BMW.id is
in Dispute,
Who’s to
Blame
Ownership for BMW.id
domain is in dispute. This
is due to the fact that the
ownership is controlled
by Benny Muliawan who is facing
a lawsuit filed by Bayerische
Motoren Werke AG (BMW). Benny
Muliawan was sent a subpoena
by BMW legal proxy, Suryo
Mucito. As the party who is held
responsible for domain names
allocation in Indonesia, Indonesia
Domain Name Manager (Pandi) is
ready to mediate both parties.
This was conveyed by Chairman
of Pandi for Socialization and
Communication field, Sigit
Widodo. According to Sigit, the
dispute is normal. Nevertheless
Pandi itself has prepared Domain
Name Dispute Settlement (PPND)
as the mediator of the disputing
parties. “For this apapun.id
domain, this is the first case. For
settlement, first Pandi is willing to
assist in mediation. If mediation
fails, we will offer to use PPND
procedures,” said Sigit.
According to Sigit, if PPND
procedures are followed, the
concerned parties will appoint
PPND panel members. Such
panel members are appointed by
PPND secretariat based on their
expertise and professionalism.
“They determine who are entitled
to use bmw.id domain,” he said.
Another settlement mechanism
is by filing lawsuit to the
court. However, said Sigit, if
legal procedures were used, it
would take a awhile. He gave
an example in the use of ebay.
co,id domain in which it required
2-3 years until finally Ebay
international won at the court
versus CV Ebay Indonesia.
Chronology
Pandi as the authorized party
in Indonesia domain name
has opened apapun.id domain
registration since 20 February
2014. Such registration is divided
into several periods. The first
period (Sunrise) was held from
20 February to 17 April 2014. In
such period Pandi provided the
opportunity for trade mark owners
to register apapun.id officially.
Such opportunity was used by
Benny Muliawan to obtain bmw.id
domain.
If using general initial, Benny
Muliawan supposed to be allowed
to use BM initial, however
Benny applied BMW brand in
2012, despite the rumor that
such application had not been
approved by Directorate General
of Intellectual Property. Here is
the root of the issue. Despite it
had not been approved by the
authorities, Pandi allowed such
BMW.id domain purchase, since
there had been a statement letter
of trade mark application. Such
statement letter was sufficient to
complete administration required
by Pandi. It means that bmw.id
domain purchase process could be
conducted.
Benny was reported to purchase
bmw.id domain with a total fee of
IDR20.5 million, in which the IDR15
million was for BMW.id domain
including limited domain (2-4
characters), then Sunrise period
registration fee in the amount of
IDR5 million, and administration in
the amount of IDR500 thousand.
Then the ‘original’ BMW
planned to take over the bmw.
id domain name held by Benny.
BMW sent a subpoena to Benny
on 3 December 2014. Benny
himself already responded to
BMW law office on 12 January
2015. According to BMW
Group Indonesia legal proxy,
represented by attorney office
Suryomucito & Co. the BMW.id
domain takeover was to protect
BMW global trade mark. Such
matter was also intended to
avoid confusion for customers
of bmw.id and BMW.co.id
domain have different contents.
From this case, BMW side also
hopes that the process can be
settled amicably.
Ririek would go after his name was
not listed in Telkom Board of Director
which was announced in Extraordinary
General Meeting of Shareholders. The
name Ririek disappeared together with
those of Sukardi Silalahi and Priyanto,
and replaced by the entry of Telkomsel
team, Herdy Harman and Abdus Somad
Arief. As it turned out Ririek and friends
exchanged positions from Telkom Group
holding to subsidiaries, Telkomsel.
Hence, Telkom and Telkomsel high
officers’ position change was only for
the office swap.
The interesting part of the Board
of Directors’s change is the entry of
the name Diaz Hendroprionom, son of
former head of BIN Hendropriono. Recompensation
politic emerged when
the government announced that Diaz
entered Telkomsel. That happened
because Diaz established ‘Kawan Jokowi’
to provide support when Jokowi-JK ran
for the president and vice president in
the 2014 Presidential Election.
