President’s Desk<br />

The recent events in Japan are not only sobering but also serve as<br />
another reminder of how fragile society and order can be when<br />
placed under great duress. At the same time, the tragedy shines a<br />
harsh light of perspective on our local budgetary and political woes.<br />
While I in no way minimize them or their impact on people, I am<br />
also reminded we still have much to be grateful for. To that end,<br />
the focus of this month’s column is on some very positive things<br />
— developments involving our members and courts.<br />
In my first column I talked about challenges facing our association<br />
and chief among them was re-districting; with <strong>San</strong> <strong>Bernardino</strong>,<br />
Riverside and Imperial Counties joining <strong>San</strong> Diego <strong>County</strong>,<br />
which has more lawyers than the other three combined. In an<br />
effort to ensure the smaller counties have voice at the state level,<br />
former SBCBA President Mike Scafiddi is running for a seat on<br />
the State <strong>Bar</strong> Board of Governors. Mike has tremendous energy<br />
and enthusiasm for the job; I support and applaud his efforts. He<br />
has been formally endorsed by the <strong>San</strong> <strong>Bernardino</strong> <strong>County</strong> <strong>Bar</strong><br />
<strong>Association</strong> and I expect both Riverside and Imperial will follow<br />
suit. The most important thing you can do to ensure representation<br />
at the state level is VOTE. Our own Bryan Hartnell’s bid was<br />
unsuccessful because the turnout was nothing less than dismal. If<br />
you want local representation on the Board of Governors, cast your<br />
ballot as soon as you get it in the mail. Ballots come out in April<br />
and are not due until June. If you set it aside, figuring you have<br />
plenty of time, chances are you will forget and not think about or<br />
run across it again until it is too late. You can make a difference but<br />
only if you vote.<br />
During a time when most of what you read about lawyers and the<br />
legal system is negative, the opportunity to write about recognizing<br />
lawyers and judges for doing something positive is a treat. The<br />
SBCBA’s Kaufman-Campbell award is given each year to a judge<br />
or judges who have demonstrated the highest standards of judicial<br />
excellence in the pursuit of justice while exemplifying courtesy,<br />
integrity, wisdom and impartiality. I am pleased to announce the<br />
2011 Kaufman-Campbell award will be presented to the Honorable<br />
Manuel A. Ramirez, Presiding Justice of the 4th District Court of<br />
Appeal, Division 2. After seven years as a deputy district attorney,<br />

Manuel Ramirez was appointed to the<br />
Municipal Court in 1983 by Governor<br />
George Dukmejian. He was elevated to<br />
the Superior Court in 1986 and served<br />
until 1990 when Governor Dukmejian<br />
appointed Justice Ramirez to his current<br />
position. Since that time, he has served<br />
with distinction, exhibiting all of the<br />
qualities embodied by the award and its<br />
namesakes.<br />
Justice Ramirez is a most gracious<br />
and willing ambassador for our justice<br />
system and the importance of the law<br />
and lawyers in civilized society and<br />
how we live our daily lives. I have been<br />
particularly impressed with his DCA<br />
Outreach Program. Each year, Justice<br />
Ramirez selects a high school with a<br />
connection to the 4th District Court of<br />
Appeal, ranging from a justice’s alma<br />
mater to a member of the court staff’s<br />
children go there. On the appointed<br />
day, the justices and their staff travel<br />
to the school and set up court. Court<br />
then convenes and hears oral argument<br />
in two matters. These are not mock<br />
presentations but actual cases argued<br />
by counsel of record and then decided<br />
in the normal course. The justices take<br />
questions from the audience and then<br />
split up and visit classrooms, joined<br />
by volunteer lawyers to talk to smaller<br />
groups about whatever they want to<br />
know about law, lawyers and the courts.<br />
It serves to educate people early on about<br />
the importance of the justice system and<br />
how it impacts their lives every day. I<br />
have been fortunate to participate in the<br />
program and highly recommend it. On<br />
behalf of the SBCBA and its members,<br />
congratulations.<br />
Congratulations are also in order for<br />
SBCBA member Mike Bidart who<br />
was recently named Cal-ABOTA Trial<br />
Lawyer of the Year. The American<br />
Board of Trial Advocates’ mission is<br />
to foster improvement in the ethical<br />
and technical standards of practice in<br />
the field of advocacy to the end that<br />
individual litigants may receive more<br />
effective representation and the general<br />
public be benefited by more efficient<br />
administration of justice consistent with<br />
time-tested and traditional principles<br />
of litigation. It exists to elevate the<br />
standards of integrity, honor and courtesy<br />
in the legal profession and to aid in<br />
further education and training of trial<br />
lawyers; to work for the preservation<br />
of our jury system; to improve methods<br />
of procedure of our present trial court<br />
system. Mike is a long time member<br />
of the <strong>San</strong> <strong>Bernardino</strong>/Riverside<br />
Chapter of ABOTA. Please join me in<br />
congratulating Mike; as a fellow member<br />
of the <strong>San</strong> <strong>Bernardino</strong>/Riverside Chapter<br />
I can say without fear of contradiction<br />
the recognition is well deserved and<br />
long overdue.<br />
Last month the local chapters of the<br />
American Inns of Court held their joint<br />
dinner at the Mission Inn. Retiring (now<br />
retired) California Supreme Court Justice<br />
Carlos Moreno was the guest speaker.<br />
Justice Moreno spoke about the some of<br />
the cases he was most proud of, many of<br />
them controversial. In addition to giving<br />
the audience behind the scenes insight<br />
in connection with some of the court’s<br />
high profile decisions, his message was<br />
a reminder about how the law shapes<br />
society and the responsibility we all have<br />
because of that. I took Justice Moreno’s<br />
remarks as a challenge to do what we<br />
know is right rather than what may be<br />
popular and to devote the full measure<br />
of our skill, energy and integrity toward<br />
everything we do as lawyers. I took it<br />
to mean leave it all on the field, do what<br />
is in the best interests of your client but<br />
integrity, civility and professionalism<br />
must not be compromised in the name of<br />
zeal for a cause or result. Pretty good<br />
advice.

