Licence <strong>Forum</strong><br />
Pour la première fois depuis sa création en<br />
1996, le <strong>Forum</strong> des éditeurs de l’<strong>Union</strong><br />
européenne a révisé les termes des licences<br />
qu’il accorde, afin de mieux répondre aux<br />
demandes et aux besoins des éditeurs.<br />
Le cadre du <strong>Forum</strong> s’intègre dans la politique<br />
de gestion de la propriété intellectuelle<br />
appliquée par l’Office des publications<br />
<strong>of</strong>ficielles des Communautés européennes<br />
en matière de rediffusion à des fins<br />
commerciales de documents dont les droits<br />
d’auteur appartiennent aux Communautés<br />
européennes.<br />
Le nouvel accord de licence présente des<br />
termes juridiques, une politique tarifaire et<br />
des conditions simples et précis.<br />
La licence garde ainsi son caractère<br />
particulier, déterminé par des principes<br />
de collaboration faciles, transparents et<br />
avantageux pour les éditeurs. Les droits et<br />
obligations sont prédéfinis, connus de tous<br />
les membres du <strong>Forum</strong>, et ne nécessitent<br />
donc pas de négociation.<br />

Conditions générales régissant les licences accordées<br />
par l’Office des publications aux membres<br />
du <strong>Forum</strong> des éditeurs de l’<strong>Union</strong> européenne<br />
Article premier<br />
Agissant pour le compte des services auteurs<br />
des institutions, agences ou autres organes de<br />
l’<strong>Union</strong> européenne, l’Office des publications<br />
accorde à l’éditeur une licence non exclusive<br />
autorisant la publication, la reproduction, la<br />
traduction ou l’adaptation, et la diffusion dans<br />
le monde entier, du document, conformément<br />
aux conditions générales et selon les procédures<br />
spécifiées ci-dessous.<br />
Article 2<br />
La licence entre en vigueur à la date de sa<br />
signature par l’Office des publications et viendra<br />
à échéance selon les modalités y prévues. Elle<br />
porte sur une édition unique du document et<br />
ne peut être modifiée ou prorogée, et l’éditeur<br />
n’acquerra un droit sur une autre édition ou<br />
version linguistique du document que par un<br />
nouvel accord écrit conclu entre les parties.<br />
Article 3<br />
L’Office des publications certifie que les droits<br />
de propriété intellectuelle du document<br />
appartiennent au service auteur (Communautés<br />
européennes, agence ou autre organe de l’<strong>Union</strong><br />
européenne).<br />
L’éditeur s’engage à obtenir les autorisations<br />
requises pour l’utilisation dans le produit de<br />
tout matériel textuel ou artistique appartenant<br />
à des tiers, contenu dans le document et spécifié<br />
comme tel.<br />
Article 4<br />
Le service auteur reste détenteur des droits de<br />
propriété intellectuelle du document, ce que<br />
l’éditeur s’engage à mentionner dans le produit<br />
conformément aux termes indiqués en annexe.<br />
Article 5<br />
L’Office des publications fournit le document<br />
selon le format et les conditions prévus par la<br />
licence.<br />
Article 6<br />
En contrepartie de la fourniture du document,<br />
l’éditeur paie le montant indiqué, au tarif en<br />
vigueur au moment de la signature de la licence.<br />
Un barème dégressif est appliqué lorsque la<br />
licence couvre plus d’une version linguistique du<br />
même document.<br />
Article 7<br />
L’éditeur s’engage à effectuer le paiement<br />
libératoire dans un délai de trente (30) jours<br />
à compter de la date de la facture, libellée en<br />
euros, hors taxes et charges.<br />
En cas de retard de paiement, il est porté en<br />
compte le taux appliqué par la Banque centrale<br />
européenne à ses opérations principales de<br />
refinancement tel que publié au Journal <strong>of</strong>ficiel<br />
de l’<strong>Union</strong> européenne, série C, en vigueur le<br />
premier jour calendrier du mois de l’échéance,<br />
majoré de trois points et demi de pourcentage.<br />
Article 8<br />
La reproduction, la traduction ou l’adaptation du<br />
document et la production du produit sont à la<br />
charge de l’éditeur, seul bénéficiaire des recettes<br />
provenant de sa vente.<br />
La fabrication, la commercialisation et la<br />
promotion, le nombre et la distribution<br />
d’exemplaires gratuits, la tarification et les<br />
conditions de vente ainsi que le retirage du<br />
produit sont laissés à la discrétion de l’éditeur.<br />
Article 9<br />
Dès la première publication, l’éditeur livre sans<br />
délai à l’Office des publications, sans taxes ni<br />
charges, cinq (5) exemplaires gratuits du produit.<br />
L’Office des publications peut acheter des<br />
exemplaires supplémentaires, à des fins non<br />
commerciales et au prix prévu par la licence.<br />
Si l’éditeur publie le produit en ligne, un accès<br />
gratuit au service auteur peut être décidé d’un<br />
commun accord entre les parties.<br />
Article 10<br />
Une fois par an, l’éditeur transmet les comptes<br />
des ventes et de la diffusion du produit<br />
à l’Office des publications, qui garantit la<br />
confidentialité des informations commerciales<br />
communiquées.<br />
Article 11<br />
L’éditeur ne cède pas les droits et avantages qui<br />
lui sont conférés par la licence et il ne publie<br />
pas le produit sous une raison sociale autre<br />
que la sienne sans l’accord écrit de l’Office des<br />
publications.<br />
Article 12<br />
Chaque partie peut résilier la licence par lettre<br />
recommandée adressée à l’autre partie si celle-ci<br />
a manqué à l’une des conditions de la licence et<br />
n’a pas remédié à ce manquement dans un délai<br />
de un mois après y avoir été invitée par l’autre<br />
partie.<br />
Article 13<br />
Aucune des parties contractantes n’est<br />
considérée comme ayant manqué ou<br />
contrevenu à ses obligations si elle n’a pu les<br />
exécuter en raison d’une force majeure.<br />
Si l’une des parties contractantes est confrontée<br />
à un cas de force majeure, elle en avertit sans<br />
délai l’autre partie par lettre recommandée avec<br />
accusé de réception, en précisant la nature, la<br />
durée probable et les effets prévisibles de cet<br />
événement.<br />
On entend par «force majeure» toute situation<br />
ou tout événement imprévisible et exceptionnel,<br />
indépendant de la volonté des parties et non<br />
imputable à la faute ou à la négligence de l’une<br />
d’entre elles, qui empêche l’une des parties<br />
d’exécuter une ou plusieurs de ses obligations<br />
contractuelles, et qui n’a pu être surmonté en<br />
dépit de toute la diligence déployée.<br />
Article 14<br />
La présente licence est régie par le droit<br />
luxembourgeois et interprétée à tous les égards<br />
conformément à celui-ci. Les tribunaux du<br />
Luxembourg auront compétence exclusive pour<br />
le règlement de tout litige entre les parties.<br />
Article 15<br />
Toute modalité particulière non prévue et/ou<br />
toute modification aux conditions établies<br />
ci-dessus sont spécifiées à l’annexe de la<br />
présente licence.<br />

