Vol. 39, No. 6 Our 136th Year April 2011
From the
President’s Desk
by
John S. Lowenthal
The recent events in Japan are not only sobering but also serve as
another reminder of how fragile society and order can be when
placed under great duress. At the same time, the tragedy shines a
harsh light of perspective on our local budgetary and political woes.
While I in no way minimize them or their impact on people, I am
also reminded we still have much to be grateful for. To that end,
the focus of this month’s column is on some very positive things
— developments involving our members and courts.
In my first column I talked about challenges facing our association
and chief among them was re-districting; with San Bernardino,
Riverside and Imperial Counties joining San Diego County,
which has more lawyers than the other three combined. In an
effort to ensure the smaller counties have voice at the state level,
former SBCBA President Mike Scafiddi is running for a seat on
the State Bar Board of Governors. Mike has tremendous energy
and enthusiasm for the job; I support and applaud his efforts. He
has been formally endorsed by the San Bernardino County Bar
Association and I expect both Riverside and Imperial will follow
suit. The most important thing you can do to ensure representation
at the state level is VOTE. Our own Bryan Hartnell’s bid was
unsuccessful because the turnout was nothing less than dismal. If
you want local representation on the Board of Governors, cast your
ballot as soon as you get it in the mail. Ballots come out in April
and are not due until June. If you set it aside, figuring you have
plenty of time, chances are you will forget and not think about or
run across it again until it is too late. You can make a difference but
only if you vote.
During a time when most of what you read about lawyers and the
legal system is negative, the opportunity to write about recognizing
lawyers and judges for doing something positive is a treat. The
SBCBA’s Kaufman-Campbell award is given each year to a judge
or judges who have demonstrated the highest standards of judicial
excellence in the pursuit of justice while exemplifying courtesy,
integrity, wisdom and impartiality. I am pleased to announce the
2011 Kaufman-Campbell award will be presented to the Honorable
Manuel A. Ramirez, Presiding Justice of the 4th District Court of
Appeal, Division 2. After seven years as a deputy district attorney,
2 San Bernardino County Bar Association April 2011
From the President’s Desk... (continued from page 1)
Manuel Ramirez was appointed to the
Municipal Court in 1983 by Governor
George Dukmejian. He was elevated to
the Superior Court in 1986 and served
until 1990 when Governor Dukmejian
appointed Justice Ramirez to his current
position. Since that time, he has served
with distinction, exhibiting all of the
qualities embodied by the award and its
namesakes.
Justice Ramirez is a most gracious
and willing ambassador for our justice
system and the importance of the law
and lawyers in civilized society and
how we live our daily lives. I have been
particularly impressed with his DCA
Outreach Program. Each year, Justice
Ramirez selects a high school with a
connection to the 4th District Court of
Appeal, ranging from a justice’s alma
mater to a member of the court staff’s
children go there. On the appointed
day, the justices and their staff travel
to the school and set up court. Court
then convenes and hears oral argument
in two matters. These are not mock
presentations but actual cases argued
by counsel of record and then decided
in the normal course. The justices take
questions from the audience and then
split up and visit classrooms, joined
by volunteer lawyers to talk to smaller
groups about whatever they want to
know about law, lawyers and the courts.
It serves to educate people early on about
the importance of the justice system and
how it impacts their lives every day. I
have been fortunate to participate in the
program and highly recommend it. On
behalf of the SBCBA and its members,
congratulations.
Congratulations are also in order for
SBCBA member Mike Bidart who
was recently named Cal-ABOTA Trial
Lawyer of the Year. The American
Board of Trial Advocates’ mission is
to foster improvement in the ethical
and technical standards of practice in
the field of advocacy to the end that
individual litigants may receive more
effective representation and the general
public be benefited by more efficient
administration of justice consistent with
time-tested and traditional principles
of litigation. It exists to elevate the
standards of integrity, honor and courtesy
in the legal profession and to aid in
further education and training of trial
lawyers; to work for the preservation
of our jury system; to improve methods
of procedure of our present trial court
system. Mike is a long time member
of the San Bernardino/Riverside
Chapter of ABOTA. Please join me in
congratulating Mike; as a fellow member
of the San Bernardino/Riverside Chapter
I can say without fear of contradiction
the recognition is well deserved and
long overdue.