Books<br />
50 ways to do More in Less Time<br />
(Often with less money)<br />

1. Books are not antiquated, outmoded<br />
objects. We love our Kindle on a cruise<br />
(carrying tons of books on that small device<br />
is sweet), but settling in with a book at home<br />
in front of the fire is still a great experience<br />
– and a glass of wine doesn’t hurt. No TV, no<br />
computer, no smartphone – this will actually<br />
enhance your learning and therefore your<br />
productivity.<br />
2. Google for Lawyers is a remarkable new<br />
book by 1egal tech experts Mark Rosch and<br />
Carole Leavitt (ABA, 2010). You have no<br />
idea what Google can do for free until you<br />
read this book.<br />
3. Virtual lawyering Is booming and no<br />
wonder. With jobs scarce, smart solos<br />
are leveraging the cost savings of virtual<br />
lawyering to begin their law practices. An<br />
excellent resource is Virtual Law Practice:<br />
How to Deliver Legal Services Online by<br />
Stephanie Kimbro (ABA, 2010).<br />
4. If you’re headed for the mid-large law firm<br />
world and want to he ready, read Michael<br />
Downey’s Introduction to Law Firm Practice<br />
(ABA 2010). You’ll be more knowledgeable<br />
and productive from day one.<br />
5. Social Media for Lawyers: The Next<br />
Frontier by Carolyn Elefant and Nicole<br />
Black (ABA 2010) is a good way to get a<br />
10,000 foot overview of this new frontier. If<br />
you’re trying to get a handle on how to use<br />
social media productively, reading this book<br />
is a good first step.<br />
Smartphones<br />
6. Recognize their potential. Smartphones are<br />
now computers — and very powerful ones at<br />
that. With a flotilla of applications, you can<br />
do many things faster on your Smartphone<br />
and. your location is now irrelevant (except<br />
if you’re using GPS apps).<br />
7. You can also spend vast amounts of time<br />
on time-sucking Smartphone games and app<br />
applications. Resist that urge to increase<br />
productivity.<br />
8. Subscribe to www.lifehacker.com. If<br />
what you receive doesn’t interest you, hit<br />
delete, but this productivity site has carefully<br />
followed tips for Smartphone use — and<br />
many other “work harder, not smarter” tips.<br />
Finding Jobs<br />
9. Yes, they’re scarce. Career Counsel is<br />
the official career resources website for the<br />
American <strong>Bar</strong> <strong>Association</strong>. It gives you<br />
access to a variety of legal resources as we1l<br />
as information regarding the law industry,<br />
continuing legal education, and law careers.<br />