According to State Minister of State
Owned Enterprises Rini Soemarno, the
entry of Diaz in Telkomsel array was
among others due to the involvement
of president Joko Widodo. According to
him, in the government capacity, it is
normal for the president to participate
in proposing the name of commissioner
of State Owned Enterprises, including
Diaz’s name. Nevertheless Rini denied
that Diaz’s appointment only considered
Jokowi’s proposal.
Rini said that she also considered many
factors before appointing Diaz. “We
decided to appoint Diaz due to among
others his background. There was indeed
an involvement from the government. It
involved first echelon and two technical
ministries. There were several matters
that we could not take for granted,” she
assured.
Not only Telkom and Telkomsel, PT. XL
MAIN REPORT
MAIN REPORT
XL “Locomotive” will Change in April
PT XL Axiata Tbk. (XL) held
Extraordinary General Meeting of
Shareholders (EGMS) in Jakarta
early this month. In the change of
Board of Directors composition Board
of Directors, EGMS agreed to appoint
Dian Siswarini to become a member
of Company Board of Directors. The
appointment of Dian was reported
to be not the first step since Dian
was rumored to be appointed as the
President Director of XL when EGMS will
be held this April.
This was due to the fact that the
present President Director of XL, Hasnul
Suhaemi, will enter his retirement period
this year. Hasnul himself revealed that
it was Dian who would replace him.
“Dian has participated in the training
to prepare to become Chief Executive
Officer for three years. During such time
Dian was positioned in Axiata Group,
then she went to other countries for
comparative study,” said Hasnul.
Dian herself is an XL original product,
she started her career from the bottom,
dealing with XL network planning and
design. This ITB graduate resigned
from XL last year to study and join
Axiata, the parent company. And now,
Dian has come back to XL to become
C
T
Hasnul’s representative. And let us just
wait whether in April Dian will take the
position of XL-1 or remain as Hasnul’s
representative.
Concerning the strategy in the future,
Dian said that XL would transform into
digital directed business. Therefore XL
will actively trigger digital business to
become company revenue. It is such
digital service business that XL will
be engaged in. At the present XL is
still reviewing business model which is
suitable with the company. According
to her, at least there are main business
models in digital content business,
namely as content producer, content
broker or collaborating with global
content players referred to as over
the top (OTT) such as Facebook, and
Google. And XL, said Dian, would choose
one of the three business models in its
course of digital content business in the
future.
To start this business, such company
is studying three business models. Each
to become content broker, content
producer or PT XL Axiata (XL) will
transform into digital-oriented business.
Therefore XL will actively drive digital
business to become company revenue.
It is such digital service that will be
studied by XL as conveyed by Vice
President Director of XL Axiata, Dian
Siswarini.
“We will choose one of them to run
in digital content business,” said Dian.
Since it is still on studying stage, Dian
has not been able to mention how much
the investment to be spent by XL in
digital business will be. One thing is for
sure, gradually XL business service type
will shift to digital, such as sales service,
customer or market services.
Actually, said Dian, XL has been aware
MAIN REPORT
of digital business since several years
ago. “Therefore, XL has had three
digital business such as digital financial
transaction service named XL Tunai and
also mobile banking, internet of things
business such as machine to machine,
cloud computing and online shopping
site named Elevenia,” she explained.
And from such business, Dian opines
that this business growth exceeds the
stipulated target. Nevertheless she
admitted that this digital business
margin originating from data service is
still small. “Data margin is indeed still
small, only half of the conventional
business,” she said. For such reason
XL also does not have the courage
to stipulate digital business revenue
aggressively in a short period.” This is a
general matter, [we] experience loss in
the early year,” she said.
To cause the margin to increase, XL
has three methods: expenditure charge
efficiency, data service sales tariff
increase and increase of XL customer
data service traffic volume.
Its Commissioner Becomes a
Minister, Indosat Held EGMS
PT Indosat Tbk plans to hold
Extraordnary General Meeting of
Shareholders on 28 January. This
EGMS is rumored to have the agenda
of the change of Board of Commissioners
composition of such Ooredo subsidiary.
In addition to Commissioner, the latest
development says there will be change of
Board of Directors composition.