Last month the local chapters of the
American Inns of Court held their joint
dinner at the Mission Inn. Retiring (now
retired) California Supreme Court Justice
Carlos Moreno was the guest speaker.
Justice Moreno spoke about the some of
the cases he was most proud of, many of
them controversial. In addition to giving
the audience behind the scenes insight
in connection with some of the court’s
high profile decisions, his message was
a reminder about how the law shapes
society and the responsibility we all have
because of that. I took Justice Moreno’s
remarks as a challenge to do what we
know is right rather than what may be
popular and to devote the full measure
of our skill, energy and integrity toward
everything we do as lawyers. I took it
to mean leave it all on the field, do what
is in the best interests of your client but
integrity, civility and professionalism
must not be compromised in the name of
zeal for a cause or result. Pretty good
advice.

Fasten your seat belts — we’re off!
Books
50 ways to do More in Less Time
(Often with less money)
By Sharon D. Nelson, Esq. and John W. Simek
1. Books are not antiquated, outmoded
objects. We love our Kindle on a cruise
(carrying tons of books on that small device
is sweet), but settling in with a book at home
in front of the fire is still a great experience
– and a glass of wine doesn’t hurt. No TV, no
computer, no smartphone – this will actually
enhance your learning and therefore your
productivity.
2. Google for Lawyers is a remarkable new
book by 1egal tech experts Mark Rosch and
Carole Leavitt (ABA, 2010). You have no
idea what Google can do for free until you
read this book.
3. Virtual lawyering Is booming and no
wonder. With jobs scarce, smart solos
are leveraging the cost savings of virtual
lawyering to begin their law practices. An
excellent resource is Virtual Law Practice:
How to Deliver Legal Services Online by
Stephanie Kimbro (ABA, 2010).
4. If you’re headed for the mid-large law firm
world and want to he ready, read Michael
Downey’s Introduction to Law Firm Practice
(ABA 2010). You’ll be more knowledgeable
and productive from day one.
5. Social Media for Lawyers: The Next
Frontier by Carolyn Elefant and Nicole
Black (ABA 2010) is a good way to get a
10,000 foot overview of this new frontier. If
you’re trying to get a handle on how to use
social media productively, reading this book
is a good first step.
Smartphones
6. Recognize their potential. Smartphones are
now computers — and very powerful ones at
that. With a flotilla of applications, you can
do many things faster on your Smartphone
and. your location is now irrelevant (except
if you’re using GPS apps).
7. You can also spend vast amounts of time
on time-sucking Smartphone games and app
applications. Resist that urge to increase
productivity.
8. Subscribe to www.lifehacker.com. If
what you receive doesn’t interest you, hit
delete, but this productivity site has carefully
followed tips for Smartphone use — and
many other “work harder, not smarter” tips.
Finding Jobs
9. Yes, they’re scarce. Career Counsel is
the official career resources website for the
American Bar Association. It gives you
access to a variety of legal resources as we1l
as information regarding the law industry,
continuing legal education, and law careers.
Go to www.abanet.org/careercounsel.
20. Don’t be a slave to geography. If times
aren’t good where you are, perhaps you need
to find your fortune elsewhere. Be flexible
and scatter your resume to the winds.
21. Learn to write real English. Those who
do hiring in law firms are irritated by the
inability of many law school graduates to
use the English language correctly — and
they despair of finding those who can write
it persuasively. Take inexpensive online
courses if you know you need to bone up.
22. Perfect your elevator speech, a 15– 30
second rendition of who you are and what
you do. Create a version for e-mail, too.
23. Get up to speed on social networking
– increasingly, leads to job and actual job
postings are there.
24. Don’t post anything on social media
you don’t want mom to read, the New York
Times to publish or your potential employer
to find.
Managing Your E-mail
25. You can do this. You must do this.
Otherwise, your work product and your
life will be a disorganized mess. Having
hundreds or thousands of e-mails in your
inbox does not constitute a system.
