Crumrine News Editor On Wednesday, Nov. 4, Gov. Arnold Schwarzenegger appointed State Sen. John J. Benoit (R-37th District) to fill the remaining term of former Riverside County 4th District Supervisor Roy Wilson. Benoit will resign from the California Senate on Nov. 30 and be sworn in as supervisor Tuesday, Dec. 1. Originally, Benoit tendered his resignation effective Sunday, Nov. 8, and planned to be sworn into office as supervisor Monday morning, Nov. 9. The governor sets the dates of the special elections to fill state elective posts. If Benoit resigned this week, the party primaries would have been in January 2010 and the General Election to choose his successor would have been scheduled for March. By waiting the three weeks, the election to replace Benoit can be consolidated with the statewide primary on June 8, 2010. This will avoid the county holding a special election just to fill the 37th District seat. “After consulting with members of the board, Senate leadership, the See Benoit, page 23 By Marshall Smith Staff Reporter IFPD hears auditor, Ka-ching $ By J.P. Crumrine News Editor Mary Lou Prosin, treasurer of the Animal Rescue Friends of Idyllwild (ARF) received a “Statement of Information” form from a reputed agency of the state government, the Business Filings Division (BFD). The form looked official — seal, corporation number, control number, and citation of applicable state code — but it raised alarms for Prosin. The first warning bell was the fee. “We’ve never had to pay a filing fee this large,” she said. The other was the date of receipt. “We received it about 10 days after the due date,” she remembered. Failure to file the Statement of Information by the due At the Wednesday, Nov. 4, Idyllwild Fire Protection District (IFPD) meeting, the auditor explained discrepancies in the agency’s audits but didn’t explain why the audits have been delayed since 2004. Except for the 2008 and 2009 audits, the remaining four are ready for the commission’s approval. All of the previous questions regarding the ending balances from one year not matching the beginning balances of the next year have been corrected. Changes to ensure the most glaring inconsistencies were eliminated. But David Marion, partner in IFPD’s auditing firm Smith Marion & Co. admitted that some discrepancies remained. For example, the “Net Assets ending” in the June 2004 report is $1,933,375. Yet, in the June 2005 report “Net Assets Beginning” is $1,806,504. Similarly, the beginning and ending See IFPD, page 18 Effort to scam local businesses date would result in a charge of $235. The back of the form was replete with legal boilerplate language including California Corporations Code and Revenue and Taxation code. It also contained a warning that if failure to file resulted in the corporation’s suspension, the business would: lose its right to conduct business; lose the right to retain the entity name; have no right to answer a lawsuit; and while suspended, any other entity could file articles of incorporation using the suspended corporation’s name. The form requested additional information about the business entity, including corporate phone number and e-mail address and the name See Scam, page 4
