Trial Proceedings<br />

In 2011, <strong>the</strong> ICC had three <strong>on</strong>going trial proceedings, two<br />

in <strong>the</strong> DRC Situati<strong>on</strong> and <strong>on</strong>e in <strong>the</strong> CAR Situati<strong>on</strong>. The first,<br />

against Thomas Lubanga Dyilo, began in January 2009 and<br />

c<strong>on</strong>cluded in August 2011. The sec<strong>on</strong>d, against Germain<br />

Katanga and Mathieu Ngudjolo Chui, began in November<br />

2009. The third, against Jean-Pierre Bemba Gombo began in<br />

November 2010. Developments in all three trials are covered<br />

in detail in this secti<strong>on</strong>.<br />

Specifically, this secti<strong>on</strong> analyses in detail <strong>the</strong> closing arguments in <strong>the</strong> Lubanga<br />

case, which took place in August 2011, and provides a detailed account of <strong>the</strong><br />

closing statements made by <strong>the</strong> Prosecuti<strong>on</strong>, <strong>the</strong> Legal Representative of Victims<br />

and <strong>the</strong> Defence. It also explores <strong>the</strong> issue of a potential breach of Article 70<br />

regarding offenses against <strong>the</strong> administrati<strong>on</strong> of justice. Finally, it extensively<br />

covers <strong>the</strong> issues related to <strong>the</strong> Defence abuse of process filing that built <strong>on</strong><br />

issues related to <strong>the</strong> Prosecuti<strong>on</strong>’s use of intermediaries, which led to a stay of<br />

proceedings in 2010.<br />

With respect to <strong>the</strong> Katanga & Ngudjolo case, this secti<strong>on</strong> presents an account<br />

of <strong>the</strong> final witnesses who testified for <strong>the</strong> Prosecuti<strong>on</strong> and provides an analysis<br />

of <strong>the</strong> Defence cases to date. For <strong>the</strong> first time before <strong>the</strong> ICC, in <strong>the</strong> case against<br />

Katanga & Ngudjolo, both accused will take <strong>the</strong> stand. This secti<strong>on</strong> includes an<br />

account of <strong>the</strong> testim<strong>on</strong>y of Katanga, <strong>the</strong> first accused to testify, as of <strong>the</strong> writing<br />

of this <str<strong>on</strong>g>Report</str<strong>on</strong>g>.<br />

The secti<strong>on</strong> <strong>on</strong> <strong>the</strong> Bemba case reviews <strong>the</strong> commencement of <strong>the</strong> trial from <strong>the</strong><br />

opening statements through <strong>the</strong> testim<strong>on</strong>y of Prosecuti<strong>on</strong> witnesses through 16<br />

September 2011. The secti<strong>on</strong> includes detailed summaries of <strong>the</strong> twelve crimebased<br />

witnesses called by <strong>the</strong> Prosecuti<strong>on</strong> to substantiate charges of rape.<br />

Lastly, this secti<strong>on</strong> includes a review of <strong>the</strong> use of in-pers<strong>on</strong> testim<strong>on</strong>y in ICC<br />

proceedings in light of <strong>the</strong> recent Appeals Chamber affirmati<strong>on</strong> of <strong>the</strong> principle<br />

of orality.<br />
