When an applicati<strong>on</strong> for landlord registrati<strong>on</strong> is approved by a local authority it is valid for three<br />

years. If a landlord is still letting then they should apply to renew their registrati<strong>on</strong> prior to the expiry<br />

date being reached.<br />

The renewals process has now started for some local authorities. Fife Council’s first applicati<strong>on</strong> is due<br />

for renewal in September 2010. There will be <strong>on</strong>-going informati<strong>on</strong> provided and discussi<strong>on</strong>s with<br />

landlords/agents prior to this date, to keep every<strong>on</strong>e fully informed.<br />

The legislati<strong>on</strong> governing landlord registrati<strong>on</strong> is the Antisocial Behaviour etc (Scotland) Act 2004 (part<br />

8). This requires all landlords to be registered with their local authority. Secti<strong>on</strong> 84(6) specifies that<br />

registrati<strong>on</strong> will expire after three years, beginning with the day <strong>on</strong> which the entry is made (the date<br />

of approval). Landlords who are still letting when their registrati<strong>on</strong> expires are legally required to make<br />

an applicati<strong>on</strong> for renewal.<br />

When should I renew my registrati<strong>on</strong>?<br />

The Landlord Registrati<strong>on</strong> Team will notify landlord/agents 3 m<strong>on</strong>ths prior to the expiry of the<br />

applicati<strong>on</strong> to allow a reas<strong>on</strong>able period of time to submit a renewal applicati<strong>on</strong>. A further reminder<br />

will be issued after the expiry date. The sec<strong>on</strong>d reminder will warn that if an applicati<strong>on</strong> is not make<br />

within 14 days, the late applicati<strong>on</strong> fee of £110 may be added to the registrati<strong>on</strong> fee.<br />

How much does it cost?<br />

Landlords who are renewing are required to pay a £55.00 registrati<strong>on</strong> fee and £11.00 for each let<br />

property which is listed <strong>on</strong> their registrati<strong>on</strong> at the time of renewal. Payment must be made at the<br />

time of applicati<strong>on</strong>. There are a number of discounts and you may be entitled to if you fall into any<br />

of the following categories – HMO landlord, Joint Owner, Charitable Organisati<strong>on</strong>, Landlord with<br />

registrati<strong>on</strong>s in more than <strong>on</strong>e local authority.<br />

How do I renew my registrati<strong>on</strong>?<br />

Landlords can apply to renew their registrati<strong>on</strong> <strong>on</strong>line at www.landlordregistrati<strong>on</strong>scotland.gov.<br />

uk up to 3 m<strong>on</strong>ths before their current registrati<strong>on</strong> expires. A paper renewal applicati<strong>on</strong> can also<br />

be obtained by c<strong>on</strong>tacting a member of the landlord registrati<strong>on</strong> team <strong>on</strong> 01592 583397 or email<br />

renewals.registrati<strong>on</strong>@fife.gov.uk. See “Getting Started” <strong>on</strong> page 5 for help with renewing <strong>on</strong>line.<br />

Landlords who renew <strong>on</strong>line do not need to re-enter all their registrati<strong>on</strong> details. You are required to<br />

check all the details currently held about you and <strong>your</strong> let properties and if necessary, correct and<br />

amend <strong>your</strong> registrati<strong>on</strong> property portfolio.<br />

Why am I being asked to renew if I have never registered before?<br />

If you held an HMO Licence <strong>on</strong> or after 30th April 2006, or have had a licence granted since that<br />

date, you may not have d<strong>on</strong>e anything to apply for landlord registrati<strong>on</strong>. This is because both you<br />

and <strong>your</strong> HMO properties could have been entered <strong>on</strong>to the register by us <strong>on</strong> <strong>your</strong> behalf. This<br />

process is called HMO ‘passporting’. This would also happen if you were an agent of HMO property.<br />

It is however <strong>your</strong> resp<strong>on</strong>sibility to keep both <strong>your</strong> HMO and Landlord Registrati<strong>on</strong> records up to date<br />

and ensure that <strong>your</strong> landlord registrati<strong>on</strong> is renewed when it falls due. As before, HMO licensed<br />

properties will have no fee to pay but you must check <strong>your</strong> entry <strong>on</strong> the register and make<br />

any adjustments.<br />

In a number of cases joint owners of let properties were not approved at the same time. Additi<strong>on</strong>ally,<br />

in some cases we were not notified that there was a joint owner until some time after the lead owner<br />

had applied. In these cases the renewal date may be different, however the majority of lead and<br />

joint owners in Fife will have the same renewal date. Both lead and joint owners must renew their<br />

registrati<strong>on</strong> prior to their own expiry date.<br />

What if I d<strong>on</strong>’t renew my registrati<strong>on</strong>?<br />

If a registrati<strong>on</strong> expires and is not renewed then the landlord will be c<strong>on</strong>sidered to be no l<strong>on</strong>ger<br />

registered. If the landlord c<strong>on</strong>tinues to let they will be doing so illegally. It is a criminal offence for<br />

a landlord to let property without being registered or not having submitted a valid applicati<strong>on</strong> for<br />

registrati<strong>on</strong> or renewal.<br />

What if I am no l<strong>on</strong>ger a landlord/agent acting <strong>on</strong> behalf of a landlord?<br />

If you are no l<strong>on</strong>ger letting property or no l<strong>on</strong>ger act as an agent then you can delete <strong>your</strong> own<br />

registrati<strong>on</strong> <strong>on</strong>line. To do this you should access <strong>your</strong> current registrati<strong>on</strong>, delete the properties which<br />

are no l<strong>on</strong>ger let and then delete <strong>your</strong> registrati<strong>on</strong> if required. Landlords who remove properties that<br />

they no l<strong>on</strong>ger own from their registrati<strong>on</strong> will allow prospective new landlords the ability to register<br />

properties without any delay. If there was a joint owner in respect of any of the let properties and they<br />

are also no l<strong>on</strong>ger a landlord, please ask them to delete their registrati<strong>on</strong>s or to c<strong>on</strong>tact us c<strong>on</strong>firming<br />

this in writing so that we can arrange for their entries to be updated or deleted as appropriate.<br />

You can inform us by email or letter that you are no l<strong>on</strong>ger a landlord or agent so that <strong>your</strong> details can<br />

be removed from the register of landlords. This will ensure that we do not take enforcement acti<strong>on</strong><br />

against you. We cannot assume that you are no l<strong>on</strong>ger a landlord or agent because we have not<br />

heard from you.<br />

Getting Started<br />

Go to www.landlordregistrati<strong>on</strong>scotland.gov.uk and log into <strong>your</strong> registrati<strong>on</strong><br />

If <strong>your</strong> registrati<strong>on</strong> is due for renewal you will see the note ‘C<strong>on</strong>firm <strong>your</strong> details before renewing’<br />

should be displayed in red <strong>on</strong> <strong>your</strong> registrati<strong>on</strong>.<br />

You are legally required to register each let property as so<strong>on</strong> as it is advertised for let. You may add<br />

this property now. You will be charged a fee for the registrati<strong>on</strong> of this property. You must then<br />

resubmit <strong>your</strong> applicati<strong>on</strong> and pay to renew <strong>your</strong> registrati<strong>on</strong>.<br />

You will find in this guidance a detailed selecti<strong>on</strong> of key screen pages with instructi<strong>on</strong>s to assist you<br />

with renewing <strong>your</strong> landlord registrati<strong>on</strong> applicati<strong>on</strong>. We trust that this will be a practical guide for<br />

landlords who are renewing for the first time.<br />
