<strong>32</strong>.180; or<br />
(b) pass an examination in accordance with a question framework set by the Director to test<br />
whether the applicant has maintained the relevant standard of competence in relevant<br />
areas.<br />

Sea service<br />
<strong>32</strong>.182 Approval of sea service<br />
(1) The Director may approve sea service, or one or more equivalents to sea service provided<br />
for in rule <strong>32</strong>.184 in satisfaction of sea service requirements under this <strong>Part</strong>, if he or she is<br />
satisfied—<br />
(a) that the sea service is appropriate to the certificate or endorsement being sought taking<br />
into account the criteria in rule <strong>32</strong>.183; and<br />
(b) that the sea service meets any minimum requirements stated in a relevant rule in this<br />
<strong>Part</strong>; and<br />
(c) the applicant has provided proof of having completed the sea service.<br />
(2) An equivalent means an equivalent under rule <strong>32</strong>.184.<br />
<strong>32</strong>.183 Criteria relating to approval of sea service<br />
For the purpose of rule <strong>32</strong>.182, the Director may take into account:<br />
(a) the purpose of sea service requirements, which is:<br />
(i) to provide adequate instruction and practice in relevant safe and proper practices,<br />
procedures and routines aboard a ship, with appropriate supervision as necessary;<br />
and<br />
(ii) to provide that instruction and practice on ships of a relevant size and type,<br />
carrying out a relevant operation, within relevant operating limits (as appropriate for<br />
the certificate or endorsement sought) ; or<br />
(iii) in a case relating to revalidation of a certificate, to provide a means by which to<br />
maintain professional competence in the matters set out in paragraphs (i) and (ii);<br />
and<br />
(b) the duties that the applicant has performed and their type, duration and frequency; and<br />
(c) the frequency and duration of voyages; and<br />
(d) the existing seafarer <strong>certification</strong> and relevant qualifications held by the applicant; and<br />
(e) the capacity in which the applicant has served while holding that <strong>certification</strong> or<br />
qualification; and<br />
(f) any other relevant sea service completed by the applicant; and<br />
(g) international standards and practices relating to requirements for seagoing service<br />
related to <strong>certification</strong> of seafarers; and<br />
(h) any other matter that the Director considers appropriate in the interests of maritime<br />
safety.<br />
<strong>32</strong>.184 Equivalents to sea service<br />
(1) Where the applicant provides proof of successful completion, the Director may approve one<br />
or more of the following equivalents in part or full satisfaction any requirement in this <strong>Part</strong><br />
that an applicant for the issue or revalidation of certificate or an endorsement must have<br />
completed sea service:<br />
(a) ship board training in a supernumerary capacity:<br />
(b) non seagoing service:<br />
(c) demonstration of competencies:<br />
(d) passing an examination or equivalent:<br />
(e) records contained in task or record books:<br />
(f) other relevant experience.<br />
(2) In considering whether to accept any of the matters listed in subrule (1) as an equivalent, the<br />
Director must consider the extent to which the equivalent or equivalents will meet the<br />
purpose of seagoing service as set out in rule <strong>32</strong>.183(a).<br />

<strong>32</strong>.185 Proof of sea service<br />
A person must provide proof of sea service of a kind and in a form acceptable to the<br />
Director, which may include but is not limited to:<br />
(a) task or record books:<br />
(b) a statement about the applicant’s sea service from the applicant or a person in a<br />
specified role which may include statements about the circumstances in which the sea<br />
service was completed, the duties and functions performed by the applicant, the degree<br />
of practice, instruction and supervision that the applicant had in the performance of<br />
those duties and functions, and any other relevant matters:<br />
(c) a statutory declaration by the applicant or a person in a specified role attesting to the<br />
matters set out in paragraph (b).<br />
<strong>32</strong>.186 Calculation of sea service<br />
(1) Where sea service has been performed on a regular full-time basis, the Director must—<br />
(a) calculate the length of sea service from the date of commencing work on the ship to the<br />
date of leaving the ship; and<br />
(b) exclude time spent on leave or spent in extended periods in port.<br />
(2) The Director must calculate non-watchkeeping sea service on the basis of the number of<br />
hours of service on board, which, unless otherwise established, will be calculated as—<br />
(a) not more than 8hours in any 24 hour period unless the Director considers a greater<br />
number of hours is acceptable because non-watchkeeping service is attained though a<br />
rostered arrangement that satisfactorily manages fatigue ; and<br />
(b) 12 months for 1500 hours service acquired over a period of 12 months or more.<br />
(3) Where duties involving navigational watchkeeping are required as sea service in this <strong>Part</strong>,<br />
the Director may accept evidence of having been in charge of cargo operations watch for not<br />
less than eight hours out of every 24 hours claimed as satisfying the sea service<br />
requirement.<br />
(4) Sea service on fishing ships will only be counted—<br />
(a) in the case of sea service for a deckhand certificate, or a combined skipper and<br />
engineer certificate, or a bridge watchkeeper, mate or master certificate, when the ship<br />
is at sea or in port in a fully operational condition; and<br />
(b) in the case of sea service for an engineer officer certificate, when the ship is at sea or in<br />
port in a fully operational condition or undergoing significant maintenance or repairs.<br />
Miscellaneous<br />
<strong>32</strong>.187 Misrepresentation of sea service or meeting of eligibility requirements<br />
(1) No person may intentionally misrepresent—<br />
(a) the length of sea service; or<br />
(b) the capacity of sea service; or<br />
(c) any work or records in a task book; or<br />
(d) the demonstration of any competencies by an accepted means under rule <strong>32</strong>.180.<br />
(2) If a person is in breach of subrule (1), the Director may—<br />
(a) refuse to accept proof that the person has demonstrated any relevant competencies by<br />
an accepted means of demonstrating competency under rule <strong>32</strong>.180; and<br />
(b) prohibit that person from sitting an examination for revalidation purposes or final<br />
examination for a specified period.<br />
(3) No person may certify sea service or a task book or that a person has completed any<br />
training if he or she knows the information is incorrect.<br />

