Adrian Guerrero to receive the<br />

2014 “20 under 40” Award<br />

The Jayhawk Area Council<br />

announced the 2014 Honorees for<br />

Topeka’s Top “20 Under 40” award.<br />

The annual “20 Under 40” program<br />

honors community members of<br />

the Topeka/Shawnee County who<br />

demonstrate leadership skills and<br />

community involvement on both a<br />

professional and personal level. The<br />

20 honorees were determined from<br />

a list of more than 200 nominations<br />

submitted, then considered by a<br />

committee of Topeka leaders. Adrian<br />

Guerrero, Director of Operations for<br />

the <strong>Kansas</strong> State of <strong>Nursing</strong> is one of<br />

the 20 honorees.<br />

Adrian began at the Board of<br />

<strong>Nursing</strong> in 2000. He excelled in the<br />

year long Certified Public Manager<br />

Program and was awarded the George<br />

C. Askew National Award.<br />

He has served on numerous local,<br />

state and national committees<br />

including, but not limited to, the<br />

statewide Information Technology Advisory Board, Human Resource Policy<br />

Team, Perceptive Software Influence ImageNow Customer Advisory Council,<br />

and Chair of the National Council of State Board of <strong>Nursing</strong> Nursys IT<br />

Committee. He has been asked numerous times to provide information and<br />

leadership for other departments within the <strong>Kansas</strong> government who need<br />

to establish procedures or adopt new systems. He has also been asked to<br />

present at various state and national conferences.<br />

Adrian’s commitment is not just to his profession, but also to his wife and<br />

family. He has a family comes first philosophy. He has helped his two sons<br />

succeed in Boys Scouts activities, learning to drive, fishing, and support<br />

them in various school activities. Adrian is also an active member of the<br />

Seaman USD 345 Information Technology Advisory Committee and Seaman<br />

Band Boosters.<br />

Coffeyville Regional<br />

Medical Center to Honor<br />

Hall of Fame Recipient<br />

Judy Hiner, RN<br />

Coffeyville Regional Medical<br />

Center announced the 2013<br />

recipient of the CRMC Hall of<br />

Fame. The retired Chief <strong>Nursing</strong><br />

Officer, Judy Hiner, RN, was<br />

inducted into the CRMC Hall of<br />

Fame at a reception on Saturday,<br />

October 18th, 2014.<br />

The Hall of Fame recognizes<br />

a person in the community who<br />

has been or was an instrumental<br />

part of the hospital. Judy<br />

Hiner grew up in Wamego,<br />

KS, graduated from Stormont-<br />

Vail School of <strong>Nursing</strong> in<br />

Topeka, KS, married her highschool<br />

sweetheart, Larry, and<br />

moved to Coffeyville, in 1967,<br />

for her husband to attend<br />

Coffeyville Community College<br />

on a football scholarship. Judy<br />

began employment as a Staff<br />

RN at Coffeyville Memorial<br />

Hospital, Funk Manufacturing<br />

(now John Deere) hired Larry, and they became permanent residents of<br />

Coffeyville. Judy worked in the Coronary Care and later became a House<br />

Supervisor. Before her daughters started school, she worked part time,<br />

but after resuming full-time status, she worked in various roles including<br />

House Supervisor, Patient Care Coordinator, Director of Education, and<br />

Chief <strong>Nursing</strong> Officer. Some of her accomplishments include development<br />