<strong>Forum</strong> licence<br />
For <strong>the</strong> first time since it was set up in<br />
1996, <strong>the</strong> <strong>European</strong> <strong>Union</strong> Publishers’<br />
<strong>Forum</strong> has revised <strong>the</strong> terms <strong>of</strong> <strong>the</strong> licences<br />
it grants, with a view to meeting publishers’<br />
requests and needs more effectively.<br />
The <strong>Forum</strong> upholds <strong>the</strong> policy applied by<br />
<strong>the</strong> Publications Office <strong>of</strong> <strong>the</strong> <strong>European</strong><br />
Communities for <strong>the</strong> management <strong>of</strong><br />
intellectual property when documents<br />
whose copyright is held by <strong>the</strong> <strong>European</strong><br />
Communities are used for commercial<br />
purposes.<br />
The new licensing agreement sets out <strong>the</strong><br />
legal terms, a pricing policy, and simple and<br />
precise conditions.<br />
Thus, <strong>the</strong> licence continues to be based<br />
on principles <strong>of</strong> collaboration that are<br />
straightforward, transparent and beneficial<br />
for publishers. Rights and obligations are<br />
laid down in advance and known to all <strong>the</strong><br />
members <strong>of</strong> <strong>the</strong> <strong>Forum</strong>. There is no need,<br />
<strong>the</strong>refore, for negotiation.<br />

General terms applying to licences granted<br />
by <strong>the</strong> Publications Office to <strong>the</strong> members<br />
<strong>of</strong> <strong>the</strong> <strong>European</strong> <strong>Union</strong> Publishers’ <strong>Forum</strong><br />
Article 1<br />
The Publications Office, acting on behalf <strong>of</strong><br />
<strong>the</strong> originating departments <strong>of</strong> <strong>the</strong> <strong>European</strong><br />
<strong>Union</strong>’s institutions, agencies or o<strong>the</strong>r<br />
organisations, hereby grants to <strong>the</strong> Publisher<br />
a non-exclusive licence to publish, reproduce,<br />
translate or adapt, and to distribute throughout<br />
<strong>the</strong> world <strong>the</strong> Document subject to <strong>the</strong><br />
conditions and according to <strong>the</strong> procedures<br />
specified below.<br />
Article 2<br />
The licence shall enter into force on <strong>the</strong> date<br />
<strong>of</strong> its signature by <strong>the</strong> Publications Office and<br />
shall expire in accordance with <strong>the</strong> terms set<br />
out <strong>the</strong>rein. It relates to a single edition <strong>of</strong><br />
<strong>the</strong> Document and may not be modified or<br />
extended, and <strong>the</strong> Publisher will obtain no rights<br />
in any o<strong>the</strong>r edition or language edition <strong>the</strong>re<strong>of</strong><br />
save by fur<strong>the</strong>r formal agreement in writing<br />
between <strong>the</strong> parties.<br />
Article 3<br />
The Publications Office certifies that copyright<br />
and o<strong>the</strong>r intellectual property rights <strong>of</strong><br />
<strong>the</strong> Document are held by <strong>the</strong> originating<br />
department (<strong>European</strong> Communities, agency or<br />
o<strong>the</strong>r organisation <strong>of</strong> <strong>the</strong> <strong>European</strong> <strong>Union</strong>).<br />
The Publisher shall obtain <strong>the</strong> permission<br />
required for <strong>the</strong> use in <strong>the</strong> Product <strong>of</strong> any thirdparty<br />
copyright literary or artistic material<br />
contained in <strong>the</strong> Document and specified as<br />
such.<br />
Article 4<br />
Intellectual property rights <strong>of</strong> <strong>the</strong> Document<br />
shall remain with <strong>the</strong> originating department,<br />
to which <strong>the</strong> Publisher undertakes to give due<br />
acknowledgement in <strong>the</strong> Product, in compliance<br />
with <strong>the</strong> terms set out in <strong>the</strong> Annex to this<br />
licence.<br />
Article 5<br />
The Publications Office shall supply <strong>the</strong><br />
Document in <strong>the</strong> format and under <strong>the</strong><br />
conditions specified in this licence.<br />
Article 6<br />
By way <strong>of</strong> compensation for <strong>the</strong> provision <strong>of</strong> <strong>the</strong><br />
Document, <strong>the</strong> Publisher shall pay <strong>the</strong> indicated<br />
sum, based on <strong>the</strong> current rates at <strong>the</strong> time <strong>of</strong><br />
signature <strong>of</strong> this licence. A sliding scale is applied<br />
if <strong>the</strong> licence covers more than one language<br />
edition <strong>of</strong> <strong>the</strong> Document.<br />
Article 7<br />
The Publisher undertakes to pay <strong>the</strong> sum due<br />
within thirty (30) days from <strong>the</strong> date <strong>of</strong> <strong>the</strong><br />
invoice, drawn up in euro, exempt from taxes<br />
and charges.<br />
Should <strong>the</strong> Publisher be in arrears with <strong>the</strong><br />
payment, interests shall be demanded at <strong>the</strong><br />
rate applied by <strong>the</strong> <strong>European</strong> Central Bank to its<br />
principal refinancing operations, as published in<br />
<strong>the</strong> C series <strong>of</strong> <strong>the</strong> Official Journal <strong>of</strong> <strong>the</strong> <strong>European</strong><br />
<strong>Union</strong>, in force on <strong>the</strong> first calendar day <strong>of</strong> <strong>the</strong><br />
month in which <strong>the</strong> due date falls, increased by<br />
three and a half percentage points.<br />
Article 8<br />
The reproduction, translation or adaptation<br />
<strong>of</strong> <strong>the</strong> Document, and <strong>the</strong> production <strong>of</strong><br />
<strong>the</strong> Product shall be at <strong>the</strong> expense <strong>of</strong> <strong>the</strong><br />
Publisher, as <strong>the</strong> only beneficiary <strong>of</strong> <strong>the</strong> revenues<br />
generated by his sale.<br />
The production, marketing and promotion, <strong>the</strong><br />
number and <strong>the</strong> distribution <strong>of</strong> free copies, <strong>the</strong><br />
pricing, <strong>the</strong> terms <strong>of</strong> sale and <strong>the</strong> reprinting<br />
<strong>of</strong> <strong>the</strong> Product shall be at <strong>the</strong> Publisher’s sole<br />
discretion.<br />
Article 9<br />
On first publication <strong>of</strong> <strong>the</strong> Product, <strong>the</strong> Publisher<br />
shall forthwith deliver to <strong>the</strong> Publications Office,<br />
free <strong>of</strong> all delivery costs and charges, five (5)<br />
complimentary copies <strong>the</strong>re<strong>of</strong>.<br />
The Publications Office may purchase additional<br />
copies, for non-commercial purposes and at <strong>the</strong><br />
price specified in this licence.<br />
Should <strong>the</strong> Publisher publish <strong>the</strong> Product online,<br />
free access <strong>the</strong>reto may be supplied to <strong>the</strong><br />
originating department, by mutual agreement<br />
between <strong>the</strong> parties.<br />
Article 10<br />
Once a year, <strong>the</strong> Publisher shall provide <strong>the</strong><br />
Publications Office with accounts <strong>of</strong> <strong>the</strong><br />
sales and <strong>the</strong> dissemination <strong>of</strong> <strong>the</strong> Product.<br />
The Publications Office shall guarantee <strong>the</strong><br />
confidentiality <strong>of</strong> <strong>the</strong> commercial information<br />
received.<br />
Article 11<br />
The Publisher shall not assign <strong>the</strong> rights and<br />
benefits conferred by this licence nor issue <strong>the</strong><br />
Product under any imprint o<strong>the</strong>r than his own<br />
without <strong>the</strong> written approval <strong>of</strong> <strong>the</strong> Publications<br />
Office.<br />
Article 12<br />
Ei<strong>the</strong>r party may terminate this licence by<br />
registered letter addressed to <strong>the</strong> o<strong>the</strong>r party<br />
if <strong>the</strong> latter has violated any <strong>of</strong> <strong>the</strong> terms <strong>of</strong> this<br />
licence and has failed to remedy such a breach<br />
within one month <strong>of</strong> notice to it <strong>of</strong> such breach<br />
from <strong>the</strong> o<strong>the</strong>r party.<br />
Article 13<br />
Nei<strong>the</strong>r <strong>of</strong> <strong>the</strong> contracting parties shall be<br />
considered as being in breach or infringement <strong>of</strong><br />
its obligations if it has been unable to comply on<br />
account <strong>of</strong> force majeure.<br />
If ei<strong>the</strong>r party is subject to force majeure, it<br />
shall notify <strong>the</strong> o<strong>the</strong>r party without delay by<br />
registered letter with acknowledgement <strong>of</strong><br />
receipt, stating <strong>the</strong> nature, likely duration and<br />
foreseeable effects <strong>of</strong> this event.<br />
Force majeure shall mean any unforeseeable<br />
and exceptional situation or event beyond <strong>the</strong><br />
control <strong>of</strong> one or both parties, which prevents<br />
ei<strong>the</strong>r <strong>of</strong> <strong>the</strong>m from performing any <strong>of</strong> <strong>the</strong>ir<br />
obligations under this licence, was not due to<br />
error or negligence on <strong>the</strong>ir part, and could<br />
not have been avoided by <strong>the</strong> exercise <strong>of</strong> due<br />
diligence.<br />
Article 14<br />
The rights and liabilities <strong>of</strong> <strong>the</strong> parties, in so<br />
far as <strong>the</strong>y are not expressly covered by this<br />
licence, shall be established according to <strong>the</strong><br />
law <strong>of</strong> Luxembourg, and any dispute, whe<strong>the</strong>r<br />
as to <strong>the</strong> express terms <strong>of</strong> this Agreement or<br />
o<strong>the</strong>rwise, shall be determined by <strong>the</strong> courts <strong>of</strong><br />
Luxembourg.<br />
Article 15<br />
Any particular terms not mentioned and/or any<br />
modification to <strong>the</strong> conditions set out above<br />
shall be specified in <strong>the</strong> Annex to this licence.<br />

