The Hazards of Air Bags<br />
Isabella (“Izzy”) was a year old<br />
Chihuahua owned by Candy Cain, of<br />
A d o p t - A - Pet in the Nashville, T N<br />
area. Izzy was in her crate when<br />
Candy had a minor car accident<br />
which caused the air bag to open up<br />
and crush the crate. This caused<br />
Izzy to have a fractured skull which<br />
resulted in her death. Candy wants<br />
the public to be aware of the hazards<br />

Izzy’s death may not be without benefit to other animals. It is safer for pets<br />
to be left at home, but if they must travel, keep them in the back seat.<br />
Cop Berates Dog Owner ….Pet Runs into<br />
Traffic and Is Killed<br />
When Maura Ciardiello decided to being her dog with her while she went<br />
shopping, it became a nightmare for her and her dog. Stephen Sexton, an<br />
off-duty police officer with the N. J. Dept.of Human Services (a previous<br />
Woodbridge police officer who got fired from the force) approached<br />
Ciardiello about leaving her dog locked in a Mazda SUV. After a heated<br />
argument in which she told Sexton she was in the store for less than 20<br />
minutes, he arrested her for leaving the dog in the hot SUV. Sexton then<br />
arrested her, handcuffed her & called for the local animal control. As a<br />
result of the exchange, Ms. Ciardiello advised that she suffered a broken<br />
tooth, injured ribs. Rusti jumped out of the SUV, bit Sexton on the back of<br />
both of his legs & ran back into the vehicle. When the local animal control<br />
officer arrived & attempted to get the dog, it escaped and ran about 1/2<br />
mile on to Route 1 and got killed by a car.<br />

FOR THOSE WHO BELIEVE IN<br />
TEMPERAMENT TESTING…….<br />
The Society has frequently been asked if we do temperament testing.<br />
Because of new regulations that are attempting to be brought about by a<br />
new state agency, this is a grave concern – and should be to all who bring<br />
an animal to a pound or shelter that does temperament testing.<br />
The behavior in an animal brought to a strange place is not a reliable<br />
barometer of their real personality. According to Karen Overall, V.M.D.,<br />
Ph.D., DACVB, who is a canine behaviorist: “You cannot expect to see a<br />
dog or cat’s real behavior until he or she is totally comfortable in a new<br />
home. This can take as long as 3 or 4 months, depending on how long it<br />
takes to rehome an animal, what his or her previous problems were, and<br />
how traumatic the entire rehoming experience has been”.<br />
In a seminar attended by a Society staffer held at the Animal Rescue<br />
League in Boston, MA, Dr. Amy Marden advised that in a test of “food<br />
aggressive” dogs at their shelters, once the dog was adopted, more than<br />
85% overcame the behavior within 3 months after adoption. Society<br />
staffers have attended temperament testing seminars at N. J. shelters and<br />
found the test results were too difficult for most homeless orphans & they<br />
failed.<br />
Temperament testing at a shelter is a bad excuse for euthanasia.<br />
The HUMANE NEWS has been publishing this paper for the last 34 years.Sadly, we have found that we cannot change the world...even though<br />

WHAT HAPPENS TO SURPLUS ANIMALS AT<br />
MONMOUTH COUNTY’S LONGSTREET FARM?<br />
These two Percherons were purchased from Pennsylvania….ill at the<br />
time of sale …and were then removed.What was their future?<br />
Longstreet Farm in Holmdel, N J is under the aegis of the Monmouth<br />
County Park System (MCPS) and is known as an “historic working farm” –<br />
complete with mules, cows, sheep, goats & horses that pull wagons & plow<br />
fields.<br />
The Society became involved when Longstreet Farm announced that<br />
Butch & Buddy, 2 Belgian draft horses, along with Susy & Sally, 2 mules,<br />
were being retired due to age & chronic health problems. Animal lovers<br />
were concerned about these animals & their final destinations. After a public<br />
clamor, Butch & Buddy were turned over to a private horse owner who<br />
ultimately found a sanctuary for them in Florida.<br />
While these efforts were underway, Longstreet (Monmouth County Park<br />
System) paid over $14,000.00 to buy two Percherons & two mules that<br />
were brought in from Pennsylvania.There is a high concentration of cruel,<br />
irresponsible operations and auctions in Pennsylvania’s Amish area.<br />
Within a day of their arrival of the Percherons, Society Director Roseann<br />
Trezza, along with an experienced horse person visited to see them &<br />
noted that they were ill.As soon as the concern was noted, Longstreet had<br />
the two Percherons “removed”. – both of which had to be returned due to<br />
health problems. And what is now the fate of the Percherons they purchased<br />
from Pennsylvania that so quickly came and went with no veterinary<br />
care?<br />
A huge area for the sale of horses is New Holland, Pennsylvania -- the<br />
largest horse auction in the East, and while horses are auctioned there for<br />
many reasons, it is a central point for buyers to purchase horses for slaughter<br />
for horsemeat.They purchase the lame, the ill, the old, those who can<br />

As New Jersey and several other states are attempting to pass legislation<br />
which would ban the use of needless dissection in middle school, junior<br />
high and high schools, Wal-Mart is running a commercial in which a young<br />
girl enthusiastically awaits to return to school to dissect a frog.<br />
Dissection results in a tremendous cost – millions of dollars are spent on<br />
dissection kits, the lives of frogs, cats, and other animals are wasted—and<br />
we will never know what it cost in traumatic behavior of school children who<br />
do take part in this “education”.The cost of taking these animals from the<br />

