EU Directive on Consumer Rights<br />
The European Commission has<br />
announced new measures that will<br />
give greater clarity <strong>and</strong> transparency<br />
on consumer rights. The changes for<br />
consumers <strong>and</strong> businesses include<br />
eliminating hidden costs <strong>and</strong> charges<br />
on the internet; ensuring the total<br />
cost <strong>of</strong> a product or service is shown;<br />
banning pre-ticked boxes on the internet;<br />
extending the period under which<br />
consumers can withdraw from a sales<br />
contract to 14 days; the introduction<br />
<strong>of</strong> an EU-wide model withdrawal form;<br />
eliminating surcharges for the use <strong>of</strong><br />
credit cards <strong>and</strong> hotlines; common rules<br />
for businesses to enable them to trade all<br />

launch a new national innovation voucher<br />
scheme to encourage smaller businesses<br />
to work with external experts.<br />
Vouchers will be relevant to the areas <strong>of</strong><br />
agri-food, built environment <strong>and</strong> space<br />
sectors. They will be start-up, micro,<br />
small or medium-sized businesses <strong>and</strong><br />
provide up to £5,000 (or up to £8,000<br />
for projects in the space sector) for the<br />

made in a single payment instead <strong>of</strong><br />
two instalments <strong>and</strong> employers will<br />
be allowed to claim grants to support<br />
up to ten new apprentices. Eligibility<br />
restrictions will be revised, opening the<br />
scheme to employers that have not<br />
employed an apprentice in the previous<br />
12 months (reduced from three years).<br />

New Higher Apprenticeships in Project<br />
Management <strong>and</strong> Human Resource<br />
Management have been launched.<br />
The Higher Apprenticeship in Project<br />
Management was developed in<br />
partnership with the Association for<br />
Project Management (APM), <strong>and</strong><br />
the Higher Apprenticeship in Human<br />
Resource Management was created<br />
in partnership with the Chartered<br />
Institute for Personnel <strong>and</strong> Development<br />

IT Apprentices<br />
Research conducted by mobile operator<br />
O2 has concluded that businesses need<br />
to do more to make the most <strong>of</strong> the
Members’ Briefing - <strong>October</strong> <strong>2012</strong><br />

digital skills young people possess. The<br />
research estimates that digital skills that<br />
young unemployed people have could<br />
be worth £6.7 billion to businesses.<br />
<strong>Chamber</strong> Training has welcomed the<br />
research <strong>and</strong> is encouraging employers<br />
in <strong>Derbyshire</strong> <strong>and</strong> <strong>Nottinghamshire</strong> to<br />
look to young people to fill their digital<br />
skills gaps. The team has already seen<br />
an increase this year in the number<br />
<strong>of</strong> businesses looking to employ IT<br />
apprentices <strong>and</strong> apprentices to lead the<br />
company social media activities.<br />
HR<br />
Update on Employment Tribunal<br />
Fees from Qdos Consulting –<br />
suppliers <strong>of</strong> <strong>Chamber</strong> HR<br />
The Government seems certain to<br />
implement a new <strong>and</strong> more complex<br />
set <strong>of</strong> fees payable by claimants<br />
who wish to bring a claim before<br />
an Employment Tribunal. The new<br />
fee structure is likely to apply from<br />
the summer <strong>of</strong> 2013 <strong>and</strong> will define<br />
claims as either level one (single issue<br />
straightforward matters <strong>and</strong> level two<br />
(complex issues requiring considerably<br />
more judicial time). Proposed fees for<br />
level one claims are a fee <strong>of</strong> £160 on<br />
issue <strong>of</strong> a claim <strong>and</strong> a further £230<br />
at the hearing stage <strong>and</strong> for level two<br />
claims a fee <strong>of</strong> £250 <strong>and</strong> a further £950<br />
at the hearing stage. The overriding<br />
intention <strong>of</strong> the new fee system is to<br />
encourage the parties to settle any<br />
claims through conciliation or mediation<br />
<strong>and</strong> to pay what the Government feels<br />
is a fair contribution to the costs <strong>of</strong> the<br />
administration <strong>of</strong> the process. Once the<br />
final commencement date <strong>and</strong> content<br />
is announced, the definitive details <strong>of</strong><br />
the new arrangements will be published<br />
to <strong>Chamber</strong> members. The Government<br />
is also proposing to cap compensation<br />
payments for unfair dismissal claims,<br />
currently set at £72,300. The two<br />
proposals are a cap <strong>of</strong> up to 12 months<br />
pay <strong>and</strong> a new, reduced, upper limit.<br />
National Minimum Wage Increases<br />
National minimum wage rates increase<br />
in <strong>October</strong> <strong>2012</strong> when they will be £6.19<br />
per hour for over 21 years (up by 11p<br />
per hour); £4.98 for 18-20 years (no<br />
change); £3.68 for 16-17 years (no<br />
change); £2.65 for apprentices (up by 5p<br />
per hour).<br />
Building on Apprenticeships<br />
A recent survey* <strong>of</strong> 300 employers in the<br />
UK construction industry has found that<br />

young people for the construction<br />

Settlement Agreement Option for<br />
Underperforming Staff<br />
The Business Secretary Vince Cable has<br />
announced a proposal that would enable<br />
firms to <strong>of</strong>fer under-performing workers<br />
a pay-<strong>of</strong>f (called settlement agreements),<br />
<strong>and</strong> avoid the need to go through an<br />
employment tribunal.<br />

Online Retail Market<br />
The UK’s online retail market is expected<br />
to grow by 12% in <strong>2012</strong>. UK online retail<br />
businesses increased 30% last year at<br />
around 228,000 with the total figure<br />
expecting to double by 2015. Shopping<br />
through mobile devices continues to<br />
grow with sales representing 5% <strong>of</strong> total<br />
e-retail for the first time at the end <strong>of</strong><br />
2011 while visits to e-retail sites through<br />
mobile devices increased to 8.2%.<br />