<strong>Forum</strong> Lizenz<br />
Zum ersten Mal seit seiner Gründung im<br />
Jahr 1996 hat das Verlegerforum der<br />
Europäischen <strong>Union</strong> die Bedingungen der<br />
von ihm vergebenen Lizenzen geändert, um<br />
der Nachfrage und den Bedürfnissen der<br />
Verleger besser nachkommen zu können.<br />
Diese Maßnahme des <strong>Forum</strong>s fügt<br />
sich ein in den Rahmen der Politik der<br />
Verwaltung des geistigen Eigentums, die<br />
das <strong>Amt</strong> für amtliche Veröffentlichungen der<br />
Europäischen Gemeinschaften im Bereich<br />

Allgemeine Bedingungen für die Vergabe von Lizenzen<br />
durch das <strong>Amt</strong> für Veröffentlichungen an die Mitglieder<br />
des Verlegerforums der Europäischen <strong>Union</strong><br />
Artikel 1<br />
Im Namen der Autorendienste der Organe,<br />
Agenturen und sonstigen Einrichtungen der<br />
Europäischen <strong>Union</strong> erteilt das <strong>Amt</strong> für amtliche<br />
Veröffentlichungen dem Verleger eine nicht<br />
ausschließliche Lizenz zur Veröffentlichung,<br />
Reproduktion, Übersetzung oder Anpassung<br />
und zur weltweiten Verbreitung des Werkes<br />
gemäß den nachfolgend beschriebenen<br />
Vertragsbedingungen.<br />
Artikel 2<br />
Die Lizenz tritt in Kraft am Tag ihrer<br />
Unterzeichnung durch das <strong>Amt</strong> für<br />
Veröffentlichungen und endet gemäß den in ihr<br />
vorgesehenen Bedingungen. Sie erstreckt sich<br />
auf eine einzige Ausgabe des Werkes und kann<br />
weder geändert noch verlängert werden; der<br />
Verleger erwirbt die Rechte an einer weiteren<br />
Ausgabe oder Sprachfassung nur durch eine<br />
neue schriftliche Vereinbarung zwischen den<br />
Parteien.<br />
Artikel 3<br />
Das <strong>Amt</strong> für Veröffentlichungen sichert zu, dass<br />
die Urheberrechte am Werk dem Autorendienst<br />
(Europäische Gemeinschaften, Agenturen oder<br />
sonstige Einrichtungen der Europäischen <strong>Union</strong>)<br />
gehören.<br />
Der Auftragnehmer verpflichtet sich zur<br />
Beschaffung der Genehmigungen, die<br />
erforderlich sind, um in dem Produkt<br />
enthaltenes Dritten gehörendes und als solches<br />
ausgewiesenes schriftliches oder künstlerisches<br />
Material zu verwenden.<br />
Artikel 4<br />
Der Autorendienst bleibt Inhaber der<br />
Urheberrechte am Werk, und der Verleger<br />
verpflichtet sich, darauf im Produkt gemäß<br />
den im Anhang aufgeführten Bedingungen<br />
hinzuweisen.<br />
Artikel 5<br />
Das <strong>Amt</strong> für Veröffentlichungen liefert das Werk<br />
in dem Format und zu den Bedingungen, die die<br />
Lizenz vorsieht.<br />
Artikel 6<br />
Als Gegenleistung für die Lieferung des Werkes<br />
zahlt der Verleger den Betrag zu dem Tarif,<br />
der zum Zeitpunkt der Unterschrift gültig<br />
war. Erstreckt sich die Lizenz auf mehr als eine<br />
Sprachfassung desselben Werkes, so gilt eine<br />
degressive Preisstaffel.<br />
Artikel 7<br />
Der Verleger verpflichtet sich, die Zahlung<br />
schuldbefreiend innerhalb von dreißig (30)<br />
Tagen vom Rechnungsdatum an in Euro ohne<br />
Steuern und Abgaben zu leisten.<br />
Im Falle nicht fristgerechter Zahlung werden<br />
Verzugszinsen erhoben in Höhe des Zinssatzes,<br />
der am ersten Tag des Monats der Fälligkeit<br />
von der Europäischen Zentralbank für ihre<br />
Transaktionen in Euro angewandt und im<br />
<strong>Amt</strong>sblatt der Europäischen <strong>Union</strong>, Reihe C,<br />
veröffentlicht wurde, zuzüglich dreieinhalb<br />
Prozentpunkten.<br />
Artikel 8<br />
Die Reproduktion, Übersetzung oder Anpassung<br />
des Werkes und die Herstellung des Produkts<br />
erfolgen auf Kosten des Verlegers, dem allein<br />
sämtliche Erlöse aus dem Verkauf des Produkts<br />
zustehen.<br />
Der Verleger entscheidet allein über Herstellung,<br />
Vermarktung, Werbung, Anzahl und Verteilung<br />
von Freiexemplaren, Preisfestsetzung und<br />
Verkaufsbedingungen sowie über den<br />
Nachdruck des Produkts.<br />
Artikel 9<br />
Bei der Erstveröffentlichung liefert der Verleger<br />
dem <strong>Amt</strong> für Veröffentlichungen unverzüglich<br />
steuer- und abgabenfrei fünf (5) Freiexemplare<br />
des Produkts.<br />
Das <strong>Amt</strong> für Veröffentlichungen kann zusätzliche<br />
Exemplare für nicht kommerzielle Zwecke zu<br />
dem in der Lizenz festgelegten Preis erwerben.<br />
Veröffentlicht der Verleger das Produkt online,<br />
kann zwischen den Parteien ein kostenloser<br />
Zugang für den Autorendienst vereinbart<br />
werden.<br />
Artikel 10<br />
Der Verleger übermittelt einmal jährlich eine<br />
Aufstellung über Absatz und Verbreitung des<br />
Produkts an das <strong>Amt</strong> für Veröffentlichungen, das<br />
seinerseits die Vertraulichkeit der mitgeteilten<br />
geschäftlichen Angaben gewährleistet.<br />
