standards;<br />

• ECAC – Doc 30, PART II –> recommendations;<br />

• EU (for EU Member States) – aviation security<br />

regulations (framework and implementing regulations)<br />

–> “common rules”;<br />

• National Authorities – national legislation –><br />

national AVSEC programmes (NCASP, NCASQCP,<br />

NCASTP), national security measures, procedures,<br />

methods, methodologies and guidelines.<br />

2. Diversity and Complexity of Requirements<br />

Arising from:<br />

• Different sources as mentioned above;<br />

• Different interpretations to the same requirements by<br />

states, international organisations or EU;<br />

• Not all requirements are formulated in a clear<br />

wording, due to, mainly, the compromises (between<br />

states, organisations) that had to be reached during<br />

the rulemaking process;<br />

• Different understanding of how requirements should<br />

be implemented at the national level.<br />

3. Appropriate Authority – inherent organisational<br />

and functional difficulties<br />

• Insufficient staffing due to:<br />

‣ Low salaries as compared to those in the industry;<br />

‣ Very demanding job (complex and high volume of<br />

work);<br />

‣ Narrow area of recruiting staff (ideally, staff with<br />

operational experience in aviation);<br />

• Training of national auditors<br />

‣ Lack of instructors, at the national level, to train future<br />

national auditors;<br />

‣ Fortunately, Romania has benefited from ECAC<br />

assistance programme<br />

3. Appropriate Authority – inherent organisational<br />

and functional difficulties<br />

• Position of Appropriate Authority amongst other<br />

state authorities<br />

‣ There are difficulties for states in providing the<br />

Appropriate Authorities with necessary enforcement<br />

powers to ensure the effectiveness of the NCASPs.<br />

• Dissemination of classified information<br />

‣ Most of the implementing security measures are<br />

contained in classified documents and because of that,<br />

Appropriate Authorities find it difficult to provide<br />

security related information.<br />

and functional difficulties<br />

• Time and resources consuming activities<br />

‣ Some activities are “process generating” type of<br />

activities: e.g. certification of screeners (it took us<br />

approx. 3 years to certifying around 1,000 screeners).<br />

Generaly speaking, all activities such<br />

authorisation/approval/supervision are time and<br />

resources consuming activities.<br />

4. Appropriate Authority – other difficulties<br />

• Short time for implementing the newly adopted<br />

legislation – the process of amending NASP in<br />

order to be compliant with new international and<br />

European legislation;<br />

• Lack of guidance material on the operational<br />

aspects of important requirements which generate<br />

processes such as, for example, certification of<br />

screeners;<br />

4. Appropriate Authority – other difficulties<br />

Lack of reliable data (validated by<br />

independent recognised entities) on<br />

equipment technical specifications<br />

‣ states not having national equipment testing<br />

laboratories, must rely entirely on manufacturers.<br />

• Not all Annex 17 standards are covered in full by<br />

ECAC Doc 30 recommendations or EU<br />

regulations in the field of aviation security.<br />

‣ e.g. management of response to acts of unlawful<br />

interference (Chap. 5, ICAO Annex 17).<br />

4. Appropriate Authority – other difficulties<br />

• An additional task on Appropriate Authority<br />

consists in the oversight activities conducted by<br />

different international/intergovernmental<br />

organizations. Between February 2006 and April<br />

2008, Romania ha been subjected to the following<br />

Quality control activities :<br />

‣ 13-16.02.2006 – assessment by EC<br />

‣ 19-26.06.2006 – audit by ICAO/ECAC<br />

‣ 13-17.05.2007 – security visit TSA<br />

‣ 04-08.2007 – assessment by EC – OTP Airport<br />

‣ 14-18.01.2008 – assessment by EC – Appropriate Authority<br />

‣ 31.03-01.04.2008 – follow-up audit visit by ICAO

4. Appropriate Authority – other difficulties<br />

• Although these activities are time and<br />

resources- consuming – organization,<br />

preparation of the pre-audit (assessment)<br />

questionnaire, issuing Corrective Action<br />

Plan, Romania has obtained good results<br />

at all this quality control activities.
