Adrian Guerrero to receive the 

2014 “20 under 40” Award 

The Jayhawk Area Council 

announced the 2014 Honorees for 

Topeka’s Top “20 Under 40” award. 

The annual “20 Under 40” program 

honors community members of 

the Topeka/Shawnee County who 

demonstrate leadership skills and 

community involvement on both a 

professional and personal level. The 

20 honorees were determined from 

a list of more than 200 nominations 

submitted, then considered by a 

committee of Topeka leaders. Adrian 

Guerrero, Director of Operations for 

the Kansas State of Nursing is one of 

the 20 honorees. 

Adrian began at the Board of 

Nursing in 2000. He excelled in the 

year long Certified Public Manager 

Program and was awarded the George 

C. Askew National Award. 

He has served on numerous local, 

state and national committees 

including, but not limited to, the 

statewide Information Technology Advisory Board, Human Resource Policy 

Team, Perceptive Software Influence ImageNow Customer Advisory Council, 

and Chair of the National Council of State Board of Nursing Nursys IT 

Committee. He has been asked numerous times to provide information and 

leadership for other departments within the Kansas government who need 

to establish procedures or adopt new systems. He has also been asked to 

present at various state and national conferences. 

Adrian’s commitment is not just to his profession, but also to his wife and 

family. He has a family comes first philosophy. He has helped his two sons 

succeed in Boys Scouts activities, learning to drive, fishing, and support 

them in various school activities. Adrian is also an active member of the 

Seaman USD 345 Information Technology Advisory Committee and Seaman 

Band Boosters.

Medical Center to Honor 

Hall of Fame Recipient 

Judy Hiner, RN 

Coffeyville Regional Medical 

Center announced the 2013 

recipient of the CRMC Hall of 

Fame. The retired Chief Nursing 

Officer, Judy Hiner, RN, was 

inducted into the CRMC Hall of 

Fame at a reception on Saturday, 

October 18th, 2014. 

The Hall of Fame recognizes 

a person in the community who 

has been or was an instrumental 

part of the hospital. Judy 

Hiner grew up in Wamego, 

KS, graduated from Stormont- 

Vail School of Nursing in 

Topeka, KS, married her highschool 

sweetheart, Larry, and 

moved to Coffeyville, in 1967, 

for her husband to attend 

Coffeyville Community College 

on a football scholarship. Judy 

began employment as a Staff 

RN at Coffeyville Memorial 

Hospital, Funk Manufacturing 

(now John Deere) hired Larry, and they became permanent residents of 

Coffeyville. Judy worked in the Coronary Care and later became a House 

Supervisor. Before her daughters started school, she worked part time, 

but after resuming full-time status, she worked in various roles including 

House Supervisor, Patient Care Coordinator, Director of Education, and 

Chief Nursing Officer. Some of her accomplishments include development 

of patient, staff, and community education programs, staff and community

Education Programs for nurses, PRN pool 

for nursing staff, pay incentives for advanced 

education by nurses, and appointment to the 

Kansas State Board of Nursing which she 

continues to serve. Judy has served as President, 

Vice-President, Secretary, and Chairperson of 

numerous committees in her role as a Kansas 

State Board Member. While serving on the Kansas 

State Board of Nursing, she also served on several 

committees of the National Council State Boards 

of Nursing, and was recognized by NCSBN as 

the recipient of the 2007 award for excellence in 

Leadership. Judy retired from CRMC in 2004, and 

began working as the RN Consultant at Assisted 

Living at Windsor Place. She is a member of the 

Kansas Organization of Nurse Leaders. She was 

appointed to the CRMC Foundation Board of 

Directors in 2004, the CRMC Board of Trustees 

in 2008, and Board of Directors in 2011. She is the 

current Board Chairman. Judy is also involved 

in the community as the Coordinator for the 

Red Cross Coffeyville Community Blood Drives, 

a member of Chapter EZ, PEO, First United 

Methodist Church, and is Treasurer for the First 

United Methodist Women.

Committee 

The Education Committee met June 17, 2014 

and was called to order by Jeanne Walsh, RN, 

MSN Chair at 8:35 a.m. in Room 509 of the 

Landon State Office Building. The minutes from 

March 25, 2014 were approved. The Education 

Specialist report was given by Carol Moreland, 

MSN, RN. 

Barton Community College ADN Program had 

a re-approval site visit on February 25 – 27, 2014 

It was moved to accept the site visit report with 

recommendations and to reapprove the program 

for a period consistent with ACEN accreditation 

with a progress report due 12/1/2014. 

Flint Hills Technical College PN Program 

had a re-approval site visit on April 2 – 3, 2014. 

It was moved to accept the site visit report 

with recommendation and to reapprove the PN 

program for five years with a progress report on 

recommendations numbers 3 and 4 due by 12/1/14. 