These baby lambs appear to be the only small animals left at<br />
Longstreet Farm.What happened to all of the adult sheep?<br />
no longer do their jobs be it racing, plowing, or show competitions, and the<br />
just plain unwanted.<br />
Gus & Ada are the new Percheron pair that the MCPS has just purchased<br />
from Pennsylvania and are now ensconced at Longstreet Farm.<br />
We have also discovered that the mules, Susy & Sally, have been adopted<br />
to someone who wishes to remain anonymous.<br />
Many families visit Longstreet & their children grew up with Butch & Buddy<br />
& other animals. But the Board of Recreation Commissioners has a policy<br />
of “moving out animals to make room for replacements”. Sheep, goats,<br />
cows – all continue to reproduce and they have alternatives for the “overflow<br />
or extras”– they usually sell the extra animals at auction.They have a<br />
vet on staff & these farm animals are sold at livestock auction because of<br />
poor animal husbandry? They can neuter the male animals.<br />
In a throwaway society where useless items are quickly discarded, this is<br />
a disturbing practice and it is important that this matter is not cloaked in<br />
secrecy. We cannot comprehend why a government entity is doing business<br />
with a dealer that sold them sick horses or perhaps taking to slaughter<br />
unwanted animals because they never neutered them.All animals that<br />
are there for the pleasure and “education” of the public should be protected<br />
from going to private individuals or slated for auction.<br />

CHARGES AGAINST EGG PRODUCER<br />
Newton county District Attorney Scott Watson filed criminal animal cruelty<br />
charges against egg producer MOARK Industries, and two subcontractors.<br />
It was charged that the defendants purposely killed chickens “in a manner<br />
not allowed by the law”. Missouri law is absolutely clear that all animals<br />
enjoy the same legal protection & also holds corporations responsible for<br />
abusing animals in the name of profit. A conveyor belt ends at a massive<br />
truck container and chickens , desperately & wildly, try in vain to escape<br />
their inevitable tumble and death scene in the container. The modern egg<br />
industry is arguably the most abusive and part of the problem is that no<br />
federal laws apply to the treatment of chickens and other animals on the<br />

The Radisson Seven Seas cruise<br />
line has announced that they will<br />
no longer offer dolphin encounter<br />
tours at any of their ports of call.<br />
This sends a clear signal to the<br />
t ravel & tourism industry that<br />
entertainment does not have to<br />
come at the expense of marine<br />
c r e a t u r e s. According to Dari u s<br />
Mehta, director of Radisson’s<br />
land programs: “Sadly, under the<br />
guise of communing with nature or advancing or scientific understanding,<br />
dolphin encounter programs too often overlook the way dolphins actually<br />
exist & interact with each other in the wild…while we will continue to<br />
employ programs that allow our guests the wonderful experience of<br />
observing dolphins in the wild, we’re opposed to those that interfere with<br />
dolphins’natural behavior.The decision came after discussions with WSPA<br />
(World Society for Protection of Animals).Radisson Seven Seas Cruises is<br />

TWO STEPS BACK…<br />
A Hong Kong marine park will be adding 33 new animal species to its current<br />
collection. Ocean Park would like to add threatened or endangered<br />
animals such as Indo-Pacific humpback dolphins …. which would violate<br />
international trade rules. They would also like orcas, belugas, polar bears,<br />
walruses – wild captures which are notoriously violent & often lead to injury<br />
& death. Ocean Park has a dismal record of keeping marine mammals.<br />
The park is trying to compete with Disneyland Hong Kong which will open<br />
Sept. 2005 which is animal-free. An easy method to express your concerns,<br />

NEW LAW IN COSTA RICA<br />
TO PROTECT DOLPHINS<br />
On July 28th, the Costa Rica government approved a law that PROHIBITS<br />
keeping dolphins and whales in captivity! The law also bans swimming with<br />
these marine mammals in either captive or wild settings. This bold step to<br />
protect dolphins effectively stops the swim-with-the-dolphins industry<br />
which appears to be expanding across Latin America & the Caribbean.<br />
Presently, there are 45 whale & dolphin-watching companies operating out<br />
of Costa Rica but none advertising swimming with the marine mammals.<br />
Dolphins that live in captivity are extremely stressed & it decreases their<br />
life expectancy.<br />
ANIMAL ANTI-CRUELTY BILL PA S S E S<br />
OVER GOVERNOR’S SECOND VETO<br />
After a 4 year battle, the U S Virgin Islands Senate voted unanimously to<br />
approve an OVERRIDE TO Governor Turnbull’s SECOND VETO of a<br />
much-debated animal abuse bill. Anyone convicted of the offenses will be<br />
prohibited from owning an animal for 5 years, with a probation violation<br />
occurring if the regulation is not adhered to. The law will apply to entrapment<br />
of all animals with the exception of fowls, for fighting.Although many<br />
are against cockfighting which is legal here, the groups did not want to<br />
jeopardize passage of this bill.<br />
Great opportunities to help others seldom come, but<br />
small ones surround us every day.<br />

SUPPORT NEEDED FOR CAPTIVE<br />
PRIMATE SAFETY ACT<br />
U. S. Senator James Jeffords (I-VT) & U.S. Senator Lincoln Chafee (R-RI)<br />
have introduced the “Captive Primate Safety Act” & companion bill H.R.<br />
1329 (U. S. Rep. Eddie Bernice Johnson (D-TX) and U S. Rep. Rob<br />
Simmons (R-CT) would restrict pet trade in monkeys & chimpanzees.<br />
Sadly, these animals are given up quickly when they become too difficult to<br />
handle & most responsible sanctuaries are at capacity. Please contact your<br />
Senators & Representatives urging that they co-sponsor & favorably support<br />
this bill.<br />

