A Guide to Working at <strong>Ryerson</strong><br />

Reproduction of Copyrighted Materials<br />

Under Canada’s Copyright Act, it is illegal to copy most published<br />

materials without permission. <strong>The</strong> agreement with Access<br />

Copyright (formerly CANCOPY) that governed the ability of most<br />

universities to print course packs and to conveniently photocopy<br />

works not permitted by the Copyright Act expired December<br />

31, 2010. Since January 2011, <strong>Ryerson</strong> <strong>University</strong>, along with a<br />

number of other Canadian universities, has elected to operate<br />

under an interim copyright tariff until a smooth transition to new<br />

practices can be ensured. Permission to copy is subject to certain<br />

limits. Please read the following and make every effort to keep<br />

within these limits.<br />

Volume of Photocopying<br />

No copying shall exceed 10 percent of a published work or<br />

the following, whichever is greater:<br />

• an entire newspaper article or page<br />

• an entire single short story, play, poem, essay, or article from<br />

a book or periodical issue (including a set of conference<br />

proceedings) containing other works<br />

• an entire single item of print music from a book or periodical<br />

issue containing other works<br />

• an entire entry from an encyclopedia, dictionary, annotated<br />

bibliography, or similar reference work<br />

• an entire reproduction of an artistic work (including drawing,<br />

sculpture, painting, prints, architectural works of art or works<br />

of artistic craftsmanship) from a book<br />

or periodical issue containing other works<br />

• one chapter, provided it is no more than 20 percent of a book<br />

<strong>The</strong> Interim Tariff does not cover the following:<br />

• works listed on the Exclusions List (see Access Copyright<br />

webpage for listing at www.accesscopyright.ca/<br />

media/6347/access_copyright_exclusions_list.pdf and<br />

notice of changes at www.accesscopyright.ca/media/6374/<br />

notice_of_change_to_exclusions_list_02_01_11.pdf)<br />

• works for which copyright is held by the institution<br />

• crown or provincial publications except Quebec<br />

• unpublished works<br />

• originals of artistic works<br />

• publications containing a notice which expressly prohibits<br />

reproduction under the authorization of a licence from a<br />

Reproduction Rights Organization<br />

• published workbooks, work cards, assignment sheets, tests,<br />

examination papers, and any other published works intended<br />

to be “consumable”<br />

• instruction manuals including teachers’ guides<br />

• advertisements and letters to the editor<br />

• print music published for use by choirs, orchestras, bands, etc.<br />

• newsletters<br />

• business cases which are available for purchase<br />

Coursepacks for Sale at Bookstore<br />

Resale of copies is prohibited unless reported and paid for through<br />

the <strong>University</strong>. <strong>The</strong> Institution shall include on at least one page<br />

of all Copies made pursuant to section 2(b) of this Tariff the<br />

international copyright symbol ©, a credit to the publisher, the<br />

artist or illustrator of any artistic work reproduced (where known)<br />

and the author or authors (where known) and shall display the<br />

following prominent notice: “This material has been copied under<br />

licence from Access Copyright. Resale or further copying of this<br />

material is strictly prohibited. Copies of the request form are<br />

available from <strong>The</strong> <strong>Chang</strong> <strong>School</strong> office in Heaslip House, 297<br />

Victoria Street, or from the Bookstore, 17 Gould Street.<br />

Digital Copying<br />

<strong>Ryerson</strong> did not elect the interim tariff’s digital copies option<br />

and there is no indemnity applicable to digital copying. Links<br />

to websites and library-subscribed electronic resources are<br />

generally permitted. However, ensure that you have any required<br />

permissions to scan copyrighted content on Blackboard or your<br />

website. Links or scanned documents created by Library e-reserve<br />

staff for your Blackboard postings are either permitted by the<br />

Library’s subscribed databases or transactional permissions with<br />

the publisher or publisher’s representative. (See Library Reserve<br />