From the array of Commissioners,
with the appointment of Rudiantara to
become Minister of Communication and
Informatics, as well as Rachmat Gobel to
become Minister of Trade, this position is
vacant and will be filled by new figures.
In addition to become Ministers, another
commissioner of Indosat, Rionald Silaban
will represent Indonesia to sit in the World
Bank.
It has not been clarified who will enter,
however based on what is seen what
have happened to Telkomsel and Telkom,
it is possible that these positions will be
filled by representatives from Jokowi-JK
supporting parties. It is also possible that
they will be from Success Team, such
as Diaz Hendropriyono who established
Kawan Jokowi who will be positioned as
Commissioner in Telkomsel.
In addition to Commissioner position, it is
also rumored that there will be evaluation
towards Indosat President and CEO
Alexander Rusli. Rumor has it that Ooredo
is still not satisfied with Alex performance
since Indosat position is not superseded
by PT XL Axiata and company finance has
continued to suffer loss for the past two
years. However, Alex’s closeness with the
government causes it to look like a rushed
decision to release this former Special
Staff of State Minister of State Owned
enterprises and Minister of Communication
and Informatics when Sofyan Djalil was the
Minister.
In the array of Board of Directors the
name Indar Atmano will also be released
and replaced by a new figure. In addition,
the Republic of Indonesia government
representation who will hold the position
of Board of Directors, Director and Chief
Wholesale & Office of Company Fadzri
Sentosa is also being evaluated. Moreover,
Fadzri has held this position for quite a
while, since June 2007.
MoboMarket released a report
on Android smartphone use in
Indonesia. The report entitled
“Q4/2014 Indonesia Mobile
Data Report , Based on MoboMarket
Users Data Research” was composed
based on the result of MoboMarket
research on its users habit in Indonesia
in the fourth quarter (Q4) in 2014.
MoboMarket is a special Android
application store developed by Baidu,
an internet and application development
company from China. MoboMarket was
introduced in February 2014 and up to
December 2014 it has attracted 2.88
million monthly active users in Indonesia.
Present as alternative application
store for Android users in Indonesia,
MoboMarket has had 517,000
applications more than 1,000 of which
are applications from Indonesia. Out of
all applications MoboMarket recorded
a total of 265 million application
distributions which have been used by
its users during the fourth quarter of
2014.
In this research MoboMatket found
that games are the most downloaded
application by users, namely in the
amount of 43%.
After games, the favorite application
downloaded is social media (12%) and
picture application (11%).
The type of game that is mostly
downloaded is casual game, namely in
the amount of 16%. The other types of
game liked by users are arcade genre
game (16%), racing (12%), action
(11%) and sport game (7%).
Despite being the most downloaded
game downloaded by users, in terms
of update, game is the least updated
application namely only in the amount of
12%. This shows that games use short
time span.
“Meanwhile the number of social
applications such as Facebook,
BlackBerry Messenger and Line have the
most portion, namely in the amount of
39%. This shows that the majority of
users need social application for long
period of time. Also from this research
MoboMarket found that most users
install 3 to 4 social applications on their
cellular phones.
Most Android users who access
MoboMarket in Indonesia, namely
in the amount of 31.89% use
smartphone in the size of 4
inches with screen resolution
of 800x480 pixel.
Such cellular phone’s size
and screen resolution
are quite small
compared to
the cellular phone’s size and screen
resolution of cellular phones which are
used mostly by MoboMarket in China.
Most cellular phones used in China are
larger than 4 inches with resolution of
1280 x 720 pixel.
Most users start to access their cellular
phones from 17:00 Western Indonesian
Time and reach its first access peak at
20:00 Western Indonesian Time, at that
time they are resting after work.
Nevertheless beyond expectation, the
peak is in the middle of the night from
23:00 – 24:00 Western Indonesian
Time. This shows that most users are
used to playing games on their cellular
phones before bedtime. This access
time reaches its lowest point at 03:00
Western Indonesian Time.
“Through this report we intend to
provide knowledge on the trend and
mobile market situation in Indonesia.