lived with her family for 20 years.<br />
S a d l y, Pixie’s erratic behav i o r<br />
became a source of concern to her<br />
owners. She began attacking for<br />
unknown reasons and they decided<br />
that they would have to give up<br />
their long-time pet.They contacted<br />
Popcorn Park and we took in Pixie<br />
– a hard separation for Pixie and<br />
her family. Pixie has settled in and<br />
is quite happy here. But a great<br />
deal of sorrow, fear and concern<br />
preceded her arrival at Popcorn<br />
Park.<br />
ELEPHANT WITH ROTTING CALF<br />
INSIDE DIES AT DISNEY-ORLANDO<br />
The Animal Rights Foundation of Florida (ARFF) called on the U. S. Dept.<br />
of Agriculture to investigate reports that Ibala, a female elephant & firsttime<br />
mother, died at Disney’s Animal Kingdom after her dead calf was left<br />
rotting inside of her for weeks.<br />
According to ARFF, Disney’s Animal Kingdom has had an abysmal history<br />
of caring for live animals as listed below:<br />
- At least 31 animals died at Disney’s Animal Kingdom before the park even<br />
opened. It included 2 West African crowned cranes that were run over by<br />
safari trucks; 4 cheetah cubs swallowed antifreeze & 2 Oriental otters ate<br />
poisonous seeds from loquat trees planted in their exhibit.<br />
- In 1990 Disney pled guilty to violating wildlife laws & paid $100,000 in<br />
fines after illegally removing nests & eggs of egrets, ibises other protected<br />
birds & brutally killing dozens of black vultures because they were disruptive.<br />
- Between 1985 & 1990 four of Disney’s 6 original dolphins died after they<br />
had been captured from their original habitat.<br />
- In 1987, accusations of neglect & mismanagement followed the deaths of<br />
the last remaining dusky seaside sparrows after an unsuccessful, captivebreeding<br />
program at Disney World.<br />
TRADE IN EXOTIC ANIMALS<br />
EXPANDS TO INTERNET<br />
According to recent news articles, the internet has become a haven for the<br />
sale of exotic pets & products – many of them illegal & made from endangered<br />
species. According to the IFAW (International Fund for Animal<br />
Welfare) thousands of endangered animals & animal products are available<br />
including a live Siberian tiger for $70,000, a lion, peregrine falcons &<br />
many medicines made from leopard, rhinos, tigers & elephant parts.<br />
During a one week period in January, more than 9,000 live wild animals<br />
and products were offered on animal-trading websites, in chat rooms & on<br />
auction sites.<br />
Several sites depict capuchins, monkeys wearing baby clothes and offering<br />
for sale between $3,500 to $6,800. Unbelievably, USDA approved,<br />
there are companies located in the State of Washington and on the East<br />
Coast.Not all sales of endangered animals & products are illegal. It would<br />
depend if the product was made before laws were passed banning such<br />
items.

softball game. The game will be held on Saturday, September 17 at 2 in<br />
the afternoon at Winding River park in Toms River. All proceeds go to the<br />
<strong>Associated</strong> <strong>Humane</strong> <strong>Societies</strong>' Vested Interest Fund to purchase six (6)<br />
bullet-proof K-9 vests for the Dover Township K-9 Unit. Donations can be<br />

Police Dogs, who are the intended recipients of the vests to be purchased<br />
through this fundraiser, are considered patrol dogs and work hand-in-hand<br />
with the officers on the street.Each dog is also cross trained in Narcotics<br />
detection. Dover Twp. is the 7th largest municipality in New Jersey, and its<br />
police serve a population of over 90,000.<br />

MOST ANIMALS DIED AFTER<br />
ABANDONMENT IN RENTED ROOM<br />
On Aug. 11th, Christopher Albee, 33, pleaded guilty to animal cruelty in<br />
Upper Freehold Township, Municipal Court. Four counts of animal cruelty<br />
had been issued by the N J State SPCA. Albee had rented a room & when<br />
he had not been present for at least 2 weeks, the homeowner opened the<br />
door & found a variety of animals including iguanas, monitor lizards, tarantulas,<br />
turtles, fish, 15 rats, a cat & a rabbit.There were two dead ferrets in<br />
cages under a bed, turtles in a bucket of water that were dead & fish had<br />
been eating each other. All surviving animals were taken to the Society’s<br />
Forked River Animal Care Center for immediate care. Some of the surviving<br />
reptiles were later relocated to a reptile rehabilitator.<br />
Municipal Court Judge Bonnie Goldman fined Albee $3,000 under a plea<br />
agreement that Albee have supervised probation to confirm that he no<br />
longer has animals. Albee also pleaded guilty to possession of non-game<br />
& exotic wildlife as charged by the N J Division of Fish & Game & paid a<br />
$750 fine. Albee now resides in Seaside Heights.<br />
BOB BARKER DONATES $1 MILLION TO<br />
N O RTHWESTERN U. SCHOOL OF LAW<br />
Kudos to animal lover & PRICE IS RIGHT host, Bob Barker, who donated<br />
$1 million to Northwestern University School of Law for an animal rights<br />
law course that will teach students about species protection, human-animal<br />
interaction & international wildlife law. This will ensure future generations<br />
to be taught effectively to be advocates for animals.<br />
AIRLINES REPORT ANIMAL<br />
DEATH/INJURIES MONTHLY<br />
Four years ago, Congress passed a law requiring airlines to file reports<br />
about family-owned animals that were killed, injured or light on domestic<br />
flights. As of July 1st, reports will begin appearing in the monthly Air Travel<br />
Consumer Report.It is important for the public to report any problems with<br />
regard to animal transport.The Dept.of Transportation will begin to check<br />
the self-reported data against consumer complaints to verify accuracy. In<br />
May, ten animals were killed, injured or lost on flights by six airlines. A large<br />
dog escaped his kennel in the cargo hold of an Alaska Airlines flight and<br />
killed an Abyssinian cat in one of the deaths reported to the Dept. of<br />
Transportation. A dog & a cat arrived dead on Continental Airlines …. A<br />
Sheltie named Kelly was euthanized after ingesting a toxic substance on a<br />
US Airways Group flight. Injuries & a loss were reported on Northwest<br />
Airlines, Continental Airlines, Alaska Air Group, Alaska Frontier Airlines &<br />
Delta Airlines’ Comair. Obviously this law does not include those animals<br />
shipped from puppy mills/breeders.<br />
On January 24th, an employee of Continental Airlines brought in a 2 month<br />
old Hairless Sphynx cat that was suffering from hypothermia.The outside<br />
temperature was 9 degrees Fahrenheit and the kitten had arrived from a<br />
breeder in Texas. It is against the Animal Welfare Act to ship during such<br />
temperature extremes, Continental had accepted the kitten. Immediate<br />
care was given to the kitten who was then sent to an emergency 24 hour<br />
veterinary service to monitor during the night.We contacted the new owner<br />
who advised it was a gift for his wife. Also at home was a 2 year old baby.<br />
The Society contacted the U. S. Dept. of Agriculture for further action on<br />
the matter.<br />
For the monthly report for June, only Continental Airlines had a pet related<br />
incident involving a flight from Houston to Washington, D C. A 3 year old<br />
Chow/Lab mix had gotten out of its kennel & ran out onto the tarmac.<br />
According to the owner, a Continental Airline employee had been chasing<br />
the dog for an hour & it bit the employee after it was cornered.The dog was<br />
taken to a vet & died the next morning due to heat exhaustion. The family<br />
was so upset that they took their other dog & rented a car to drive from<br />
Houston to Los Angeles.<br />
WOMAN SMUGGLES BIRDS IN<br />
WHEELCHAIR – SOME DIED<br />
Mercedes Ruiz, 54, was caught by the U. S. Dept. of Agriculture officer &<br />
“QT”, a member of the “Beagle Brigade”– a team of dogs that inspect passengers<br />
& luggage at various airports throughout the U.S. Ruiz had<br />
returned to Miami from a 2 day trip to Cuba via a connecting flight through<br />
the Bahamas. Inspectors found cloth pouches tied to the bottom of the<br />
wheelchair. Inside were 39 exotic birds crammed in plastic tubes the size<br />
of toilet paper rolls. At least 9 were dead.Ruiz had been stopped on 3 previous<br />
occasions trying to sneak wildlife aboard planes to Miami. She faces<br />
up to 5 years in prison & fines of up to $250,000 on each count.Sentencing<br />
is scheduled for Oct. 18th.<br />