(4) No person may knowingly submit any incorrect information related to the eligibility<br />
requirements in this <strong>Part</strong>.<br />
<strong>32</strong>.188 Surrender of superseded certificate<br />
A holder of a certificate of competency must surrender the certificate if required by the<br />
Director for the issue of a higher grade of certificate of competency.<br />
<strong>32</strong>.189 Doubt of ability by reason of medical condition<br />
(1) If the Director believes on reasonable grounds that, by reason of a medical condition, the<br />
applicant may not be able to carry out the duties required of her or him as the holder of the<br />
certificate or endorsement sought, the Director may require the applicant to undergo a<br />
medical test.<br />
(2) The medical test required by subrule (1) must be carried out—<br />
(a) by an accepted medical practitioner nominated by the applicant or nominated by the<br />
Director; and<br />
(b) having regard to the general medical fitness required for the duties of a holder of the<br />
certificate sought by the applicant.<br />
(3) The Director may nominate an approved medical practitioner only if the applicant fails to<br />
nominate an approved medical practitioner.<br />
(4) If the results of the medical test confirm the Director's belief that the applicant may not be<br />
able to carry out the duties required of her or him as the holder of the certificate or<br />
endorsement sought, or if the applicant refuses to undergo a medical test, the Director<br />
may—<br />
(a) refuse to allow the applicant to sit an examination in accordance with section 51 of the<br />
Act; or<br />
(b) if an examination has already been undertaken, decline to issue the applicant with a<br />
certificate of competency in accordance with section 51 of the Act.<br />
<strong>32</strong>.190 Reissue of expired certificates<br />
(1) A certificate of competency or a certificate of proficiency that has expired, together with any<br />
endorsements on the certificate may be reissued.<br />
(2) An application for reissue is an application for the issue of a certificate in accordance with—<br />
(a) section 41 of the Act; and<br />
(b) the applicable requirements of this <strong>Part</strong>, subject to the exercise of the Director’s<br />
discretion under this rule.<br />
(3) The Director may, if satisfied that except for the expiry of the certificate the person meets the<br />
requirements for revalidation of the certificate and it is in the interests of maritime safety,<br />
reissue the certificate.<br />
(4) Nothing in subrule (3) prevents the Director from treating the application as an application for<br />
a new certificate issued under section 41 and the applicable requirements of this <strong>Part</strong>.<br />
Subpart E – Revocations, savings, transitional provisions and consequential<br />
amendments<br />
<strong>32</strong>.210 Revocations<br />
<strong>Part</strong> <strong>32</strong> made 21 September 1999 is revoked.<br />
<strong>32</strong>.211 Savings<br />
Despite rule <strong>32</strong>.110, for the purpose of rule <strong>32</strong>.212,—<br />
(a) <strong>Part</strong> <strong>32</strong> as in force immediately before the entry into force of this <strong>Part</strong> may be treated as<br />
remaining in force; and<br />

(b) any approval of a syllabus, structured training programme, training programme or<br />
refresher course that has been approved for the purposes of <strong>Part</strong> <strong>32</strong> may be treated as<br />
valid, for the purposes of rule <strong>32</strong>.212.<br />
Option for applicants to apply for a certificate under former <strong>Part</strong> <strong>32</strong><br />
<strong>32</strong>.212 Option to have certificate issued under former <strong>Part</strong> <strong>32</strong> where seagoing service or<br />
training commenced prior to 1 July 2013<br />
(1) An applicant may apply under <strong>Part</strong> <strong>32</strong> as in force immediately before the entry into force of<br />
this <strong>Part</strong> for the issue of a new certificate listed in subrule (3) if—<br />
(a) the person applies before 1 January 2017; and<br />
(b) the person provides proof that he or she has completed seagoing service or a training<br />
course or a training programme in satisfaction of the requirements of the certificate of<br />
competency; and<br />
(c) the person commenced the seagoing service or training course or training programme<br />
before 1 July 2013.<br />
(2) However, any certificate issued under this rule must be revalidated in accordance with the<br />
requirements of this <strong>Part</strong>.<br />
(3) Nothing in this rule prevents a person from applying for the issue of a new a certificate<br />
provided for in this <strong>Part</strong> in accordance with this <strong>Part</strong>.<br />
(4) The certificates of proficiency or certificates of competency to which this rule applies, with<br />
the corresponding rule number under the former rules in brackets are:<br />