We expect that this information
can be useful for internet mobile
industry industrial actors, particularly
application developers, in studying
and understanding mobile users’
characteristics in this country. For
supporters of internet mobile
ecosystem development in
Indonesia, we also plan to
release this report regularly
each quarter,” said Bao
Using taxi is one of lifestyles of
city community. Unfortunately
when calling a taxi on the side
of the road not all taxis can be
trusted in taking us to destinations.
Sometimes, we do not check whether
the driver is the same as the ID in the
taxi. Due to some horrible incidents that
happened to taxi passengers, GrabTaxi
had a campaign for save taxi rides.
At this time GrabTaxi is one of the
solutions to call taxis without having to
do so on the side of the road. Kiki Rizki
as Head of Marketing GrabTaxi Indonesia
said GrabTaxi could promise the ordered
taxi through an application, they will
be far safer than if they pick up taxis
directly on the side of the road.
One of the reasons of this is because
taxi number and driver’s name as well as
his/her photographs directly appear on
such application when ordering a taxi.
Users can also find out where the taxi is

Even during the ride users can share
their journeys by using the “Share Ride”
Grab Taxi has been equipped with GPS.
To be safer, GrabTaxi conducts tight
Meanwhile, the difficulties in distance
transportation which can cover small roads
as well as overcoming Jakarta’s traffic causes
motor transportation two-wheel cab (ojeg) to
be an option. However, sometimes obtaining
ojeg is not easy. We do not know where the
ojegs are , or on the contrary we see ojegs
when we do not need them. To answer this
challenge Go-Jek application is present.
This application developed by PT Go_Jek
Indonesia attempts to make ojeg in Jakarta
to be more organized. The efforts sought
are by presenting mobile application which
can be used by users with Android or iOS
operating systems device basis.
At least at this time there are about a
thousand ojeg riders in Jakarta that have
been organized, in order to be more trusted
and easy to access. However according
to Nadiem Makarim, Chief Executive Ojek
Go-Jek, this application is made since now
people are using smartphones. “We want
people to be able to get ojeg easier, the
existing ones are market inefficiency. When
we need ojeg there isn’t any, when we don’t
need them there are a lot of them on the
side of the road,” he said
And this application succeeded in obtaining
responses. Nadiem claimed that Go-Jek
application has favorable responses from
the people, as evidenced by thousands of
people who have downloaded this application.
“Now there have been a total of 15 thousand
download on Apple App Store and Google
Play,” said Nadiem delightedly.
He expected that the presence of Go-
Jek application can assist ojeg riders as its
partners to be easier in obtaining customers.
Go-Jek at this time provides three types
of service in its application, namely inter
passenger ojek, inter package ojek, and
shopping order with a maximum order
amount of IDR1 million. “This application
will not be effective until 2 weeks later
however 25% of orders have come from the
application,” he said.
Cawidu said that pursuant to provisions
contained in article 71 paragraph (1)
of Government Regulation Number 52
of 2000 regarding Telecommunication
Organizing, it is mentioned that each
telecommunication equipment and
device used, assembled, installed to
be traded and/or used in the area of
the Republic of Indonesia must satisfy
technical requirements.
“This Minister Regulation Bill is
the guidance in conducting NFC
device testing in which NFC device is
contactless communication technology
which uses radio wave by ways of
touching or placing the concerned device
at close distance,” he said.
The concerned Minster Regulation Bill
among others regulates general Terms
which include Definition, Configuration,
Initials and Terminology and further on
NFC Device Technical Requirements,
completeness of NFC Device Testing and
NFC Device Testing Implementation NFC.
Near Field Communication (NFC) is a
contactless communication technology
which uses radio wave by ways of
touching or placing the device at a close
distance.
This technology is compatible
with contactless smart card reader
infrastructure and has had specification
stipulated by ISO/IEC, ECMA, ETSI, and/
or NFC Forum. NFC device can function
as contactless smart card emulation,
peer-to-peer communication and also
read.
In the bill, working frequency of NFC is
13.56 MHz, which is for Operational Field
Strength in active communication mode,
initiator and target must alternately
power RF field at least 1.5 A/m (rms)
and no higher than 7.5 A/m (rms)
on a certain position stipulated by
manufacturer (operational volume).