of patient, staff, and community education programs, staff and community<br />

wellness programs, <strong>Kansas</strong> State Board of<br />

<strong>Nursing</strong> approved provider of Continuing<br />

Education Programs for nurses, PRN pool<br />

for nursing staff, pay incentives for advanced<br />

education by nurses, and appointment to the<br />

<strong>Kansas</strong> State Board of <strong>Nursing</strong> which she<br />

continues to serve. Judy has served as President,<br />

Vice-President, Secretary, and Chairperson of<br />

numerous committees in her role as a <strong>Kansas</strong><br />

State Board Member. While serving on the <strong>Kansas</strong><br />

State Board of <strong>Nursing</strong>, she also served on several<br />

committees of the National Council State Boards<br />

of <strong>Nursing</strong>, and was recognized by NCSBN as<br />

the recipient of the 2007 award for excellence in<br />

Leadership. Judy retired from CRMC in 2004, and<br />

began working as the RN Consultant at Assisted<br />

Living at Windsor Place. She is a member of the<br />

<strong>Kansas</strong> Organization of Nurse Leaders. She was<br />

appointed to the CRMC Foundation Board of<br />

Directors in 2004, the CRMC Board of Trustees<br />

in 2008, and Board of Directors in 2011. She is the<br />

current Board Chairman. Judy is also involved<br />

in the community as the Coordinator for the<br />

Red Cross Coffeyville Community Blood Drives,<br />

a member of Chapter EZ, PEO, First United<br />

Methodist Church, and is Treasurer for the First<br />

United Methodist Women.<br />

Committee<br />

The Education Committee met June 17, 2014<br />

and was called to order by Jeanne Walsh, RN,<br />

MSN Chair at 8:35 a.m. in Room 509 of the<br />

Landon State Office Building. The minutes from<br />

March 25, 2014 were approved. The Education<br />

Specialist report was given by Carol Moreland,<br />

MSN, RN.<br />

Barton Community College ADN Program had<br />

a re-approval site visit on February 25 – 27, 2014<br />

It was moved to accept the site visit report with<br />

recommendations and to reapprove the program<br />

for a period consistent with ACEN accreditation<br />

with a progress report due 12/1/2014.<br />

Flint Hills Technical College PN Program<br />

had a re-approval site visit on April 2 – 3, 2014.<br />

It was moved to accept the site visit report<br />

with recommendation and to reapprove the PN<br />

program for five years with a progress report on<br />

recommendations numbers 3 and 4 due by 12/1/14.<br />

Manhattan Area Technical College PN<br />

Program had a site visit on April 16 – 17, 2014.<br />

It was moved to accept the site visit report with<br />

recommendations and to reapprove the PN<br />

program for five years with a progress report on<br />

recommendation number 3 by 12/1/14.<br />

Manhattan Area Technical College ADN<br />

program had a site visit on April 16 – 17. 2014.<br />

It was moved to accept the site visit report with<br />

recommendation and for a period consistent with<br />

national accreditation with a progress report on<br />

recommendation number 3 by 12/1/14.<br />

More Information About the Requirement for<br />

Professional Liability Insurance for Nurse Midwife<br />

The enactment of House Bill 2516 adds nursemidwives<br />

to the list of health care providers<br />

who are required to obtain professional liability<br />

insurance coverage and participate in the<br />

<strong>Kansas</strong> Health Care Stabilization Fund. This<br />

also means nurse-midwives will be eligible for<br />

insurance coverage via the Health Care Provider<br />

Insurance Availability Plan. Compliance with<br />

the Health Care Provider Insurance Availability<br />

Act is a condition of licensure for those health<br />

care providers defined under K.S.A. 40-3401.<br />

Beginning <strong>January</strong> 1, <strong>2015</strong> this will include nursemidwives.<br />

The Legislature made this new nurse-midwives<br />

requirement effective <strong>January</strong> 1, <strong>2015</strong> to allow<br />

a few months for you to make arrangements for<br />

your basic insurance coverage and Health Care<br />

Stabilization Fund participation. There are<br />

numerous guidance documents available at the<br />

HCSF website. You will be particularly interested<br />

in Bulletins 2014-2, 2014-3, and 2014-4. The<br />

website address is www.hcsf.org and to find the<br />

list of bulletins, select “News” above the sunflower<br />

banner. It is recommend that you begin your<br />

research by reading the “General Information<br />

Brochure” listed under Bulletin 2014-2. If you<br />

cannot find the information you need at the HCSF<br />

website, you can call 785-291-3777 and ask for a<br />

member of the Compliance Section staff.<br />

The <strong>Kansas</strong> State Board of <strong>Nursing</strong> has<br />

received several calls from nurse-midwives who<br />

are currently not practicing but still maintain a<br />

current <strong>Kansas</strong> license that will not expire until<br />

after <strong>January</strong> 1, <strong>2015</strong>. At the September 17, 2014<br />

<strong>Kansas</strong> State Board of <strong>Nursing</strong> meeting, the Board<br />

voted to approve an affidavit “For the Intent of<br />

Not Rendering Professional APRN Nurse-Midwife<br />

Services” which the nurse-midwife may sign and<br />

send to the Board of <strong>Nursing</strong>. This affidavit states<br />

that the APRN nurse-midwife affirms that they<br />

will not provide professional services in the State<br />

of <strong>Kansas</strong>. The form must be signed, notarized and<br />

returned to the Board of <strong>Nursing</strong> before <strong>January</strong><br />