However, research by the European<br />
Commission Digital Agenda found that<br />
only 14% <strong>of</strong> small businesses sell their<br />
products online, against a target <strong>of</strong> 33%<br />
by 2015.<br />

Conference Highlighting the<br />
Importance <strong>of</strong> Manufacturing<br />
DNCC is holding a major policy<br />
conference on 11th <strong>October</strong> at The<br />
Silk Mill in Derby highlighting the<br />
importance manufacturing plays in<br />
the economy <strong>of</strong> the East Midl<strong>and</strong>s,<br />
<strong>and</strong> looking at ways <strong>of</strong> breaking<br />
down the barriers to growth for local<br />
manufacturers. Dr Will Barton, Head<br />
<strong>of</strong> Manufacturing for the Technology<br />
Strategy Board, which advises the<br />
Government on growth innovation, is the<br />
keynote speaker <strong>and</strong> will provide<br />
an overview <strong>of</strong> the opportunities <strong>and</strong><br />
challenges from a national <strong>and</strong> global<br />
perspective. Speakers will also include<br />
industry experts from across <strong>Derbyshire</strong><br />

Building Business Resilience<br />
Climate East Midl<strong>and</strong>s is supporting<br />
businesses to become more resilient to<br />
severe weather <strong>and</strong> climate change. This<br />
is particularly topical for businesses given<br />
the prolonged heavy rain we’ve been<br />
experiencing, <strong>and</strong> prior to that a drought<br />
<strong>and</strong> several very cold winters. A recent<br />
survey <strong>of</strong> businesses in the East Midl<strong>and</strong>s<br />
found that over half the respondents had<br />
been affected by severe weather in the<br />
past 5 years. Many <strong>of</strong> these had incurred<br />
extra costs as a result, but some had<br />
experienced benefits such as increased<br />
dem<strong>and</strong> for products <strong>and</strong> services.<br />
The next phase <strong>of</strong> this Environment<br />
Agency funded project is now underway,<br />
<strong>and</strong> includes workshops for businesses<br />
to identify practical actions to build<br />
resilience <strong>and</strong> save money, a new<br />
resilience award as part <strong>of</strong> Business<br />
in the Community’s award scheme,<br />
updating the ‘Weathering the Storm’<br />

A source <strong>of</strong> funding for innovative ways<br />
to reduce the products <strong>and</strong> resources<br />
consumed <strong>and</strong> increase re-use, repair<br />
<strong>and</strong> recovery capacity, the Waste<br />
Prevention Loan Fund, is open to<br />
commercial <strong>and</strong> third sector businesses.<br />
Priority sectors are textiles, electrical <strong>and</strong><br />
furniture with loans available to eligible<br />

BESPOKE: Energy Efficiency<br />
Advice <strong>and</strong> Grants for Derby City<br />
Businesses<br />
Derby City Council has launched a new<br />
project to support businesses to make<br />
energy efficiency <strong>and</strong> carbon saving<br />
improvements to their buildings <strong>and</strong><br />
processes. BESPOKE will provide energy<br />
efficiency advice <strong>and</strong> surveys as well<br />
as access to grants <strong>of</strong> up to £5,000<br />
for energy efficiency improvements to<br />
commercial premises <strong>and</strong> processes. This<br />
can include heating <strong>and</strong> lighting upgrades<br />
<strong>and</strong> controls, insulation <strong>and</strong> renewable<br />
energy. The project is part funded by<br />
the European Regional Development<br />
Fund, open to small <strong>and</strong> medium sized<br />

Health & Safety Checks Change for<br />
Low Risk Firms <strong>and</strong> Self-Employed<br />

Roll Out <strong>of</strong> 4G<br />
EE (Everything Everywhere) has<br />
announced that it plans to roll out its<br />
4G mobile broadb<strong>and</strong> network into<br />
rural areas <strong>and</strong> cities. This will provide<br />
an alternative to fixed broadb<strong>and</strong> in<br />
areas where there are not many fibre<br />
cables <strong>and</strong> could make a huge difference<br />

£5bn Export Refinancing<br />
The Government has announced a<br />
£5bn facility to provide long-term loans<br />
for overseas buyers <strong>of</strong> UK exports at<br />
competitive rates by guaranteeing<br />
short term bank loans. The plan will<br />
bring the UK into line with the USA<br />
<strong>and</strong> other countries that already lend<br />
to export buyers <strong>and</strong> aims to make UK<br />
exports more attractive <strong>and</strong> help more<br />

workshops for its popular Passport<br />
to Export Programme which gives<br />

Exports Up for East Midl<strong>and</strong>s<br />
Latest figures for the East Midl<strong>and</strong>s show<br />
that exports to markets outside the EU<br />
continue to grow, but that exports to EU<br />
countries are down when compared to<br />
last year:<br />
• exports for the East Midl<strong>and</strong>s for the<br />
first half <strong>of</strong> <strong>2012</strong> hit £9.1 billion to<br />
the end <strong>of</strong> June, compared to £8.5<br />
billion for the equivalent period in<br />
2011<br />
• exports to Asia <strong>and</strong> Oceania, mainly<br />
India <strong>and</strong> China, hit £2 billion for the<br />
first six months, up by 24 per cent<br />
compared to the same period last<br />
year<br />
• exports to Middle-East <strong>and</strong> North<br />
Africa up by 27 per cent, £140m, for<br />
the same period<br />
• exports to EU from January to June<br />
down by £232m compared to the<br />
same period last year - £4 billion<br />