Now Treasured in Pitman, NJ<br />
Treated like a piece of garbage, a horribly matted, extremely emaciated &<br />
badly injured Shih Tzu was discarded in a garbage bag & would not have<br />
been found were it not for Newark resident, Darius Webster’s pit bull who<br />
refused to leave the bag alone. After the dog had been shaved down, it was<br />
revealed that she suffered a crushed left paw. After her appearance on<br />
Channel 12 N J <strong>News</strong>, many offers for adoption came in.Daniel Mills and<br />
Keith Armstrong, who had previously owned a Shih Tzu & a Lhasa, both of<br />
which had passed away at 17 and 18 years old respectively, were given the<br />
green light to adopt this beautiful lass.<br />

great companion…especially now that he has learned to focus his chewing<br />
on chew toys! He has even found his way into a sermon. We are<br />

Pomeranian Fills Empty Spot in<br />
Elizabeth, N J Animal Lover ’s Heart<br />
Harold Beim, Society Board Member recently passed away after serving in<br />
this capacity for over 40 years. Shortly before his passing, Harold & his<br />
wife, Naomi, lost their beloved Shih Tzu of 15 years. Recently, Naomi<br />
stopped in for a visit and expressed an interest in adopting a Pomeranian<br />
in the event one came in.As in Kismet, two days later the Society received<br />
a call from an elderly wheelchair-bound Newark resident. She had a very<br />
young Pomeranian who needed immediate vet care, had no funds and very<br />
little resources to properly care for the dog.After a chat with the owner, she<br />
felt it would be in the best interest of the dog to give her up. The Society<br />
picked up the dog, took care of the medical problems, spayed her….and<br />
then called Naomi. Thankfully, “Tinker Toy” has filled an empty spot in<br />
Naomi’s heart. Also at home are two other orphans adopted from the<br />
Society – Puff a Persian and Kelly, an Amazon Parrot.If you are looking for<br />

Meet Allie – once a Society orphan who now puts smiles on those people<br />
who need a lift. Fritz Pastuck of Clinton, N J adopted the dog from our<br />
Newark Animal Care Center & has made Fritz proud! Allie has been<br />
installed in the N. J. Veterinary Foundation’s Animal Hall of Fame for therapy<br />
efforts given in relation to September 11, 2001 & a Certificate of<br />
Appreciation from Therapy Dogs International for her efforts during the<br />
same period of time. Allie & her best friend, Fritz Pastuck, were also presented<br />
with a Certificate of Achievement for accumulating 50 or more<br />
Therapy Dog Visits! Quite a triumphant accomplishment for a dog with a<br />

male Shepherd mix. Well, that’s just<br />
about what we found! It said on his<br />
cage that his name was Cheeks. He<br />
was about 6 months old & he was a<br />
Belgian Malinois mix.He was adorable!<br />
He was in a cage with 2 other dogs his<br />
size & we asked to take him out. We<br />
walked him around a bit & then we decided to adopt him. We changed his<br />
name to Chex & he’s one of the best dogs ever! He loves our other dog<br />
Buddy, a Husky mix & he also likes to do a little agility. He loves to run<br />
around & play in the yard & for walks. He never wants to leave my sight. I<br />
just wanted to say thank you for such a wonderful dog!”<br />

Meet Wooby – a 3-legged Husky Mix who was adopted by Sue & Peter<br />
Herflicker of Toms Rivers, N J. on April 13, 2003 – a banner day for this<br />
dog. She came to the Society a month before when she & 2 litter mates<br />
were rescued from Asbury Park.Due to an old break in her leg, the veterinary<br />
thought it would be much better for the dog to have the leg amputated.<br />
Sue decided to put Wooby into a Therapy Dog Program & because of her<br />
intelligence & eagerness-to-please, she officially became a Therapy Dog in<br />
August 2004. Wooby had to complete a basic 8 week obedience course,<br />
then another 8 weeks to become certified.She passed all courses with flying<br />
colors…& did so well, she even got an added bonus & became a<br />
“Canine Good Citizen”. When visiting the Burnt Tavern Convalescent<br />
Center in Brick, everyone who met her there fell in love with her – residents<br />
and staff. Everyone was amazed by her story & her stamina & look forward<br />
eagerly to future visits. Wooby has been a regular visitor to Country Manor<br />
in Toms River to cheer up the residents there.<br />
According to Sue: “She has touched our lives in an awesome way. Thank<br />