26. Get in the habit of emptying your Inbox
(or nearly emptying it) every day. Have an
appropriate, well-categorized folder structure
(and use it).
27. For speed and efficiency in filing, if
you‘re using Outlook, purchase our favorite
utility for e-mail management. SimplyFile
can be downloaded for free for a 30-day trial
here: For $39.95 a year, it’s a steal. With
more than 95% accuracy, it will guess which
folder your e-mail belongs in. And there is a
QuickPick list which almost always contains
the right folder. One caution: it takes a while
to index and “learn” your files — start the
indexing when you’re going to be gone
for a couple of hours as the software hogs
computing power while indexing.
28. Work smart. You don’t need to see or
hear your e-mail when you have something
serious to accomplish. Minimize it and turn
off the sound notification. It will be there
when you return to it. Really.
29. Have two e-mail accounts, one for
business and one for your personal stuff,
a free Hotmail Yahoo, Gmail account etc.
Make sure anything you order on1ine, or
anything you sign for online uses the personal
address — this will mean most of the Spain
will go there, keeping your business Inbox
mostly free of spam.
Utilities
30. FavBackup 2.0.2: lf you’re like us,
then you probably have multiple browsers
installed on your computer. If you’re looking
at upgrading your computer to Windows 7,
this tool provides an easy way to back up and
restore your web browser settings and other
data. FavBackup (www.favbrowser.com/
backup) is a free utility and supports Internet
Explorer 6-8, FireFox 2, 3, 3.5, 3.6 and 3.7;
Opera 9, 10, 10.5, and 10.6; Safari 3 and 4;
and Google Chrome 1-6.

April 2011
31. What used to be the Maxtor one Touch is
now the Seagate FreeAgent (what marketing
genius thought of that one?). But it is still the
one touch and the easiest way to back up your
computer to an external hard drive. $99.99
on the site, but there’s a helpful comparison
button where (as of this writing) you can get
it for $79.99 at Best Buy and Staples. Lots of
portable products from this manufacturer as
well. http://www.seagate.com/www/en-us/
products/external/.
32. YouSendIt. Transmit large file attachments
without charge. The free offering is called
Lite and can transmit an attachment that is
up to 100 MB in size. There are premium
versions as well. Since a lot of ISPs limit
the size of attachments, YonSendIt is a great
alternative to “push” the occasional large
attachment. .
33. How do you manage Twitter? We
use TweetDeck, a free utility that helps
you organize Twitter and those you are
following. You follow specific subjects, see
who retweets your tweets or mentions you,
direct message fo1lowers, etc. TweetDeck
requires the installation of Adobe Air, which
needs full administrative access to your hard
disk. It is available at .
34. Evernote (www.evernote.com) makes
it easy to remember things big and small,
allowing you to capture everything you see
when using your computer, cell phone or
other mobile device. Using the program,
you can clip a web page, snap a photo or
grab a screenshot, and upload it to Evernote.
Once uploaded, everything you capture
is automatically processed, indexed and
made searchable. Evernote can integrate
with your web browser, or you can install
a small application on both Mac OS X and
Windows-based computers, or your iPhone,
iPod Touch, Blackberry, Palm Pre, or
Windows Mobil smartphone. To sign up for a
free account, visit Evernote’s website at .
35. Copy2Contact – This used to be
Anagram (does anything stay the same in
legal tech?). This allows you to capture
contact information from e-mails – it also
allows you to turn the e-mail into a task or a
calendar entry. There’s a free 14 day trial and
it s $39.95 to buy.
36. What do we like for an all-inclusive
security package? Kaspersky is a good choice.
Try Kasperskv Internet Security 2011 at http:
//usa.kaspersky.com/products-services/
home-computer-security/internet-security.
Hot, new and useful
37. The MacBook Air 11". To our friend and
Apple fanboy Brett Burney, this is the perfect
balance of size and power. It’s basically the
Apple netbook. So tiny, so portable, and so
Mac. If its initial debut bugs get worked out,
it’s a keeper.
www.sbcba.org
38. Legal Talk Network — LTN has really
gathered steam in the last year – it now has
hundreds of free podcasts on all imaginable
legal subjects at your fingertips, including
the authors’ own Digital Detectives podcast.
