agreement, the descriptions in the local agreement shall control.<br />

118 SECTION 2 – JURISDICTION<br />

119 The Employer and the Union agree that no jurisdiction over any group of<br />

Employees shall be surrendered to any other union during the life of this<br />

<strong>Agreement</strong> except by mutual <strong>Agreement</strong> of the parties hereto.<br />

120 SECTION 3 – NOTIFICATION OF NEW EMPLOYEES<br />

121 No later than the tenth (10th) of the following month the Employer shall supply<br />

the Union with the names, addresses and classifications of work of new<br />

Employees and the names of Employees terminated.<br />

122 A. NORTHERN CALIFORNIA REGION Written Notice.<br />

At the time a new Employee is hired who will be subject to this <strong>Agreement</strong>,<br />

the Employer shall deliver to the Employee a written notice stating that the<br />

Employer recognizes the Union as the collective bargaining agent for the<br />

Employees covered by the <strong>Agreement</strong> and quoting or paraphrasing the<br />

provisions of “Article V – Union Membership” of this <strong>Agreement</strong>.<br />

123 SECTION 4 – BONA FIDE SUPERVISORY EMPLOYEES<br />

124 A. Authority of Bona Fide Supervisors.<br />

The Employer recognizes the fact that only bona fide supervisory<br />

Employees have the authority to hire, promote, discipline, discharge, or<br />

otherwise effect changes in the status of Employees or effectively<br />

recommend such actions, and it is not the Employer’s policy to establish<br />

jobs or job titles for the purpose of excluding such Employees from the<br />

unit(s). Bona fide supervisors will not perform duties performed by<br />

Employees falling within the scope of this <strong>Agreement</strong> except for training,<br />

emergencies requiring immediate action, or under circumstances that are<br />

beyond the control of the Employer.<br />

125 B. Bona Fide Supervisors Performing Bargaining Unit Work.<br />

It is not the Employer’s intent to hire or utilize bona fide supervisors to<br />

perform bargaining unit work; however, in an emergency and/or a situation<br />

where the delivery of health care services could be compromised it may<br />

be necessary for a supervisor to assist until an appropriate bargaining unit<br />

Employee is available.<br />
