AVIATION SECURITY REQUIREMENTS – CHALLENGES
TO APPROPRIATE AUTHORITIES
Catalin RADU – Director General
ROMANIA
Ministry of Transport
Directorate General of Civil Aviation
Transport Security Conference
Athens, 22-23 May 2008
1. Sources of Requirements
• ICAO – Annex 17 to Chicago Convention –>
standards;
• ECAC – Doc 30, PART II –> recommendations;
• EU (for EU Member States) – aviation security
regulations (framework and implementing regulations)
–> “common rules”;
• National Authorities – national legislation –>
national AVSEC programmes (NCASP, NCASQCP,
NCASTP), national security measures, procedures,
methods, methodologies and guidelines.
2. Diversity and Complexity of Requirements
Arising from:
• Different sources as mentioned above;
• Different interpretations to the same requirements by
states, international organisations or EU;
• Not all requirements are formulated in a clear
wording, due to, mainly, the compromises (between
states, organisations) that had to be reached during
the rulemaking process;
• Different understanding of how requirements should
be implemented at the national level.
3. Appropriate Authority – inherent organisational
and functional difficulties
• Insufficient staffing due to:
‣ Low salaries as compared to those in the industry;
‣ Very demanding job (complex and high volume of
work);
‣ Narrow area of recruiting staff (ideally, staff with
operational experience in aviation);
• Training of national auditors
‣ Lack of instructors, at the national level, to train future
national auditors;
‣ Fortunately, Romania has benefited from ECAC
assistance programme
3. Appropriate Authority – inherent organisational
and functional difficulties
• Position of Appropriate Authority amongst other
state authorities
‣ There are difficulties for states in providing the
Appropriate Authorities with necessary enforcement
powers to ensure the effectiveness of the NCASPs.
• Dissemination of classified information
‣ Most of the implementing security measures are
contained in classified documents and because of that,
Appropriate Authorities find it difficult to provide
security related information.
3. Appropriate Authority – inherent organisational
and functional difficulties
• Time and resources consuming activities
‣ Some activities are “process generating” type of
activities: e.g. certification of screeners (it took us
approx. 3 years to certifying around 1,000 screeners).
Generaly speaking, all activities such
authorisation/approval/supervision are time and
resources consuming activities.
Athens, 22-23 May 2008
4. Appropriate Authority – other difficulties
• Short time for implementing the newly adopted
legislation – the process of amending NASP in
order to be compliant with new international and
European legislation;
• Lack of guidance material on the operational
aspects of important requirements which generate
processes such as, for example, certification of
screeners;
Transport Security Conference
Athens, 22-23 May 2008
4. Appropriate Authority – other difficulties
Lack of reliable data (validated by
independent recognised entities) on
equipment technical specifications
‣ states not having national equipment testing
laboratories, must rely entirely on manufacturers.
• Not all Annex 17 standards are covered in full by
ECAC Doc 30 recommendations or EU
regulations in the field of aviation security.
‣ e.g. management of response to acts of unlawful
interference (Chap. 5, ICAO Annex 17).
4. Appropriate Authority – other difficulties
• An additional task on Appropriate Authority
consists in the oversight activities conducted by
different international/intergovernmental
organizations. Between February 2006 and April
2008, Romania ha been subjected to the following
Quality control activities :
‣ 13-16.02.2006 – assessment by EC
‣ 19-26.06.2006 – audit by ICAO/ECAC
‣ 13-17.05.2007 – security visit TSA
‣ 04-08.2007 – assessment by EC – OTP Airport
‣ 14-18.01.2008 – assessment by EC – Appropriate Authority
‣ 31.03-01.04.2008 – follow-up audit visit by ICAO
Transport Security Conference
Athens, 22-23 May 2008
4. Appropriate Authority – other difficulties
• Although these activities are time and
resources- consuming – organization,
preparation of the pre-audit (assessment)
questionnaire, issuing Corrective Action
Plan, Romania has obtained good results
at all this quality control activities.