Popcorn Park Zoo is a 7 acre zoo located at the Society’s Forked<br />
River Animal Care Center and caters to wildlife, farm animals, and<br />
exotics that have been abused, exploited,injured, abandoned, handicapped,<br />
elderly, etc. The zoo is open daily from 11 a.m. to 5 p.m.<br />
Admission is $4.25 for adults and $3.00 for children under 12 years<br />
and senior citizens over 62 - including tax. Babies under 1 year are<br />
free, as well as all members of the Popcorn Park Wildlife Club,<br />

The Atlantic County SPCA confiscated 6 goats from a local resident<br />
who was not caring for them properly. It was the second offense for<br />
the couple and the goats were not to be returned.The SPCA contacted<br />
Popcorn Park to hold them “temporarily”until good homes could<br />
be found. The goats were heavily infested with internal parasites &<br />
treatment is a long-term process and was started immediately. These<br />
3 goats are next door to Chief & Featherston & the trio just love<br />

When Newa rk Animal Control<br />
brought in a horseshoe crab, we<br />
marveled at the huge size of this anim<br />
a l . In checking furt h e r, it wa s<br />
ascertained that it had been kept as<br />
a house pet for the last 15 years!<br />
Therefore, the Society decided to<br />
find some place where the animal<br />
could be kept under safe conditions.<br />
His diet had been boiled chicken<br />
breast pieces.<br />
J e n k i n s o n ’s Aquarium in Po i n t<br />
Pleasant Beach, N J advised that they would take the animal in.She now<br />
lives in a community tank with other of her species…..but she is quite big.<br />
The mouth is on the underside of the body and the eyes are on the top front<br />
part of the shell.<br />
Unfortunately, the horseshoe crab is treated cruelly and taunted because<br />
of the unattractive appearance. During spawning , they crowd up on the<br />
beach at high tide and females scoop out a hole in the sand and lays her<br />
eggs and the males fertilize them. Birds going north will stop to feast on<br />
horseshoe crab eggs, fishermen use the eggs as bait & therefore, the population<br />
of the horseshoe crab has diminished greatly. The prehistoric looking<br />
horseshoe crab has not changed much in the last 350 – 400 million<br />
years. LAST MINUTE UPDATE: After several weeks the female horseshoe<br />
crab, along with several others, have been released into a safe area.<br />

SEA CREATURES DIE FOR<br />
ORNAMENTAL USE<br />
After the HUMANE NEWS story<br />
appeared in the previous issue concerning<br />
sea creatures such as seahorses,<br />
starfish, etc., it was a cons<br />
c i o u s n e s s - raising for many. In a<br />
walk-through several large stores,<br />
i.e, Target, Wal-Mart, K-Mart, etc., it<br />
became apparent that it is not necessary<br />
to be a “vacationer” as there<br />
are a host of products that have such<br />
sea creatures as adornments. Be an<br />
educated consumer - you can use<br />
your pocketbook as a weapon.<br />
There are new permit requirements<br />
for global trade in seahorses which<br />
took effect in May. Millions of seahorses are “harvested”each year & most<br />
are dried & used in traditional medicine. Hundreds of thousands are also<br />
collected live for sale in the aquarium trade. According to the U. S. Fish &<br />
Wildlife Service, shipments of seahorses must be accompanied by a permit<br />
from the country of origin which confirms that they were legally<br />
acquired & that the trade does not threaten the species’ survival. All<br />
species of seahorses now fall under CITES (Convention on International<br />
Trade in Endangered Species & Flora) protection.

