Electi<strong>on</strong>s 2011<br />

In 2011, during its tenth sessi<strong>on</strong>, <strong>the</strong> ASP will hold electi<strong>on</strong>s<br />

for six judges and <strong>the</strong> Chief Prosecutor. In additi<strong>on</strong>, <strong>the</strong> ASP<br />

will elect six new members to <strong>the</strong> Committee <strong>on</strong> Budget<br />

and Finance (CBF). These electi<strong>on</strong>s come at a crucial time in<br />

<strong>the</strong> Court’s development. The ICC’s sec<strong>on</strong>d Chief Prosecutor<br />

will inherit active investigati<strong>on</strong>s in seven Situati<strong>on</strong>s, a<br />

full caseload, and <strong>the</strong> <strong>on</strong>going work of developing <strong>the</strong><br />

investigative and trial practices of <strong>the</strong> world’s first permanent<br />

internati<strong>on</strong>al criminal court. The new Chief Prosecutor will<br />

also be <strong>the</strong> public face of <strong>the</strong> Court’s investigati<strong>on</strong>s and<br />

prosecuti<strong>on</strong>s, and as such will be looked to by victims, <strong>the</strong><br />

general public, and <strong>the</strong> diplomatic community to represent<br />

<strong>the</strong> highest levels of professi<strong>on</strong>alism, competence and pers<strong>on</strong>al<br />

and professi<strong>on</strong>al integrity. The six judges who are elected<br />

in 2011 will be joining active Pre-Trial, Trial, and Appeals<br />

Chambers which are charged with making important decisi<strong>on</strong>s<br />

about investigati<strong>on</strong>s and arrest warrants, managing complex<br />

criminal trials, c<strong>on</strong>tending with a dynamic and evolving body<br />

of law, and delivering solid and well-reas<strong>on</strong>ed decisi<strong>on</strong>s.<br />

The processes for nominati<strong>on</strong> and electi<strong>on</strong> of <strong>the</strong>se important positi<strong>on</strong>s are set<br />

out in <strong>the</strong> Rome Statute and fur<strong>the</strong>r elaborated by <strong>the</strong> ASP as described below.<br />

While <strong>the</strong> formal electi<strong>on</strong>s will take place at <strong>the</strong> ASP’s tenth sessi<strong>on</strong>, in fact many<br />

of <strong>the</strong> most important decisi<strong>on</strong>s and selecti<strong>on</strong> processes will have taken place prior<br />

to <strong>the</strong> ASP itself. In respect of <strong>the</strong> Prosecutor positi<strong>on</strong>, a Search Committee has<br />

been c<strong>on</strong>vened for <strong>the</strong> selecti<strong>on</strong> process and to assist with <strong>the</strong> identificati<strong>on</strong> of a<br />

c<strong>on</strong>sensus candidate for electi<strong>on</strong> at <strong>the</strong> ASP meeting. With respect to <strong>the</strong> judges, as<br />

of <strong>the</strong> closing date of <strong>the</strong> nominati<strong>on</strong> period of 16 September 2011, 19 candidates<br />

had been nominated, <strong>on</strong>ly two of whom are female; two of <strong>the</strong> candidates are from<br />

WEOG, five from GRULAC, two from Eastern European States, eight from African<br />

States and two from Asian States.<br />
