This record series consists <strong>of</strong> applications <strong>for</strong> an order authorizing the interception <strong>of</strong> a wire or oral communications and orders<br />

granted pursuant to Chapter 934, Florida Statutes. Also included are original recordings <strong>of</strong> the contents <strong>of</strong> any wire or oral<br />

communication made pursuant to Section 934.09, Florida Statutes. They shall not be destroyed except upon an order <strong>of</strong> the<br />

issuing or denying judge, or that judge’s successor in <strong>of</strong>fice, and in any event shall be kept <strong>for</strong> ten (10) years.<br />

This record series consists <strong>of</strong> documentation <strong>of</strong> all in<strong>for</strong>mation provided and required <strong>of</strong> any criminal defendant who is required to<br />

meet monetary bail or bail with any monetary element. Types <strong>of</strong> bonds included are: Surety Bonds, Cash Bonds, and Release on<br />

Recognizance Bonds. Series may also include transmittals from the jail <strong>of</strong> bonds transferred to the Clerk, correspondence to<br />

agencies concerning bonds posted in the county, and cash appearance bond books. See also Section 903.105, Florida Statutes<br />

and Rule 3.131 <strong>of</strong> the Florida Rules <strong>of</strong> Court, Rules <strong>of</strong> Criminal Procedure.<br />

date, etc. This is presented to the Clerk's <strong>Office</strong> <strong>for</strong> acknowledging receipt <strong>of</strong> the original bond <strong>for</strong> the appropriate <strong>court</strong> files.<br />

This record series pertains to bonds that are required under various chapters <strong>of</strong> the Florida Statutes to be filed with the Clerk <strong>of</strong> the<br />

Circuit Court. The single largest type is the one <strong>for</strong> the Deputy Sheriffs. Also <strong>for</strong> commissioners <strong>of</strong> the Mosquito Control <strong>District</strong>,<br />

Hospital Taxing <strong>District</strong> Trustees, etc. Reference Sections 30.09, 155.09, and 388.131, Florida Statutes.<br />

RETENTION:<br />

a) Based on failure to per<strong>for</strong>m services. Five (5) years after termination or settlement <strong>of</strong> cases provided applicable audits have<br />

contain in<strong>for</strong>mation relating to the amount <strong>of</strong> the check, to whom the check was issued, the purpose <strong>of</strong> the check, the date and the<br />

check number. Also contained on the stub is the remaining balance after the check is written and the amount <strong>of</strong> the deposits when<br />

made.<br />

defendant/plaintiff along with the <strong>court</strong> file number, <strong>court</strong> date, and attorney <strong>of</strong> record. Notations are placed on the docket by<br />

attending <strong>court</strong> <strong>clerks</strong> regarding <strong>schedule</strong>d <strong>court</strong> events <strong>for</strong> a specific judge and <strong>court</strong> session which include but are not limited to,<br />

pleas, fine amount, or other sentencing in<strong>for</strong>mation as stated by the judge during the <strong>court</strong> hearing.<br />

This record series consists <strong>of</strong> probate proceedings as stated in Rule 2.075(d)(4) <strong>of</strong> the Florida Rules <strong>of</strong> Court, Judicial<br />

Administration. Series may include caveats. As required by Section 28.223 <strong>of</strong> the Florida Statutes, all wills and codicils admitted to<br />

probate, orders revoking the probate <strong>of</strong> any wills and codicils, letters <strong>of</strong> administration, orders affecting or describing real property,<br />

final orders, orders <strong>of</strong> final discharge, and orders <strong>of</strong> guardianship filed in the <strong>clerks</strong> <strong>of</strong>fice” are to be recorded in the “Official<br />

Records.”<br />

RETENTION:<br />

a) Record copy. Ten (10) years after a judgment has become final, media copy optional.<br />

PROGRESS DOCKETS (COURT RECORDS)<br />

This record series consists <strong>of</strong> dockets in which the clerk notes the filing <strong>of</strong> each pleading, motion or other paper and any step taken<br />

by the clerk in connection with each action, appeal or other proceeding be<strong>for</strong>e the <strong>court</strong> as required by Section 28.211, Florida<br />

Statutes. The dockets may be <strong>for</strong> civil, juvenile, probate, appeals, or criminal matters. Note: civil and criminal dockets may be filed<br />

PUBLIC UTILITY RATE ADJUSTMENT ORDERS<br />

This record series consists <strong>of</strong> a copy <strong>of</strong> rate orders issued by Florida Public Service Commission to adjust (increase or reduce)<br />

utilities rates. This order is posted with the Clerk <strong>of</strong> the Circuit Court <strong>of</strong> each county in which customers are served who are affected<br />

by the adjustment.<br />

This record series consists <strong>of</strong> the original affidavit <strong>for</strong> search warrant, search warrant and return <strong>of</strong> the search warrant. Series may<br />

also include property inventory and receipt, if any property was obtained. After execution <strong>of</strong> the warrant it is filed with the Clerk <strong>of</strong><br />

Court pursuant to Section 933.14(4), Florida Statutes, as served with no arrest having been made. Since no <strong>court</strong> case is<br />

generated, these are kept as a separate record series.<br />

RETENTION:<br />

a) Record Copy. One (1) year after date <strong>of</strong> return.<br />

SMALL CLAIMS CASE FILES<br />

Item#-73<br />

This record series consists <strong>of</strong> those cases involving proceedings under the Rules <strong>of</strong> Small Claims (Summary) Procedure and<br />