1, <strong>2015</strong>. The form can be found at www.ksbn.org<br />

under forms. The Board of <strong>Nursing</strong> will share the<br />

information with the Health Care Stabilization<br />

Fund and you also need to contact the Health Care<br />

Stabilization Fund at 785-291-3777.<br />

June Finance<br />

Committee<br />

The June Finance Committee was called to<br />

order June 18, 2014 at 8:30 a.m. in room 560 of<br />

the Landon State Office Building in Topeka by<br />

Bernard Becker, Chair. The minutes of the March<br />

26, 2014 Finance Committee were approved as<br />

written.<br />

The draft Fee Fund Policy was reviewed. It<br />

was consensus of the Finance Committee to<br />

incorporate this policy into the KSBN Articles and<br />

bring back to the September Finance Committee<br />

for review and then take to full Board for approval.<br />

Mary Blubaugh reported that the agency was<br />

currently $126,000 under budget for FY 14 without<br />

the end of year purchases. In March the Board<br />

approved the agency to spend up to $25,000 for<br />

the upgrade and implementation of licensing<br />

software, the actual cost was $24,000. They also<br />

approved the agency to spend up to $35,000 to<br />

do all necessary work to implement an online<br />

application for all applicants; the actual cost was<br />

$48,580, which was $13,580 over the amount that<br />

was approved. All applications but the LMHT’s are<br />

included. It was consensus of the committee that<br />

approval of the additional $13,580 be taken to the<br />

Board.<br />

A. Guerrero reported that he was notified the<br />

version of ImageNow software the agency uses was<br />

at end of life. The agency will upgrade and migrate<br />

the new version of ImageNow to the new virtual<br />

system so hardware will not need to be purchased.<br />

There are approximately 6.2 million images<br />

currently in the system. Migration is estimated to<br />

cost $4,000 to $8,000 and the agency is expecting<br />

to have it completed before the end of the year.<br />

The agency will use FY14 funds to complete the<br />

migration.<br />

K.A.R 60-4-103 was reviewed to see if fees need<br />

to be raised. M. Blubaugh will research other<br />

state agencies and other state Boards of <strong>Nursing</strong><br />

charges.<br />

The meeting adjourned at 8:51 A.M.<br />

Investigative<br />

Committee<br />

The Investigative Committee met on Monday and<br />

Tuesday June 16 and 17. The Committee reviewed<br />

194 cases. A new format for the newsletter postings<br />

The June CNE Committee was called to order<br />

June 17, 2014 at 9:30 a.m. in room 560 of the Landon<br />

State Office Building in Topeka by Judy Hiner,<br />

Chair. There was no addition to the agenda. The<br />

minutes from the March 25, 2014 meeting were<br />

approved as distributed.<br />

Diane Glynn reported there were thirty two<br />

timeliness, thirty one for missing documentation,<br />

three did not fit the definition of CNE, and two were<br />

Committee<br />

The June ARNP Committee was called to order<br />

June 17, 2014 at 1:30 p.m. in room 509 of the Landon<br />

State Office Building in Topeka by Brenda Moffitt,<br />

Chair. There were two additions to agenda: approval<br />

of Marquette University-Adult-Older Adult Acute<br />

Care NP, Winona State University-Adult-Gero<br />

CNS, and an endorsement application for review.<br />

The minutes from the March 25, 2014 meeting were<br />

approved.<br />

The Committee approved 14 out of state advance<br />

practice programs. An endorsement application was<br />

reviewed and discussed. It was determined that the<br />

applicant did not meet the criteria for licensure.<br />

Carol Moreland asked the Committee for<br />

clarification regarding the 10 year re-approval<br />

review of out of state programs. The Committee<br />

directed information to be brought to the committee<br />

when an applicant who graduated from a program<br />

needing 10 year re-approval seeks licensure.<br />

The meeting was adjourned at 1:50 p.m.<br />

Practice Committee<br />

The Practice Committee met on Tuesday June<br />

17th. The final update of the School Delegation<br />

Table was approved for posting. The second meeting<br />

of the multidisciplinary committee reviewing the<br />

Joint Policy Statement on the Use of Controlled<br />

Substances has been scheduled. Brenda Moffitt<br />

and Diane Glynn will be attending on behalf of<br />

the agency. A review of <strong>Kansas</strong> Administrative<br />

Regulations 60-15-101 and 102 was performed and<br />

no changes were suggested. A task force to work on<br />

updating the IV Therapy Exam Question Pool and<br />

study the need for a live stick in the competency<br />

check off was requested by the committee and then<br />

authorized by the Board. The committee will be<br />

chaired by Rex Patty.<br />

Renewal Schedule<br />

An Advanced Practice Registered Nurse (APRN) in the role of Clinical<br />

Nurse Specialist, Nurse Midwife or Nurse Practitioner licensed in <strong>Kansas</strong><br />

