Directors’ Pay Reforms 

New measures announced by the 

Business Secretary will empower 

shareholders to engage effectively with 

companies on pay. The measures will 

give shareholders binding votes on pay 

policy and exit payments, so they can 

hold companies to account and prevent 

rewards for failure; boost transparency 

so that what people are paid is easily 

understood and the link between pay 

and performance is clearly drawn; and 

ensure that reform has a lasting impact 

by empowering business and investors to 

maintain recent activism. It is intended 

that all these reforms will be in place by

Funding for Lending Scheme (FLS) 

The Funding for Lending Scheme is 

designed to provide cheaper borrowing 

to businesses. Under the scheme, banks 

and building societies can borrow at 

cheaper rates, for periods of up to four

EU Directive on Consumer Rights 

The European Commission has 

announced new measures that will 

give greater clarity and transparency 

on consumer rights. The changes for 

consumers and businesses include 

eliminating hidden costs and charges 

on the internet; ensuring the total 

cost of a product or service is shown; 

banning pre-ticked boxes on the internet; 

extending the period under which 

consumers can withdraw from a sales 

contract to 14 days; the introduction 

of an EU-wide model withdrawal form; 

eliminating surcharges for the use of 

credit cards and hotlines; common rules 

for businesses to enable them to trade all 

over Europe. The new rules are expected 

to become law in each member state by

A payment of up to £2,275 will be

Work Choice – a specialist disability 

employment programme that provides 

tailored support to help disabled people 

who have the most complex support 

needs. This extra support for young 

disabled people will sit alongside the 

Youth Contract, which is already boosting 

the employment prospects of young 

Innovation Voucher Scheme 

The Technology Strategy Board is due to 

launch a new national innovation voucher 

scheme to encourage smaller businesses 

to work with external experts. 

Vouchers will be relevant to the areas of 

agri-food, built environment and space 

sectors. They will be start-up, micro, 

small or medium-sized businesses and 

provide up to £5,000 (or up to £8,000 

for projects in the space sector) for the 

help of an external expert to develop

New Measures to Help Employers 

Take on Apprentices 

The Government has outlined new 

measures to help SMEs take on 

apprentices. As a result of the findings of

• improve the performance of providers 

of training to SMEs by agreeing

• improve the Apprenticeship Grant for 

Employers (a grant to employers for 

employing apprentices aged 16-24) by 

making it simpler and more accessible 

to more employers - the grant will be 

made in a single payment instead of 

two instalments and employers will 

be allowed to claim grants to support 

up to ten new apprentices. Eligibility 

restrictions will be revised, opening the 

scheme to employers that have not 

employed an apprentice in the previous 

12 months (reduced from three years).

New Higher Apprenticeships 

New Higher Apprenticeships in Project 

Management and Human Resource 

Management have been launched. 

The Higher Apprenticeship in Project 

Management was developed in 

partnership with the Association for 

Project Management (APM), and 

the Higher Apprenticeship in Human 

Resource Management was created 

in partnership with the Chartered 

Institute for Personnel and Development

IT Apprentices 

Research conducted by mobile operator 

O2 has concluded that businesses need 

to do more to make the most of the

digital skills young people possess. The 

research estimates that digital skills that 

young unemployed people have could 

be worth £6.7 billion to businesses. 

Chamber Training has welcomed the 

research and is encouraging employers 

in Derbyshire and Nottinghamshire to 

look to young people to fill their digital 

skills gaps. The team has already seen 

an increase this year in the number 

of businesses looking to employ IT 

apprentices and apprentices to lead the 

company social media activities. 

HR 

Update on Employment Tribunal 

Fees from Qdos Consulting – 

suppliers of Chamber HR 

The Government seems certain to 

implement a new and more complex 

set of fees payable by claimants 

who wish to bring a claim before 

an Employment Tribunal. The new 

fee structure is likely to apply from 

the summer of 2013 and will define 

claims as either level one (single issue 

straightforward matters and level two 

(complex issues requiring considerably 

more judicial time). Proposed fees for 

level one claims are a fee of £160 on 

issue of a claim and a further £230 

at the hearing stage and for level two 

claims a fee of £250 and a further £950 

at the hearing stage. The overriding 

intention of the new fee system is to 

encourage the parties to settle any 

claims through conciliation or mediation 

and to pay what the Government feels 

is a fair contribution to the costs of the 

administration of the process. Once the 

final commencement date and content 

is announced, the definitive details of 

the new arrangements will be published 

to Chamber members. The Government 

is also proposing to cap compensation 

payments for unfair dismissal claims, 

currently set at £72,300. The two 

proposals are a cap of up to 12 months 

pay and a new, reduced, upper limit. 

National Minimum Wage Increases 

National minimum wage rates increase 

in October 2012 when they will be £6.19 

per hour for over 21 years (up by 11p 

per hour); £4.98 for 18-20 years (no 

change); £3.68 for 16-17 years (no 

change); £2.65 for apprentices (up by 5p 

per hour). 

Building on Apprenticeships 

A recent survey* of 300 employers in the 

UK construction industry has found that

young people for the construction 

industry than degrees.

