Policy Considerations and Reasons In reaching this decision the policies in the Development Plan for the area, which currently comprises the Bournemouth, Dorset and Poole Structure Plan 2000 and the East Dorset Local Plan, were taken into account. This includes specifically the following policies: OBLIG1 NCON1 NCON4 DES8 DES12 Item Number: 7. Ref: 3/07/0730/FUL Proposal: Site Address: Constraints Detached Garage Enfield, Higher Merley Lane, Corfe Mullen, for Alan Russel And Linda Dennis Airport Safeguarding (45m high) Airport Safeguarding (Birdstrike) Groundwater Protection Zone Open Space/Recreational Area LP Urban Areas LP Windfarm Consultation Zone Site Notice expired: 13 July 2007 Advert expired: Nbr-Nfn expired: 9 July 2007 Corfe Mullen Parish Council Comments: Objection: Due to its proximity to the road it is considered that a garage located here would be too prominent in the street scene. The proposal is therefore contrary to policy DES8 of the local plan. Consultee Responses: County Highways Development Liaison Officer No Objection, subject to the same conditions as 07/0302 Neighbour Comments: Officers Report: This application comes to committee as the Officer recommendation is contrary to the comments of the Parish Council. The proposal is for a detached double garage measuring 7.2 metres wide, 6.4 metres deep and 4.2 metres high. It will be set back 3.5 metres from the front boundary of the site with Higher Merley Lane. The application follows a refusal for a much larger garage (9.34 metres wide, 6.74 metres deep and 4.8 metres tall) that was to be 1.5 metres closer to the road than the current proposal. The character of development in the immediate area is formed by dwellings set back from the road, with some having detached double garages sited in front of the dwellings, but set back from the road. 20

The immediate neighbouring property at Rosebank has been granted planning permission (in 2006) for a detached garage of the same size as that now applied for, but set back slightly further from the road (5.5m). There is also a detached garage in the front garden of ‘High Ridge’ immediately to the west of Rosebank. This was permitted in 2003 and is set back from the road by 7 metres. There is a tall coniferous hedge that provides screening to this garage and it is not immediately apparent when viewed from Higher Merley Lane. It is intended to have an area of landscaping surrounding the rear and sides of the proposed garage to reduce its visual impact in the street scene, and the 3.5 metre set back is considered adequate to permit meaningful landscaping. In this respect it is considered that the proposed garage will sit comfortably in the street scene and respect the character of development in the immediate area, and approval is recommended. Recommendation: GRANT – SUBJECT TO THE FOLLOWING CONDITION(S):- Conditions/Reasons:- 1 The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: This condition is required to be imposed by Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. 2 Before the development is commenced, proposals for the landscaping of the garage, to include provision for the retention and protection of existing trees and shrubs, if any, thereon, shall be submitted to and approved by the District Planning Authority by means of a large scale plan and a written brief. All proposed and existing trees and shrubs shall be correctly described and their positions accurately shown. Upon approval such new planting shall be carried out during the planting season October/March inclusive, in accordance with the appropriate British Standards for ground preparation, staking, etc., in BS4428:1989 (1979), immediately following commencement of the development. The landscaping shall thereafter be maintained for five years during which time any specimens which are damaged, dead or dying shall be replaced and hence the whole scheme shall thereafter be retained. Reason: Pursuant to Section 197 of the Town and Country Planning Act 1990 and to protect and enhance the appearance and character of the site and the locality. 3 The development hereby permitted shall not be brought into use until the access, turning space, garaging and parking shown on the approved plan has been constructed and these shall be maintained and be kept available for that purpose at all times. Reason: In the interests of highway safety. 4 The materials and finishes to be employed on the external faces of the development, hereby permitted, shall match those of the existing dwelling unless otherwise first agreed in writing by the Local Planning Authority. 21
