3 INTRODUCTION NATIONAL HUMAN RIGHTS COMMISSION he National Human Rights Commission was established by the National Human Rights Commission Act, 1995, in line with the United Nations th General Assembly Resolution No. 48/134 of 20 December 1993, which Tenjoins all member states to establish National Human Rights Institutions relative to their environment. The Act empowers the Commission to deal with all human rights issues taking into consideration the provisions of the Constitution of the Federal Republic of Nigeria, African Charter on Human and Peoples' Rights, United Nations Charter, Universal Declaration on Human Rights and all other International Human Rights Instruments, to which Nigeria is a party. The Commission is not a substitute or rival to law courts. Its complaint treatment mechanism is to complement the work of the Courts, whose Constitutional duty it is to enforce fundamental human rights. It targets the poor and vulnerable and other victims of human rights abuse and violations, by offering services, which are free, non-technical, less time consuming and more accessible to the public. The Functions and Powers of the Commission are set out under Section 5 of its enabling Act. Functions and Powers of the National Human Rights Commission The functions of the Commission are set out under section 5 of the enabling Act, and it provides that the Commission shall: a. Deal with all matters relating to the protection of human rights as guaranteed by the Constitution of the Federal Republic of Nigeria, the African Charter, the United Nations Charter and the Universal Declaration on Human Rights and other international treaties on human rights to which Nigeria is a signatory; b. Monitor and investigate all alleged cases of human rights violations in Nigeria and make appropriate recommendations to the Federal Government for prosecution and such other actions as it may deem expedient in each circumstance; c. Assist victims of human rights violations and seek appropriate redress and remedies on their behalf;