Manhattan Area Technical College PN 

Program had a site visit on April 16 – 17, 2014.

More Information About the Requirement for 

Professional Liability Insurance for Nurse Midwife 

The enactment of House Bill 2516 adds nursemidwives 

to the list of health care providers 

who are required to obtain professional liability 

insurance coverage and participate in the 

Kansas Health Care Stabilization Fund. This 

also means nurse-midwives will be eligible for 

insurance coverage via the Health Care Provider 

Insurance Availability Plan. Compliance with 

the Health Care Provider Insurance Availability 

Act is a condition of licensure for those health 

care providers defined under K.S.A. 40-3401. 

Beginning January 1, 2015 this will include nursemidwives. 

The Legislature made this new nurse-midwives 

requirement effective January 1, 2015 to allow 

a few months for you to make arrangements for 

your basic insurance coverage and Health Care 

Stabilization Fund participation. There are 

numerous guidance documents available at the 

HCSF website. You will be particularly interested 

in Bulletins 2014-2, 2014-3, and 2014-4. The 

website address is www.hcsf.org and to find the 

list of bulletins, select “News” above the sunflower 

banner. It is recommend that you begin your 

research by reading the “General Information 

Brochure” listed under Bulletin 2014-2. If you 

cannot find the information you need at the HCSF 

website, you can call 785-291-3777 and ask for a 

member of the Compliance Section staff. 

The Kansas State Board of Nursing has 

received several calls from nurse-midwives who 

are currently not practicing but still maintain a 

current Kansas license that will not expire until 

after January 1, 2015. At the September 17, 2014 

Kansas State Board of Nursing meeting, the Board 

voted to approve an affidavit “For the Intent of 

Not Rendering Professional APRN Nurse-Midwife 

Services” which the nurse-midwife may sign and 

send to the Board of Nursing. This affidavit states 

that the APRN nurse-midwife affirms that they 

will not provide professional services in the State 

of Kansas. The form must be signed, notarized and 

returned to the Board of Nursing before January 

1, 2015. The form can be found at www.ksbn.org 

under forms. The Board of Nursing will share the 

information with the Health Care Stabilization 

Fund and you also need to contact the Health Care 

Stabilization Fund at 785-291-3777.

June Finance 

Committee 

The June Finance Committee was called to 

order June 18, 2014 at 8:30 a.m. in room 560 of 

the Landon State Office Building in Topeka by 

Bernard Becker, Chair. The minutes of the March 

26, 2014 Finance Committee were approved as 

written. 

The draft Fee Fund Policy was reviewed. It 

was consensus of the Finance Committee to 

incorporate this policy into the KSBN Articles and 

bring back to the September Finance Committee 

for review and then take to full Board for approval. 

Mary Blubaugh reported that the agency was 

currently $126,000 under budget for FY 14 without 

the end of year purchases. In March the Board 

approved the agency to spend up to $25,000 for 

the upgrade and implementation of licensing 

software, the actual cost was $24,000. They also 

approved the agency to spend up to $35,000 to 

do all necessary work to implement an online 

application for all applicants; the actual cost was 

$48,580, which was $13,580 over the amount that 

was approved. All applications but the LMHT’s are 

included. It was consensus of the committee that 

approval of the additional $13,580 be taken to the 

Board. 

A. Guerrero reported that he was notified the 

version of ImageNow software the agency uses was 

at end of life. The agency will upgrade and migrate 

the new version of ImageNow to the new virtual 

system so hardware will not need to be purchased. 

There are approximately 6.2 million images 

currently in the system. Migration is estimated to 

cost $4,000 to $8,000 and the agency is expecting 

to have it completed before the end of the year. 

The agency will use FY14 funds to complete the 

migration. 

K.A.R 60-4-103 was reviewed to see if fees need 

to be raised. M. Blubaugh will research other 

state agencies and other state Boards of Nursing 

charges. 

The meeting adjourned at 8:51 A.M. 

Investigative 

Committee 

The Investigative Committee met on Monday and 

Tuesday June 16 and 17. The Committee reviewed 

194 cases. A new format for the newsletter postings 

was approved and will be implemented with the 

next newsletter. The review of the LMHT Act will 

be carried to the September meeting. Three statutes 

were reviewed as part of the 5 year legislative review 

process. Information was presented on the NCSBN 

Competency Study was passed until the September 

meeting so that pending information from NCSBN 

can be included. The new AG opinion on the BEMS 

committee process for case review was noted and 

further discussion was had at the Board meeting.

June CNE 

Committee 

The June CNE Committee was called to order 

June 17, 2014 at 9:30 a.m. in room 560 of the Landon 

State Office Building in Topeka by Judy Hiner, 

Chair. There was no addition to the agenda. The 

minutes from the March 25, 2014 meeting were 

approved as distributed. 