Meanwhile for passive communication
mode, initiator will result in RF field
to provide energy on target. Target
must operate continuously on RF field
between 1.5 A/m (rms) and 7.5 A/m
(rms).
The bit rate for transmission during
initialization and SDD must have a
value in one of the three bit rates
which is based on the formula fc/128
(~106 kbps), fc/64 (~212 kbps), or
fc/32 (~424 kbps). For 106 kbps,
communication from initiator to target
and from target to initiator for bit rate
fc/128 must use ASK 100% modulation
from operational field to result in a
phone credit.
Meanwhile for 212 kbps and 424 kbps,
initiator must use ASK with modulation
amounting from 8% to 30% from
RF operational field. For operational
distance which is determined by the
government, the maximum is only 10
cm.

Multiplexing Broadcasting
Organizing Business
Opportunity Through
Terrestrial System in the
areas of Jakarta, Bogor,
Depok, Tangerang and
Bekasi.
In addition to KM
No.729/2014, Tifatul also
issued KM No.730/2014
regarding Multiplexing
Broadcasting Organizing
Business Opportunity
Through Terrestrial
South East Sulawesi, West
Sulawesi, Central Sulawesi,
North Sulawesi, West
Kalimantan and Central
Kalimantan.
The consideration to
issue KM No.730/2014
was digital broadcasting
organizing implementation
which required
multiplexing broadcasting
organizers. Meanwhile
for Jabodetabek area
it is pursuant to KM
No. 729/2014 in which
multiplexing organizing
has existed for the
need of the additional
multiplexing organizers in
these areas.
“That the
letter conveyed to DKI
province region Indonesia
Broadcasting Commission
Jakarta, additional
number of multiplexing
broadcasting organizers
through terrestrial system
in the areas of Jakarta,
Bogor, Depok, Tangerang
and Bekasi is needed,” said
Tifatul in Minister Decision
signed on 25 July 2014.
Since it is addition,
particularly for the areas
of Jakarta, Bogor, Depok,
Tangerang and Bekasi, this
business opportunity is
only provided to Private
Broadcasting institutions
which have not won in
the previous selection or
TELECOMMUNICATION
The Government will Open
1.800 MHz and 2.1 GHz for LTE
Minister of
Communication
and Informatics
Rudiantara will
soon issue a new policy
on 4G LTE technology
adoption. The policy to
be issued in February
concerns neutral
technology opening for
1.800 MHz frequency
opening.
4G policy will soon be
implemented. We will issue
in February the application
of 4G LTE on band 1,800
MHz this year,” said
Rudiantara. According to
him this is the second
stage of LTE adoption
after previously 4G LTE on
900 MHz frequency was
opened.
Rudiantara explained that
the policy to be issued
will be followed by 1.800
MHz frequency structuring
itself.
“Essentially this month
I will invite all President
Directors of all operators.
After such policy is issued,
structuring will continue,”
he said.
The 1.800 MHz opening
policy taken for LTE, is
said by Rudiantara to
be the most supportive
ecosystem on 1.800 MHz.
“The most supportive
ecosystem is on 1.800
MHz,” he explained.
Due to such readiness,
it is predicted that
1.800 MHz frequency
utilization for LTE will
be faster, including
support from cellular
phone manufacturers who
promised to be ready to
launch their products in
the second quarter of this
year.
After the opening of
1.800 MHz frequency
range for LTE, Ministry
of Communication and
Informatics also plans to
open 2.1 GHz frequency
for 4G. At this time, 2.1
GHz can only be used
for 3G technology IMT-
2000. “2.1 GHz policy
will be announced in mid
year after 1.800 MHz is
commercialized,” said
Rudiantara.
Nevertheless, since at
this time 3G frequency
allocation on 2.1 GHz
leaves 2 blocks on blocks
11 and 12, Ministry
of Communication and
Informatics is said
to firstly open the
opportunity of allocation
for telecommunication
operators to add their
frequency.
2.1 GHz policy is planned
to be announced around
June 2015 after 1.800
MHz frequency allocation
process is completed.