As was reported in the June/July 2005 issue of the HUMANE NEWS, over<br />
200 cats were found rotting in garbage bags in the East Orange, N J home<br />
of Marlene Kess, founder & director of Kitty-Kind, a New York City no-kill<br />
shelter. The <strong>Associated</strong> <strong>Humane</strong> <strong>Societies</strong>, along with investigators from<br />
the N J State SPCA, found over 48 cats – with sick and healthy cats together.<br />
The SPCA advised that she could retain ownership if she separated the<br />
sick cats from the healthy ones.The SPCA issued 38 counts of animal cruelty<br />
which was heard in East Orange Municipal Court on August 23rd.<br />
A trial was held in front of Judge Karimu Hill-Harvey who found Hess guilty<br />
on all counts and was sentenced to 21 days in jail, fined over $14,000.00<br />
and must serve 1140 days of community service. As part of the sentencing,<br />
all cats had to be relinquished to the <strong>Associated</strong> <strong>Humane</strong> <strong>Societies</strong>.<br />
The judge banned Kess from having any animals for 3 years.<br />
The Society dispatched several ambulances to remove over 95 cats –<br />
which included 5 nursing mothers with kittens. Two veterinarians were on<br />
hand to examine each and every cat and treat those that required medication.There<br />
were over 30 cats that had to be euthanized – one was continually<br />
seizuring since it had been picked up, several for kidney failure, liver<br />
failure and other terminal illnesses.<br />
According to Stuart Rhodes, President of the N J State SPCA: “Anyone<br />
who thought this woman was the Mother Teresa of the feline world should<br />
have been at her premises today. It was among the most disgusting and<br />
inhumane conditions we’ve ever seen.Living in filth with feces and urine on<br />
their coats, infested with fleas and in the case of one cat, found dead in a<br />
clothes bureau drawer, in the 98 degree interior, 95 live and one dead cat<br />
were removed. This was a severe degradation of conditions observed<br />
three months ago. We are sure additional charges will be filed against this<br />
individual”.<br />
Judge Hill-Har vey said that Kess’ cats lived in unsanitary conditions “that<br />
made healthy cats sick and sick cats sicker. I find the defendant’s actions<br />
are incongruent with the mission of her organization – Kitty Kind.The fate<br />
of these animals were worse than death”. Kess’s lawyer, Wilfredo Benitez,<br />
urged the judge to let Kess find another home for the cats – “asking your<br />
honor for some mercy”. Judge Hill-Harvey stated: “Let’s not talk about<br />
mercy. Let’s not define mercy today. Let’s talk about justice”.<br />
The Society has received phone calls from as far away as Albany, New<br />
York from those who had given her cats, donations, food, etc.Due to budgetary<br />
constraints, the Society must struggle to take on this additional burden<br />
and continue to give quality care to all of the animals that come<br />
through our doors. Our emotionally strained staff must struggle to care for<br />
these cats, provide ongoing veterinary care, find them new homes and<br />
respond to calls from distraught owners who had put their cats in Kitty<br />
Kind’s care in good faith.This, in addition to providing care for the homeless<br />
and unwanted cats that continue to come through our doors.<br />
According to an investigator with the N J State SPCA:“Your staff was E X<br />
C E L L E N T in their response. Wish I was rich enough to throw them a<br />
party. They are the heros........ “<br />
N. J. WILDLIFE REHABILIT ATORS<br />
NEED PUBLIC SUPPOR T<br />
It didn’t take very long for the number of wildlife in New Jersey to find no<br />
assistance from the very agency that should be helping them. The N. J.<br />
Division of Fish & Game has set out on a path to reduce the number of<br />
wildlife rehabilitators in the state so that<br />
As is always the case, it is the animals that suffer because of man's greed<br />
for control.<br />
N. J. wildlife rehabilitators must be certified and presently, they are required<br />
to do a one year apprenticeship which is difficult, cumbersome, inconsistent,<br />
time consuming and we are not talking brain surgery here. Until now,<br />
homeowners, animal lovers and concerned citizens could call a wildlife<br />
rehabilitator who would rescue these animals at no expense to them or to<br />
the taxpayer.<br />
Both of these animals died in illegal traps.The squirrel was caught in<br />
a trap set up by a pest control agency. The groundhog was killed in a<br />
conibear trap.The pest control agency was found guilty of animal crue<br />
l t y. The Mountainside resident who killed the groundhog was<br />
charged with animal cruelty by the N J SPCA & is answerable in<br />
Municipal Court.<br />
In a recent case, a healthy baby raccoon brought to a wildlife care center<br />
was euthanized for no apparent reason but because it was the expedient<br />
thing to do<br />
A pest control agency was using traps to remove wildlife during the summer<br />
days when the temperature was in the triple digits. Two groundhogs<br />
died from the heat. A nursing mother raccoon was taken out of an attic by<br />
another pest control agency. When they were called to advise that babies<br />
had been left behind, they advised the homeowner that everything would<br />
be okay. They could fend for themselves. By the time a wildlife rehabilitator<br />
became involved, all of the babies had died for lack of nourishment.<br />
There is presently more than a 50% reduction in the number of wildlife<br />
rehabilitators in the state. They admirably perform this service AT NO<br />
COST TO MUNICIPALITIES OR TAXPAYERS, but due to the lack of rehabbers,<br />
many animals are dealt with in an inhumane and illegal manner.<br />
Senate Bill 3235 (Karcher) and Assembly Bill 3939 (Chiappone, Panter)<br />
would solve the problem in a fair and equitable manner. Please write to<br />
your legislators asking that they support this legislation.<br />
We have already gone through one breeding season and it has been unfair<br />
to the many animals that died as a result of lack of care for them.<br />
TEENS CHARGED IN DEATHS OF<br />
GROUNDHOG MOTHER & BABY<br />
One of the most horrendous incidents of cruelty recently perpetrated on<br />
groundhogs occurred in Middletown, N J. Two high school students were<br />
charged in connection with the death of two groundhogs. They killed a<br />
young groundhog with a paint ball gun & then shot & wounded its mother.<br />
They then trapped the mother in a net & brought it into the woods & set it<br />
on fire. Christopher Welch, 18 and an unidentified 17 year old male face up<br />
to 6 months in jail, community service or a fine if convicted.

bill seeks to upgrade penalties for<br />

ELLISBURG<br />
David & Emily Ashley were visited<br />
on several occasions warning that<br />
their dogs should not be left out in<br />
the heat without water. When they<br />
returned, they found one terrier,<br />
tied to a tree with no shelter or<br />
water; it was dead. A town justice<br />
ordered removal of the other 3<br />
dogs. There is a court order saying<br />
t h ey can never get those dogs<br />
back. As of late June, they were in<br />
J e f ferson County Jail in lieu of<br />
$500 bail.<br />
NAPANOCH<br />
Camille Fraracci, 59, was charged<br />
with 9 counts of animal cruelty for<br />
failing to provide shelter for animals<br />
she had displayed at a flea market<br />
in the Valley Mall in Napanoch. A<br />
search warrant was issued & several<br />

City officials in National City are<br />
considering a proposal that would<br />
prohibit selling kittens & puppies in<br />
public places such as in front of<br />
grocery stores. Animal advocates<br />
s ay the amendment would help<br />
curb the sale of sick animals that<br />
have been smuggled over the border.<br />
CALIFORNIA<br />
An amended version of the ferret<br />
legislation, Assembly Bill 647,<br />
passed the Assembly which would<br />
require that the state study the<br />
effects of removing the domestic<br />
ferret from its list of wild animals<br />
that are unlawful to import, transport,<br />
possess or release. If the<br />
study permits removal, responsibility<br />
for enforcement, steri l i z a t i o n ,<br />
vaccination, etc, would tra n s fe r<br />
from Dept. of Fish & Game & state<br />
enforcement officers to local animal<br />
control agencies.<br />
CALIFORNIA<br />
Oakland City Council has drafted<br />
an ordinance that requires dog<br />
owners to have a microchip imbedded<br />
under the skin or be fined $100<br />
for a second offense & $1,000 for<br />
subsequent infractions. The ordinance<br />
also bars owners have having<br />
more than 3 dogs & bans ownership<br />
of roosters.<br />
LOUISIANA<br />
The Baker City Council has voted<br />
to amend its animal cruelty laws to<br />
prohibit the tethering of dogs within<br />
city limits. The ordinance makes it<br />
illegal to tie or chain a dog for more<br />
than one hour regardless of<br />
whether the dog’s yard is fenced.<br />