Diane Glynn reported there were thirty two 

IOA’s denied since last meeting. Six were denied for 

timeliness, thirty one for missing documentation, 

three did not fit the definition of CNE, and two were 

repeat subjects from basic nursing programs.

June ARNP 

Committee 

The June ARNP Committee was called to order 

June 17, 2014 at 1:30 p.m. in room 509 of the Landon 

State Office Building in Topeka by Brenda Moffitt, 

Chair. There were two additions to agenda: approval 

of Marquette University-Adult-Older Adult Acute 

Care NP, Winona State University-Adult-Gero 

CNS, and an endorsement application for review. 

The minutes from the March 25, 2014 meeting were 

approved. 

The Committee approved 14 out of state advance 

practice programs. An endorsement application was 

reviewed and discussed. It was determined that the 

applicant did not meet the criteria for licensure. 

Carol Moreland asked the Committee for 

clarification regarding the 10 year re-approval 

review of out of state programs. The Committee 

directed information to be brought to the committee 

when an applicant who graduated from a program 

needing 10 year re-approval seeks licensure. 

The meeting was adjourned at 1:50 p.m. 

Practice Committee 

The Practice Committee met on Tuesday June 

17th. The final update of the School Delegation 

Table was approved for posting. The second meeting 

of the multidisciplinary committee reviewing the 

Joint Policy Statement on the Use of Controlled 

Substances has been scheduled. Brenda Moffitt 

and Diane Glynn will be attending on behalf of 

the agency. A review of Kansas Administrative 

Regulations 60-15-101 and 102 was performed and 

no changes were suggested. A task force to work on 

updating the IV Therapy Exam Question Pool and 

study the need for a live stick in the competency 

check off was requested by the committee and then 

authorized by the Board. The committee will be 

chaired by Rex Patty.

Renewal Schedule 

An Advanced Practice Registered Nurse (APRN) in the role of Clinical 

Nurse Specialist, Nurse Midwife or Nurse Practitioner licensed in Kansas 

may prescribe drugs following a written protocol as authorized by a 

responsible physician. This is a separate requirement from the collaborative 

agreement. Each written protocol shall contain a precise and detailed 

medical plan of care for each classification of disease or injury for which 

the APRN is authorized to prescribe and shall specify all drugs which may 

be prescribed by the APRN. Any written prescription order shall include 

the name, address, and telephone number of the responsible physician. 

The APRN may not dispense drugs, but may request, receive and sign for 

professional samples and may distribute professional samples to patients 

following a written protocol as authorized by a responsible physician. In order 

to prescribe controlled substances, the APRN must: 

1) Register with the federal drug enforcement administration; and 

2) Notify the board of the name and address of the responsible physician 

or physicians. In no case shall the scope of authority of the APRN 

exceed the normal and customary practice of the responsible physician. 

A Controlled Substance Verification Form (CSVF) is the form used 

to notify the Board and must be on file with the Kansas State Board of 

Nursing before the federal drug administration will issue a DEA number 

to the APRN. The CSVF must be filed with the Board of Nursing initially 

before obtaining a DEA number and also when there are any changes in the 

responsible physician or drug prescription authorization of the APRN. It is 

not necessary to send a copy of the written protocol between the responsible 

physician and APRN to the Board of Nursing. The CSVF is available on our 

website under the “Forms” link. A CSVF is not necessary for an APRN in the 

role of Registered Nurse Anesthetist while functioning as a registered nurse 

anesthetist as per K.S.A 65-1158.

What is KNAP? 

KNAP is a professional assistance program 

designed to assist all nurses and mental health 

technicians who have a problem or illness that has 

or could impair their ability to practice safely. 

The Goal of KNAP 

Mental and physical illness, including alcohol 

and other drug addiction, can potentially impair 

practice and health. We estimate that at any 

given time, approximately 10% of the population 

is affected. This same percentage is thought to be 

true of healthcare professionals. 

Alcohol and other drug addiction, as well as 

mental and physical illnesses, are treatable. 

KNAP works with the program participants to 

obtain an evaluation, treatment (if indicated), and 

monitoring throughout the recovery process. 

Referrals 

Self-referrals to the program are encouraged, 

but referrals may be made by a family member, 

a friend, employer or anyone concerned about the 

nurse/LMHT. 

Anonymous referrals are not accepted. A person 

may call for information or advice without giving 

their name, however. Referrals may be made by 

calling 913-236-7575. 

KNAP Providers

• Increasing isolation from colleagues, friends 

and family and avoiding social activities. 

• Complaints from others about work 

performance or alcohol or drug use. 

• Mood swings, irritability or depression, or 

suicide threats or attempts, perhaps caused 

by accidental overdose. 

Physical Symptoms 

• Obvious intoxication such as swaying, 

staggering or slurred speech. 

• Odor of alcohol on breath or the excessive 

use of breath-fresheners or perfume to 

disguise the odor of alcohol.