20. Don’t be a slave to geography. If times<br />
aren’t good where you are, perhaps you need<br />
to find your fortune elsewhere. Be flexible<br />
and scatter your resume to the winds.<br />
21. Learn to write real English. Those who<br />
do hiring in law firms are irritated by the<br />
inability of many law school graduates to<br />
use the English language correctly — and<br />
they despair of finding those who can write<br />
it persuasively. Take inexpensive online<br />

22. Perfect your elevator speech, a 15– 30<br />
second rendition of who you are and what<br />
you do. Create a version for e-mail, too.<br />
23. Get up to speed on social networking<br />
– increasingly, leads to job and actual job<br />
postings are there.<br />
24. Don’t post anything on social media<br />
you don’t want mom to read, the New York<br />
Times to publish or your potential employer<br />
to find.<br />
Managing Your E-mail<br />
25. You can do this. You must do this.<br />
Otherwise, your work product and your<br />
life will be a disorganized mess. Having<br />
hundreds or thousands of e-mails in your<br />
inbox does not constitute a system.<br />
26. Get in the habit of emptying your Inbox<br />
(or nearly emptying it) every day. Have an<br />
appropriate, well-categorized folder structure<br />
(and use it).<br />
27. For speed and efficiency in filing, if<br />
you‘re using Outlook, purchase our favorite<br />
utility for e-mail management. SimplyFile<br />
can be downloaded for free for a 30-day trial<br />
here: For $39.95 a year, it’s a steal. With<br />
more than 95% accuracy, it will guess which<br />
folder your e-mail belongs in. And there is a<br />
QuickPick list which almost always contains<br />
the right folder. One caution: it takes a while<br />
to index and “learn” your files — start the<br />
indexing when you’re going to be gone<br />
for a couple of hours as the software hogs<br />
computing power while indexing.<br />
28. Work smart. You don’t need to see or<br />
hear your e-mail when you have something<br />
serious to accomplish. Minimize it and turn<br />
off the sound notification. It will be there<br />
when you return to it. Really.<br />
29. Have two e-mail accounts, one for<br />
business and one for your personal stuff,<br />
a free Hotmail Yahoo, Gmail account etc.<br />
Make sure anything you order on1ine, or<br />
anything you sign for online uses the personal<br />
address — this will mean most of the Spain<br />
will go there, keeping your business Inbox<br />
mostly free of spam.<br />
Utilities<br />
30. FavBackup 2.0.2: lf you’re like us,<br />
then you probably have multiple browsers<br />
installed on your computer. If you’re looking<br />
at upgrading your computer to Windows 7,<br />
this tool provides an easy way to back up and<br />
restore your web browser settings and other<br />
data. FavBackup (www.favbrowser.com/<br />
backup) is a free utility and supports Internet<br />
Explorer 6-8, FireFox 2, 3, 3.5, 3.6 and 3.7;<br />
Opera 9, 10, 10.5, and 10.6; Safari 3 and 4;<br />
and Google Chrome 1-6.

31. What used to be the Maxtor one Touch is<br />
now the Seagate FreeAgent (what marketing<br />
genius thought of that one?). But it is still the<br />
one touch and the easiest way to back up your<br />
computer to an external hard drive. $99.99<br />
on the site, but there’s a helpful comparison<br />
button where (as of this writing) you can get<br />
it for $79.99 at Best Buy and Staples. Lots of<br />
portable products from this manufacturer as<br />

32. YouSendIt. Transmit large file attachments<br />
without charge. The free offering is called<br />
Lite and can transmit an attachment that is<br />
up to 100 MB in size. There are premium<br />
versions as well. Since a lot of ISPs limit<br />
the size of attachments, YonSendIt is a great<br />
alternative to “push” the occasional large<br />
attachment. .<br />
33. How do you manage Twitter? We<br />
use TweetDeck, a free utility that helps<br />
you organize Twitter and those you are<br />
following. You follow specific subjects, see<br />
who retweets your tweets or mentions you,<br />
direct message fo1lowers, etc. TweetDeck<br />
requires the installation of Adobe Air, which<br />
needs full administrative access to your hard<br />
disk. It is available at .<br />
34. Evernote (www.evernote.com) makes<br />
it easy to remember things big and small,<br />
allowing you to capture everything you see<br />
when using your computer, cell phone or<br />
other mobile device. Using the program,<br />
you can clip a web page, snap a photo or<br />
grab a screenshot, and upload it to Evernote.<br />
Once uploaded, everything you capture<br />
is automatically processed, indexed and<br />
made searchable. Evernote can integrate<br />
with your web browser, or you can install<br />
a small application on both Mac OS X and<br />
Windows-based computers, or your iPhone,<br />
iPod Touch, Blackberry, Palm Pre, or<br />