Learn while you drive, exercise, etc.
39. Get Acrobat X for less – Buy Acrobat 7
Standard on eBay for $45-$80. Upgrade on
Adobe’s site to Acrobat X Pro. You could
get the software for $244 instead ofthe retail
price of $449.
Save Money and Time
40. Learn how to spend as little as
possible when you have to spend
– leverage free Internet pricing engines like
Pricegrabber.com, Shopper.com, and Google
Product Search.
41. Free phone service, including longdistance
and international calls to Canada,
Mexico, and several European countries
including free conferencing? You bet, with
Skype.com.
42. If you re all about “free,” check open
source software at .
43. Check out legal product reviews on
– often a good source of deals as well.
44. The ABA’s Legal Technology Resource
Center is the Consumer Reports of legal tech.
They have “no dog in the hunt” and their
annual survey of how lawyers use legal tech
will let you know where you stand. They also
have terrific feature/price comparison charts
for many kinds of legal software.
Time Management
45. Most things that take less than five
minutes should be done right away.
46. Something you DREAD doing? Do it
first. Compel yourself. Your day will be
much nicer when it’s over.
47. Get up and walk around. Do not be
manacled to the keyboard. Do some yoga.
Walk down the hall to ask a colleague a
question rather than e-mailing. Get some
sun. We have too large a population of pastyfaced
technophiles with lousy posture, bad
backs and a body mass index that makes their
doctors cry.
48. Find a way of managing tasks that works
for you and stick to it – and reminders are
critical. You can do tius simply by using
the Tasks feature of Outlook – and setting
reminders. A good trick, as you go through
your reminders each morning is to leave up
the six most important things to get done that
day. It is psychologically gratifying to see
them disappear.
49. Do not let ALL blog posts, news items,
etc. come into your Inbox. They will distract
you. Create a rule in Outlook to file them in
a ‘to be read” file. You can read them after
you’ve finished the tasks you‘ve been putting
off
50. Another way to keep unnecessary mail
out of your e-mail – subscribe to RSS feeds
and send everything to Google Reader – visit
one or twice a day to keep yourself abreast.
And one bonus tip . . .
51. Can’t find a document you know is
on your machine? Use Google Desktop to
search — free and easy.
There you have it. Go forth and be productive,
saving money at the same time.
10 San Bernardino County Bar Association April 2011
April Foolishness
The following quotations are taken from
official court records across the nation,
over the years, showing how even the
slightest unwitting comment is preserved for
posterity in a court of law. (Go ahead, send
me a letter. They’re still funny.)
Lawyer: “Now, Mrs. Johnson, how was
your first marriage terminated?”
Witness: “By death.”
Lawyer: “And by whose death was it
terminated?”
•
Accused, Defending His Own Case: “Did
you get a good look at my face when I
took your purse?” (This defendant was
found guilty and sentenced to ten years in
jail.)
•
Lawyer: “Can you describe what the
person who attacked you looked like?”
Witness: “No. He was wearing a mask.”
Lawyer: “What was he wearing under the
mask?”
Witness: “Er...his face.”
•
Lawyer: “How old is your son, the one
living with you?”
Witness: “Thirty-eight or thirty-five, I
can’t remember which.”
Lawyer: “How long has he lived with
you?”
Witness: “Forty-five years.”
•
Lawyer: “What was the first thing your
husband said to you when he woke that
morning?”
Witness: “He said, ‘Where am I, Cathy?’”
Lawyer: “And why did that upset you?”
Witness: “My name is Susan.”
•
Lawyer: “Now sir, I’m sure you are an
intelligent and honest man--”
Witness: “Thank you. If I weren’t under
oath, I’d return the compliment.”
•
Lawyer: “Do you know how far pregnant
you are now?”
Witness: “I’ll be three months November 6.”
Lawyer: “Apparently, then, the date of
conception was August 6?”