Artikel 11<br />
Der Verleger darf ohne schriftliche<br />
Genehmigung des <strong>Amt</strong>es für Veröffentlichungen<br />
weder die mit der Lizenz erworbenen<br />
Rechte und Leistungen abtreten noch das<br />
Produkt unter einer anderen als der eigenen<br />
Firmenbezeichnung veröffentlichen.<br />
Artikel 12<br />
Jede Vertragspartei kann diese Lizenz per<br />
Einschreiben an die andere Partei kündigen, falls<br />
diese eine Bedingung der Lizenz verletzt und<br />
diese Verletzung nicht innerhalb eines Monats,<br />
nachdem sie dazu aufgefordert wurde, behoben<br />
hat.<br />
Artikel 13<br />
Es wird keiner Partei als Verstoß gegen die<br />
Pflichten aus dem Vertrag ausgelegt, wenn sie<br />
durch „höhere Gewalt” an der Erfüllung dieser<br />
Pflichten gehindert ist.<br />
Ist eine Partei „höherer Gewalt” ausgesetzt, so<br />
unterrichtet sie die andere Partei unverzüglich<br />
durch Einschreiben mit Rückschein und<br />
gibt darin Art, voraussichtliche Dauer und<br />
vorhersehbare Folgen des betreffenden<br />
Ereignisses an.<br />
Unter „höhere Gewalt“ sind unvorhersehbare<br />
und außergewöhnliche, trotz der gebotenen<br />
Sorgfalt unabwendbare Situationen oder<br />
Ereignisse zu verstehen, die unabhängig vom<br />
Willen der Vertragsparteien eintreten, nicht auf<br />
einem Fehler oder einer Fahrlässigkeit einer<br />
Partei beruhen und diese Partei daran hindern,<br />
eine Pflicht aus dem Vertrag zu erfüllen.<br />
Artikel 14<br />
Für diese Lizenz gilt das luxemburgische<br />
Recht, dem gemäß sie in jeder Hinsicht zu<br />
interpretieren ist. Ausschließlicher Gerichtsstand<br />
für Rechtsstreitigkeiten zwischen den Parteien<br />
ist Luxemburg.<br />
Artikel 15<br />
Jegliche Abweichung von diesen allgemeinen<br />
Vertragsbedingungen bzw. in ihnen nicht<br />
vorgesehene, besondere Bedingungen werden<br />
als vollwertiger Bestandteil im Anhang der<br />
vorliegenden Lizenz aufgeführt.<br />

Lors de la réunion annuelle à Francfort,<br />
en octobre 2004, le <strong>Forum</strong> des éditeurs<br />
a lancé l’idée de la création d’un groupe de<br />
travail dont l’objectif était une réflexion sur<br />
le fonctionnement et sur les évolutions à<br />
envisager pour l’avenir.<br />
Un appel à candidatures a été lancé à<br />
tous les membres en automne 2004. Afin<br />
d’optimiser le déroulement des travaux,<br />
le nombre de participants a dû être limité.<br />
Par conséquent, il s’est avéré nécessaire de<br />
procéder à une sélection qui puisse assurer<br />
un groupe équilibré des nationalités et des<br />
domaines d’activité.<br />
1. Orientations révisées<br />
pour la coopération<br />
avec le <strong>Forum</strong><br />
Cinq formes majeures de coopération<br />
peuvent être prévues:<br />
a) Réutilisation de l’information du<br />
secteur public — Produits à valeur<br />
ajoutée<br />
Elle concerne des informations<br />
publiées obligatoirement (sur papier ou<br />
électroniquement) par les institutions et les<br />
agences (par exemple, le Journal <strong>of</strong>ficiel).<br />
Les éditeurs pourraient les réutiliser en tout<br />
ou en partie, pour fabriquer des produits à<br />
valeur ajoutée.<br />
b) Initiative de l’Office des publications<br />
pour faire connaître la matière disponible<br />
Elle concerne la matière que les institutions<br />
ou les agences doivent publier, mais pas<br />
nécessairement elles-mêmes (par exemple,<br />
certaines versions linguistiques). La<br />
collaboration avec des partenaires privés<br />
peut engendrer un contrat de licence ou une<br />
coédition. De telles publications seraient<br />
considérées comme <strong>of</strong>ficielles.<br />
En collaboration avec la Fédération des éditeurs européens (FEE) et sous la présidence<br />
de M. Jean Vandeveld, le groupe de travail est né, comprenant les membres suivants:<br />

Le groupe s’est réuni trois fois (le 26 janvier, le 9 mars et le 10 juin) au cours de l’année<br />
2005, dans les locaux de l’Office des publications à Bruxelles, et a abouti aux conclusions<br />
suivantes, qu’il a l’avantage de présenter aux membres du <strong>Forum</strong>.<br />
c) Initiative de l’éditeur<br />
À la demande de l’éditeur, le <strong>Forum</strong> pourrait<br />
aider dans la recherche de matière sur un<br />
sujet spécifique. L’éditeur publiera, pour son<br />
propre compte, les ouvrages originaux basés<br />
sur les informations qu’on lui fournira.<br />
d) Coédition à l’initiative de l’éditeur<br />
Elle concerne un projet proposé à l’initiative<br />
de l’éditeur avec l’Office des publications<br />
comme coéditeur.<br />
e) Partnersearch<br />
C’est un espace qui <strong>of</strong>fre un échange<br />
d’informations sur les projets éditoriaux<br />
entre les membres du <strong>Forum</strong>.<br />