Rudiantara himself
admitted that he will first
discuss with operators
before announcing his
policy. According to
him Communication and
Informatics will first
open the opportunity to
four operators on such
spectrum to compete in
obtaining the remaining
two channels.
As to the allocation
mechanism, the frequency
taken by the government
partially from this XL-
AXIS merger process will
depend on the needs of
the operators. “If the
demand is higher than
supply, then selection
[will be conducted].
It can be by ways of
beauty contest, tender or
anything,” he said.
As to which have been
requested, Rudiantara
revealed that operator
Akamai Report:
Internet Speed
Increases, Hacking
Decreases
Despite Indonesia
internet speed
improves, it is still
slumped and on the
77th position in the world.
This can be seen from the
newest Akmai report which
has released its newest data
on the world “State of the
Internet” for Q3-2014.
Based on Akmai report,
now Indonesia is on 77th
place in the world. In
average Indonesia internet
speed is still on the figure
3.7 Mbps. Nevertheless, this
speed figure increased from
the previous quarter which
was 49% and year-on-year
(YoY) increased to become
149%.
Indonesia’s position is
under other Asean countries
such as Singepore with
12.2 Mbps (10), Thailand
with 6.6 Mbps (48) as well
as Malaysia with 4.1 Mbps
(71).
In terms of the highest
(peak) internet speed,
Indonesia is on the 64th
position with a speed of
25.8 Mbps. Indonesia’s
position is far below Asean
countries such as Singapore
(2) with internet speed
in average of 83 Mbps,
then Thailand on the 28th
position with average
of 41.9 Mbps as well as
Malaysia (56) with 29.8
Mbps.
Based on its report,
Akamai stipulates that the
fastest average of internet
connection speed during
the third quarter of 2014
was South Korea with 2.3
Mbps then Hong Kong has
the speed of 84.6 Mbps and
Japan on the third place
with 15.0 Mbps.
Meanwhile the government
seems to continue to need
to work hard in terms
of providing broadband
connection. This is caused
by the fact that until
today Indonesia broadband
connectivity for more than
4 Mbps is in the amount of
35%. This speed increased
by 250% compared to
the previous quarter and
increased by 1884%
compared to the previous
year. This sharp increase
must be understood since
previously Indonesia was
not included in Akmai radar
in terms of broadband
development.
Meanwhile, for connectivity
above 10 Mbps, Indonesia is
on the 56th position with
connection of 3.3%. This
speed increased by 534%
QoQ (quarter on quarter)
and 2403 year-on year.
Despite of such increase,
Indonesia’s position for
broadband above 4 Mbps is
still below ASEAN countries
such as Thailand (15),
Singapore (20) and Malaysia
(67).
Meanwhile for that which is
above 10 Mbps Indonesia is
still below Singapore (11).
Thailand (43) and Malaysia
(52). The top position for
the world above 5 Mbps
Hacking Decreased
The interesting part
from the newest Akmai
report is that Indonesia
is no longer the king and
central of Internet hacking
traffic in Indonesia.
Indonesia’s position which
had always been in the
top three, is now thrown
to the 6th position.
On the second quarter
Indonesia was on the
second position below
China with 15% meanwhile
China controlled the world
hacking with 43% hacking.
The third position is The
United States with the
figure 13%.
On the third quarter
of 2014, the position
changed. The central
of hacking is still led by
China with the figure of
49% followed by the
United States with 17%.
Indonesia itself is on the
6th position with only
1.9%.
Meanwhile the third
position is held by Taiwan
with the figure 3.8%,
followed by India with
2.9% and Russia with a
figure of 2.1%.
Indonesia, IICD uses ASEA reference
by IICD. In 2012 IICD was supported
by Asian Development Bank to
asses 100 public companies in
Indonesia which have the largest
capitalization and then since 2013
Financial Service Authority (OJK)
has appointed IICD to continue such
assessment.
Assessment instrument refers to
GC principles which are developed
by Organization for Economic
(OECD) namely (1) shareholders’
rights; (2) equal treatment to
shareholders (3) stakeholders’ roles
(4) disclosure and transparency (5)
Board’s responsibilities. Scorecard
and its results may be used by
