Modalities for c<strong>on</strong>tacting potential witnesses<br />

Following <strong>the</strong> decisi<strong>on</strong> <strong>on</strong> <strong>the</strong> 23 March Defence<br />

request for a variati<strong>on</strong> of <strong>the</strong> Summ<strong>on</strong>s c<strong>on</strong>diti<strong>on</strong>s in<br />

<strong>the</strong> Muthaura et al case, <strong>on</strong> 6 April 2011 Single Judge<br />

Trendafilova issued an identical decisi<strong>on</strong> in <strong>the</strong> case of<br />

Ruto et al, adopting <strong>the</strong> same interpretati<strong>on</strong> of <strong>the</strong> first<br />

c<strong>on</strong>diti<strong>on</strong> set out in <strong>the</strong> Summ<strong>on</strong>s. 2129 The Single Judge<br />

noted that by virtue of benefiting from all ‘minimum<br />

guarantees’ under Article 67, <strong>the</strong> Defence ‘may<br />

approach, in principle, any pers<strong>on</strong> willing to give his or<br />

her account of <strong>the</strong> events in relati<strong>on</strong> to this case’. 2130<br />

However, she emphasised that <strong>the</strong> VWU must be timely<br />

notified of any such c<strong>on</strong>tact, and must be c<strong>on</strong>sulted<br />

about whe<strong>the</strong>r or not this would put <strong>the</strong> pers<strong>on</strong> at risk<br />

and/or which security arrangements would need to be<br />

made. In <strong>the</strong> case a security risk arises, <strong>the</strong> VWU must<br />

notify <strong>the</strong> Single Judge immediately.<br />

Chamber to review its holding that <strong>the</strong> Defence’s<br />

c<strong>on</strong>tact with potential witnesses should be arranged<br />

in cooperati<strong>on</strong> with <strong>the</strong> VWU. The Defence postulated<br />

that <strong>the</strong> decisi<strong>on</strong> may prevent Defence counsel from<br />

c<strong>on</strong>tacting potential witnesses and thus has <strong>the</strong><br />

potential to create obstacles to <strong>the</strong> preparati<strong>on</strong> of <strong>the</strong><br />

defence. 2133 The Defence also requested <strong>the</strong> Chamber<br />

to reiterate that <strong>the</strong>se c<strong>on</strong>diti<strong>on</strong>s apply to all parties<br />

c<strong>on</strong>cerned, including to <strong>the</strong> Prosecuti<strong>on</strong>. The Defence<br />

request was rejected in a decisi<strong>on</strong> <strong>on</strong> 12 May 2011.<br />

The Chamber held that ‘<strong>the</strong> established modalities<br />

of Defence c<strong>on</strong>tact with witnesses equally ensure<br />

<strong>on</strong> <strong>the</strong> <strong>on</strong>e hand <strong>the</strong> protecti<strong>on</strong> of witnesses, victims<br />

and o<strong>the</strong>r pers<strong>on</strong>s at risk and, <strong>on</strong> <strong>the</strong> o<strong>the</strong>r hand, <strong>the</strong><br />

respect for <strong>the</strong> rights of <strong>the</strong> suspects, in particular<br />

<strong>the</strong> right to prepare <strong>the</strong>ir defence and <strong>the</strong> right to<br />

liberty’. 2134 As <strong>the</strong> Chamber found that <strong>the</strong> issues did<br />

not c<strong>on</strong>stitute ‘appealable issues’, <strong>the</strong> Defence request<br />

for leave to appeal <strong>the</strong> Chamber’s decisi<strong>on</strong> <strong>on</strong> <strong>the</strong><br />

variati<strong>on</strong> of Summ<strong>on</strong>s c<strong>on</strong>diti<strong>on</strong>s was also rejected.<br />

On 6 April 2011, <strong>the</strong> Prosecuti<strong>on</strong> requested a fur<strong>the</strong>r<br />

four c<strong>on</strong>diti<strong>on</strong>s to be added to <strong>the</strong> Summ<strong>on</strong>ses to<br />

Appear. Specifically, it requested <strong>the</strong> Chamber to<br />

order <strong>the</strong> accused: (i) to provide <strong>the</strong> Chamber with all<br />

residential and office addresses, email addresses and<br />

teleph<strong>on</strong>e numbers; (ii) to submit complete financial<br />

informati<strong>on</strong>; (iii) to not make any public statements<br />

that c<strong>on</strong>tain or can be c<strong>on</strong>strued as c<strong>on</strong>taining<br />

an open or veiled threat to actual or prospective<br />

witnesses or victims; and, (iv) to appear in pers<strong>on</strong><br />

before <strong>the</strong> Chamber at least <strong>on</strong>ce every six m<strong>on</strong>ths<br />

and certify before <strong>the</strong> Chamber, under oath, that <strong>the</strong>y<br />

have complied in full with all <strong>the</strong> c<strong>on</strong>diti<strong>on</strong>s. 2131 This<br />

request was denied by <strong>the</strong> Chamber <strong>on</strong> 20 April 2011<br />

<strong>on</strong> <strong>the</strong> basis that <strong>the</strong>re were no substantial changes in<br />

circumstances since <strong>the</strong> issuance of <strong>the</strong> Summ<strong>on</strong>ses to<br />

warrant a change in c<strong>on</strong>diti<strong>on</strong>s. 2132<br />

Following <strong>the</strong> rejecti<strong>on</strong> of a variati<strong>on</strong> of summ<strong>on</strong>s<br />

c<strong>on</strong>diti<strong>on</strong>s <strong>on</strong> 6 April 2011, <strong>on</strong> 14 April 2011, <strong>the</strong><br />

Defence in <strong>the</strong> Ruto et al proceedings again requested<br />

<strong>the</strong> Chamber to review and vary <strong>the</strong> modalities<br />

to comply with <strong>the</strong> Summ<strong>on</strong>s c<strong>on</strong>diti<strong>on</strong>s. In <strong>the</strong><br />

alternative, <strong>the</strong> Defence requested leave to appeal<br />

<strong>the</strong> 6 April decisi<strong>on</strong> <strong>on</strong> <strong>the</strong> variati<strong>on</strong> of Summ<strong>on</strong>s<br />

c<strong>on</strong>diti<strong>on</strong>s. In particular, <strong>the</strong> Defence requested <strong>the</strong><br />