2. Traduction<br />
Le <strong>Forum</strong> s’engage à rechercher des moyens<br />
de financement d’aide à la traduction.<br />
3. Réunions<br />
Une réunion <strong>of</strong>ficielle sera tenue une fois par<br />
an à Francfort, lors de la Foire du livre. Une<br />
réunion «à la demande» sera organisée sur<br />
un sujet spécifique à la demande de l’un ou<br />
de plusieurs membres du <strong>Forum</strong> et si celui-ci<br />
rencontre l’intérêt d’un nombre significatif<br />
de participants parmi les membres.<br />
Les réunions ne prévoiront plus<br />
l’intervention des institutions pour présenter<br />
leurs programmes de publication, sauf sur<br />
des projets concrets. L’ordre du jour pourra<br />
être basé sur des propositions provenant de<br />
l’Office des publications et des éditeurs.<br />

This concerns information published<br />

<strong>the</strong> institutions and agencies (for example,<br />
<strong>the</strong> Official Journal). Publishers could reuse<br />
all or part <strong>of</strong> it for value‐added products.<br />
(b) Publications Office initiative to create<br />
awareness <strong>of</strong> <strong>the</strong> material available<br />
This concerns material that <strong>the</strong> institutions<br />
or agencies have to publish, but not<br />
necessarily by <strong>the</strong>mselves (for example,<br />
certain language versions). Collaboration<br />
with private partners could lead to a<br />
licensing contract or joint publishing.<br />
Publications <strong>of</strong> this kind would be regarded<br />
as <strong>of</strong>ficial.<br />

(c) Publisher’s initiative<br />
At <strong>the</strong> publisher’s request, <strong>the</strong> <strong>Forum</strong> could<br />

behalf, issue original work on <strong>the</strong> basis <strong>of</strong><br />
<strong>the</strong> information supplied.<br />
(d) Joint publishing at <strong>the</strong> publisher’s<br />
initiative<br />
This concerns projects proposed by <strong>the</strong><br />
publisher, with <strong>the</strong> Publications Office as<br />
joint publisher.<br />
2. Translation<br />
The <strong>Forum</strong> undertakes to seek funding for<br />
translation aids.<br />
3. Meetings<br />
An <strong>of</strong>ficial meeting will be held once a year<br />
in Frankfurt on <strong>the</strong> occasion <strong>of</strong> <strong>the</strong> book fair.<br />
Ad hoc meetings will be held on specific<br />
subjects at <strong>the</strong> request <strong>of</strong> one or more<br />
members <strong>of</strong> <strong>the</strong> <strong>Forum</strong> and if a significant<br />
number <strong>of</strong> members are interested.<br />
The institutions will no longer attend<br />
meetings in order to present <strong>the</strong>ir<br />
publishing programmes, except in <strong>the</strong><br />
case <strong>of</strong> specific projects. The agenda will<br />
be based on proposals by <strong>the</strong> Publications<br />
Office and publishers.<br />
4. <strong>Bulletin</strong><br />
The <strong>Bulletin</strong> <strong>of</strong> <strong>the</strong> <strong>European</strong> Publishers’<br />
<strong>Forum</strong> will continue to appear twice a year,<br />
reporting on projects conducted under <strong>the</strong><br />
auspices <strong>of</strong> <strong>the</strong> <strong>Forum</strong>.<br />
(e) Partnersearch<br />
This is an area for <strong>the</strong> exchange <strong>of</strong><br />
information on publishing projects between<br />

Arbeitsgruppe „Neugestaltung<br />
des <strong>Forum</strong>s“ — Schlussfolgerungen<br />
Auf der Jahressitzung des Verlegerforums<br />
in Frankfurt im Oktober 2004 entstand die<br />
Idee einer Arbeitsgruppe, deren Ziel es sein<br />
sollte, Reflexionen über die Arbeitsweise des<br />
<strong>Forum</strong>s und die künftigen Entwicklungen<br />
anzustellen.<br />
Im Herbst 2004 erging ein Aufruf zur<br />
Einreichung von Bewerbungen an alle<br />
Mitglieder. Um den Ablauf der Arbeiten zu<br />
optimieren, musste die Zahl der Teilnehmer<br />
begrenzt werden. Daher wurde unter den<br />
Bewerbern eine Auswahl getr<strong>of</strong>fen, die<br />
gewährleistet, dass alle Nationalitäten<br />
und Tätigkeitsbereiche in der Gruppe<br />
ausgewogen vertreten sind.<br />
Die Arbeitsgruppe wurde in Zusammenarbeit mit dem Europäischen Verlegerverband<br />
(FEE) und unter dem Vorsitz von Jean Vandeveld gegründet. Ihr gehören folgende<br />

müssen (z. B. das <strong>Amt</strong>sblatt). Die Verleger<br />
könnten diese Informationen ganz oder<br />
teilweise nutzen, um Mehrwertprodukte<br />
herzustellen.<br />
b) Bekanntgabe des verfügbaren<br />
Materials auf Initiative des <strong>Amt</strong>s für<br />
Veröffentlichungen<br />
Diese Zusammenarbeit betrifft das Material,<br />
das zwar veröffentlicht werden muss, aber<br />
nicht unbedingt von den Organen und<br />
Agenturen der EU selbst (z. B. bestimmte<br />
Sprachfassungen von Veröffentlichungen).<br />
Die Kooperation mit privaten Partnern<br />
kann im Rahmen eines Lizenzvertrags<br />
oder einer Koedition erfolgen. Derartige<br />
Veröffentlichungen hätten amtlichen<br />
Charakter.<br />
c) Initiative des Verlegers<br />
Auf Anfrage des Verlegers leistet das<br />
<strong>Forum</strong> Hilfestellung bei Recherchen zu<br />
einem bestimmten Thema. Der Verleger<br />
veröffentlicht die auf den ihm gelieferten<br />
Informationen basierenden Werke für<br />
eigene Rechnung.<br />
d) Koedition auf Initiative des Verlegers<br />
Der Verleger schlägt ein Projekt vor, für<br />
das er das <strong>Amt</strong> für Veröffentlichungen als<br />
Mi<strong>the</strong>rausgeber gewinnen möchte.<br />
e) Partnersearch<br />
Partnersearch bietet den Mitgliedern<br />
des <strong>Forum</strong>s die Möglichkeit eines<br />
Informationsaustauschs über Projekte im<br />
Verlagsbereich.<br />
2. Übersetzung<br />
Das <strong>Forum</strong> verpflichtet sich, nach Mitteln<br />
zur Finanzierung von Übersetzungshilfen zu<br />
suchen.<br />

anlässlich der Frankfurter Buchmesse eine<br />
<strong>of</strong>fizielle Sitzung ab.<br />
Auf Antrag eines oder mehrerer Mitglieder<br />
des <strong>Forum</strong>s können Ad-hoc-Sitzungen zu<br />
spezifischen Themen veranstaltet werden,<br />
wenn bei genügend <strong>Forum</strong>mitgliedern<br />
Interesse an diesen Themen besteht.<br />
Die Institutionen werden auf den Sitzungen<br />
keine Veröffentlichungsprogramme mehr<br />
vorstellen, sondern nur noch konkrete<br />
Projekte. Die Tagesordnung wird anhand der<br />
Vorschläge des <strong>Amt</strong>s für Veröffentlichungen<br />
und der Verleger erstellt.<br />
4. <strong>Bulletin</strong><br />
Das <strong>Bulletin</strong> des <strong>Forum</strong>s wird weiterhin<br />
zweimal pro Jahr erscheinen. In ihm werden<br />
die im Rahmen des <strong>Forum</strong>s ausgeführten<br />
Projekte ausführlich dargestellt.<br />