may prescribe drugs following a written protocol as authorized by a<br />

responsible physician. This is a separate requirement from the collaborative<br />

agreement. Each written protocol shall contain a precise and detailed<br />

medical plan of care for each classification of disease or injury for which<br />

the APRN is authorized to prescribe and shall specify all drugs which may<br />

be prescribed by the APRN. Any written prescription order shall include<br />

the name, address, and telephone number of the responsible physician.<br />

The APRN may not dispense drugs, but may request, receive and sign for<br />

professional samples and may distribute professional samples to patients<br />

following a written protocol as authorized by a responsible physician. In order<br />

to prescribe controlled substances, the APRN must:<br />

1) Register with the federal drug enforcement administration; and<br />

2) Notify the board of the name and address of the responsible physician<br />

or physicians. In no case shall the scope of authority of the APRN<br />

exceed the normal and customary practice of the responsible physician.<br />

A Controlled Substance Verification Form (CSVF) is the form used<br />

to notify the Board and must be on file with the <strong>Kansas</strong> State Board of<br />

<strong>Nursing</strong> before the federal drug administration will issue a DEA number<br />

to the APRN. The CSVF must be filed with the Board of <strong>Nursing</strong> initially<br />

before obtaining a DEA number and also when there are any changes in the<br />

responsible physician or drug prescription authorization of the APRN. It is<br />

not necessary to send a copy of the written protocol between the responsible<br />

physician and APRN to the Board of <strong>Nursing</strong>. The CSVF is available on our<br />

website under the “Forms” link. A CSVF is not necessary for an APRN in the<br />

role of Registered Nurse Anesthetist while functioning as a registered nurse<br />

anesthetist as per K.S.A 65-1158.<br />

What is KNAP?<br />

KNAP is a professional assistance program<br />

designed to assist all nurses and mental health<br />

technicians who have a problem or illness that has<br />

or could impair their ability to practice safely.<br />

The Goal of KNAP<br />

Mental and physical illness, including alcohol<br />

and other drug addiction, can potentially impair<br />

practice and health. We estimate that at any<br />

given time, approximately 10% of the population<br />

is affected. This same percentage is thought to be<br />

true of healthcare professionals.<br />

Alcohol and other drug addiction, as well as<br />

mental and physical illnesses, are treatable.<br />

KNAP works with the program participants to<br />

obtain an evaluation, treatment (if indicated), and<br />

monitoring throughout the recovery process.<br />

Referrals<br />

Self-referrals to the program are encouraged,<br />

but referrals may be made by a family member,<br />

a friend, employer or anyone concerned about the<br />

nurse/LMHT.<br />

Anonymous referrals are not accepted. A person<br />

may call for information or advice without giving<br />

their name, however. Referrals may be made by<br />

calling 913-236-7575.<br />

KNAP Providers<br />

• Confidential services to <strong>Kansas</strong> RNs,<br />

LPNs, and LMHTs experiencing problems<br />

and illnesses which could lead to impaired<br />

practice.<br />

• Interventions, assessments, referrals for<br />

evaluation and treatment (if indicated.)<br />

• On-going monitoring through random urine<br />

drug screens, contact with employers and<br />

monthly groups.<br />

Causes for Concern<br />

• Narcotics discrepancies, e.g.: incorrect<br />

counts, alteration of narcotic containers,<br />

increased patient reports of ineffective pain<br />

control, discrepancies on records or frequent<br />

corrections of records, unusual amounts<br />

of narcotics wasted, significant variations<br />

in the quantity of narcotics ordered for<br />

technician's unit or shift.<br />

• Fluctuations in the quality of work<br />

performance.<br />

• Irresponsible behavior from someone<br />

previously conscientious and responsible.<br />

• Requests to work shifts that are the least<br />

supervised.<br />

• Inordinate interest in patients' pain control<br />

medications.<br />

Behavior<br />

• Increasing isolation from colleagues, friends<br />

and family and avoiding social activities.<br />

• Complaints from others about work<br />

performance or alcohol or drug use.<br />

• Mood swings, irritability or depression, or<br />

suicide threats or attempts, perhaps caused<br />

by accidental overdose.<br />

Physical Symptoms<br />

• Obvious intoxication such as swaying,<br />

staggering or slurred speech.<br />

• Odor of alcohol on breath or the excessive<br />

use of breath-fresheners or perfume to<br />

disguise the odor of alcohol.<br />

KNAP is supported by funds from the Board of<br />

<strong>Nursing</strong> and, in small part, by fees charged to the<br />
