advertising devices shall draw power from alternate renewable resources like solar power. To promote the use of alternative energy, advertisers and licensee of the advertising devices shall be given a rebate as determined by the Commissioner from time to time. 5. Prohibited areas and areas of special control: - The Commissioner may:- (a) by order prohibit the erection, exhibition, fixation retention or display of all or any class of advertisements in any street, road or public park or part thereof or in any place or public resort. (b) Regulate the erection, exhibition, fixation, retention or display of advertisements in any manner in the areas of the special control, in accordance with the regulations indicated in the Advertisement Zoning Plans of the said areas. 6. Restrictions in prohibited areas and areas of special control: - No person shall erect, exhibit, fix, retain or display or cause to be erected, exhibited, and fixed retained or displayed any advertisement. (i) In area of special control except in accordance with regulations indicated in the advertisement zoning plan of the said areas. Explanations: - The restrictions indicated in the advertisement zoning plans shall be in addition to those mentioned in the other clause of the byelaws. (ii) (iii) (iv) Restrictions regarding public buildings and parks :- No person shall erect, exhibit, fix, paste or retain, display or cause to be erected, exhibited, fixed, pasted, painted retained or displayed any advertisement so as to injuriously affect the amenities of public buildings or monuments or any public parks or place of pleasure or place of worship. Restrictions regarding Municipal and State Property : - Except as provided in the byelaws no person shall erect, fix, paste retain or display or cause to be erected, fixed, pasted, painted or retained or displayed an advertisement on any property vesting in the Municipal Corporation, the State/Center Govt. including bridges, water tanks, urinals, lavatories, lamp posts, trees, electric/telephones or telegraph posts signage, road surface, retaining walls, embankments, fly posters and wall paintings. Fly posters, wall posters and wall paintings: - No person shall fix paste, paint or inscribe any fly poster, wall poster or wall painting as the case may be, at any place in the city except with the written permission of the Commissioner. (v) Defacement : - No person shall deface or cause to be defaced any sign or mark or letter or words that may have been put up by the Municipal Corporation on the advertisement erected, exhibited, fixed, retained or displayed in token of there having been permitted
or approved by the Commissioner and of the fees having been collected thereon. 7. Hoarding shall not be permitted if the Commissioner is of the view that: a. Any hoarding, which is likely to be confused with an authorized traffic sign signal. b. Any hoarding erected in such manner and such places, which will cause obstruction or interference with the visibility of approaching merging or intersecting traffic. c. No hoarding shall be permitted in building of archaeological historical or heritage importance or public building. d. No hoardings shall be permitted, which is likely to obstruct the view of any building or monument of historical, archaeological, heritage importance or coming in the way of the elevation of any such building or monument. e. No hording shall be permitted which is declared dangerous (partly or fully) or has been issued with the notice under the Punjab Municipal Corporation Act, 1976. f. If it offends good taste, decency, public moral and aesthetics. g. Any hording which can distract the vehicular traffic. h. If the advertisement is not in conformity with the general building facade of the street/roads. i. If it violates the building byelaws of Municipal Corporation. j. It is against public interest. 8. (i) No advertisement projecting over any public street or place or land vested in the Municipal Corporation shall be retained, placed, put up or fixed at a height less than 8 feet or as specified in the permission and over all the advertisement projection on the public street should not more than 6 inches in thickness at right angles to its surface. (ii) No hoarding shall be permitted in the residential areas. No sign shall be attached in any way to any tree or shrubs. (iii) No trade and business sign, messages, posters or printing material of any nature shall be pasted on to any supporting column, pillar or post. No advertisement shall be permitted which obstructs any pedestrian movement, partially or wholly, fire escape, door or window openings or interferes with opening required for light and ventilation and further obstructs any fire safety transit exist space. 9. Illuminated Advertisements: - Illuminated advertisements of the following descriptions are objectionable from the angle of traffic safety and shall not be allowed: - a. Illuminated advertisement of such intensity or brilliance as to cause glare or impair vision of the driver or pedestrian or which otherwise interface with any operations of driving.