Italian publishing —<br />
an overview<br />
The Italian publishing industry is<br />
Germany managing to keep Greece pace, albeit with<br />
difficulty, with o<strong>the</strong>r <strong>European</strong><br />
publishing industries. It is feeling<br />
<strong>the</strong> ill effects <strong>of</strong> a combination <strong>of</strong><br />
factors: an unfavourable economic<br />
situation, a very low level <strong>of</strong> reading<br />
and little public inclination<br />
Ne<strong>the</strong>rlands towards cultural consumption Portugal in<br />
general.<br />
Since <strong>the</strong> end <strong>of</strong> <strong>the</strong> 1990s, <strong>the</strong> publishing<br />
sector in Italy seems to have experienced<br />
slight growth. However, it is still marked by<br />
uncertainty and stagnation. This is partly<br />
due to low cultural consumption, which<br />
means that <strong>the</strong> level <strong>of</strong> book reading among<br />
Italians is one <strong>of</strong> <strong>the</strong> lowest<br />
Cyprus<br />
in Europe.<br />

Data on total production (53 000 titles<br />
published and 254 million copies sold in<br />
2003) are comparable to <strong>the</strong> averages <strong>of</strong> <strong>the</strong><br />
o<strong>the</strong>r main <strong>European</strong> publishing industries,<br />
and confirm <strong>the</strong> tendency towards growth<br />
(2 % annually, 1995–2003). These data are<br />
an important indicator <strong>of</strong> <strong>the</strong> publishing<br />

sector’s reaction to variable demand. Faced<br />
with ever more demanding readers and <strong>the</strong><br />
fragmentation <strong>of</strong> <strong>the</strong>ir tastes, <strong>the</strong> market<br />
responds with an ever increasing range <strong>of</strong><br />
titles, new publishing houses and a growing<br />
number <strong>of</strong> relationships with international<br />
partners.<br />

Still, Italy is in third last position <strong>of</strong> <strong>the</strong><br />

published, ahead <strong>of</strong> only Greece and<br />
Portugal. Italy’s average <strong>of</strong> 0.95 titles per<br />
1 000 people is lower than <strong>the</strong> averages <strong>of</strong><br />
France, Germany, Finland, Sweden, Spain<br />
and <strong>the</strong> United Kingdom (although any<br />
comparison with UK or Spanish publishers<br />
is difficult given that <strong>the</strong>y enjoy <strong>the</strong> benefits<br />
<strong>of</strong> working with languages that are widely<br />

manuals, atlases, art books, etc; 10 % is<br />
made up <strong>of</strong> textbooks (a percentage which<br />
has generally remained stable, although<br />
it has recently been in decline due to <strong>the</strong><br />
period <strong>of</strong> adjustment following <strong>the</strong> reform<br />
<strong>of</strong> <strong>the</strong> education system); and <strong>the</strong> remaining<br />
8 % is made up <strong>of</strong> literature for children and<br />
adolescents.<br />

Italians and reading<br />
In Italy, only 42 % <strong>of</strong> <strong>the</strong> total population are<br />
readers ( 1 ). This ranks Italy among <strong>the</strong> lowest<br />
in Europe.<br />
When asked why <strong>the</strong>y didn’t read, <strong>the</strong><br />
majority <strong>of</strong> Italians answered as follows<br />

› lack <strong>of</strong> interest: 44.4 %;<br />
› lack <strong>of</strong> time: 28.1 %;<br />
› being too tired after work: 13.3 %;<br />
› health reasons: 16.4 %.<br />
Statistics on reading have remained almost<br />
totally unchanged since <strong>the</strong> 1990s and<br />
reveal <strong>the</strong> following features.<br />

than text books) in <strong>the</strong> previous 12 months.
› Women read more than men: 46.7 % <strong>of</strong><br />
women as against 35.8 % <strong>of</strong> men; even <strong>the</strong><br />
commercial phenomenon <strong>of</strong> books being<br />
sold toge<strong>the</strong>r with newspapers has not<br />
reversed this trend.<br />
› Young people read more than adults: <strong>the</strong><br />
tendency to read declines as people get<br />
older.<br />
› Differences between geographical areas<br />
persist: readers represent 48–50 % <strong>of</strong> <strong>the</strong><br />
population in <strong>the</strong> north-east and northwest<br />
and 29–32 % in <strong>the</strong> south and on <strong>the</strong><br />
islands (53 % in Trentino-Alto Adige; 28 %<br />
in Apulia and Sicily).<br />
› Reading is more popular in large urban<br />
centres: readers represent 47 % <strong>of</strong> <strong>the</strong><br />
population <strong>of</strong> large metropolitan areas,<br />
but only 38–39 % in centres <strong>of</strong> less than<br />
50 000 inhabitants.<br />
Italians and newspapers<br />
The newspaper sector — which, toge<strong>the</strong>r<br />
with magazines, is <strong>the</strong> most important<br />
<strong>of</strong> <strong>the</strong> industry — is not immune to<br />
<strong>the</strong> effects <strong>of</strong> <strong>the</strong> low level <strong>of</strong> reading.<br />
Moreover, newspaper publishers have to<br />
cope with uncertain advertising revenue<br />
(which is dependent on <strong>the</strong> state <strong>of</strong> <strong>the</strong><br />
economy), a low level <strong>of</strong> subscribers (15 %),<br />
<strong>the</strong> dominance <strong>of</strong> television and <strong>the</strong><br />
competition posed by <strong>the</strong> Internet.<br />
In Italy, around 100 newspapers are sold per<br />
1 000 people. This statistic is worrying when<br />
compared with levels in o<strong>the</strong>r countries:<br />
for example, in <strong>the</strong> United Kingdom 317<br />
newspapers are sold per 1 000 people, while<br />
<strong>the</strong> figure in Germany is 289. Newspapers<br />
are also much more widely read in new<br />
Member States such as Slovenia, Lithuania,<br />
Hungary, Slovakia and Poland.<br />
Approximately 40 % <strong>of</strong> Italians regularly read<br />
newspapers. Levels <strong>of</strong> newspaper reading<br />
increase with education levels (62 % <strong>of</strong><br />
university graduates are newspaper readers<br />
as against 27 % <strong>of</strong> those who have only<br />
completed primary school). Fur<strong>the</strong>rmore,<br />
unlike books, newspaper reading is still a<br />
predominantly male habit (51 % <strong>of</strong> men as<br />

against 30 % <strong>of</strong> women). On <strong>the</strong> o<strong>the</strong>r hand,<br />
weekly and monthly magazines are much<br />
more widely read by women.<br />
Newspapers and books<br />
44 % <strong>of</strong> Italians do not read<br />
because <strong>of</strong> a lack <strong>of</strong> interest<br />
Italians still buy most <strong>of</strong> <strong>the</strong>ir books in<br />
bookshops, although it is becoming<br />
increasingly popular to buy <strong>the</strong>m in large<br />
retail stores or online.<br />
Since 2002, on <strong>the</strong> initiative <strong>of</strong> Corriere<br />
della Sera and La Repubblica, <strong>the</strong> sale <strong>of</strong><br />
books toge<strong>the</strong>r with newspapers has been<br />
so successful that it has contributed to<br />
restoring <strong>the</strong> economic health <strong>of</strong> many<br />
publishing groups and has considerably<br />
increased sales in news-stands. On <strong>the</strong> o<strong>the</strong>r<br />
hand, this phenomenon has not increased<br />
<strong>the</strong> number <strong>of</strong> readers but, ra<strong>the</strong>r, has led<br />
regular readers to buy books sold toge<strong>the</strong>r<br />
with newspapers.<br />
The large number <strong>of</strong> books sold toge<strong>the</strong>r<br />
with newspapers (62 million copies in<br />
2003 and an estimate <strong>of</strong> 70 million copies<br />
in 2004) is evidence that <strong>the</strong> newspaper<br />
has an extraordinary multiplier effect for<br />
its capacity to influence <strong>the</strong> public to buy<br />
books.<br />
These figures should encourage those who<br />
mistakenly believe that printed information<br />
is today overcome by new technology to<br />
reconsider <strong>the</strong>ir views.<br />

