financing thereof; and that the Board of Selectmen or other appropriate local body or
official is authorized to enter into a project regulatory agreement with the Department
of Environmental Protection, to expend all funds available for the project and to take
any other action necessary to carry out the project.
ARTICLE 21. Passed by a 2/3rds vote that $3,600,000 is appropriated for the purpose
of financing the construction of general sewerage system improvements, including
without limitation all costs thereof as defined in Section 1 of Chapter 29C of the General
Laws; that to meet this appropriation the Treasurer with the approval of the Board of
Selectmen is authorized to borrow $3,600,000 and issue bonds or notes therefore under
Chapter 44 of the General Laws and/or Chapter 29C of the General Laws; that the Treasurer
with the approval of the Board of Selectmen is authorized to borrow all or a portion of such
amount from the Massachusetts Water Pollution Abatement Trust established pursuant to
Chapter 29C and in connection therewith to enter into a loan agreement and/or security
agreement with the Trust and otherwise to contract with the Trust and the Department of
Environmental Protection with respect to such loan and for any federal or state aid available
for the project or for the financing thereof; and that the Board of Selectmen or other appropriate
local body or official is authorized to enter into a project regulatory agreement with
the Department of Environmental Protection, to expend all funds available for the project
and to take any other action necessary to carry out the project.
ARTICLE 22. Passed unanimously that $2,900,000 is appropriated for DPW
Capital street reconstruction; that to meet this appropriation the Treasurer with the
approval of the Board of Selectmen is authorized to borrow $2,900,000 under Chapter
44 of the General Laws or any other action necessary to carry out this project.
ARTICLE 23. Passed by majority vote, pursuant to MGL Chapter 82A, Section
2, to authorize the Board of Selectmen to designate the board or officer to regulate
trenches as that term is defined by said law and the provisions of 520 CMR 14.00.
ARTICLE 24. Passed by majority vote to discontinue the public’s right of
access to Reservoir Road west from the intersection of the Old Dunbar Road and
Reservoir Road to the Richmond town line. A map depicting the proposed road discontinuance
is on file at the Town Clerk’s office.
ARTICLE 25. Passed unanimously to authorize the Board of Selectmen to
enter into a contract for up to twenty years with the City of Pittsfield for sewer services,
and to appropriate $400,000 from the bond proceeds approved in Article 21 for
said sewer services.
ARTICLE 26. Passed by a 2/3rds vote to authorize the Board of Selectmen to
extend the existing 10-year lease to a twenty-year lease with the Lenox Library
Association.
