Parental Leave within <strong>the</strong> Staff Rules<br />

ICC staff are entitled to a c<strong>on</strong>tinuous period of 16 weeks’ maternity leave with full<br />

pay; a c<strong>on</strong>tinuous period of 8 weeks’ adopti<strong>on</strong> leave with full pay; and 4 weeks of<br />

‘o<strong>the</strong>r parent leave’ with full pay in c<strong>on</strong>necti<strong>on</strong> with <strong>the</strong> birth or adopti<strong>on</strong> of <strong>the</strong> staff<br />

member’s child.<br />

A staff member seeking maternity leave must present a medical certificate stating<br />

<strong>the</strong> probable date of delivery of her child; maternity leave may commence between<br />

six and three weeks prior to <strong>the</strong> probable date of delivery. A staff member seeking<br />

adopti<strong>on</strong> leave shall inform <strong>the</strong> Registrar or <strong>the</strong> Prosecutor at least <strong>on</strong>e m<strong>on</strong>th prior to<br />

<strong>the</strong> anticipated commencement of <strong>the</strong> adopti<strong>on</strong> leave and submit <strong>the</strong> documentary<br />

proof available at that time. A staff member seeking ‘o<strong>the</strong>r parent leave’ must submit<br />

proof of <strong>the</strong> birth or adopti<strong>on</strong> of <strong>the</strong> child within three m<strong>on</strong>ths of <strong>the</strong> o<strong>the</strong>r parent<br />

leave ending.<br />

Staff are not given an orientati<strong>on</strong> <strong>on</strong> staff rules and c<strong>on</strong>diti<strong>on</strong>s including <strong>the</strong> parental<br />

leave provisi<strong>on</strong>s.<br />

Direct managers for maternity leave and o<strong>the</strong>r parent leave; Registrar or Prosecutor<br />

for adopti<strong>on</strong> leave.<br />

As adopted by <strong>the</strong> ASP 2004, ‘spouse’ is defined as a partner by marriage recognised as<br />

valid under <strong>the</strong> law of <strong>the</strong> country of nati<strong>on</strong>ality of a judge or by a legally recognised<br />

domestic partnership c<strong>on</strong>tracted by a judge under <strong>the</strong> law of <strong>the</strong> country of his or her<br />

nati<strong>on</strong>ality.<br />