Settlement Agreement Option for 

Underperforming Staff 

The Business Secretary Vince Cable has 

announced a proposal that would enable 

firms to offer under-performing workers 

a pay-off (called settlement agreements), 

and avoid the need to go through an 

employment tribunal.

RETAIL 

Online Retail Market 

The UK’s online retail market is expected 

to grow by 12% in 2012. UK online retail 

businesses increased 30% last year at 

around 228,000 with the total figure 

expecting to double by 2015. Shopping 

through mobile devices continues to 

grow with sales representing 5% of total 

e-retail for the first time at the end of 

2011 while visits to e-retail sites through 

mobile devices increased to 8.2%.

However, research by the European 

Commission Digital Agenda found that 

only 14% of small businesses sell their 

products online, against a target of 33% 

by 2015. 

MANUFACTURING 

Conference Highlighting the 

Importance of Manufacturing 

DNCC is holding a major policy 

conference on 11th October at The 

Silk Mill in Derby highlighting the 

importance manufacturing plays in 

the economy of the East Midlands, 

and looking at ways of breaking 

down the barriers to growth for local 

manufacturers. Dr Will Barton, Head 

of Manufacturing for the Technology 

Strategy Board, which advises the 

Government on growth innovation, is the 

keynote speaker and will provide 

an overview of the opportunities and 

challenges from a national and global 

perspective. Speakers will also include 

industry experts from across Derbyshire 

and Nottinghamshire representing the 

electrical, healthcare, engineering and 

automotive sectors, and a panel of 

experts will lead a Q & A session. The 

day’s discussions and findings will be 

incorporated into an action plan that the 

Chamber will use to lobby Whitehall and 

Ministers on the barriers to growth. This

Building Business Resilience 

Climate East Midlands is supporting 

businesses to become more resilient to 

severe weather and climate change. This 

is particularly topical for businesses given 

the prolonged heavy rain we’ve been 

experiencing, and prior to that a drought 

and several very cold winters. A recent 

survey of businesses in the East Midlands 

found that over half the respondents had 

been affected by severe weather in the 

past 5 years. Many of these had incurred 

extra costs as a result, but some had 

experienced benefits such as increased 

demand for products and services. 

The next phase of this Environment 

Agency funded project is now underway, 

and includes workshops for businesses 

to identify practical actions to build 

resilience and save money, a new 

resilience award as part of Business 

in the Community’s award scheme, 

updating the ‘Weathering the Storm’ 

guide for businesses, and publishing 

good practice case studies.

Waste Prevention Loan Fund 

A source of funding for innovative ways 

to reduce the products and resources 

consumed and increase re-use, repair 

and recovery capacity, the Waste 

Prevention Loan Fund, is open to 

commercial and third sector businesses. 

Priority sectors are textiles, electrical and 

furniture with loans available to eligible 

companies of £100,000 to £1m. More

BESPOKE: Energy Efficiency 

Advice and Grants for Derby City 

Businesses 

Derby City Council has launched a new 

project to support businesses to make 

energy efficiency and carbon saving 

improvements to their buildings and 

processes. BESPOKE will provide energy 

efficiency advice and surveys as well 

as access to grants of up to £5,000 

for energy efficiency improvements to 

commercial premises and processes. This 

can include heating and lighting upgrades 

and controls, insulation and renewable 

energy. The project is part funded by 

the European Regional Development 

Fund, open to small and medium sized 

businesses within Derby city only and 

criteria apply.

Health & Safety Checks Change for 

Low Risk Firms and Self-Employed 

Shops, offices, pubs and clubs will no 

longer face the same health and safety 

inspections under new Government 

proposals for firms and local authorities 

due to come into force in April 2013.

Roll Out of 4G 

EE (Everything Everywhere) has 

announced that it plans to roll out its 

4G mobile broadband network into 

rural areas and cities. This will provide 

an alternative to fixed broadband in 

areas where there are not many fibre 

cables and could make a huge difference 

in speed for both businesses and 

individuals. By the end of the year both 

Derby and Nottingham will be among the 

16 cities that should be hooked up to the 

4G network. Issues such as poor fixed 

line speeds are close to the heart of the 

Chamber’s eBusiness Club, which offers

£5bn Export Refinancing 

The Government has announced a 

£5bn facility to provide long-term loans 

for overseas buyers of UK exports at 

competitive rates by guaranteeing 

short term bank loans. The plan will 

bring the UK into line with the USA 

and other countries that already lend 

to export buyers and aims to make UK 

exports more attractive and help more 

businesses break into new markets. UK 

Export Finance will begin supporting 

loans by the end of this year.

Exports Up for East Midlands 

Latest figures for the East Midlands show 

that exports to markets outside the EU 

continue to grow, but that exports to EU 

countries are down when compared to 

last year: 

• exports for the East Midlands for the 

first half of 2012 hit £9.1 billion to 

the end of June, compared to £8.5 

billion for the equivalent period in 

2011 

• exports to Asia and Oceania, mainly 

India and China, hit £2 billion for the 

first six months, up by 24 per cent 

compared to the same period last 

year 

• exports to Middle-East and North 

Africa up by 27 per cent, £140m, for 

the same period 

• exports to EU from January to June 

down by £232m compared to the 

same period last year - £4 billion