Besides, news-stands enjoy a number <strong>of</strong><br />
important competitive advantages over<br />
traditional sales channels.<br />
› Newspapers, <strong>the</strong> popular media par<br />
excellence, require little promotional<br />
spending.<br />
› Consumers unconsciously perceive a<br />
saving on products bought in newsstands<br />
as compared to those bought in<br />
traditional shops.<br />
› The number <strong>of</strong> news-stands (38 000) is<br />
greater than <strong>the</strong> number <strong>of</strong> bookshops<br />
(2 000).<br />
Newspapers<br />
There are around 177 daily newspapers in Italy. Most <strong>of</strong> <strong>the</strong>m, including <strong>the</strong> main titles, are<br />
concentrated in a small number <strong>of</strong> publishing groups.<br />
› The RCS group owns <strong>the</strong> major Italian dailies, <strong>the</strong> Corriere della Sera and La Gazzetta dello Sport.<br />
› The Editoriale l’Espresso is one <strong>of</strong> <strong>the</strong> leading media groups. It publishes La Repubblica and<br />
L’Espresso.<br />
› The Fiat Group publishes La Stampa.<br />
› The Monti-Riffeser (Poligrafici Editoriale), groups, under <strong>the</strong> brand ‘QN Quotidiano Nazionale’,<br />
three newspapers with <strong>the</strong> oldest traditions: La Nazione, Il Resto del Carlino and Il Giorno.<br />
› The Caltagirone Group owns Rome’s daily Il Messaggero and Naples’ Il Mattino.<br />
› The Mondadori Group publishes Il Giornale. Marina Berlusconi is <strong>the</strong> current chairman.<br />
Italy does not have tabloid daily newspapers. This is mainly due to <strong>the</strong> existence <strong>of</strong> a successful<br />
weekly press <strong>of</strong> popular character. The most popular dailies in Italy are definitely <strong>the</strong> sporting<br />
papers, vis-à vis <strong>the</strong> remaining types which are more like <strong>the</strong> so-called quality papers.<br />
Main national and supra-regional daily newspapers<br />
Corriere della Sera, founded in 1876, is <strong>the</strong> most widely read daily newspaper in this<br />
category. It is complemented by regional editions.<br />

i.e. bestsellers or classics, thus reducing<br />
to a minimum <strong>the</strong> risk <strong>of</strong> <strong>the</strong>ir remaining<br />
unsold.<br />
It should be noted that, in Italy, unlike<br />
in o<strong>the</strong>r countries, <strong>the</strong> majority <strong>of</strong> <strong>the</strong><br />
advertising market is held by television<br />
(54 % in Italy as against 23 % in <strong>the</strong> USA) and<br />
not by newspapers and magazines.<br />

Government policies<br />
In 2001, a new law (Law No 62 <strong>of</strong> 7 March<br />
2001) was introduced, laying down<br />
regulations to protect <strong>the</strong> newspaper<br />
and magazine publishing sector. These<br />
included <strong>the</strong> setting up <strong>of</strong> a fund to grant<br />
subsidies for loan interest and a fund for<br />
<strong>the</strong> promotion <strong>of</strong> books and publishing<br />
products <strong>of</strong> high cultural value. But <strong>the</strong>se<br />
funds were never put in place.<br />
Article 11 <strong>of</strong> <strong>the</strong> law provides for <strong>the</strong><br />
regulation <strong>of</strong> sales prices in Italy, setting<br />
a maximum possible discount <strong>of</strong> 15 %<br />
on publishers’ recommended prices. The<br />
principle <strong>of</strong> fixed book prices maintains<br />
stability in cover prices, limits discounts<br />
and ensures that book prices are set<br />
by publishers or importers. There are<br />
exceptions to this principle for a number <strong>of</strong><br />
categories including books for bibliophiles,<br />
art books, books sold online and secondhand<br />
books.<br />
This provision brought Italy into line with<br />
<strong>the</strong> legislation in force in <strong>the</strong> majority <strong>of</strong><br />
EU countries. Countries which have no real<br />
price regulation system have much higher<br />
average prices, alongside discounts which<br />
can reach 50 % (see table, p. 22).<br />
This law has had positive effects,<br />
particularly in relation to distribution and<br />
price containment. Boosted by a more<br />
stable and regulated market, bookshops<br />
have modernised greatly with regard to<br />
diversification <strong>of</strong> <strong>the</strong> range <strong>of</strong> products<br />
<strong>of</strong>fered, management, logistics and<br />
technology. The negative trend for sales in<br />
bookshops which characterised <strong>the</strong> 1990s<br />
as a result <strong>of</strong> strong competition from large<br />
retailers has been reversed. Consumers now<br />
have a wider range to choose from.<br />
The law has also contributed to stabilising<br />
cover prices, which have increased on<br />
average at a rate lower than general<br />
inflation. The average price <strong>of</strong> books in<br />
Italy is well below <strong>the</strong> <strong>European</strong> average.<br />
According to 2002 data, <strong>the</strong> average price<br />
was EUR 18.52 (source: Istat 2003), an<br />
increase <strong>of</strong> 1.3 % compared with previous<br />
years.<br />

houses and <strong>the</strong> establishment <strong>of</strong> new<br />
publishing houses.<br />
The presence <strong>of</strong> foreign companies in <strong>the</strong><br />
Italian market can be seen in various sectors.<br />
For example, McGraw-Hill, Pearson and<br />
Oxford University Press are present in <strong>the</strong><br />
textbook sector; in <strong>the</strong> legal–pr<strong>of</strong>essional<br />
field, Wolters Kluwer controls 100 % <strong>of</strong> Ipsoa,<br />
Cedam, Utet and De Agostini Pr<strong>of</strong>essionale,<br />
and Reed Elsevier owns 40 % <strong>of</strong> Giuffré; in<br />
<strong>the</strong> area <strong>of</strong> romantic fiction, Mondadori<br />
cooperates with <strong>the</strong> Canadian firm<br />
Harlequin; in e-commerce, Mondadori and<br />
Bertelsmann are partners, etc. In <strong>the</strong> area <strong>of</strong><br />
distribution, <strong>the</strong> Coin group and <strong>the</strong> French<br />
company FNAC have cooperated to form a<br />
chain <strong>of</strong> five megastores.<br />
Sales <strong>of</strong> Italian books abroad represent 5 %<br />
<strong>of</strong> <strong>the</strong> sector’s total turnover. The majority<br />
<strong>of</strong> exports (72.4 %) are to <strong>European</strong> <strong>Union</strong><br />
countries. However, purchases <strong>of</strong> foreign<br />
rights by <strong>the</strong> Italian purchasing sector exceed<br />
sales <strong>of</strong> Italian rights abroad. Although UK and<br />
North American books make up <strong>the</strong> majority<br />
<strong>of</strong> imports (67 % in 2003), Italian exports to<br />
<strong>the</strong> UK and <strong>the</strong> USA are only 8 %. Central<br />
<strong>European</strong> countries are becoming more<br />