Medical Mediation Proceedings. The files usually contain trial memoranda, statement <strong>of</strong> claims, attachment <strong>of</strong> evidence, the<br />

disposition <strong>of</strong> the case, and all other related papers filed during the progress <strong>of</strong> the case. See also Rule 2.075(d)(2) <strong>of</strong> the Florida<br />

Rules <strong>of</strong> Court, Judicial Administration.<br />

RETENTION:<br />

a) Record copy. Two (2) years after a judgment has become final.<br />

SUPPLEMENTAL PLEADINGS<br />

This record series consists <strong>of</strong> pleading(s) filed in a disposed <strong>court</strong> case after it has met its retention requirements. These<br />

documents do not reopen a case or otherwise change the status <strong>of</strong> the case. This paperwork is submitted to the Clerk after the<br />

<strong>court</strong> file has been destroyed or copied to media (electronic or film media) other than paper.<br />

RETENTION:<br />

a) Record copy. One (1) calendar year after filed with the Clerk <strong>of</strong> Court.<br />

TAX DEED REDEMPTION RECORDS<br />

This record series consists <strong>of</strong> the original delinquent tax <strong>records</strong> provided to the Clerk by the Tax Collector pursuant to Chapter<br />

197, Florida Statutes in which the titleholder (or other interested party) has redeemed the taxes. Included in this series are work<br />

sheets, title searches, copy <strong>of</strong> tax certificates, documentation generated via advertisement and administration <strong>of</strong> the clerk's<br />

responsibility to notify applicable persons that the application <strong>for</strong> tax deed has been made, as well as other miscellaneous <strong>records</strong>.<br />

RETENTION:<br />

a) Record copy. One (1) fiscal year after redemption provided applicable audits have been released.<br />

b) Duplicates. Retain until obsolete, superseded or administrative value is lost.<br />

TAX DEED SALE RECORDS Item #-74<br />

This record series consists <strong>of</strong> the original delinquent tax <strong>records</strong> provided to the Clerk by the Tax Collector pursuant to Chapter<br />

197, Florida Statutes. Series may also include <strong>records</strong> <strong>of</strong> lands available <strong>for</strong> taxes, work sheets, title searches, original tax<br />

certificates, sheriff services, certificate <strong>of</strong> advertisement, certificate <strong>of</strong> mailing notices to title holders and lienholders, copies <strong>of</strong><br />

correspondence to the Board <strong>of</strong> County Commissioners regarding surplus monies and claims, surplus claim affidavits, notices and<br />

warning statements mailed to title holders and lienholder, copies <strong>of</strong> disbursement <strong>records</strong> which include: refunds to applicants,<br />

payment <strong>of</strong> surplus claims, check requisitions <strong>for</strong> surplus monies transferred to the Board <strong>of</strong> County Commissioners as well as<br />

other miscellaneous <strong>records</strong>. The file also contains a copy <strong>of</strong> the recorded tax deed. The original deed, after is has been recorded<br />

in the <strong>of</strong>ficial <strong>records</strong> <strong>of</strong> the county, has been released to the successful bidder.<br />

This record series consists <strong>of</strong> non-judicial hearings, which include but are not limited to, Probable Cause Affidavits, Civil Citations,<br />

Teen Court Program introductory letters to parents, letters to victims (restitution), victims statement, waiver <strong>of</strong> rights, intake<br />

interview summaries, jury sentencing <strong>for</strong>ms, contract agreements, verification <strong>of</strong> restitution (receipt), letter <strong>of</strong> apology/essay, TASC<br />

(Treatment Alternative <strong>for</strong> Street Crime) Assessment (Psychosocial Evaluation), community service or jury duty time sheets,<br />

successful completion reports (disposition <strong>for</strong>ms), and Department <strong>of</strong> Juvenile Justice Recommendation to State Attorney’s <strong>Office</strong>.<br />

TOURIST DEVELOPMENT TAX RECORDS<br />

This record series consists <strong>of</strong> any documents relating to the collection <strong>of</strong> the levy that is imposed by counties on persons who rent,<br />

lease or let <strong>for</strong> consideration any living quarters or accommodations in any motel, apartment motel, apartment hotel, resort motel,<br />

apartment, rooming house, mobile home park, recreational vehicle park or condominium <strong>for</strong> a term <strong>of</strong> six (6) months or less. See<br />

also Section 125.0104 and 95.091 <strong>of</strong> the Florida Statutes and Rule 12A-1.093, Florida Administrative Code.<br />

incarceration and <strong>for</strong> which there is no right to a trial by jury or a right to a <strong>court</strong> appointed counsel) and parking tickets. For<br />

This record series consists <strong>of</strong> a recording <strong>of</strong> the contents <strong>of</strong> any wire, oral or electronic communication pursuant to Section<br />

934.09(7), Florida Statutes. These <strong>records</strong> are sealed under the direction <strong>of</strong> the judge and are submitted to the Court by law<br />

en<strong>for</strong>cement agencies. They shall not be destroyed except upon an order <strong>of</strong> the issuing or denying judge, or that judge’s successor<br />

in <strong>of</strong>fice, and in any event shall be kept <strong>for</strong> ten (10) years.<br />
