37.3. The Contracting Officer shall approve the procurement award within five (5) business days at
the latest following the date of award or cancel the award with the reasons thereof.
37.4. İhale; kararın ihale yetkilisince onaylanması halinde geçerli, iptal edilmesi halinde ise
hükümsüz sayılır.
37.4. The procurement shall be deemed valid if the award is approved, and invalid if it is cancelled
by the Contracting Officer.
Madde 38 - Kesinleşen ihale kararının bildirilmesi
Article 38 - Notification of final disposition of the awarding.
38.1. İhale sonucu, ihale kararının ihale yetkilisi tarafından onaylandığı günü izleyen en geç
üç gün içinde, ihale üzerinde bırakılan dahil, ihaleye teklif veren bütün isteklilere bildirilir.
İhale sonucunun bildiriminde, tekliflerin değerlendirmeye alınmama veya uygun bulunmama
gerekçelerine de yer verilir.
38.1. The result of the procurement shall be notified to all tenderers including the tenderer that is
awarded the contract that submit tenders for the procurement within maximum three (3) days
following the approval of the procurement award by the contracting officer.
38.2. İhale; kararının ihale yetkilisi tarafından iptal edilmesi durumunda da isteklilere
gerekçeleri belirtilmek suretiyle bildirim yapılır.
38.2. In the event the tender decision is cancelled by the tender authority as well, the applicants are
notified by stating the reasons.
38.3. İhale sonucunun bütün isteklilere bildiriminden itibaren on gün geçmedikçe sözleşme
imzalanmayacaktır.
38.3. The agreement shall not be signed, unless ten days pass from the notification of the tender
results to all applicants.
Madde 39- Sözleşmeye davet
Article 39- Invitation to sign the contract
39.1. 4734 sayılı Kanunun 41 inci maddesinde belirtilen sürenin bitimini, ön mali kontrol
yapılması gereken hallerde ise bu kontrolün tamamlandığı tarihi izleyen günden itibaren üç
gün içinde, ihale üzerinde bırakılan istekli sözleşmeye davet edilir. Bu davet yazısında, tebliğ
tarihini izleyen on gün içinde yasal yükümlüklerini yerine getirmek suretiyle sözleşmeyi
imzalaması hususu bildirilir. Yabancı istekliler için bu süreye oniki gün ilave edilecektir.
39.1. The applicants who is awarded the bid is invited for agreement within three days of ; (either)
the completion of the period of time stated in the 41st article of Act number 4734, (or) in the events
that a preliminary financial check needs to be done, then the date that such control is completed. In
such letter of invitation the matter that the agreement is to be signed by satisfying its legal
obligations within ten days following the date of notification. Twelve days shall be added to this
period for foreign applicants.
39.2. İsteklinin, bu davet yazısının bildirim tarihini izleyen on gün içinde yasal
yükümlülüklerini yerine getirerek sözleşmeyi imzalaması zorunludur.
39.2 The tenderer shall be liable to sign the contract by providing the performance bond within ten (10)
days following the notification date of this invitation.
Madde 40-Kesin teminat
Article 40- Performance bond
40.1. İhale üzerinde bırakılan istekliden, sözleşme imzalanmadan önce, ihale bedelinin % 6’ sı
oranında kesin teminat alınır.
40.1. The tenderer that is awarded the contract shall be liable to provide performance bond at an
amount corresponding to 6% of the procurement price before concluding the contract.