Capital 2006 by <strong>the</strong> Unesco selection<br />
committee because <strong>of</strong> <strong>the</strong> excellence<br />
<strong>of</strong> its programme submitted in<br />
collaboration with <strong>the</strong> city <strong>of</strong> Rome.<br />
Internationalisation <strong>of</strong> <strong>the</strong> Italian<br />
publishing market<br />
Globalisation has had a major influence<br />
on <strong>the</strong> publishing market by means <strong>of</strong> a<br />
significant opening up <strong>of</strong> <strong>the</strong> market to<br />
foreign books and constant growth in<br />
<strong>the</strong> number <strong>of</strong> books co‐published and<br />
co‐produced with national and international<br />
partners.<br />
The proportion <strong>of</strong> translated books<br />
constantly increased throughout <strong>the</strong> 1990s.<br />
One in four books is translated, with by far<br />
Toge<strong>the</strong>r, <strong>the</strong>y created a strong synergy<br />
among all sectors <strong>of</strong> <strong>the</strong> book production<br />
chain, including a number <strong>of</strong> aspects <strong>of</strong><br />
book promotion and reading (for more<br />
information see p. 22).<br />
<strong>the</strong> most commonly translated language<br />
being English, followed by French and<br />
German. Translations from o<strong>the</strong>r languages<br />
such as Slavonic languages are increasing<br />
rapidly — <strong>of</strong>ten for little-known literature<br />
and authors that create particular interest.<br />
The main Italian publishing groups have<br />
entered into agreements with foreign<br />
groups, from Europe and <strong>the</strong> rest <strong>of</strong> <strong>the</strong><br />
world, to increase <strong>the</strong>ir presence abroad.<br />
At <strong>the</strong> same time, <strong>the</strong> presence <strong>of</strong> foreign<br />
publishing groups in Italy has increased,<br />
through acquisitions <strong>of</strong> Italian publishing<br />

Publishing exports are greatly affected<br />
by <strong>the</strong> fact that <strong>the</strong> Italian language is<br />
not widely spoken throughout <strong>the</strong> world.<br />
According to an approximate estimate by<br />
<strong>the</strong> AIRE (Anagrafe degli Italiani residenti<br />
all’Estero — Italian Registry <strong>of</strong> Residents<br />
Government initiatives<br />
Abroad), <strong>the</strong> number <strong>of</strong> Italians living<br />
abroad is around 4 million, while <strong>the</strong>re are<br />
approximately 60 million people <strong>of</strong> Italian<br />
origin. This is a potentially important market,<br />
though unfortunately 70 % <strong>of</strong> those <strong>of</strong><br />
Italian origin cannot speak or never use <strong>the</strong><br />
language.<br />
The Ministry <strong>of</strong> Culture (Department IV) is responsible for policies promoting books and reading.<br />
In addition to <strong>the</strong> responsibilities and initiatives <strong>of</strong> <strong>the</strong> central government, regional and local<br />
administrations have an ever increasing number <strong>of</strong> duties following <strong>the</strong> revision <strong>of</strong> Title V <strong>of</strong> <strong>the</strong><br />
Constitution. In particular, <strong>the</strong>re are provisions for <strong>the</strong> following initiatives.<br />
PROMOTION OF READING<br />
La Settimana della lettura (Reading week)<br />
An opportunity for pupils at upper secondary schools in Rome to get to know writers and<br />
<strong>the</strong>ir books at <strong>the</strong> ‘Più libri più liberi’ (More books, more freedom) event, which is based on a<br />
different <strong>the</strong>me each year.<br />

A programme <strong>of</strong> readings, exhibitions and conferences tracing <strong>the</strong> geographical history <strong>of</strong><br />

World Book and<br />
Copyright Day,<br />
23 April<br />
In 1996, UNESCO launched <strong>the</strong> celebration <strong>of</strong> this day<br />
throughout <strong>the</strong> world with <strong>the</strong> aim to promote reading,<br />
publishing and <strong>the</strong> protection <strong>of</strong> intellectual property<br />
through copyright.<br />
The choice <strong>of</strong> <strong>the</strong> date was not accidental. The idea for this<br />
celebration originated in Catalonia where on 23 April, Saint<br />
George’s Day, a rose is traditionally given as a gift for each<br />
book sold. Moreover, 23 April is a symbolic date for world<br />
literature for on this date and in <strong>the</strong> same year <strong>of</strong> 1616,<br />
Cervantes, Shakespeare and Inca Garcilaso de la Vega all<br />
died. It is also <strong>the</strong> date <strong>of</strong> birth or death <strong>of</strong> o<strong>the</strong>r prominent<br />
authors such as Maurice Druon, Halldór Kiljan Laxness,<br />
Vladimir Nabokov, Josep Pla and Manuel Mejía Vallejo.<br />
World Book<br />
Capital City<br />
The World Book Capital City was launched by UNESCO six<br />
years later, following <strong>the</strong> positive experience <strong>of</strong> <strong>the</strong> World<br />
Book and Copyright Day, and Madrid was nominated <strong>the</strong><br />
capital for 2001.<br />
The award is given for <strong>the</strong> programme considered <strong>the</strong> best,<br />
dedicated to books and reading, between one World Book<br />
and Copyright Day (23 April) and <strong>the</strong> next. The winner<br />
does not gain any financial prize but <strong>the</strong> award has a high<br />
prestige value.<br />

<strong>Forum</strong> meetings<br />
› A meeting with <strong>the</strong> Italian members <strong>of</strong><br />
<strong>the</strong> <strong>Forum</strong> took place in Rome, on 23 June<br />
2005, at Eurispes Institute’s premises. It is<br />
<strong>the</strong> first time that a <strong>Forum</strong> meeting was<br />
held outside Brussels or Luxembourg.<br />
On this occasion, those Italian publishers<br />
present had <strong>the</strong> opportunity to ask<br />
questions about <strong>the</strong> <strong>Forum</strong> initiative,<br />

Booklet<br />
A new edition <strong>of</strong> <strong>the</strong> Booklet, presenting general information on <strong>the</strong><br />
<strong>Forum</strong>’s objectives, activities and <strong>the</strong> new licence framework, will<br />
be available at <strong>the</strong> stand <strong>of</strong> <strong>the</strong> Office for Official Publications <strong>of</strong> <strong>the</strong><br />
<strong>European</strong> Communities at <strong>the</strong> Frankfurt Bookfair (M 905 – Hall 8)<br />
The 2005 edition <strong>of</strong> <strong>the</strong> <strong>Forum</strong> catalogue<br />