of the following table (old certificate) is deemed for all purposes under the maritime rules to<br />
be the certificate shown in the corresponding row of the second column of the table<br />
(confirmed certificate) issued in accordance with this <strong>Part</strong>.<br />
(2) The confirmed certificate (as deemed under this rule) expires on the date that the old<br />
certificate would have expired, however, where the old certificate has no expiry date, it<br />
expires on the date that is 5 years after the entry into force of this <strong>Part</strong>.<br />
(3) A person who has a confirmed certificate under this rule must, for the purposes of<br />
revalidation of the certificate after confirmation, meet the relevant standard of competence<br />

(3) In considering whether an applicant meets the requirements of subrule (2)(c), the Director<br />
must give appropriate weight to—<br />
(a) the principle that instruction and practice in the course of sea service and relevant<br />
experience is an alternative route by which the relevant standard of competence for the<br />
applicable competencies or the certificate overall may have been achieved or<br />
maintained; and<br />
(b) the sea service and experience of the applicant during the applicant’s career as a<br />
seafarer, with particular attribution of value to the applicant’s sea service and<br />
experience in the last 10 years and proportionally greater value to the most recent<br />
experience.<br />

<strong>Rule</strong> 34.8 is revoked and substituted with the following rule—<br />
“34.8A Eye and vision tests for certain STCW and STCW-F certificates of<br />
competency<br />
(1) An applicant who applies for an STCW certificate described in subrule (3) or an STCW-<br />
F certificate described in subrule (4) must, as a condition of eligibility for a certificate of<br />
competency under <strong>Part</strong> <strong>32</strong> of the maritime rules, provide evidence of,—<br />
(a) within the last 12 months, having passed the letter eyesight test performed by an<br />
accepted optometrist; and<br />
(b) within the last 6 years, having passed the lantern colour vision test or special<br />
colour vision test performed by an accepted optometrist.<br />
(2) When determining if the seafarer complies with the eyesight and colour vision standards<br />
required by <strong>Part</strong> <strong>32</strong> for the issue of that certificate of competency, the approved<br />
optometrist must ensure that—<br />
(a) the eye and vision tests are carried out in accordance with the procedures<br />
specified in Appendix 5B; and<br />
(b) the seafarer’s eyesight and colour vision meet the standards in Appendix 5A; and<br />
(c) there is no evidence of serious or progressive eye disease.<br />
(3) The relevant STCW certificates are the following certificates as described in rule <strong>32</strong>.03<br />
of <strong>Part</strong> <strong>32</strong> of the maritime rules: DWR, AB Deck, IR, OOW unlimited, OOW
<strong>Maritime</strong> <strong>Rule</strong>s<br />
(4) The relevant STCW-F certificates are the following certificates as described in rule<br />
<strong>32</strong>.03 of <strong>Part</strong> <strong>32</strong> of the maritime rules: ADH-F, SFV 24-45m, SFV-U, SFV.”<br />
<strong>32</strong>.222 Appendix 5A to <strong>Part</strong> 34<br />
(1) The heading above clause 5A.5 is omitted and the following heading substituted:<br />

<strong>Part</strong> 34 is amended by inserting, after rule 34.14, the following section heading, and rule:<br />
“Section 4: Medical requirements for holders of domestic certificates<br />
34.4A Medical examination of seafarers for the issue of domestic certificates under<br />
<strong>Part</strong> <strong>32</strong><br />
(1) A person who holds a domestic certificate under <strong>Part</strong> <strong>32</strong> must not exercise the<br />
privileges of that certificate unless—<br />
(a) the person holds a medical certificate, issued in accordance with rule 44(1) of<br />
the Land Transport (Driver Licensing) <strong>Rule</strong> 1999, that is applicable for a Class<br />
2, 3, 4 or 5 driver licence with passenger endorsement and that was issued<br />
within the previous 5 years; or<br />
(b) the person complies with every condition, restriction and endorsement on the<br />
medical certificate.<br />
(2) An applicant for a domestic certificate under <strong>Part</strong> <strong>32</strong> of the maritime rules must<br />
provide evidence of having passed the medical examination and of having been<br />
issued with the medical certificate described in subrule (1)(a).<br />
(3) If a holder of a domestic certificate under <strong>Part</strong> <strong>32</strong> is aware of, or has reasonable<br />
grounds to suspect, any change in his or her medical condition or the existence of<br />
any previously undetected medical condition that may interfere with the safe<br />
exercise of the privileges of the licence, the licence holder must not exercise the<br />
privileges of the licence unless a medical practitioner confirms the licence holder is<br />
fit to hold a medical certificate referred to in subrule (1)(a).<br />

(4) A holder of a domestic certificate must produce his or her current medical<br />
certificate when requested to do so by—<br />
(a) the Director; or<br />
(b) the master of the ship on which the holder is employed.”<br />