Witness: “Yes.”
Lawyer: “What were you doing at that
time?”
•
Lawyer: “How many times have you
committed suicide?”
Witness: “Four times.”
•
Lawyer: “You say that the stairs went
down to the basement?”
Witness: “Yes.”
Lawyer: “And these stairs, did they go up
also?”
•
Lawyer: “Have you lived in this town all
your life?”
Witness: “Not yet.”
•
Fisher v. Lowe
122 Mich.App. 418, 33 N.W.2d 67
(1983)
Syllabus
A wayward Chevy struck a tree
Whose owner sued defendants three.
He sued car’s owner, driver two,
And insurer for what was due
For his oak tree that now may bear
A lasting need for tender care.
The Oakland County Circuit Court,
John N. O’Brien, J., set forth
The judgment that defendants sought
And quickly an appeal was brought.
Court of Appeals, J.H. Gillis, J.,
Gave thought and then had this to say:
1) There is no liability
Since No-Fault grants immunity;
2) No jurisdiction can be found
Where process service is unsound;
And thus the judgment, as it’s termed,
Is due to be, and is, Affirmed.
Opinion
Before BRONSON, P.J., and V.J.
BRENNAN and J.H. GILLIS, JJ.
J.H. GILLIS, Judge.
We thought that we would never see
A suit to compensate a tree.
A suit whose claim in tort is prest
Upon a mangled tree’s behest;
A tree whose battered trunk was prest
Against a Chevy’s crumpled crest;
A tree that faces each new day
With bark and limb in disarray;
A tree that may forever bear
A lasting need for tender care.
Flora lovers though we three,
We must uphold the court’s decree.
Judgment affirmed.
Lawyer: (realizing he was on the verge of
asking a stupid question) “Your Honor, I’d
like to strike the next question.”
•
Lawyer: “Did you ever stay all night with
this man in New York?”
Witness: “I refuse to answer that question.
Lawyer: “Did you ever stay all night with
this man in Chicago?”
Witness: “I refuse to answer that question.
Lawyer: “Did you ever stay all night with
this man in Miami?”
Witness: “No.”
•
Lawyer: “Doctor, how many autopsies
have you performed on dead people?”
Witness: “All my autopsies have been
performed on dead people.”
•
Lawyer: “What happened then?”
Witness: “He told me, he says, ‘I have to
kill you because you can identify me.’”
Lawyer: “Did he kill you?”
Witness: “No.”
•
The Court: “Now, as we begin, I must ask
you to banish all present information and
prejudice from your minds, if you have
any.”
•
Lawyer: “When he went, had you gone
and had she, if she wanted to and were
able, for the time being excluding all the
restraints on her not to go, gone also,
would he have brought you, meaning you
and she, with him to the station?”
Other Lawyer: “Objection. That question
should be taken out and shot.”
What was that?
Lawyer: “Do you have any children or
anything of that kind?”
Lawyer: “The youngest son, the 20 year
old, how old is he?”
Lawyer: “You don’t know what it was,
and you didn’t know what it looked like,
but can you describe it?”
Lawyer: “You were there until the time
you left, is that true?”
Lawyer: “So you were gone until you
returned?”
Lawyer: “Were you alone or by yourself?”
Lawyer: “How long have you been a
French Canadian?”
• Western Region Bar Association
The local bar associations listed above are engaged in a competition with
each other to raise money, donate food and volunteer time at our Inland
Empire food bank. Each bar association will have food bins where members
can donate food. Donations can go directly to the bar association with a
designation of FFTB. People can arrange to volunteer with the food bank and
credit goes to the organization of their choice. The winning bar association
will get the annual rotating prize.
Food bin location for SBCBA:
Towards the middle of the year, food banks will run out of food. Statistics
show that 12% of our residents do not know where their next meal is coming
from. Spring and summer breaks mean that children cannot rely on school
meals for their basic sustenance. Donations have decreased with the tight
economy and demand outstrips supply.
Our community needs our help so let’s work together to make this the biggest
food drive of the year.
Please call us to find out how to donate money or volunteer your time!