value & vet care from $5,000 to<br />
$7,500.<br />
NEW HAMPSHIRE<br />
No amendments were approved to<br />
Bill 36 which would have placed a<br />
tax on cat food distributed in the<br />
state to fund its animal population<br />
control program, effectively killing<br />
the legislation.<br />
NORTH CAROLINA<br />
Senate Bill 1032 would require the<br />
D e p t . of Environment & Natura l<br />
Resources, in conjunction with the<br />
North Carolina Zoological Park &<br />
Wildlife Resources Commission to<br />
propose practices that several entit<br />
i e s, including commercial pet<br />
r e t a i l e r s, exotic pet hobbyists &<br />
wild animal breeders, should adopt<br />
to protect the public from the risks<br />
posed by dangerous animals. The<br />
bill was as a result of a child’s<br />
severe mauling by someone’s pet<br />
tiger.The report will contain a list of<br />
dangerous animals, type of danger<br />
each animal poses, suggested<br />
ways to regulate ownership & a<br />
comprehensive list of persons &<br />
entities that should be exempt from<br />
r e g u l a t i o n s. The bill passed the<br />
Senate & is in the House<br />
Committee on Environment &<br />
Natural Resources.<br />
OHIO<br />
A new law created a pet-friendly<br />
license plate and up to $40 from<br />
the sale of each plate goes to provide<br />
low cost spay/neuter services<br />
and information on animal care.<br />
Animal shelters, humane societies,<br />
non-profit foster and breed rescues<br />
are slated to receive funds.<br />
OHIO<br />
A proposed bill would make pet<br />
stores selling dogs liable for certain<br />
defects in the animals until they are<br />
15 months old. Other provisions<br />
would include that a person who<br />
purchases a dog from any commercial<br />
seller is entitled to a refund,<br />
c o m p a ra ble exchange or reimbursement<br />
of vet fees up to the<br />
price of the animal if it develops a<br />
“congenital defe c t ” or “ c o m m o n<br />
h e r e d i t a ry disorder”. It wo u l d<br />
exempt humane societies, animal<br />
control agencies & other non-profit<br />
groups.<br />
KENTUCKY<br />
A new regulation bans exotic animals<br />
as “pets” and is one of the<br />
most comprehensive restrictions in<br />
the U.S. It will prohibit future possession<br />
as well as prohibit existing<br />
animals from being bred. Common<br />
animals kept as “ p e t s ” i n c l u d e<br />
lions, tigers, cougars, ocelots, serva<br />
l s, wo l ve s, bears, alligators,<br />
snakes, monkeys & other primates.<br />
To date, 37 states have some form<br />
of law either banning or regulating<br />
private possession of exotic animals.<br />
FLORIDA<br />
Suspended Animation, Inc. is a<br />
Boca Raton, Florida research company<br />
that originally planned to use<br />
animals in which they were going<br />
to use them in a “cryopreservation”<br />
l a b o ra t o ry to study freezing &<br />
r e s u s c i t a t i o n . The company has<br />
since undergone a complete<br />
change which includes leaving animals<br />
out of its research plans.<br />
RHODE ISLAND<br />
H 6169 would include several shelter<br />
& tethering requirements. Dogs<br />
would not be allowed to be kept or<br />
tied outside for more than 30 minutes<br />
without access to adequate<br />
p r o t e c t i o n ; t e t h e ring dogs on a<br />
rope less than 6 feet long;tethering<br />
dogs when owner/guardian is not<br />
present & tethering dogs for more<br />
than 10 hours or caging for more<br />
than 18 hours during a 24 hour<br />
period. The bill also requires owners<br />
to provide fresh drinkable water<br />
& food that fosters normal body<br />
weight & gr owth for the dog’s<br />
breed, age & size.<br />
SOUTH CAROLINA<br />
R o b e rt Triolo & Tina Bogutzski,<br />
owners of Sunsational Pets, pleaded<br />
no contest to 5 counts of animal<br />
mistreatment & one nuisance count<br />
each. Both were ordered to pay<br />
$3,528 each or serve 90 days in<br />
jail. The judge stipulated that they<br />
would not be able to claim any of<br />
the 105 animals seized.The Grand<br />
Strand <strong>Humane</strong> Society is working<br />
to place the animals which included<br />
cats, dogs, birds, fish, rats, gerb<br />
i l s, hamsters, mice, tara n t u l a s,<br />
scorpions, a rabbit, a chameleon &<br />
a savannah monitor. Triolo had successfully<br />
had the local ordinance<br />
changed in February to allow for<br />
the sale of a wider variety of animals.<br />
Animals had been left unattended<br />
for long periods of time.<br />

On July 28th, the NEW YORK TIMES ran a paid advertisement criticizing<br />
the U. S. Dept. of Agriculture’s arbitrary definition of the term “animal”.<br />
According to the copy of the ad, the USDA has classified rabbits as “poultry”<br />
to avoid required protections for the species under the <strong>Humane</strong><br />
Slaughter Act.The ad was placed by the <strong>Humane</strong> Farming Association, the<br />
Animal Welfare Institute & animal Rights International.<br />

For several years, students in Ms. Hillary Hill’s classes at Franklin Middle<br />
School in Nutley, N J have raised funds for animals at the <strong>Associated</strong><br />
<strong>Humane</strong> <strong>Societies</strong> and Popcorn Park. The most recent fund raisers that<br />
were the most successful were run by the Artist Club 8th Grade Art League<br />
and Animal Plant Club who held annual Valentine Friendship Gram sales.<br />
As a result of their efforts, $300.00 was raised to “adopt”one dog, one cat<br />
and one of the wildlife members in the Popcorn Park Wildlife Club. The<br />
group now has a one year sponsorship of Boo Boo the Bear, Jessie Belle<br />
the Beagle and Zephyr the cat. They will receive color photos and reports<br />
of the animals they sponsor.<br />

was granted and Maureen and her family visited the Society to bring in a<br />
whole bunch of goodies for the Society’s orphans that were waiting for a<br />