37. The MacBook Air 11". To our friend and<br />

Mac. If its initial debut bugs get worked out,<br />
it’s a keeper.<br />

gathered steam in the last year – it now has<br />
hundreds of free podcasts on all imaginable<br />
legal subjects at your fingertips, including<br />
the authors’ own Digital Detectives podcast.<br />

39. Get Acrobat X for less – Buy Acrobat 7<br />
Standard on eBay for $45-$80. Upgrade on<br />
Adobe’s site to Acrobat X Pro. You could<br />
get the software for $244 instead ofthe retail<br />
price of $449.<br />
Save Money and Time<br />
40. Learn how to spend as little as<br />
possible when you have to spend<br />
– leverage free Internet pricing engines like<br />
Pricegrabber.com, Shopper.com, and Google<br />
Product Search.<br />
41. Free phone service, including longdistance<br />
and international calls to Canada,<br />
Mexico, and several European countries<br />
including free conferencing? You bet, with<br />
Skype.com.<br />
42. If you re all about “free,” check open<br />
source software at .<br />
43. Check out legal product reviews on<br />
– often a good source of deals as well.<br />
44. The ABA’s Legal Technology Resource<br />
Center is the Consumer Reports of legal tech.<br />
They have “no dog in the hunt” and their<br />
annual survey of how lawyers use legal tech<br />
will let you know where you stand. They also<br />
have terrific feature/price comparison charts<br />
for many kinds of legal software.<br />
Time Management<br />
45. Most things that take less than five<br />
minutes should be done right away.<br />
46. Something you DREAD doing? Do it<br />
first. Compel yourself. Your day will be<br />
much nicer when it’s over.<br />
47. Get up and walk around. Do not be<br />
manacled to the keyboard. Do some yoga.<br />
Walk down the hall to ask a colleague a<br />
question rather than e-mailing. Get some<br />
sun. We have too large a population of pastyfaced<br />
technophiles with lousy posture, bad<br />
backs and a body mass index that makes their<br />
doctors cry.<br />
48. Find a way of managing tasks that works<br />
for you and stick to it – and reminders are<br />
critical. You can do tius simply by using<br />
the Tasks feature of Outlook – and setting<br />
reminders. A good trick, as you go through<br />
your reminders each morning is to leave up<br />
the six most important things to get done that<br />
day. It is psychologically gratifying to see<br />
them disappear.<br />
49. Do not let ALL blog posts, news items,<br />
etc. come into your Inbox. They will distract<br />
you. Create a rule in Outlook to file them in<br />
a ‘to be read” file. You can read them after<br />
you’ve finished the tasks you‘ve been putting<br />
off<br />
50. Another way to keep unnecessary mail<br />
out of your e-mail – subscribe to RSS feeds<br />
and send everything to Google Reader – visit<br />
one or twice a day to keep yourself abreast.<br />
And one bonus tip . . .<br />
51. Can’t find a document you know is<br />
on your machine? Use Google Desktop to<br />
search — free and easy.<br />
There you have it. Go forth and be productive,<br />
saving money at the same time.<br />

Desert <strong>Bar</strong> Board meeting. We were<br />
given updates on the status of the<br />
search for more courtroom space in<br />
Victorville.<br />

each other to raise money, donate food and volunteer time at our Inland<br />
Empire food bank. Each bar association will have food bins where members<br />
can donate food. Donations can go directly to the bar association with a<br />
designation of FFTB. People can arrange to volunteer with the food bank and<br />
credit goes to the organization of their choice. The winning bar association<br />

Towards the middle of the year, food banks will run out of food. Statistics<br />
show that 12% of our residents do not know where their next meal is coming<br />
from. Spring and summer breaks mean that children cannot rely on school<br />
meals for their basic sustenance. Donations have decreased with the tight<br />
economy and demand outstrips supply.<br />
Our community needs our help so let’s work together to make this the biggest<br />