legislation which would give K-12 public school students the right to<br />

SNAIL & SLUG BAIT<br />
POISONOUS TO PETS<br />
As has been mentioned in the HUMANE NEWS on several occasions in<br />
the past, it bears repeating.SNAIL and SLUG BAIT are poisonous to dogs.<br />
Some veterinary hospitals have reported as many as 3 cases a week during<br />
the warm weather season. Any pets that ingest even a small amount<br />
MUST receive immediate veterinary care or it could result in death.<br />
The bait comes in pellets which can resemble dog food. Powder and liquid<br />
forms can get on a dog’s paws & can be ingested when it licks it off.<br />
Symptoms can occur within 30 minutes after ingestion.It is recommended<br />
that pet owners use non-toxic forms of snail & slug bait. Traps can be baited<br />
with beer or a mixture of molasses, cornmeal, flour, water & yeast to<br />
attract the slugs – which will not harm pets.<br />
According to Dr. Andrea Looney of NY State College of Veterinary<br />
Medicine at Cornell University, with regard to chemicals applied to lawns,<br />
shrubbery or trees: keep animals away from sprayed areas as the chemicals<br />
may rub off on to the animals’fur or feet & they could ingest the chemicals<br />
if they eat sprayed grass or leaves.<br />

According to Dr. Dennis Ownby, of the Medical College of Georgia’s section<br />
chief of allergy & immunology, parents who smoke wipe out the antiallergy<br />
benefits their infants receive from pets. His findings showed infants<br />
living with 2 or more pets in their first year were half as likely to develop<br />
allergies as they grew up; however, if either parent smoked, the effect was<br />

11 protection from creditors. Rufus & Co. failed to pay a $9,800 fine stemming<br />
from animal cruelty charges for an incident involving a Shar Pei<br />
puppy at their Paramus Park Mall store. Official documents reveal that this<br />
is not the first time that the company has filed for bankruptcy. The<br />
Connecticut-based chain operates pet outlets under the names Family Pet<br />
Centers, Rufus & Co., Woof & Co. and Maxie Biggs. There are over 18,000<br />
creditors in 5 states:NY, NJ, CT, MA and PA.<br />

A grand jury refused to indict former workers at a Pilgrim’s Pride Corp.<br />
chicken plant who kicked & stomped live birds while being filmed undercover<br />
by an animal rights group. Pilgrim’s Pride fired 11 employees following<br />
the release of the PETA video & provided animal cruelty training at its<br />
24 plants in North America.<br />

More reports are coming out of the Bush Administration regarding altering<br />
scientific reports. A former oil/gas industry lobbyist who worked as the<br />
P r e s i d e n t ’s environmental policy council, repeatedly revised fe d e ra l<br />
reports in an effort to downplay the seriousness of global warming.<br />
GLOBAL WARMING UPDATES<br />
As a result of the recent Discovery mission which carried a research satellite<br />
to study holes in the Earth’s ozone layer, it is feared that man-made pollutants<br />
are depleting the ozone layer.<br />
Global warming has caused Arctic sea ice to melt at a rate of 9% per<br />
decade. The polar bears hunt seals from the sea ice. & as the bears get<br />
stuck on land, finding food becomes more difficult.Some scientists believe<br />
polar bears could be extinct in 50 years…along with many other species.<br />
Deforestation has also been blamed for warmer temperatures. In 2003,<br />
Phoenix, Arizona experienced a sweltering 118 degrees & areas of that<br />
state have experienced triple digit temperatures. The warming has affected<br />
the maple syrup industry. Numerous major wildfires have occurred –<br />
and fire officials believe the worst is yet to come.<br />
How can YOU help? Plant deciduous trees near your home to help shade<br />
it & reduce energy use; buy energy-efficient appliances; insulate your<br />
home; use compact fluorescent lighting; recycle. If your water heater is<br />
more than 5 years old, wrap it in an insulating jacket;caulk & weatherstrip<br />
doors & windows;turn off the TV, video player, stereo & computer when not<br />
in use.<br />
Coal-burning power plants are the largest U. S. biggest offenders in global<br />

UNIVERSITY OF NEVADA CITED FOR<br />
MISTREATING RESEARCH ANIMALS<br />
After a 7 month investigation, the U. S. Dept. of Agriculture cited the<br />
University of Nevada in Reno for 46 federal animal welfare violations<br />
between May 2004 & March 2005. Violations include repeatedly leaving<br />
research pigs with inadequate water & housing, poor sanitation at animal<br />
care facilities, lack of vet care & failure to investigate complaints of animal<br />
neglect.Associate professor Hussein S. Hussein, an internationally known<br />
animal nutrition researcher, alleged abuse of research animals in complaints<br />
to the USDA last summer. It was later discovered that 38 pregnant<br />
sheep died in Oct.2002 while they were inside a locked gate without food<br />
or water for 3 days. Hussein has filed 2 lawsuits in federal court accusing<br />
the university and administrators with reprisals & trying to fire him. The<br />
school has agreed to pay an $11,400 fine to settle the case.<br />

and generosity of many HUMANE NEWS readers. The animals are placed on the program on the<br />
basis of such details as victims of cruelty, handicap, length of stay, etc. As a result of our efforts,<br />
brand new facilities have been given to these orphans. You can help by “adopting” one of these<br />
orphans for $10.00 a month. In turn, you will receive a color photo & report of your pet every four<br />
months, & a membership card which entitles you to FREE ADMISSION TO POPCORN PARK ZOO.<br />

Just added to the Share-A-Pet Program are three beautiful black and<br />
tan Coonhounds -- Brandon, Gracie and Gabe. In May 2004, twentyone<br />
coonhounds, one cat and two guinea pigs were confiscated by<br />
the NJ State SPCA from a Howell owner due to neglect and abuse.<br />
The home was declared uninhabitable, and children and pets had to<br />
be removed. All the dogs needed updated health care, some training<br />
and TLC, and happily, all have found loving homes but these three.<br />
We wanted to give this sweet threesome an extra chance to find love<br />
...in your homes,or in your hearts on the Animal Haven Farm where<br />
you can sponsor them. Brandon, Gracie and Gabe patiently wait ...<br />
